During the six years 1 have been Civil Rights Specialist, the Commission's workload has increased and become much more complicated. The Commission has also expanded the scope and complexity of its education and outreach activities. The increase can be described as follows: ENFORCEMENT ACTIVITIES Caseload The annual caseload has increased by 50%, from an average of 14 cases to an average of 23. Case Complexity Cases have become more complex and require extensive investigative work. One of my first cases concerned age discrimination within the area of employment. The employer readily admitted to discriminating and contended that he could do whatever he pleased. Obviously, with that sort of admis- sion, the case was easy to investigate. In contrast, an employment/race case currently under investigation is extremely time-consuming. Because the Complainant alleges to being treated less favorably than his co-work- ers in three different ways, I have to conduct a complex, multi-level Investigation including review of the Complainant's records, comparisons with records of his co-workers, and interviews. So far seven interviews have been completed and three more are scheduled. Because respondents are often uncooperative, it is more challenging and time-consuming to resolve cases. When probable cause is found, concilia- tion is pursued. If conciliation fails, a public hearing is set. Before 1980, only one public hearing had been held. Since then, a hearing was held in fiscal year 1984, with the final remedy set at {17,000. The employer appealed the case, and it has yet to be resolved. Two public hearings were scheduled for fiscal year 1985; one was settled before the hearing, and the other had to be dropped. One public hearing has been scheduled thus far -for fiscal year 1987. In another case, a Respondent refused to give us the information requested, even ignoring our subpoena. That case will be heard before the Iowa Supreme Court on November 4. 1986. Dollar remedy has increased reflecting increase in the 'damage' experi- enced by complainants. The $17,000 remedy has already been mentioned. Other total remedies per fiscal year have been: 2 Fiscal Year 1986: $8,333.40 Fiscal Year 1985: $2,491.00 Fiscal Year 1984: $1,580.00 EDUCATION AND OUTREACH ACTIVITIES An important aspect of the Commission's work has been expansion and enhancement of our education and outreach activities. Six years ago such activities were restricted to dissemination of newsletters, brochures, public service announcements, and posters. We are now involved in more active education programs: o 'Civil Tongue' - The Commission's cable TV program airs on Channel 29 every Thursday at 6:3o p.m. Ten shows have been produced: o Workshops (2 sexual harassment, several affirmative action and civil rights law). o Speaking engagements - eight during Fiscal Year 1986. o Human Rights Award Breakfast. The third annual breakfast will be held on October 30, 1986. o Two housing audits were coordinat4g by the former Civil Rights Assistant who worked from June 19 to December 1985. The first housing audit, which involved 92 tenants, found Black auditors were treated less favorably than the white auditors 42 percent of the time. The second audit, which tested the extent of discriminatory practices affecting families with children, found testers with children were treated less favorably than testers without children 33 percent of the time. Such outreach and educational activities are being restricted because we don't have the staff we need to develop and manage them properly. OTHER ADMINISTRATIVE ACTIVITIES Besides the technical work which includes the enforcement and education activities, I am also responsible for providing leadership and direction. Adminlstrati4e activities include: o Administer the HUD contract first entered into during Fiscal Year 1983. o Pursue grants, such as that offered for the first time in Fiscal Year 1986 by the Iowa Supreme Court lawyers Trust Account Commis- sion. Funding is being sought for Fiscal Year 1987 to develop and administer a racial climate survey and cultural awareness training workshops. o Train three new Commissioners per year. Offer training to all Commissioners at least once per year. (Training was formally pro- vided by the Iowa Civil Rights Commission.) 9 o Represent the Commission as an active member of the Association of Iowa Human Rights Agencies. Through the Human Rights Comission, the City has made clear its genuine commitment to the ideals of equal opportunity. Enforcement of the City's non-discrimination ordinance puts out fires and education programs promote real progress. An aggressive outreach education. program teaches the community how to accept differences in others ultimately breaking down the barriers which contribute to conflict and tension between Blacks and whites, young and the old, able and differently abled. Other Iowa human rights comnissions are not nearly as active or as effec- tive as we strive and need to be primarily because they have no paid staff. They have been self-suffi- cient living in balance with natural law and the land. The Human Rights Commission takes >, a stand against Public Law 93-531 and we urge you to investigate this law, Public Law 93-531 enacted December 22, 1974, is an act of Congress "to provide for final settlement of the conflicting rights and interest of the Hopi -and Navajo Tribes to an inland, lying within the Joint Use Area of the reservation established by the Executive Order of December 16, 1882, and lands lying within the reservation created by the Act of June 14, 1934 and for other purposes." This law is ^- commonly referred to as the Navajo -Hopi Resettlement Actof 1974 and essentially allows for the resettlement of 13,000 Navajos living on 960,000 acres of their land around Big Mountain in Arizona as a means of resolving an alleged "century -old conflict" between the Navajo and Hopi people, The problem was created in 1882 when the federal government hastily and arbitrarily drew a Hopi reservation boundary that erroneously included the homes of hundreds of Navajos. The alleged centuries-old conflict between the two tribes supposedly makes continued cooperation on the deringtthe NavajotandJoint HopiUse reservationst- imposswo iblecressof land splits the Joint Use Area equally between the two peoples while ordering all Navajos or Hopies living the "wrong on side" of the partition to leave their present homes. The bill has also authorized a 90% reduction in the Hopi livestock and has stopped all building and repairs on the property and mandated barbed a wire fence. They still speak their own languages and practice their own forms of governance. 