Consider an ordinance to rezone certain lots in South- west Estates Subdivision, Part Two, from ID -RS to RR -1. (first consideration) (Z-8609) Comment: By a vote of 6-0, the Planning and Zoning Commission recommended to approve the rezoning of a portion of Southwest Estates Subdivision, Part Two, from ID -RS to RR -1, at its meeting of January 15, 1987. After final plat approval in July 1986, it was discov- ered that the northern tier of lots extended into the ID -RS zone. At the time of subdivision approval, it was assumed that the entire subdivision was within the RR -1 zone. The applicant, Seville Corporation, seeks RR -1 zoning to permit the development of the subdivi- sion as platted. The Commission's recommendation is consistent with that of staff's. Action:c7i�17�f� b. Consider a recommendation from the Planning and Zoning Commission that the filing fee for Z-8609 (a request to rezone certain lots in Southwest Estates Subdivision, Part Two, from ID -RS to RR -1) be waived. Comment: At its January 15, 1987, meeting, the Plan- ning and Zoning Commission recommended that the City Council waive the filing fee of the rezoning request Z-8609. The Commission felt the need for the rezoning was attributed in part to a clerical error on the Zoning Map. The applicant had requested that the filing fee be waived. Consider a recommendation from the Planning and Zoning Commission that parking around the Cambria Court cul-de-sac be prohibited. Comment: At its January 15, 1987, meeting, the Plan- ning and Zoning Commission, by a vote of 6-0, recom- mended that no parking be permitted around the Cambria Court cul-de-sac. This recommendation is based upon the Commission's concern regarding congestion in the area and an effort to discourage the use of Cambria Court for parking purposes by Willow Creek Park users. Council may wish to refer this item to appropriate staff. Action:M J _.2 i f. Consider an ordinance designating the North Side Resi- dential Area an Historic Preservation Overlay (OHP) zone. (first consideration) Comment: The Planning and Zoning Commission held four meetings for public discussion concerning the designa- tion of the OHP zone. On December 4, 1986, the Commis- sion recommended, by a vote of 6-1 (Wallace voting no), that the district north of Church Street be approved, including additions an North Dubuque Street and at the north end of North Johnson Street; and on December 18, 1986, recommended that the area south of Church Street be approved including two lots at the southwest corner of Davenport and Dubuque streets, and a two -block square area south of Church Street and east of Gilbert Street, by a vote of 7-0. The district is generally described as being bounded on the north by Brown Street and Kimball Road, to the south byDavenport Street, to the west by Clinton and Dubuque streets, and to the east by Johnson and Dodge streets. The Iowa Office of Historic Preservation has recommended in favor of the establishment of the local historic district. A public hearing was held on this ordinance on Januarythir 27, 1987, and oertower vies t the Council sInrreferencentostheeformationeof thew dis- trict. Consider an ordinance to rezone a 13.83 acre subdivi- sion known as Streb South Industrial Park from I-1 to CI -1. (second consideration) Comment: At its meeting on November 20, 1986, the Planning and Zoning Commission recommended denial of the proposed rezoning of Streb South Industrial Park from I-1 to CI -1, by a vote of 2-4 (Perry and Scott voting in the affirmative). Council members cited that no compelling reason to change the zoning was expressed by property owners within the subdivision, and expressed concern that Iowa City's small industrial base would be eroded. The Commission also recognized that the subdivision lies along one of the entranceways to Iowa City and felt CI -1 zoning would have a detri- mental impact on the Old Highway 218 corridor. The Airport Commission has also recommended denial of this request. A public hearing was held on January 13, 1987, with Mr, John Rhoades speaking on behalf of property owners within the subdivision to support the rezoning of the subdivision. Action: rilaD� 2�/.I> ITEM NO. 6 - PUBLIC HEARING ON AN ORDINANCE ADOPTING THE 1985 EDITION OF THE UNIFORN BUILDING CODE, AS