Re: Solid Waste Management Planning I
As discussed many months ago, the issue of solid waste management and the
implications of the state ground water pollution law will become
increasingly critical to our community's ability to provide quality waste
collection and disposal services. Many efforts are being initiated to
satisfy the new state law and this issue can be expected to be the
challenge of the 90's as wastewater was our challenge of the 80's. A
memorandum from Councilmember Horowitz outlines the basic work of the
ECICOG concerning this issue. This work demonstrates our effort and
commitment to satisfy state policy and pursue a possible regional solid
waste solution.
When the report of the ECICOG has been completed, we will be able to
analyze the economic and political benefits of each alternative. In order
to make the implementation of the solid waste initiatives somewhat
smoother, I believe we should immediately undertake work toward establish-
ing intergovernmental agreements as well as incorporating the many
business users of our landfill into the overall planning process. A
regional waste management solution which involves many other government
entities is a most difficult process. As you are aware, each community
has its own political agenda based upon the social and economic circum- j
stances that exist in the community. These circumstances will determine
the extent to which a community chooses to be involved.

In order that we may begin to formalize many of the procedures and
policies concerning the current operation of the landfill, it is recom-
mended that, while we await the ECICOG study, other initiatives on the
part of the City be undertaken. Specifically, I would suggest: (1) Each
and every contract user of the landfill be required to enter into an
agreement with the City whereby it establishes a more formal contractual
relationship between the users of the landfill and the City as the

provider. (2) In this agreement, we would begin to address the issues
associated with the standardization of collection and disposal procedures
and policies as well as other pertinent details for the continued use of
the landfill by the user. (3) Some type of information network be
developed whereby each and every contractor with the City be kept fully
informed of the process of planning. A contractual relationship will go a
long way towards more direct involvement by the many users of the landfill
and thereby minimize the intergovernmental disputes which are likely to
occur.
From my experience in participating in a similar planning process in
another community I served, it became critical to the success of the
planning process that we undertake a formal relationship with all users of
the landfill as soon as possible. Not to do so will simply postpone the
inevitable intergovernmental debate and cause little if any interest on
the part of the business users of the landfill.
As you are aware, the City contributes less than 20% of the landfill
tonnage through our residential refuse pickup. In order to have an
effective planning process, the other 80% of the users need to be more
intimately involved in this process. Hopefully, through these agreements,
we will be able to satisfy not only the state requirements, but do so
early on and create a more thoughtful environment for conducting solid
waste discussions with all those who wish to continue to use the landfill.
It is important to note that the community also needs to be fully aware
that the City and its partners in the regional planning process are in
effect taking on the responsibilities of the state government, that is,
the state has mandated this process which involves complex intergovern-
mental relations and contacts with the business community, and yet I
believe has not satisfactorily provided either the legislative or
financial framework to fully satisfy the intent of the law. These complex j
relationships simply can make for a protracted and possibly painful
planning process. Understanding the commitments necessary from all users
of the landfill early on will hopefully reduce these potential
difficulties.

Re: Solid Waste Management Planning
The East Central Iowa Council of Governments (ECICOG) Technical Advisory
Committee met on November 15 to interview four consulting companies
concerning their proposal to prepare a comprehensive solid waste manage-
ment plan for the six -county region (Benton, Iowa, Jones, Linn, Tama and
Johnson). The plan is intended to provide guidance to the six counties as
to the future direction of solid waste management in the region. This
study is not intended to be a final product, that is what we should do,
but rather a study indicating options and their costs for our considera-
tion. Following the study, the six counties will need to reach a
consensus as to which option to chose.
On December 8, 1988, the ECICOG will take the Advisory Committee's
recommendations and authorize contract negotiations for the consulting
service. All in all this means: (1) All ECICOG entities will be
addressing DNR mandates, although there is no official DNR deadline as to
when the plan must be undertaken. A 1997 date exists for beginning to
implement whatever choice among the options is undertaken. (2) The
consultant will be working on the plan for approximately 9-12 months, and
I would guess by January 1990 we should have the final work product in
order to begin review of options. (3) At the December 8 meeting each of
the participating communities will be asked to direct an appropriation to
an ECICOG account so that all bills for this consulting service will be
paid through the ECICOG Board.
What we are responding to is Part 1 of DNR guidelines, that is the
planning process and the relevant aspects of that process. Part 2 of the
DNR guidelines involved landfill closures. The closure and the options we
select from our studies will determine the direction selected for our
region. Part 2 guidelines are not in place as of this date.

