Consider resolution affirming an employee suspen-
sion.
Comment: On January 14, 1987, employee #52610 was
given an oral warning for tardiness; on February li
23, 1987, Employee #52610 was given a written
warning for tardiness. In each instance the
employee was advised that further instances would
result in more severe discipline. On March 12,
1987, Employee #52610 did not call in until 3-3/4
hours after the beginning of the work day. As a
result, the employee was suspended without pay for
one day.

Consider resolution setting public hearing for

April 21, 1987, on plans, specifications, form of
contract, and estimate of cost for the construc-
tion of the Plaza Mini -Park Project.
Comment: This project includes demolition of
existing plantings, planters, and surfaces; in-
stallation of new planters, seeding, surfaces, and
landscape materials; and electrical and mechanical
improvements. The estimate cost of construction
is $143,000.00.

(2) Consider setting a public hearing for April 21,
1987, to consider the adoption of the 1985 edition
Of the Uniform Plumbing Code as amended. This
Code shall be known as the Iowa City Plumbing
Code.
Comment: The Board of Examiners of Plumbers has
reviewed the 1985 Uniform Plumbing Code (UPC) and
has suggested several amendments to accommodate
local conditions and practices. The 1985 UPC is
to replace the 1982 UPC.

Comment: The Board of Appeals has reviewed the

1987, to consider the adoption of the 1985 edition n

as the Iowa City Abatement of Dangerous Buildings
Code.
Comment: The Board of Appeals has reviewed the
1985 Uniform Code for the Abatement of Dangerous
Buildings. The Board recommended Code changes
substantially similar to existing amendments
presently in force. The 1985 Dangerous Buildings
Code is to replace the 1982 Dangerous Buildings
Code.

ITEM NO. 4 - PLANNING AND ZONING MATTERS.
a, Consider setting a public hearing for April 21, 1987,
on an amendment to the Research Development Park (RDP)
Zone.
Comment: At its March 5, 1987, meeting, the Planning
and Zoning Commission recommended by a vote of 6-0
approval of amendments to the RDP zone which would,
among other things, limit the amount of manufacturing
permitted in the zone, and provide for a master plan
and development standards as part of the rezoning in
exchange for limitations on public review during devel-
opment of the park. The Commission has requested that
the readings not be waived for consideration of this
ordinance.

Consider setting a public hearing for April 21, 1987,
on an ordinance to amend Section 36-65 of the Zoning
Ordinance regarding the regulation of fences and
hedges.
Comment: In response to Board of Adjustment actions to
modify minimum front yard requirements to accommodate
certain fences, the proposed ordinance amends the fence
and hedge requirements to allow fences and hedges in
locations and at heights which have been determined not
to obstruct visibility or to affect the use and enjoy-
ment of property. While adjustments in the minimum
yard requirements, via special exceptions, have been
made to allow fences which do not conform to the set-
back requirements, the proposed ordinance takes a more
direct approach by providing for a special exception to
modify the location and height requirements of the
fence regulations. At the March 19, 1987, meeting, the
Planning & Zoning Commission, by a vote of 5-1-0 (Clark
voting no), recommended approval of the location and
height requirements and the special exception provi-
sions of the proposed ordinance. By a vote of 6-0, the
Commission recommended that provisions within the
proposed ordinance which require that permits be ob-
tained for the construction or erection of all fences
be excluded from the ordinance.

on an amendment to the Zoning Ordinance to define
fitness centers and health spas.
Comment The Planning and Zoning Commission will con-
sider this amendment at its meeting of April 2, 1987.
The term "fitness centers and health spas" is used in
the amended ROP zone and is not defined in the Zoning
Ordinance. The proposed definition distinguishes
fitness centers from other commercial recreational
uses. The amendment is being expedited to schedule its
adoption with that of the ROP ordinance.

