To whom it may concern,
I am writing to you about the financial problems facing the Coralvil Is and Iowa City
transit systems. In the Daily Iowan newspaper It has mentioned that ridership has declined
since 1983. 1 suspect one of the main reasons for the decline in ridership is due to the same
measures that you are planning to pass In the near future: raising fares and cutting services.
Since the fares were raised a few years ago, it is no longer econom lost for many people to ride
the bus. Also, the reduction of services on Saturdays means that many of the people who used to
ride It on this day have found It too much of an Inconvenience to do so now. I know I , myself,
have stopped taking the bus on Saturdays for this very reason. The new fare increases and
service cuts proposed for this year may seem to save money, but in the long run, there wi I I
probably be little gain because these changes wlIt lead to further reduction in ridership.
I would like to propose a solution. In other cities I have noticed that transit systems are
sponsored by major advertising companies such as Coca Cola, Me, Donnalds etc. To my
knowledge, the Iowa City and Coralvil Is transit systems do not have contracts with such
companies. This may be a result of decision made In previous years to keep our busses free of
advertising clutter. Unfortunately, with the new national government's reductions made on
funds allocated to local governments, this decision is no longer advantageous. If our bus system
was to advertise for some "big name" companies, along with local business, this could be a new
source of revenue for the transit system. In this way, the funds col lected from fees paid by
companies to have their ads shown on busses could be used to stabil Ize fares and maintain a
regular service schedule. Perhaps they could even be used to reduce fares and return full
Saturday services, This would increase ridership levels and decrease the transit's deficit,
I don't believe that simply reducing services and raising fares will help the transit
system. Such actions will only reinforce the process that pushed the system Into a deficit In the
first place. I ask the city, since it is facing financial problems, to consider other options such as
the one mentioned above.

I have heard a rumor that the Iowa City City Council has decided to sol aside an "emergency
fund" for financial emergencies. In doing so, however, you seemed to have created a financial
Problem. I am referring to a series of cuts you are making In the transit system, a reduction in
aid for the domestic violence prevention project and any othersocial services' funding that has
been cut. If this rumor is true, I would like to ask you to reconsider your decisions and the
affects they will have on the community. I can see the importance of creating an emergency fund
but, unless you have reasons to anticipate a crisis in this year, I think, it would be more
reasonable to slowly build up such a fund over a series of time rather than suddenly taking a
large chunk of resources out of this years budoet. I would like to suggest perhaps setting aside
five percent or so of each years budget to the establishment of such a fund. I see no reason why
Important services such as the domestic violence prevention project and the transit system
shouidsuffer.
Thank you for considering these ideas. I am aware that this years budget has already been
Into areas where they are immediately needed. voted upon but perhaps it is not to late to channel some of the emergency fund's resources back

sidewalks be continued on north across Highway 6 bypass from j
Hollywood Blvd. to the siAalks on Keokuk St. which end just j
north of Highway 6 bypass. There is a great deal of pedestrian
traffic here (going to KxMart, etc.) and sidewalks here would
both improve pedlstrian safety and lessen pedestrian interfer#

Re: Parking Prohibition on Broadway Street
As directed by Section 23-16 of the Municipal Code of Iowa City, this is
to advise you of the following action:
ACTION:
Pursuant to Section 23-234 of the Municipal Code of Iowa City, the City
Traffic Engineer will direct the installation of NO PARKING ANYTIME signs
on both the east and west sides of Broadway Street from its intersection
with U.S. Highway 6 to its intersection with Apple Court. This action
will take place on or shortly after April 8, 1987.
COMMENT:
This action is being taken in recognition of the completion of the tie of
Broadway Street to U.S. Highway 6 and certain commercial enterprises along
the west side of Broadway Street. At the present time traffic is increas-
ing along Broadway Street in reflection of increased commercial activity
on the west side of Broadway Street. As commercial development increases
on the west side, additional traffic will be drawn along Broadway Street.
Both the multi -family dwellings on the east side and the commercial enter-
prise on the west side should have sufficient off-street parking which
will accommodate any parking needs in the area. Broadway Street now
functions as a collector street in the city's arterial street system. The
removal of parking will facilitate this collector function.

