Consider setting a public hearing for April 7, 1987, on an ordinance to establish a Planned Development Housing Overlay (OPDH-5) zone on a 1.69 acre tract known as Summit Place and located on the southeast corner of the intersection of Marcy Street and Kirkwood Avenue. Comment: The developer, Al Wells, proposes to develop nine condominium dwellings clustered in three buildings on this tract. In order to conserve open space and to preserve the natural features of the site, the appli- cant wishes to develop the property in accordance with the development variations permitted in the OPOH zone. The Planning and Zoning Commission will consider this application at its regular meeting on March 5, 1987, The developer has requested that expedited considera- I tion be given to this application. Action: %}l�J J / O I -1 Agenda Iowa City City Council March 10, 1987 Page 5 Consider an ordinance designating the North Side Resi- dential Area an Historic Preservation Overlay (OHP) zone. (first consideration) Comment: The Planning and Zoning Commission held four meetings for public discussion concerning the designa- tion of the OHP zone. On December 4, 1986, the Commis- sion recommended, by a vote of 6-1 (Wallace voting no), that the district north of Church Street be approved, including additions on North Dubuque Street and at the north end of North Johnson Street; and on December 18, 1986, recommended that the area south of Church Street be approved including two lots at the southwest corner of Davenport and Dubuque streets,. and a two -block square area south of Church Street and east of Gilbert Street, by a vote of 7-0. The district is generally described as being bounded on the north by Brown Street and Kimball Road, to the south by Davenport Street, to the west by Clinton and Dubuque streets, and to the east by Johnson and Dodge streets. The Iowa Office of Historic Preservation has reconnended in favor of the establishment of the local historic district. A public hearing was held on this ordinance on January 27, 1987, and numerous property owners presented their views to the Council in reference to the formation of the dis- trict. At its February 24, 1987, meeting, the Council deferred this item for consideration at its March 10, 1987, meeting. Action: JhCM/ ,jh � law (V o i�7 3= li C. (second consideration) (Z-8609 Comment: By a vote of 6-0, the Planning and Zoning I� Commission recommended to approve the rezoning of a portion of Southwest Estates Subdivision, Part Two, from 1987. AfterlfinaltPlat approvals in July 1986of anit January s5discov- ered that the northern tier of lots extended into the ID -RS zone. At the time of subdivision approval, it was assumed that the entire subdivision was within the RR -1 zone. The applicant, Seville Corporation, seeks RR -1 zoning to permit the development of the subdivi- sion as platted. The Commission's recommendation is consistent with that of staff. Consider an ordinance to rezone a 13.83 acre subdivi- sion known as Streb South Industrial Park from I-1 to CI -1. (passed and adopted) Comment: At its meeting on November 20, 1986, the Planning and Zoning Commission recommended denial of the proposed rezoning of Streb South Industrial Park from I-1 to CI -1, by a vote of 2-4 (Perry and Scott voting in the affirmative). Commission members cited that no compelling reason to change the zoning was expressed by property owners within the subdivision, and expressed concern that Iowa City's small industrial base would be eroded. The Commission also recognized that the subdivision lies along one of the entranceways to Iowa City and felt CI -1 zoning would have a detri- mental impact on the Old Highway 218 corridor. The Airport Commission has also recommended denial of this request. A public hearing was held on January 13, 1987, with Mr. John Rhoades speaking on behalf of property owners within the subdivision. Consider a resolution approving the final Large Scale Residential Development (LSRO)Plan for Meadow Ridge, an 8.11 acre tract located at 1900 North Dubuque Street (Old Highway 218). (S-8702) Comment: At its February 20, 1987, meeting, the Plan- ning and Zoning Commission recommended, by a vote of 5-0-1 (Perry abstaining), to approve the final LSRD plan for Meadow Ridge subject to fire apparatus access provisions, or suitable alternatives, which are ap- proved by the City Fire Department. Fire