The Chamber of Commerce Local Government Affairs Committee now has a
landfill subcommittee chaired by Craig Willis. I serve on this Committee.
The League of Women Voters will be holding a public brunch on December 17
at the Holiday Inn from 10:30-12:30 for the purpose of specifically
addressing solid waste management. Senator Dave Osterberg and I will
address the subject from our perspective as state and local officials.
The media has also expressed interest and information will likely be
directed toward them.
I have asked Steve to place this matter on the Council informal agenda so
that we may have a brief discussion and update of the pertinent issues.

Re: Benton Street Bridge
While the meeting in Des Moines met with some success, the Advisory
Council on Historic Preservation is requiring that an "alternatives
analysis" be performed. Simply stated, are there other traffic improve-
ments, regardless of cost, that could be initiated and reduce the traffic
on the Benton Street Bridge and thereby no longer require the demolition
of that structure. We hope to do this work in-house and it may take a
week or two to complete. This appears to be another hoop that we must
Jump through if we ever hope to receive any federal assistance.

this alley. Our research indicates that the alley is not owned by the
City and was dedicated to the University. Attached is a copy of the
ordinance which vacated the alley in 1975. With that vacation, the
University assumed responsibility for the alley you mentioned.

It has come to the attention of the University of Iowa Collegiate
Associations Council University Environment committee that a
particular alley owned by the city is in a critical state of disrepair.
The alley between Old Brick and the Shambaugh Honors House
is used not only by cars but by citizens and students alike who
wish to access these two building by way of the Clinton Street
sidewalk.
People in wheelchairs have been thrown from their chairs in
attempting to cross this alley. All other routes for the physically
disabled are circuitous and dangerous. It is our concern and the
concern of others that episodes like this should not be allowed to
occur again. This alley is of vital importance to the learning
environment of students in wheelchairs.
We would request that the city look into the possibility of
repaving this alley at the soonest possible time. We hope this
problem could be resolved before the onset of winter's subsequent
travel difficulties.

The General Partners of Cedarwood Associates have received a response
from H.U.D. regarding their request for a temporary variance in the
Section 8 contract in order to provide an apartment to the Willowcreek
Neighborhood Center. A copy of H.U.D.'s letter is enclosed, which
explains that all of the units must be leased to very low-income tenants,
and therefore cannot be used for Willowcreek's activities.
We were disappointed to learn of this adverse decision. In spite of this,
we remain interested in cooperating with you and will continue to support
your program.

We have received a response from HUD Headquarters regarding your
request to provide a rent-free apartment for use by Willowcreek Neighborhood
Center at Cedarwood Apartments.
We have been advised that it is the Department's policy not to subsidize
various human service programs with Section 8 funds even though they support
these programs. They cited, as an example, HUD's policy which prohibits
using Section 8 funds to support meal programs in elderly housing projects.
We also questioned if it would be permissible to utilize a unit for
a community center if the rent for this unit was absorbed by the owners
or paid from a source other than Section 8 funds. This inquiry was made
by telephone to Mr. Ron Wallace, Desk Officer for Region VII, after you
informed us that HUD Headquarter's letter to Senator Harkin indicated
that this may be permitted. Mr. Wallace informed us that this was not
the intent of the letter as it is HUD's policy that the Section 8 contracts
be adhered to. In the case of Cedarwood Apartments, all of the units
must be leased to very low-income tenants.

We have initiated the advertisements for the recruitment of a new Police
Chief. It is my intent to conduct a national recruitment. Those
candidates that may be interested in the position and currently serving on
the Department are invited to apply and compete for the position.

The City of Iowa City, Iowa, is seeking a new Police Chief. Chief Harvey Miller is retiring after
13 years as Chief. The new chief will be responsible for an annual budget of $3,000,000 with
53 sworn personnel, which Includes the chief, assistant chief, two captains, seven sergeants,
36 uniformed patrol officers and 6 detectives. The department also Includes 11 support staff
and 4 animal control officers.
THE CITY
Iowa City is a developing urbanized central city of 51,000. It is situated in Johnson County
(total county population 65,000). Iowa City has one suburban community of approximately
10,000 (Coralville) located immediately adjacent to the city. There are many small rural
communities throughout Johnson County.
Iowa City is located along the Iowa River, 25 miles south of the Cedar Rapids metropolitan
area. It is approximately 100 miles east of Des Moines, the state capital of Iowa.
Iowa City is governed by a mayor and six councilmembers elected for four-year terms. The
City Council chooses the mayor from Its membership, The council also appoints the City
Manager for an indefinite term, and the manager serves at the pleasure of the City Council.
The current City Manager has served over two years, and the previous manager served 11
years. The City Council also appoints the City Clerk and the City Attorney.
Iowa City is well known as the home of the University of Iowa (29,000 students) and the
University of Iowa Hospitals and Clinics. Additionally, the City is also the location of many
private employers such as Procter & Gamble, Sheller -Globe, American College Testing, National
Computer Systems, and numerous other smaller firms.
The City has consistently received a AAA bond rating and has been recognized for its
distinguished efforts in budget preparation and In comprehensive annual financial reporting.
Notable for a city the size of Iowa City, the community recently authorized the sale of over $40
million in financing to construct new sewage treatment plants and facilities. With the
construction of these facilities, the development potential for the community is now assured for
the future, Also, the voters approved approximately $4 million in financing to construct a new
indoor swimming pool as well as a major remodeling of an outdoor swimming pool. The City
has an extensive parks and recreation system. Generally speaking, the City's public buildings
are in good condition; however, a major renovation is necessary at Police headquarters,

