RESOLUTION TO ISSUE CIGARETTE PERDIITS
WHEREAS, the following firms and persons have made application
and paid the mulct tax required by law for the sale of cigarettes and
cigarette papers; therefore,
BE IT RESOLITD BY THE CITY COUNCIL OF IOWA CITY, IOWA, that the
applications be granted and the City Clerk be and he/she is hereby
directed to issue a permit to the following named persons and firms to
sell cigarette papers and cigarettes:

RESOLUTION APPROVING PLANS, SPECIFICATIONS, FORM OF CONTRACT, AND
ESTIMATE OF COST FOR THE CONSTRUCTION OF THE SOUTHEAST INTERCEPTOR SEWER
PROJECT, ESTABLISHING AMOUNT OF BID SECURITY TO ACCOMPANY EACH BID,
DIRECTING CITY CLERK TO PUBLISH NOTICE TO BIDDERS, AND FIXING TIME AND
PLACE FOR RECEIPT OF BIDS.
WHEREAS, notice of public hearing on the plans, specifications, form of contract
and estimate of cost for the construction of the above-named project was published
as required by law, and the hearing thereon held.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF IOWA CITY, IOWA:
1. That the plans, specifications, form of contract, and estimate of cost of
$10,160,000.00 for the construction of the above-named project are hereby
approved.

2. That the amount of bid security to accompany each bid for the construction of
the above-named project shall be in the amount of 5% of bid payable to

3. That the City Clerk is hereby authorized and directed to publish notice for

RESIDENTIAL DEVELOPMENT PLAN FOR R PLAZA, PHASE TWO.
WHEREAS, Mr. Kenneth Ranshaw, developer, has filed with the City Clerk of
Iowa City, Iowa, an application dated June 21, 1984, on behalf of the
owners KSaK, for approval of a preliminary and final Large Scale Non -
Residential Development (LSNRD) Plan for R Plaza, Phase Two, located on
the following described real estate in Iowa City, Johnson County, Iowa, to

Re: S-8422. Preliminary & Final LSNRD Plan - R Plaza, Phase Two
In 1984, Mr. Ken Ranshaw, developer, made application on behalf of KS&K,
owners, for a preliminary and final LSNRD plan approval of a 1.31 acre
parcel located south of Highway 1 Nest and the R Plaza development and
known as R Plaza, Phase Two. LSNRD plan approval for the original R Plaza
development was granted in 1983 with the subject parcel designated for
future development. The proposed plan represents the balance of the
development and provides for the construction of three buildings: a 7,920
sq.ft. garage building providing 30 -units of warehouse space, a 4,455
sq.ft. warehouse building, and a 7,830 sq.ft. building providing six small
office spaces with attached warehouse space, For more information, please
refer to the attached staff report dated July 5, 1984. Staff had
recommended to approve the plan subject to submission of a statement of
Intent, finding the plan to be in compliance with the LSNRD regulations
and appropriate City codes. After a thorough review, the Planning &
Zoning Commission similarly recommended the plan be approved on August 2,
1984. The City Council, however, rejected the plan on October 23, 1984,
due to concerns regarding compliance of the airport with Federal Aviation
Administration standards; the subject parcel is located in the airport
clear zone for Runway 17.
The denial of the LSNRD plan was appealed to District Court and on
November 21, 1988, the court ruled in favor of Mr. Ranshaw. The court
order requires the City to promptly approve the plan. The plan as
originally submitted complies with the requirements of the LSNRD
reguliticns and other applicable City codes tacluding FAA requirements,
Staff, therefore, recommends the preliminary and final LSNRD plan for R
Plaza, Phase Two be approved subject to the submission of a signed
statement of intent including evidence of ownership, a description of the
project, and the intended time schedule for completion.

Physical characteristics:
ANALYSIS
The topography is relatively
flat.
The applicant, Ken Ranshaw, is requesting approval of a Large Scale
Non -Residential Development Plan for Phase 2 of R Plaza. The proposed plan
includes a series of six small office spaces with attached warehouse
space, a 4455 square foot warehouse building and 30 12' X 22' garage
(storage) units. These uses require a total of 34 parking spaces and a
total of 51 parking spaces are provided (not counting the garage units.)
The property is located in the CI -1 zone, and the proposed uses conform
with the provisions of that zone.
The proposed development is also located in the Airport Overlay Zones,
clear overlay (OCL) zone and the approach overlay (OA) zone. As a result,
the project is subject to the use and height limitations of those two
zones. The OCL zone use limitations provide that "No use shall be permit-
ted in which there is connected therewith a building designed according to
the uniform building code (1979 Edition) with an occupancy rating of 50
square feet of floor area per person or less." In addition, twelve
specific uses are prohibited in this zone. Both the office and warehouse
uses proposed in Phase 2 of R Plaza conform to these provisions (office
space has an occupancy rating of 100 square feet per person, and warehouse
space has an occupancy rating of 300 square feet per person).
The OA Zone is defined as "The land lying under a surface longitudinally
centered on the extended runway centerline and extending outward and
upward from each end of the primary surface." The south property line of
the lot in question is located 552 feet north of the end of runway 17.
The approach surface for this runway extends for a horizontal distance of
5000 feet at a slope of 20:1. The height limitation for the proposed de-
velopment ranges from 26.6 feet at the rear property line to approximately
30 iPeet at the edge of the northernmost building proposed in Phase 2,
Building elevations should be submitted establishing the height of the
proposed structures prior to apprpyal of the LSNRO plan, In addition the
mature height of trees proposed to comply with the requirements of the
Tree Ordinance should be identified by species to ensure that their mature
height will fall within those height limitations.
The provisions of the Airport Overlay Zones also state that "Any person
who proposes any development of greater height than an imaginary surface
txtending outward and upward at a slope of 100:1 for a horizontal distance
of 20,000 feet from the nearest point of the nearest runway shall notify
the Federal Aviation Administration (FAA)," The applicant has already
mailed the Federal Aviation Administration the required FAA form 7460.1,
Notice of Proposed Construction or Alteration, a copy of which is attached
to this staff report. Verification should be obtained from the FAA that
they have received the required information, Note: this is purely a
notification process, rather than a review emd apir9ye1 requirement. Once

or in the vicinity thereof." A note has been provided on the plan to this
effect.
STAFF RECOMMENDATION
Staff recommends that the preliminary and final Large Scale Non -Residen-
tial Development Plan for R Plaza, Phase 2, be deferred. Upon resolution