apparatus access provisions proposed by the developer have re- cently been approved by the Fire Department. This recommendation is consistent with that of staff in- cluded in a report dated February 5, 1987. Action U � rn� 70 Agenda Iowa City City Council March 10, 1987 Page 7 f. Consider a resolution approving the preliminary and final plats of Yansky's Subdivision, a subdivision of --�— Johnson County, Iowa. (S-8704) Comment: On March 5, 1987, the Planning and Zoning Commission will consider an application submitted by Douglas and Yvette Yansky for approval of a preliminary and final plat for Yansky's Subdivision, a five (5) acre, three (3) lot subdivision located southwest of Iowa City and south of Highway 1. The proposed subdi- vision is located in Area 1 of the Fringe Area Policy Agreement between Iowa City and Johnson County. In order to meet the meeting schedule of the Johnson County Board of Supervisors, the Council is requested to give expedited consideration to this request. In a report dated March 5, 1987, staff recommends that, upon resolution of the deficiencies and discrepancies iden- tified in the report, the preliminary and final plats for Yansky's Subdivision be approved. Action: 9. Consider a recommendation of the Planning and Zoning Commission concerning a request submitted by Stephen Bright for rezoning in the County from A-1, Agricul- tural, to RS, Residential Suburban. (CZ -8614A) Comment: On March 5, 1981, the Planning and Zoning Commission will take under consideration a request submitted by Stephen Bright to rezone five (5),three (3) acre home sites in the County from A-1 to RS to permit a residential subdivision. The site lies in the new amended Area 4 of the Iowa City/Johnson County Fringe Area Policy Agreement. According to the new Area 4 policy, residential development would be permit- ted at a density of one (1) dwelling unit per three (3) acres for properties having frontage on or access to Rapid Creek Road. In order to meet the County Zoning Commission/Board of Supervisors' schedule, this item is being placed on the agenda for expedited considera- tion. Action: �D Agenda Iowa City City Council March 10, 1987 Page 10 ITEM NO. 12 - CONSIDER A NOTION SETTING A PUBLIC HEARING ON APRIL 7, 1987, ON AN APPLICATION NOT TO EXCEED FIFTY (50) UNITS OF SECTION 8 EXISTING HOUSING VOUCHERS. Comment: The Housing Authority has been invited to submit n an application for not to exceed fifty (50) units in the Section 8 Existing Housing voucher program. In response to that invitation it is recommended that the Housing Author- ity apply for not to exceed fifty (50) units. Section 403A.28, State Code of Iowa, requires that a public hearing be held concerning this application and that the notice of public hearing be published at least 15 days prior to the date set for the hearing. Request that public hearing be set for April 7, 1987. Action: �7ll b 4e 26 ITEM N0. 13 - CONSIDER A RESOLUTION ADOPTING THE REVISED STATEMENT OF POLICIES GOVERNING PARTICIPATION IN TIME HOUSING ASSISTANCE PROGRAMS ADMINISTERED BY THE IOWA CITY HOUSING AUTHORITY. Comment: This is a revision of an existing policy and incorporates all changes to date. A separate memorandum was distributed to the Council concerning the changes contained in the document. No significant deviations from existing policies are involved. The Housing Commission has reviewed and recommends adoption of this policy statement. Action: -z jjej2 V / ITEM NO. 14 - CONSIDER A RESOLUTION AUTHORIZING THE SUBMISSION OF AN APPLICATION TO THE IOWA DEPARTMENT OF ECONOMIC DEVELOPMENT _24BJ �� FOR IOWA COMMUNITY ECONOMIC BETTERMENT ACCOUNT FUMING. Comment: A-JEM Company, Inc., a product design, develop- ment and manufacturing firm now a tenant at the University of Iowa's Technology Innovation Center, has asked the City to apply for CEBA funds on its behalf to support expansion of the Company's production capacity and move to a facility within Iowa City. A memorandum accompanying the resolution describes A-JEM and outlines its request for CEBA funds. Action: �ijj� Agenda Iowa City City Council March 10, 1987 Page 11 ITEM NO. 15 - CONSIDER A RESOLUTION AUTHORIZING THE MAYOR TO SIGN AN APPLICATION TO THE STATE OF IOWA OFFICE OF HISTORIC PRESER- VATION FOR A CERTIFIED LOCAL GOVERNMENT GRANT. Comment: Designation as a Certified Local Government allows the City of