BENEFITS
Medical Insurance - The City provides 100% of the cost of medical insurance for employees
and their dependents.
Dental Insurance - The City provides dental coverage for employees. Employees have the
option of purchasing family dental coverage.
Lib Insurance - The City provides life Insurance coverage in an amount equal to annual salary
rounded to the next highest thousand.
Vacation - City employees accrue vacation at a rate of one day per month for the first five
years of employment. Accrual rates Increase every five years.

Re: New Sheriff
In order to make some initial positive moves to improve the relationship
between the County Sheriff's office and the City, we will be conducting
somewhat of an informal "getting to know each other better" process.
Recently the Fire Chief met and had a productive discussion with the new
Sheriff in order to basically get to know each other better. Over the
next few weeks and months we will continue to work on improving that
relationship. The new Police Chief will also be given the task of working
toward that end.

Re: Heritage Cablevision Senior Citizen Promotion
Heritage Cablevision contacted our Transit office regarding a promotional
drive to attract senior citizen cable users. They are forming a senior
citizen club that will include a number of discounts at businesses around
Iowa City. .Initially, they wanted the City to give away free rides to
seniors as part of the package. We said no and explained our existing
senior citizen discount program.
Heritage still wants to include Iowa City Transit in their promotion so
they agreed to pay us to participate. The program will work by having
each senior citizen who is sent information on their discount package
receive two Iowa City Transit complimentary passes. The passes will be
stamped on the back with the Heritage name and logo. They will then pay
us 506 each for every pass that is used.

Dear Ben:
In response to your recent letter in which you expressed dismay and
dissatisfaction concerning the handling of the Kent Gregg housing rehabil-
itation loan appeal, I think there are several points that must be
recognized 'before I can effectively respond to the apparent criticism by
the Commission. As you are aware, the Commission as well as the City
Council adopted an appeal process with respect to these rehabilitation
loan requests. Attached is a copy of that review process, whereby an in-
dividual is entitled to appeal the decision of the Commission to the City
Manager. I can assure you I take the appeal process seriously, and it is
my judgment that the appeal is not a means whereby my office will referee
between the opinions of the Housing Commission and their decision and the
opinions of the individual requesting the rehabilitation loan. It is my
further judgment that the appeal process is intended to allow an in-
i dividual to request a review of the decision, under strict guidelines
established by policy. That process has been fully satisfied and you will
note from the minutes of the meeting concerning the appeal, each and every
point was addressed and Mr. Gregg fully satisfied the requirements of the
rehabilitation loan. Copies of the minutes are attached.
On my review of the property in question, and the neighborhood in general,
I would share your concerns; however, the appeal process does not allow me
that type of subjective judgment. Mr. Gregg complied with all elements of
the rehabilitation loan request and for me to have denied the appeal would
have required an arbitrary, capricious action on my part. Rules were
l developed to provide for a fair and impartial review of the circumstances.
I have fully complied with those rules and any personal opinions which you
may have are not relevant to the decision I was required to make.

chapter 13. Grievance Procedure
1. COMPLAINT TO CITY MANAGER
The City Manager shall review and hear the complaint of any person ag-
grieved by the Department of Planning and Program Development or the
Housing Commission in the handling of the application for and processing
of assistance under rehabilitation programs funded by the CDBG and Rental
Rehabilitation Programs.
2. PROCEDURE
a. Filing. A grievance must be filed at the Office of the City Clerk
for the City of Iowa City. Grievances shall be filed in a timely
manner and must be received by the City of Iowa City within ten days
of the denial of an application for rehabilitation funds or within
one year of final payment by the City of grant and/or loan subsidy
funds in connection with rehabilitation work. The communication of
the action shall be in written form and should contain a short,
concise statement of the grievance and explanation of action desired.
The aggrieved person may seek the assistance of the staff of the
Department of Planning d Program Development in filing of an action.
No filing or processing fees shall be required of any aggrieved
person.
b. Notice. The City Manager shall fix a reasonable time for hearing ac-
tions and the Department of Planning & Program Development shall give
notice in writing of the time and place of the hearing to the ag-
grieved person. In no event shall the hearing be held more than 30
calendar days following receipt of the grievance at the Office of the
City Clerk. At the hearing, the aggrieved may appear in person, by
agent or by attorney. If the grievance is resolved prior to the date
of the hearing, the aggrieved party shall request in writing that the
grievance be withdrawn.