Proposal:
To construct nine (9) condominium
dwellings on a 1.69 acre tract of
land utilizing modified design tech-
niques that promote efficient use of
the land and encourage preservation
i of the natural features of the site.
The multi -family use proposed for the
site varies from the uses permitted
in the RS -5 zone. Other modified
features of the development include
reduced pavement widths, no provi-
sions for internal sidewalks, devia-
tions from the fence regulations and
provisions for common open space.
PLANNING & ZONING COMMISSION RECOMMENDATION
Date of Recommendation: March 5, 1987
Recommendation: Approval
Recommended Variations and Rationale: The Commission finds the following
variances from the applicable provisions of the zoning ordinance to be appro-
priate:
1. Land Use:
Use modification: Multi -family dwellings are not a permitted use in the
RS -5, low density single-family residential zone. Consideration has been
given in this development, however, to reduce the impact of this use on
the site itself and to lessen its effects on surrounding residential

for
arrangement of these units permits the conservation of open space and the
retention, along the perimeter of the development, of the minimum set-
backs required in the RS -5 zone.
The one and one-half story structures proposed for this development have
been designed to maintain a low profile along each building facade. The
scale of the structures, the varied roof lines, the diverse exterior
appearances of each unit and the generous use of windows on each facade
suggests a single-family atmosphere. This is further enhanced by the
site plan concept that joins no more than three units and limits the
number of clusters to three. The scale of this development, therefore,
is not expected to detract from the single-family character of surround-
ing properties.
The effects of this use modification on adjacent properties is also
E minimized by retention of a significant number of existing mature trees
on the site and by employment of a variety of methods to both integrate
the development into the existing neighborhood and to buffer this use
from adjoining land uses. Fences of a residential scale and design, an
earthen berm and vegetative screening have all been used to diminish the
impact of this multi -family development on the low density single-family
area and to incorporate the development into the surrounding neighbor-
hood.
2. Street Standards and Specifications:
Reduced pavement width requirements: A reduction in the pavement width
of the private drive within the development is endorsed by the Commis-
sion. A reduction in the conventional pavement width of 28 feet for a
publicly - owned local street to 22 feet for the proposed private drive is
expected to have a negligible impact.
Vehicular access to the property will be available from both Marcy Street
and Kirkwood Avenue. No through drive exists on the site, however, that
would connect these access drives. The Commission finds, therefore, that
a 22 foot wide street within this small, non -through street development
will have no effect on traffic circulation outside the development.

3. Fence Requirements:
A brick and iron fence resembling the existing fence along Kirkwood
Avenue is proposed adjacent to the Marcy Street/Kirkwood Avenue rights-
of-way and along a portion of the east property line of the tract. If the
requirements of the fence regulations are strictly applied to the new
portion of the fence proposed along Marcy Street, this segment of the
fence would be restricted in height to four feet and would have to be
placed two feet from the Marcy Street right-of-way line. Similar re-
strictions would apply to a portion of the section of this fence proposed
along the east property line.
Sketches of the proposed fence show that brick walls connecting some of
the piers of the existing fence will be removed and replaced with wrought
iron and that the height of the proposed fence will not exceed the pres-
ent height of the fence. The Commission finds that visibility of traffic
approaching the Kirkwood Avenue/Marcy Street intersection will not be
restricted and that visibility of the sidewalk and of traffic leaving the
development and entering either Marcy Street or Kirkwood Avenue will not
be impaired by the proposed design and location of the brick and iron
fence. Along with conservation of many existing trees on this tract,
retention of the general design of the existing fence will preserve a
feature of the property that adjacent property owners have grown accus-
tomed to and favor and will lessen the impact of the proposed development
on adjacent land uses.
4. Neighborhood Involvement:
The additional requirements for planned developments on areas of land
less than two acres but one acre or more in size oblige the owner/devel-
oper to notify property owners within 600 feet of the proposed develop-
ment of the project and to discuss the project with as many of these
property owners as possible. In accordance with these requirements, the
developer has submitted a list of neighboring property owners and has
supplied documentation of a neighborhood meeting which was held December
12, 1986. Twenty-nine residents attended this meeting.
Residents who attended the meeting encouraged the developer to retain the
existing brick and iron fence on the property; the planned development
housing plan for the proposed development indicates that this fence will
be rebuilt to resemble the present fence. The developer has also worked
with the owner of the property directly south of the development and has
incorporated screening and landscaping alternatives recommended by that
property owner into the site development plan for Summit Place. In
addition to the off-street parking spaces required for this development,
provisions have been made to accommodate eighteen additional off-street
parking spaces on the tract. These provisions are intended to assure
that parking would not occur on the private drive and to allay neighbors'
concerns that sufficient parking be provided within the development for
guests of the residents.

