Certainly my feelings are well known on the matter as I spoke at your last meeting two weeks ago. This southern area in many ways is the most threatened, contains the greater number of significant buildings, including a number depicted in several architectural history books, and is also the part of the district most of the long time workers for establishing this district live. I urge you to approve the area as a historic district. I also urge you to include block 75 in the district as there is no good reason not to. Placing this block in the district does not affect the density or use the block can be put to. It would, however, control the design of any redevelopment effort so that the new structure or structures would blend with the Mean's house and other significant structures in the district. Summit St. Iowa City, Iowa 52240 December 15, 1956 To Iowa City Zoning & Planning Commission Iowa City Historic Preservation Commission I am most concerned and unhappy about the letter that I received December 11th stating that the property at 329 N. Dubuque was included in a proposed designated historical district. The timing of presenting this proposed project disturbs me, as I am sure that a letter sent this close to Christmas is not going to get the full attention of the persons who will be affected by your de- cision. A notification delivered just seven days before the meeting date is not adequate time for anyone to study the impact of this proposal as it will affect each owners property. My objections to the proposal (in total, and as it affects my property at 329 North Dubuque are listed as follows:) TOTAL AREA OBJECTIONS: 1. I drove every street and alley of the proposed district, and I found very few properties that were of significant historical value located within boundaries of this proposed district. The Preucil School of Music, the Holub Apartment building and picturesque housing to the North are all outside this district. .Other than some large houses in the area of the University president's home, most property has been converted to rental property, and many changes have been made from the original structures. 2. Probably 40-50% of the properties are on inadequate sized lots. Selling or converting them to other uses would require acquisition of adjacent property, or obtaining variances from the zoning commission. Further encumbrance of requirements made by the Historic Preservation Commission could result in financial losses caused by loss of sales, transfers, or repairs needed. 3. There are a substantial number of older owners in this area who will have to be converting this property in some form. With their lot sizes, they simply do not need any encumbrances beyond the city requirements already in effect. 4. I feel before this proposed district is considered,' there should be a more comprehensive polling of the property ownerts wishes. I would have done it myself before the preparation of this letter if I had been given adequate time. PERSONAL OBJECTIONS IN RELATION TO PROPERTY AT 329 N. DUBUQUE: 1. I would like to state that it is my feeling that it is a total act of discrimination to dip down and take only two houses out of one block. This inclusion, if approved, will not only put an extra encumbrance on the sale of my property, but could cause problems for the next two properties on the block. I cite especially that of Ms. Clara Hinton, Age 93, lives in her duplex at 923 Davenport Street. She is in very fragile health, and soon will need to vacate. Sale of this property could be lost by realizing that possible combining of .this property with the adjacent one --namely mine, would bring it under regulations of the Iowa City Historic Commission as well as the city regulations. /GQ..e.- `1 -2- - itein either case, butlthereycouldsbetoproblems shouldtthisrbecomesall Possibility, 2. It is difficult to understand the reasoning t suggesting the deletion of the area south of Church Street inasmuch as i the property owners of this (and other blocks) have indicated a desire to be included. Mnay of these properties are o=er-occupied. In the block in which we live we own one quarter, and the Harold Peters, a second quarter. They and the two sorority Corporations, Tri Delta and Alpha Xi Delta have joined us in requesting this designation. Certainly the wishes of the property owners involved and who have invested here deserve to be considered. In fact our concern is that the area is too small and a greater number of blocks should be included. The above owners have held their properties for many years and have invested in various ways to improve and maintain their holdings. We believe it is in the best interest of this area, and all of Iowa City to do everything possible to enhance this core area which serves as an artery from the Interstate to the downtown and campus areas. It is, however,a living area. It is the normal process for older buildingsno longer viable as structures to be replaced by current, newer structures. The newer structures will meet current needs and building codes, which the older buildings may or may not. But to try and cast an area into a glass jar and not allow it to change is to ask it to stagnate. There are many towns in New England, and rural Iowa, that look just like they did when the local industry left, because no one was interested in remained`; nor able to keep the town current with the rest of the world. These spots may now be seen as quaint, charming, picturesque, and tourist traps. But for many years only the old and the poor lived in the towns, people who could not afford to move for emotional or economic reasons. The creation of so large an historical district in Iowa City could impose economic hardship on residents caught in the area. Some of the houses are better replaced with something more efficient and more economical when their usefull days end. Historical designation prevents this. You have already addressed changing usage of the area by rezoning, But to attempt to make the area stagnate in thejundred year period from the 1850's through the 1950's or o is to say there is nothing new worth looking at. It is to say the current and future generations have..._, nothing that will be good to offer. That is very Pessimistic, especially in a university town, //4 Page 2 Should this area be placed under a glass dome and any activity in the area be scrutinized by a city board? Will a city board consider the proper color scheme for the area? Will each block be given colors allowed for the area for the exteriors of the buildings? The current design review board thinks it has control over the colors used in parts of the downtown area, even requiring a national chain to alter the colors of its logo. Of course the disallowed color is on a sign just across the street, According to reports in the newspaper this summer the design review committee wants to extend the area under its control. Will the northside be added? The extent of control over the neighborhood under this proposal may be underestimated. There was a story this summer in the Des Moines Register about the historical district in Dubuque where long time residents could not put aluminum siding on their home. They were worried about exterior upkeep during their retirement years. They found out they would have to have the house painted rather than insulated and sided, because of the historical neighborhood designation. That couple was left wondering about control of their own home. This