3. REVIEW OF COMPLAINTS
a. The City Manager shall review complaints concerning:
-The sufficiency of the application for assistance;
-The eligibility of the application for assistance under the pro-
ject;
-The amount of the loan subsidy allocated or received by said per-
son;
-The quality and appropriateness of the work designated to be done;
The adequacy of the information and assistance concerning the pro-
ject which is furnished by the Department of Planning and Program
Development.
-The appropriateness of the action of the Housing Commission.
b. Standards. In exercising his powers and duties, the City Manager
shall be guided by the following standards:
1. Persons eligible for grant or loan subsidies under provisions
specified in rehabilitation programs operated by the Department
of Planning and Program Development and funded by the Community
Development Block Grant Program and the Rental Rehabilitation
Program, shall have full right to a grant or subsidized loan
sufficient to accomplish the purposes intended by the applicable
program within the limitations specified therein.
2. Eligible persons should be provided adequate assistance in deter-
mination of improvements that are needed and eligible, and tech-
nical assistance related to cost estimates, contract negotiation
and payment of contractors for work completed.

3. Service should be provided by the Department of Planning and
Program Development in such a way to assure that the administra-
tion of the program will not result in different or separate
treatment on account of age, race, color, creed, religion, na-

CALL TO ORDER:
Steve Atkins called the hearing to order at 1:35 p.m.
BACKGROUND:
On September 16, 1988, an appeal was filed at the City Clerk's office
appealing a decision that was made by the Housing Commission at their
September 13th meeting. The Housing Commission had denied Rehabilitation
Assistance for 724 Ronalds Street, Mr. Kent Gregg's property.
HEARING:
Atkins reviewed with staff all qualifying criteria necessary for this
assistance:
1. The application was complete and all necessary information was
provided.
2. Eligibility - All requirements for income and location were met.
3. Funds - Evidence of additional funds needed was provided to allow
completion of the rehabilitation.
4. Work to be done - All items on the deficiency list were appropriate
and to be completed by qualified technicians.
5. Atkins asked Gregg if staff had provided adequate information. Gregg
said staff had been very helpful.
6. Commission Position - Denial by the Housing Commission was based on
size of structure (they called it a dollhouse) and the deteriorated
state of the property. Barnes and Milkman indicated that refusal
cannot be based on the size of the house or the extent of deteriora-
tion, provided that the City's rehabilitation assistance is less than
50% of the after rehabilitation value of the property.
7. Priorities - Application was processed according to established
priorities.
Atkins asked Gregg whether he had any comments. Gregg stated that he had
been working on the house and had already bought some of the materials,
but he needed assistance to complete the project.
Atkins informed Gregg and staff that he would make a decision within a few
days and that Gregg would be informed in writing of this decision.

On Monday, September 26, 1988, Mr. Kent Gregg in a hearing before the City
Manager appealed the denial by the Housing Commission with respect to the
rehabilitation loan for the property at 724 Ronalds. The Administrative
Policy and Procedural Manual for Housing Rehabilitation programs provides
that the City Manager may review and hear the complaint of any individual
who feels aggrieved by the decision of the Housing Commission concerning
the, application for -assistance under a housing rehabilitation program.
Upon review of the appeal and the issues under which the City Manager may
consider the appeal, q is my judgment that Mr. Gregg has fully satisfied
the application process as well as all other pertinent eligibility
requirements and should be granted the rehabilitation loan. By copy of
this letter Mr. Gregg is so notified.

Dear Mr. Atkins:
On behalf of the Housing Commission I wish to express our
dismay and dissatisfaction concerning the handling of the
subject appeal. To be quite frank we did not even know our
decision was being appealed until we received your memo dated
September 28, 1988.
We are not questioning your responsibilities concerning
appeals nor the decision you made in Che case of 724 Ronalds
Street. It just so happens that the Commission was unanimous
in turning down that specific unit. There comes a time when
some good common sense must be used. We believe it was wrong
to approve an expenditure of tax dollars to rehabilitate that
structure.
It is requested that for future appeals that the Housing
Commission be informed and be given the opportunity to
present their views before a decision is made to overrule.
Further it may be prudent to obtain more than one "after
Rehab" appraisal.