Consider setting a public hearing for April 21, 1987,
on an amendment to the Zoning Ordinance
Flood Hazard Overlay Zone. to amend the
Comment: The Federal Emergency Management Agency has
issued new rules pertaining to the management of devel-
opment in floodplains, particularly as they apply to
mobile homes. Adoption of these rules into local
ordinances is required by July 1 to continue participa-
tion in the Floodplain Insurance Program. The proposed
amendment incorporates these new rules and is taken
directly from a model ordinance provided by
Department of Natural Resourcesthe Iowa

g. Public hearing on an ordinance to establish a Planned
Development Housing Overlay (OPDH-5) zone on a 1.69
acre tract known as Summit Place and located on the
southeast corner of the intersection of Marcy Street
and Kirkwood Avenue (5-8703).
Comment: The developer, Al Wells, proposes to develop
nine condominium dwellings clustered in three buildings
on this tract. In order to conserve open space and to
preserve the natural features of the site, the appli-
cant wishes to develop the property in accordance with
the development variations permitted in the OPDH zone.
At its March 5, 1987, meeting, the Planning & Zoning
Commission recommended, by a vote of 6-0, to approve
the preliminary Planned Development Housing plan for
Summit Place. This recommendation is consistent with
that of staff included in a report dated March 5, 1987.
In a report dated March 19, 1987, the Planning & Zoning
Commission substantiates its recommendation regarding
the proposed preliminary plan of this planned develop-
ment. The developer, in a letter dated March 24, 1987,
requests that the Council give expedited consideration
to this ordinance.

Comment: At its March 5, 1987, meeting, the Planning &
Zoning Commission, by a vote of 6-0, recommended ap-
proval of the preliminary and final plat of Southside
Addition. All deficiencies listed in a memorandum to
the Commission dated March 5, 1987, have been resolved.
The Commission's recommendation is consistent with that
of staff.

ITEM NO. 5 - PUBLIC HEARING ON PLANS, SPECIFICATIONS, FORM OF CONTRACT,
AND ESTIMATED COST FOR THE CONSTRUCTION OF THE PARKING RAMP
'A' MAINTENANCE AND REPAIRS PROJECT.
Comment: This project includes repairing spalled concrete
surfaces, random cracks, construction and control joints,
expansion joints; over -banding beam and column lifting
insert grout pockets; and applying concrete sealer to deck
surfaces. The Engineer's estimate for the base bid work is
$145,000.00.

ITEM NO. 7 - PUBLIC HEARING ON AN APPLICATION FOR SECTION 8 HOUSING
VOUCHERS.
The purpose of this public hearing is to receive comments
prior to undertaking this project. Application has been
made and approved for not to exceed 50 Section 8 Existing
Housing Vouchers. A resolution authorizing the revision of
the Annual Contributions Contract, which will include these
units, appears later in this agenda.
ITEM NO. 8 - PUBLIC HEARING ON PLANS, SPECIFICATIONS, FORM OF CONTRACT,
AND ESTIMATE OF COST FOR THE CONSTRUCTION OF THE JOINT
CITY/SCHOOL DISTRICT INDOOR SWIMMING POOL FACILITY AT
MERCER PARK.
Comment: This public hearing is being held to receive
comments regarding the new swimming facility to be con-
structed at Mercer Park. Now that the 28E Agreement is in
effect, it is most desirable to move through this process
as rapidly as possible, in order to fully utilize the
construction season, and minimize further delays. A memo-
randum giving the proposed schedule was furnished with the
agenda of March 10, 1987.
Consistent with Council's prior authorization, the plans
and specifications have been distributed to prospective
bidders. Any changes will be conveyed to those prospec-
tive bidders by an addendum to the plans and specifica-
tions.
ITEM NO. 9 - CONSIDER A RESOLUTION APPROVING PLANS, SPECIFICATIONS, FORM
OF CONTRACT, AND ESTIMATE OF COST FOR THE CONSTRUCTION OF

(2) The Riverfront Commission recommends to Council
that the Floodplain Ordinance be adopted with an
amendment for minor streambank erosion control
projects to be exempted from the engineer's certi-
fication requirement for floodplain development
permit applications.
Comment: At its March 4, 1987, meeting, the
Riverfront Commission reviewed the Floodplain
Ordinance and recommended approval, but requested
the exemption cited above. An explanatory memo is
included in the Council information packet. The
Planning and Zoning Commission is expected to act
on this ordinance April 2 and forward it to the
Council for public hearing on April 21.
Consider recommendation of the Broadband Telecommunica-
tions Commission that the Iowa City Cable Ordinance
Section 14-83(a) be amended to include the performance
standards. A friendly amendment that language be
included to the effect that the modern equivalent of
the Community Programming Center equipment list sup-
plied to the BTC by LeValley should be in the ordinance
as well. If the Council would be interested in pursu-
ing this, staff will forward the necessary information
for further discussion.
d. Consider recommendation of the Human Rights Commission
that the Council approve the amendments to the City's
Non -Discrimination Ordinance which the Commission feels
strengthens the current City ordinance. This matter
will be placed on the agenda for Council consideration
at the meeting of April 21, 1987.
ITEM NO. 16 - CONSIDER A RESOLUTION AUTHORIZING THE MAYOR TO EXECUTE AND
THE CITY CLERK TO ATTEST AN AMENDIENT TO THE NINTH RENEWAL
�7•(a\ OF A 28E AGREEMENT BETWEEN IOWA CITY AND JOHNSON COUNTY FOR
TRANSIT SERVICES.
Comment: This amendment adds $13,000 to Iowa City's FY87
contract with Johnson County SEATS. The SEATS Manager has
indicated that the existing funding for this contract will
be used up by May 1. Council informally approved this
action at their March 9 meeting.