should warn us about the nature of an historical designation for the 24 block northside area. If residents are concerned about a smaller area, let them ask for that specific area. It was interesting that at the last public hearing on this, the Lutheran Campus ministry asked for relief by not being included in this' historical area, and the fraternities have asked not to be included. The Lutheran Center covers the area immediately next to the University president's home. But they see it as a disadvantage to be included in the historical district. Perhaps the area of Bella Vista Place should be considered, IF the residents of the area ask. They will then be assuming the plus and minus of the designation for themselves. Indeed, we would suggest extending the district an additional half -block along Johnson street, in order to include one of the most historic homes in Iowa City, built by Hugh Downey in the 1840s. The accompanying map showed that several additions have been made to the proposed district since the proposal was last publicly considered by the Iowa City Planning and Zoning Commission Nov. 6, 1986. These additions include my property at the and of North Johnson Street, which was half a block outside the area under consideration last fall. Since I cannot attend the Jan. 27 meeting, I will have to send my comments in this letter for your consideration. Let me urge you to allow more time before making a decision on this proposal, determining first the answers to several questions, t; including the following# What wWe the cost of implementing this proposal and supporting the administrative machinery necessary to enforce it in the years ahead? Would this cost be borne t` by Iowa City taxpayers, and if no, how much would it raise our taxes? Or would t it through fees for obtaining approval residents of the area be required to suppor for new construction and remodeling? How much would its added regulations and restrictions on construction discourage new development and lower the value of properties in this area? Let me point out that the deterioration of at least the northern part of the North Side began some 30 years ago when city administrators allowed the mushrooming of Black's Gaslight Village in an area on Brown Street which had been one of the ? most attractive residential blocks in Iowa City. The progressive deterioration since has been most apparent in the almost complete neglect of many lawns in this area -- I suspect chiefly on rental properties. I would like respectfully to suggest that you consider first some steps to encourage the rehabilitation of these lawns, getting rid of scrub trees, brush and weeds which have overwhelmed foundation plantings and bringing about at least the mowing of thissareawill makes ws with some on�lyarit a dent inhatever rejuvenatingtitnwithout r habilitain given to t ons fn these lawns. Finally, since my four and one-half &ores of ground on the perimeter of the proposed district has only one existing structure which could even be considered for preservation, I ask that rqy property be removed from this proposed district. Despite concerns about changes in the boundaries and the loss of some significant properties since our last review due to demolition and inappropriate modifications, we believe the district meets the criteria for an "Area of Historical Significance,"stated in Section 303.20 of the Code of Iowa. The North Side area contains the most significant concentrations of late 19th and early 20th century architecture in Iowa City. Stylistically, the buldings here feature representative examples of almost every major movement from the Greek Revival of the 1840's to the Bungalows of the 19301s. Even more significant are the unusually large number of remarkably well preserved vernacular buildings, which borrow freely from a wide range of stylistic influences and testify to the abilities of the largely forgotten craftsmen who designed and built them. Our favorable review of the boundaries of this local historic -Z- i district should not be construed as an endorsement for listing in the National Register of Historic Places. We view our action as support for the Historic Preservation Commission's finding that the area in question contains significant cultural resources and that these resources should be conserved for future generations Of Iowa Citians. It is highly unlikely the district, as currently defined, could be listed in the National Register. It is the sense of our staff, however, that the North Side contains a number of properties that are individually eligible and that there may be one or more small National Register districts present there as well. We believe the house has historical and architectural significance, at least partially due to the Turret on the northwest corner of the building. However, we are opposed to the proposed North Side residential historical district designation. We are opposed to the ordinance for the following reasons: 1. The time and money required to implement the program would be tremendous. 2. The Building Department is already overworked. 3. The Council has enough to do without listening to appeals. 4. The property owners should be free to make exterior alterations to a building without City approval pro- viding the building code is complied with. 5. In many cases it is very expensive for property owners to historically preserve his or her building. The end result may be that the buildings are allowed to deteriorate rather than spend huge sums of money in order to comply with the historic preservation. 6. Our properties provide a rooming house, dormitory, residence, and place of study for the active members of the fraternity while they are students at the University of Iowa. The property is designed and used solely for this purpose by our fraternal society. As such, our properties have much more in common with the University of Iowa properties which have been expressly excluded from the proposed District. If the University properties should be excluded from the proposed District, so too should the Sigma Chi and other fraternity properties be excluded. r Not only does the distinct character of the Sigma Chi properties justify its exclusion from the proposed Historic Residential Dist- rict, but it must be noted that Sigma Chi's property sits like an island on the west side of Dubuque Street, buffered to the east and to the north by other fraternity houses not family dwellings. To the south it is bordered by rooming houses of a rather non- discript nature. To the west runs the Iowa River. This property a should not be merged into a Residential Historic District" with which it has absolutely nothing in common and to which there is no rational relationship or nexus to a fraternal lifestyle, culture, or architectural theme. On one of our properties, 629 N. Dubuque St., sits an'old two story frame home which has for the past 10 years been our annex. We have a dream of someday replacing thatstructure which has absolutely no redeeming social or cultural value, with a traditional fraternity house thereby enhancing the quality of life for those active members of the Sigma Chi Fraternity who are in our charge. We established the bounds of the flight paths and determined the type of trees and shrubs that could be planted and not protrude into the flight path. I found that a technique known as "notching" could be employed which would reduce the wheight of the trees to below the flight path.
