This is a yearly statement that is a requirement for receiving Federal Aid funds for projects. Public Warks recommends approval. A copy of the Assurance Statement is attached. f. Correspondence. (1) Letter from Edith Hollingsworth regarding bus service. Mrs. Hollingsworth conducted a survey of evening bus riders. A compilation is attached to her letter. Consider setting a public hearing for January 27, 1987, on an ordinance designating the North Side Residential Area an Historic Preservation Overlay (OHP) zone. Comment: The Planning and Zoning Commission held four meetings for public discussion (November 6 and 20, and December 4 and 18, 1986) concerning the designation of the OHP zone and elected to consider the proposed district in two parts. On December 4, 1986, the Com- mission recommended, by a vote of 6-1 (Wallace voting no), that the district north of Church Street be ap- proved, including additions on North Dubuque Street and at the north end of Johnson Street, and on December 18, 1986, recommended that the area south of Church Street be approved, including two lots at the southwest corner of Davenport and Dubuque Streets, and a two block square area south of Church Street and east of Gilbert Street, by a vote of 7-0. The district is generally described as being bounded on the north by Brown Street and Kimball Road, to the south by Davenport Street, to the west by Clinton and Dubuque Streets, and to the east by Johnson and Dodge Streets. The Iowa Office of Historic Preservation has completed its review of the proposed district and recommends that it be so estab- lished. Action: 1700 awe.) b. Public hearing on a resolution to amend the 1983 Com- prehensive Plan Update to change the land use classifi- cation of Streb South Industrial Park from Industrial to Intensive Commercial. Comment: On November 20, 1986, the Planning and Zoning Commission took under consideration an amendment to the Comprehensive Plan which would change the designation of Streb South Industrial Park from Industrial to In- tensive Commercial. (See Item c.) A motion to approve the proposed amendment failed for lack of a second. Staff had recommended against the Comprehensive Plan amendment in a memorandum dated October 31, 1986. Action: no or(6h� Q Agenda Iowa City City Council Regular Council Meeting January 13, 1987 Page 5 Public hearing on an ordinance to rezone a 13.83 acre subdivision known as Streb South Industrial Park from I-1 to CI -1. (Z-8607) Comment: At a meeting held November 20, 1986, the Planning and Zoning Commission recommended denial of the proposed rezoning of Streb South Industrial Park from I-1 to CI -1, by a vote of 2-f (Perry and Scott voting in the affirmative). Commission members felt no compelling reason was cited by property owners within the subdivision to change the zoning and expressed concern that Iowa City's small industrial base would be eroded. The Commission also recognized that the subdi- vision lies along one of the entranceways to Iowa City and felt CI -1 zoning would have a detrimental impact on the Old Highway 218 corridor. The Commission's recom- mendation is consistent with that of staff included in a staff report dated October 16, 1986. Action: Clo-p,,,•.,.Pa� I?h �,.P,✓ — d. Consider an ordinance to rezone property located at 401 South Gilbert Street from CC -2 to CB -2. (Z-8606) (second consideration) Comment: At its meeting of October 2, 1986, the Plan- ning and Zoning Commission recommended by a vote of 5-1 (Wallace voting no) approval of a request to rezone property located at 401 South Gilbert Street from CC -2 to CB -2, subject to the condition that off-street parking for residential dwellings developed in excess of two dwelling units be provided on an off-site loca- tion within 300 feet of the property. The Commission further recommends that the City enter into a covenant that runs with the land that binds this condition. These recommendations are consistent with that of staff. Public hearings on this ordinance were held on November 4, 1986, and November 20, 1986. No comments were received at either hearing. Consider an ordinance to approve the preliminary Planned Development Housing Plan for Meadow Ridge to be located on an 8.11 acre tract at 1900 North Dubuque Street (Old Highway 218). (second consideration) Comment: At its November 20, 1986, meeting, the Plan- ning and Zoning Commission recommended, by a vote of 6-0, to approve the preliminary planned development housing plan for Meadow Ridge. This recommendation is consistent with that of staff. No comments were re- ceived at the public hearing held on December 16, 1986. In a letter dated November 18, 1986, the applicant requests expedited consideration of this ordinance. The applicant asks that the Council waive the second read- ing of the ordinance and move for passage of the ordi- nance at the January 13, 1987, meeting. Action: ern a) p c. Co sider a reso9ution approving the preliminary Large Scale Residential Development (LSRD) Plan for Meadow Ridge, an 8.11 acre tract located at 1900 North Dubuque Street (Old Highway 218). Comment: Pending adoption of the ordinance to approve the preliminary planned development housing plan for Meadow Ridge, as