AMENDED. THIS CODE SHALL BE KNOWN AS THE IOWA CITY BUILDING CODE. Comment: The Board of Appeals has reviewed the 1985 Uni- form Building Code (UBC) and has suggested several amend- ments to accommodate local conditions and practices. An additional change is being recommended in the third para- graph of Section 303, Expiration, Subsection (d) that will provide existing permit holders the same twenty-four (24) months expiration period as that of new permit holders. The 1985 UBC is to replace the 1982 UBC. A copy of the proposed ordinance is attached. Action: Agenda Iowa City City Council Regular Council Meeting February 24, 1987 Page 7 ITEM NO. 7 - PUBLIC HEARING ON AN ORDINANCE ADOPTING THE 1985 EDITION OF THE UNIFORM FIRE CODE, AS AMENDED. THIS CODE SHALL BE KNOWN AS THE IOWA CITY FIRE CODE. Comment: The Board of Appeals has reviewed the 1985 Uni- form Fire Code (UFC). The Board recommended Code changes substantially similar to existing amendments presently in force. The 1985 UFC is to replace the 1982 UFC. A copy of the proposed ordinance is attached. ITEM NO. 8 - PUBLIC HEARING ON THE IOWA CITY TRANSIT SYSTEM'S SAVICE REDUCTIONS AND FARE INCREASES AS PROPOSED IN THE FY88 BUDGET; THESE CHANGES ARE TO BE IMPLEMENTED MARCH 16, 1987. Comment: The City Council has reviewed the proposed serv- ice reductions and fare increases for the Iowa City Transit System. A public hearing is being held to receive public input on the proposed reductions and fare increases. The Council is scheduled to give final approval to the changes on March 10, 1987. Action: "Ieo ITEM NO. 9 - PUBLIC HEARING ON THE OPERATING BUDGET ESTIMATE FOR THE FISCAL YEAR JULY 1. 1987, THROUGH JUNE 30, 1988, THE PRO-.O'O a POSED USE OF FEDERAL REVENUE SHARING MONIES FOR THE FISCAL YEAR JULY 1. 1987, THRU JUNE 30, 1988. AND THE PROPOSED FIVE-YEAR CAPITAL IMPROVEMENTS PROGRAM FOR FISCAL YEARS 1988-1992. Conment: The City Council has reviewed the FY88 Operating Budget, the use of Federal Revenue Sharing monies for FY88 and the Capital Improvements Program for FYs 1988-1992. The Federal Revenue Sharing monies being expended were received in previous years. A public hearing is being held in accordance with State regulations for the public to comment for or against the proposed budget. Consider recommendations of Broadband Telecommunica- tions Commission: (1) The Broadband Telecommunications Commission (BTC) recommends to Council, based in part on Legal staff's opinion, that Heritage should not have to provide cable service to City Block 80 downtown. The BTC will continue to monitor this situation. (2) The BTC recommends the proposed budget to Council, but also wants to advise Council that the current budget does not account for several items, which may be important in the coming one to three years. Those items not accounted for in the current budget include: 1) an upgrade in the Production Coordinator's position; 2) a financial audit of the cable company; 3) a chargeback system to the City Cable TV Department for services provided to the City departments that are non -cable TV re- lated; 4) no provisions for the institutional network (INET), interactive or other telecommuni- cations research and development have been in- cluded, which may facilitate economic savings and development for the Iowa City community; 5) the Professional services line item charges should be reviewed for possible reduction (these are reim- bursements back to the City Administration and Legal for service rendered); 6) no promotion budget is now included. Comment: At the present time, the retaining wall does not interfere with the use of Newton Road as a public right-of-way. The agreement protects the City from any liability and provides for removal of the wall if deemed necessary at a later date. The cost of this work.is $105,000, not including necessary additional right-of-way. Action: Comment: This resolution authorizes the filing of a lien against properties for delinquent sidewalk repair charges. On February 11, 1987, certified letters were mailed to each property owner listed in Exhibit A notifying them of the date for the Council's consideration of the resolution. After the resolution is moved for adoption, property owners should be permitted to be heard concerning the unpaid charges.