111 Ross Swimmer January 8, 1987 Page 2 r� Navajos that have visited Iowa City tell us there is no "centuries -old" conflict between the Navajos and Hopies, that traditional Hopi are as opposed to the resettlement act as the Navajo, recognizing it as a threat to the way of life of both peoples. The Navajos tell us that what is behind the Resettlement Act is not the desire for peace but the desire for profit, because the greatest beneficiaries of this plan are an unrepresentative Hopi tribal council, in alliance with the Bureau of Indian Affairs and the energy conglomerates and public utilities that operate in the southwest. The Black Mesa coal field, in the Joint Use Area, contains over 21 billion tons of high quality coal easily accessi- ble to strip mining, and as economic expansion continues in the sunbelt, states' demand for coal as the most economic fuel for the generation of electricity is expected to double in the next ten years. The Resettlement Act in addition to being opposed by the Navajos and Hopies has not been successful. The cost was originally estimated at { $34 million but already $275 million has been spent. Navajo and Hopi z.: families have been relocated to cultural situations in which they cannot survive. Already 50% of the families relocated to Flagstaff, Arizona, the most common relocation site, have lost their homes. i` SG i' To date, Representative Mickey Leland (D -TX) has a Repeal Bill in the House and Senator Alan Cranston (D -CA) has submitted a bill (5.2545) 9` urging a moratorium on relocation be attached to the appropriations bill. Please advise us on where you stand on the relocation of 13,000 Navajo and Hopi Indians as a result of this law and advise us on what 4:. you are going to do with regard to the growing evidence that relocation is not working. We urge you to review this situation and respond by ki repealing PL 93-531. We look forward to your response. The second student uses the bus when the weather is too bad for a bicycle. - Two college students work every other Saturday night and use the bus. This night, off work, they were going to a movie. They need half hour schedules daytimes because class hours do not fit hourly service. This person also rides midday. - An Oriental student living at Hawkeye Court uses the bus every Saturday night to get to the library, and his wife uses it during midday. He is most concerned that he not use this service because his car is inoperative. By way of a petition signed by the owners of the other 20 ij lots in Strebs Park I am also their unofficial y•; representative. Our purpose is to re -zone all of Strebs Industrial Park from the current I-1 zoning to a CI -1 zoning. �;; My comments are directed to some background information ' about this park, to the objections registered by the •��� planning and zoning staff and board, and most importantly to the injustice - of the I-1 zoning to the current and future owners of any of these lots. a1 The background of this subdivision is important to note -, because it has specific relevance to how and why this park was developed in the first place. The park was sub -divided and approved for development in s+.;a 1975 by Al Streb. The zoning at that time was M-1 which was a light industrial use. Essentially, Mr,. Streb's intent was for this park to be a blend of light manufacturing and commercial users, hence the names of the streets, Commercial Drive and Commercial Court. The lot sizes are all under one acre with the total park }� being 13.8 acres. The park was developed prior to the ;,. 1978 comprehensive plan under the designated M-1 zoning. The users included 10 lots for warehousing purposes, 5 lots for contractors, four lots for automotive related uses and 2 lots for light manufacturing. al Page Two Streb Industrial park December 16, 1986 To the best of ray knowledge the uses for these lots have not changed. Currently these are 10 lots for warehousing, four lots for contractors, two manufacturing, one is vacant, and four are currently nor, conforming. The only changes in Streb Industrial Park is the zoning because of the 1983 comprehensive plan from M- 1 to CI -1. The reason for the I-1 zoning is because the majority of the users at the time of the 183 comprehensive plan were warehouse or contractor related. It can in no way be construed to be I-1 for the purpose of future development potential for light manufacturing because the park was totally developed in 1983, and secondly the likelyhood of any of these developed lots being converted to light manufacturing would make no sense whatsoever economically. What the I-1 zoning did do was take a totally developed subdivision from a broad zoning use of M-1 to a very restrictive zoning of I-1. Ire the process it created a non -conforming use for four of the owners which is 1/5 of the total subdivision. By doing this there can be no doubt that the value of these owners properties has been seriously diminished. Further more the other seven owners values are diminished, even though they are conforming, if for no other reason than restrictive uses because of zoning. R review of I-1 zoning as opposed to CI -1 shows that the I-1 has eight allowable uses, five of which will very likely never be utilized. *The CI -1 has 20 uses of which the current owners are utilizing 6 of the 20 uses permitted. Under the CI -1 use all 21 lots would be conforming uses and under the I-1 zoning four of the eleven owners are non -conforming. Of the seven conforming users one is Currently vacant and another is desireable of selling the property but will have very slim chances zoned 1-1. I initially became involved with this park when I produced a qualified buyer to Iowa State Bank for their vacant building or, Lot 19.