Iowa City to request funds from the Office of Historic Preservation of the State Historical Society of Iowa for preservation projects. These funds are federal monies and require a local match. The application is for a two -phased project. Phase I for FY87 funds in- cludes a survey of historic buildings in two blocks of downtown Iowa City. Phase II scheduled for FY89 uses the survey to create a model facade renovation plan for commer- cial buildings in historic areas. The local match is comprised of in-kind contributions of services and admini- stration. A memo included in the Council packet more fully explains the project proposal. Action: hillu�/'...t o.J ITEM NO. 16 - CONSIDER KETTING A PUBLIC HEARING ON APRIL 7, 1987, ON PLANS, SPECIFICATIONS, FORK OF CONTRACT, AND ESTIMATE OF COST FOR THE CONSTRUCTION OF THE JOINT CITY/SCHOOL DISTRICT INDOOR SWIMMING POOL FACILITY AT MERCER PARK, DIRECTING THE CITY CLERK TO PUBLISH NOTICE OF SAID HEARING, AND DIRECTING THE DIRECTOR OF PARKS AND RECREATION TO PLACE SAID PLANS, ETC., ON FILE FOR PUBLIC INSPECTION. Comment: This and the following resolution are needed to initiate the bidding process for the new swimming facility to be constructed at Mercer Park. Now that the 28E Agree- ment is in effect, it is most desirable to move through this process as rapidly as possible, in order to fully utilize the construction season, and minimize further delays. (See enclosed memo for proposed schedule.) There have been no substantial changes in facility design, function or intent since the original concept and prelimi- nary design plans were presented to the Council. Comment: Refer to comment above. Action: 1' ITEM NO•- CONSIDER A RESOLUTION ADOPTING THE ANNUAL BUDGET FOR THE FISCAL YEAR ENDING JUNE 30, 1988, iR7.47 --Comment: A public hearing was held on February 24, 1987, to hear comments for and against the proposed FY88 Operat- ing Budget and the proposed use of General Revenue Sharing monies. Comments were received from thepublic. No changes were made. Council now proceeds to adopt the budget so that it can be certified to the Johnson County Auditor by March 15, 1987. Action: ITEM NO• - CONSIDER A RESOLUTION APPROVING CAPITAL IMPROVEMENTS PRO_ GRAN FOR THE CITY OF IOWA CITY, IOWA, FOR THE FISCAL YEARS S 1988-1992. Comment: A public hearing was held on February 24, 1987, to hear comments for or against the proposed FY88-FY92 Capital Improvements Program. No comments were received. Council now proceeds by adopting the five year Capital Improvements Program. Action: u i R �O `ITEM No. - CONSIDER A RESOLUTION AUTHORIZING CHANGES IN THE FARE STRUCTURE AND SERVICE LEVEL OF IOWA CITY TRANSIT. Comment: This matter has been discussed by the City Coun- cil in conjunction with the preparation of the FY88 City budget. A public hearing on this issue was conducted at the February 24, 1987, City Council meeting. Comment: JCCOG has completed Iowa City Transit's annual application for Iowa DOT State Transit Assistance funds. The specific amount of formula funds is not known since Iowa City Transit will receive a percentage generated from a gasoline usage tax. For the first time this year, Iowa DOT also has administrative control of the UMTA Section 9 program, so anticipated FY88 Section 9 capital projects are also programmed in this application. Section 9 capital funding is being requested for 80% of the cost of three new buses, a downtown information kiosk, and on -route schedule signs. (first consideration) Comment: Chapter 9.1 of the City Code contains the regula- tions and procedures for the granting of permits for a wide variety of uses of the City Plaza. Sections 31-134 through 31-144 of Chapter 31 of the City Code (See Item N. 26) contain similar regulations and procedures for the granting of permits for public use of city streets, sidewalks and public places. Both of these chapters require applicants to indemnify the City and provide insurance as a condition to the grant of a permit. However, the provisions on insurance and indemnity differ slightly and do not provide enough flexibility to City staff in dealing with the wide variety of groups and uses for which permits are requested. The proposed ordinances would provide a uniform provision for both City Plaza use permits and street use permits, and would afford the flexibility needed to deal with the vari- ety of applications presented.