described in item e.'the developer, R.D. Phipps, requests that the Council give expeditious consideration to the resolution to approve the LSRD plan for Meadow Ridge. At its November 20, 1986, meet- ing, the Planning and Zoning Commission recommended, by a vote of 6-0, to approve the preliminary Large Scale Residential Development plan for Meadow Ridge. This recommendation is consistent with that of staff in- cluded in the report dated November 6, 1986. Consider a resolution approving the preliminary Large Scale Non -Residential Development (LSNRD) Plan of a 20.98 acre tract located at 1630 Lower Muscatine Road for Iowa -Illinois Gas & Electric Company, Comment: By a vote of 5-0, the Planning and Zoning Commission recommended to approve the preliminary Large Scale Non -Residential Development plan for Iowa -Illi- nois on December 18, 1986. The request would permit an addition onto a control house building located on the west side of the property. The Commission's recommen- dation is consistent with that of staff included in a staff report dated December 18, 1986. The addition requires the issuance of a special exception by the Board of Adjustment to reduce a minimum side yard from 20 feet to 18 feet. This request is scheduled to appear before the Board on January 14. If received favorably, it is recommended the Council approve the preliminary LSNRD plan subject to the passage of the special exception. Comment: At the December 15, 1986his , informal Council meet - 1 for the Plaza Mini-ParBill k Mini -Park). Nowysz has been developing a design model for the park's redevelopment in accordance with the stated preferences of the Council, citizen boards and the public. At their December 1986 meetings, both the Design Review Committee and the Parks and Recreation Commission endorsed the Nowysz design for the Plaza Mini -Park. On January 13, 1981, Nowysz will present the most recent design adaptations for public review and comment. FOR DEVELOPMENT OF THE PARK ON A PORTION OF VACATED HARRISON STREET RIGHT -OF -WY BE- TVEEN LINN AND DUBUQUE STREETS. Comment: At the December 15, 1986, informal Council meet- ing, Gary Kiebel, Architect, and Ann Riley, Handicare, Inc. Director, presented the Handicare proposal to develop a vacated portion of Harrison Street into a City park. Handicare, Inc., intends to use its remaining CDBG funds ($25,000) to terrace and provide water and drainage for the site, and then to secure volunteer labor and donated mate- rials and funds to install handicapped play equipment, walkways and landscaping for the park. Both the Planning and Zoning Commission and the Parks and Recreation Commis- sion have endorsed the Handicare, Inc. proposal. On January 13, 1987, Kiebel will present a brief overview of the design of the park and will be available to answer questions which may arise during the public comment period. City Manager. b. City Attorney. —O - ITEM NO. 11 - CONSIDER RECOMMENDATIONS OF THE BOARDS AND COMMISSIONS. a. Consider recommendations of the Design Review Commit- tee: The Design Review Committee unanimously endorses the design for the mini -park and commends the architect for planning spaces for the needs described, relating the design to that of the City Plaza, providing easy access to and from the Plaza, creating a handsome addition to the existing space and simplifying the maintenance requirements. Comment: The public hearing for the mini -park design is scheduled for January 13, and this endorsement resulted from the Committee's review of the proposed plan. I _I Agenda Iowa City City Council Regular Council Meeting January 13, 1987 Page 11 b. Consider recommendations of the Human Rights Commis- sion: (1) That the City Council approve the Expanded Service Level request submitted by the Civil Rights Divi- sion. The request is for a half-time Civil Rights Assistant at a cost of $10,000 per year. The expansion is requested to keep up with the in- creased workload. For additional information please, refer to the memo dated October 29, 1986, to the City Manager from Phyllis Alexander, Civil Rights Specialist, which is attached to the Com- mission minutes of the November 24, 1986, meeting. This request will be considered during the Coun- cil's budget session. (2) That the City Council approve their letter con- cerning the Navajo -Hopi Resettlement Act of 1974. An explanation of the effect the Act will have and is having on the Navajos and Hopies is contained within the letter. With the City Council's ap- proval, the Commission will mail the letter to President Reagan, the Bureau of Indian Affairs and all other relevant indiv{duals and organizations (�Cl1er n.line4.aC •I� rc:.r�S•), ITEM NO. 12 - CONSIDER RESOLUTION AUTHORIZING THE MAYOR TO SIGN AND CITY CLERK TO ATTEST AN AGREEMENT WITH THE IOWA DEPARTMENT OF TRANSPORTATION. Comment: This Agreement is in regard to the bridge deck improvements on the Burlington Street Bridge over Ralston Creek. The Iowa Department of Transportation has agreed to reimburse the City 55% of the actual construction cost to repair and overlay the Iowa 1 (Burlington Street) bridge over Ralston Creek. The construction on this bridge deck is scheduled for completion in the spring of 1987.