Services Agencies (ESA) to administer a housing repair
program for elderly and handicapped homeowners. Passage of
this resolution will permit the ESA to assist elderly and
handicapped homeowners with minor structural repairs and
modifications to their homes.

ITEM NO. 23 - CONSIDER A RESOLUTION REVISING THE FY87 ANNUAL BUDGET FOR
PUBLIC HOUSING.
87.70 Comment: Department of Housing and Urban Development
regulations require adoption of the annual budget and any
revisions of the budget by formal resolution. The Council
adopted the FY87 budget for Projects 22-3, 22-4 and 22-5 by
Resolution No. 86-92 dated March 25, 1986. A revision is
necessary to reflect an increase of $24,740 in receipts.
The semi-annual report submitted to HUD did reflect budget
overruns in administration, and maintenance and operations.
Adjustments are required to ensure compliance with the
annual contributions contract. The proposed adjustments
are based on actual receipts and expenditures for the first
eight months of the fiscal year and projected for the
remaining four months. Based on projected receipts of
$128,500, routine expenses of $110,910 a significant revi-
sion is the inclusion of $9,050 EXTRAORDINARY MAINTENANCE.
This will provide for the replacement of the window system
of one unit, purchase of 24 pair of drapes as replacements,
repair of two driveways and construction of two driveways.
The revised budget continues to reflect a positive cash
flow and the maintenance of the reserve. The Housing Com-
mission and staff recommend adoption of the revised budget.

ITEM NO. 24 - CONSIDER A RESOLUTION AUTHORIZING THE EXECUTION OF A RE-
VISED ANNUAL CONTRIBUTIONS CONTRACT, HOUSING VOUCHER PRO -
F3 GRAM NO. IA-05-VO22-004.
Comment: The City has applied for and has received ap-
proval for approximately 50 units in the Housing Voucher
Program. HUD has offered a revised Annual Contributions
Contract. The revision increased the ACC by $189,816
annually for five years. This will support between 45 and
50 units in the Voucher Program. Administration will be
incorporated with the other Section 8 program now admini-
stered by the Authority. The Housing Commission and staff
recommend adoption of the resolution.

AS THE IOWA CITY BUILDING CODE. (Second consideration)
Comment: The Board of Appeals has reviewed the 1985 Uni-
form Building Code (UBC) and has suggested several amend-
ments to accommodate local conditions and practices. The
1985 UBC is to replace the 1982 UBC. Staff requests the
second reading be waived and final adoption given at this
time.

ITEM NO. 32 - CONSIDER AN ORDINANCE AMENDING CHAPTER 9.1 OF THE CODE OF
ORDINANCES OF THE CITY OF IOWA CITY, ENTITLED 'CITY PLAZA,'
BY AMENDING SECTION 9.1-7 RELATING TO LIABILITY INSURANCE
AND INDEMNITY AGREEMENT FOR PLAZA USE PERMITS. (second
consideration)
Comment: Chapter 9.1 of the City Code contains the regula-
tions and procedures for the granting of permits for a wide
variety of uses of the City Plaza. Sections 31-134 through
31-144 of Chapter 31 of the City Code (see Item No. 33)
contain similar regulations and procedures for the granting
of permits for public use of city streets, sidewalks and
public places. Both of these chapters require applicants
to indemnify the City and provide insurance as a condition
to the grant of a permit. However, the provisions on
insurance and indemnity differ slightly and do not provide
enough flexibility to City staff in dealing with the wide
variety of groups and uses for which permits are requested.
The proposed ordinances would provide a uniform provision
for both City Plaza use permits and street use permits, and
would afford the flexibility needed to deal with the vari-
ety of applications presented. The City Attorney requests
that second and final considerations of this and the fol-
lowing ordinance be deferred indefinitely.