and physical features of the site and to cooperate with adjacent property

The proposed development does not exceed the dwelling unit density allowed in
the RS -5 zone. Nine detached single-family dwellings could technically be
constructed on this 73,678 square foot lot. With a conventional development,
however, it may be difficult to achieve that density on this tract given the
configuration of the lot, the dimensional requirements that would be imposed
on a conventional subdivision, and the need to provide rights
-of-way of
standard width within the development.
Although nine dwelling units, arranged in three building clusters, are pro-
posed for this development, over 55% of the total land area has been retained
for open space. Section 36-48(h)(3)(b) of the Zoning Ordinance requires that
a PDH plan for an area containing less than two acres show at least 35% of
the total land area minus public and private street right-of-way area, as
open space. The proposed plan also meets the standard that specifies that at
least 50% of the required open space be improved by the developer. The only
unimproved open space on this tract is located on the southeastern portion of
the parcel and represents only 19.5X of the total open space provided. As of
this writing, no documents specifying the uses of the open space and the
means of maintaining and financing the maintenance costs of that open space
for this development have been submitted.
Section 36-48(h)(3)(a) specifies that the maximum land coverage for all
buildings in the development shall not exceed 35% of the total land area
minus street right-of-way areas. Structures within this development occupy
approximately 31.5% of the buildable area within the development.

will depend exclusively upon Marcy Street to access the drives leading to
each of these units and two of the units will be required to use Kirkwood
Avenue for this purpose. No through drive exists on the site that would
connect the Marcy Street and Kirkwood Avenue access drives. Although a curb
cut exists on Kirkwood Avenue to serve this tract, the developer proposes to
shift this access drive easterly. The applicant is expected to provide
information which gives the relative location of this proposed drive to the
Sunnit Street right-of-way. The maximum width permitted of the Marcy Street
curb cut, measured at the sidewalk, is 24 feet, The site plan, which shows a
30 foot opening, must be revised to reflect compliance with this standard.

A total of 18 off-street parking spaces must be provided for the nine pro-
posed multi -family residences. The garages attached to the units are capable
of satisfying this requirement. While most of the driveways are wide enough
and long enough to accommodate two additional standard off-street parking
spaces, provisions have been made in two instances (west of Building 1 and
north of Building 3) in which the driveways are shorter than 19 feet to ac
commodate one additional off-street parking space. The space north of Build-
ing 3 is also needed to allow vehicles to maneuver on the site to avoid
backing onto Kirkwood Avenue.
In accordance with Section 10.307(h) of the Uniform Fire Code, all dead-end
fire apparatus access roads in excess of 150 feet in length shall be provided
with approved provisions for the turning around of fire apparatus. In lieu
of a turn -around on the site, staff has approved provisions for a fire lane
between Buildings 2 and 3 that would permit secondary access for fire vehi-
cles. Use of this lane for vehicles other than emergency vehicles will be
prohibited. Revisions to the site development plan will indicate this provi-
sion. Section 10.301(c) of the Code also requires that when any portion of a
building is in excess of 150 feet from a water supply on a public street,
on-site fire hydrants and mains capable of supplying the required fire flow
shall be provided. Staff recommends that a fire hydrant be located in the
open space near the center of the site to satisfy this requirement.