Damproofing was applied to Meter Chamber 62 and some backfill was placed
around the Filter Building and the Chlorine Contact Tank.
Concrete pours totaling 640 cubic yards were made this month for the
walls at the Filter Building, Chlorine Contact Tank, Meter Chamber 02,
Manhole q5, the top slab at the Sludge Pump Station, and the center cone
for Excess Flow Clarifier 81. Approximately 30 percent of the estimated
concrete quantity has been poured to date. Forms and rebar installation
continued on all structures.
Yard piping installation included the 48" CWE line, the 48" GOF line,
the 4" and 8" Wastewater line, the 14" WBW line and the 6" PSL and drain
lines. Approximately 1500 feet of buried piping was installed this
month.
Two electrical handholes were constructed and about 200 feet of ductbank
was completed from the Control Building to the gas sphere.
II. South_ Wastewater Treatment Facilitie
Excavation was completed at the Influent Pump Station and the crushed
stone base was placed. Clearing and grubbing was done for the site
perimeter fence. Drilling and lining of the 460 feet deep well was
completed. Installation and wiring of the dewatering wells was
completed.
941 cubic yards of.concrete were poured for the base slabs of Digester
01 and 02, Chlorine Contact Tank, Digester Control Building, and the
Sludge Storage Tank. One wall pour was made on Digester p1 and one
section of footing was poured at the Sludge Processing Building. Forms
and rebar were installed at all structures. Approximately 11 percent of
the estimated concrete quantity has been poured to date.
Piping installation included the 36" GTE line, 18" Wastewater line, 6"
and, 8" DWI line, and the B" DSL line. About 2700 feet of piping was
installed this month. Electrical manhole construction began at Manhole

40 requests for information were received from the contractor this
month. Responses were provided to those inquiries as well as those from
various suppliers and manufacturer's representatives. 5 requests for
clarification were forwarded to the City for action. Answers were
.received on 4 of them. Responses to instrumentation clarifications on
the South Plant are needed immediately as lack of direction has resulted
in identification of a potential delay of the project due to long
delivery times on primary instrumentation and potential redesign of some
structures.'
Several meetings were held with Harry Boren and C. J. Schmadeke to
discuss instrumentation clarification, aerators, cleaning of the
magnetic flow meters, showers and restrooms at the North Plant Influent
Pump Station, mechanical seals for the wastewater pumps, air blowers for
the Aerated Grit Chamber, and discrepancies between the specifications
for the North Plant and the South Plant.
185 shop drawings were received in October, 1988. 129 of these were
reviewed and distributed. 668 shop drawings have been received on the .
project - to date.

Piping installation began under the Chlorine Building. Installation of the
18" Wastewater line continued. Manholes were extended. Installation of the
floor drain piping began at the Digester Control Building. Walls forms
continued at Digester 01 and were started at the Chlorine Contact Tank.
Miring and maintainence of the dewatering wells continued. Electrical
manholes are being located and forms are being built.
Next.week, concrete pours will be made at Digester 01 and the Chlorine Contact
Tank walls and at the Digester Control Building base slab. Piping will
continue under the Chlorine Building and installation of the 6" and 8" DWI
line and the 8" Sludge line will begin. Manhole forming will continue next
week. Installation and wiring of the dewatering wells should be completed
next week as well as the excavation at the Pump Station.

was completed on Excess flow Clarifier 01 and the area east of the Filter
Building was made ready for backfill. Piping work included the installation
of the 48" CWE line from the Filter Building to Meter Chamber 02, the e" drain
line from Clarifier 02 to Manhole S-8, the 8" waste line from Manhole S-8 to
Manhole S-6, 40 feet of the 4" waste line southeast from Manhole S-8, and the
3" CLS line and 1 1/2" EFW line under the Filter Building slab. Sleeves were

poured to the handholes near the gas sphere.
Next week concrete pours will be made at the Chlorine Contact Tank, the

The Contractor's Construction Schedule for the North Plant was recieved July
12, 1988, and has been entered into the SCI schedule program. The South Plant
schedule was received September 1, 1988. An updated schedule, for work
through September for both plants, was received in October.
Only the labor component of the Schedule of Values is considered in the
development of the progress schedule curves. Based on the information at the
"! end of October, the North Plant is 27 percent complete and 6 percent ahead of
schedule. The South Plant is 21 percent complete and 12 percent ahead of
schedule. The total project is 24.5 percent complete, 9 percent ahead of
I^� schedule.