The provisions of the Zoning Ordinance which regulate the placement of right-
of-way trees and residential trees apply to this proposal. In the case of a
corner lot, the provisions of Section 36-73(a)(2)a require that one tree be
planted adjacent to street rights-of-way for every 60 feet of lot frontage.
With a combined frontage of 440 feet, a total of seven trees must be planted
adjacent to the Marcy Street/Kirkwood Avenue rights-of-way. Five trees are
shown within 14 feet of the rights-of-way lines of these two streets but
since the plan does not specify the mature height of these trees, it is not
possible to determine if these trees satisfy a portion of the right-of-way
tree requirement. Section 36-73(c)(2) indicates that, for residential uses
other than single-family residences, trees shall be planted at the minimum

1. The time schedule of construction is totally dependent on the sales of
the units. Our financing is tied to having three units pre -sold prior
to start of construction. I feel as Gene Kmager of Lepic-Krveger
Realtors, that we can achieve the pre -sales requirement and start
construction late spring or early summer of 1987. Construction would
start with building # 1, then # 2, # 3. With the start of # 1 we will
also do all site improvements, restore or replace brick and iron fence ,
remove existing buildings, all 6' privacy fences, and the 2 1/2 ' high
ferns, and entry larndscaping off Marcy.
2. The open areas of the development as well as the drives, landscaping,
and exterior of buildings will be maintained under a condominium
aeration. These legal documents are in the preliminary stages.
3. On December 12, 1986, 1 held a meeting of the neighbors within 600
feet of the proposed project. Below are a list of comments made:
A. No negative comments were made. All the comments were for the
project itself.
B. Big improvement for the site.
C. Great to get lint of eyesore.
D. Recommended saving the brick & iron fence (which we plan to
restore or replace).
4. I would request the relocation of the drive on Kirkwood to align with
Summit.
5. I also agree to the installation of a fire hydrant in the front of
Building # 2, providing we can also run our water lines to each
building off this line.

Iowa City Planning and Zoning Commission effective April 30, 1987.
The experience that I had as a Commission Member was a rewarding
one to me and if I were to single out one reason for this, it would
be the people that I have worked with. We as a City are very fortunate
to have the dedicated, honest and knowledgeable people in all arenas of
our City Government. I will truly miss regular meetings with those that
I've been involved.
My reasons for leaving are simply stated family and work. Over the
next four years my three oldest daughters will graduate, and with my current
work load increasing I wish to devert the time currently spent on
Planning and Zoning into enjoying my daughters at this critical stage of
their lives.
After my daughters have left the "Nest" I will again I'm sure, be
looking for ways to dedicate my time. I hope at that time that future
councils will give me the opportunities that I feel I have had as a
Commissioner Member.

Re: Proposed Amendments to the Iowa City Floodplain Regulations
On March 4, 1987, the Riverfront Commission reviewed the Iowa Department
of Natural Resources Floodplain Management Model Ordinance, which has been
proposed as a replacement for the current City floodplain regulations. The
Commission expressed some concern about the increased stringency of the
model ordinance, but understood the need for clear definition and imple-
mentation of the federal requirements of the National Flood Insurance
Program.
The Commission voted unanimously to recommend approval of the model ordi-
nance to the Planning and Zoning Commission and to the Council. Because
of its interest in encouraging streambank erosion control, the Commission
conditioned its approval with the recommendation that the permit process
be streamlined. That is, standard streambank erosion control projects
involving less than 500 linear feet and not extending more than three feet
into the stream channel should be exempt from the requirement for an
engineer's certification. The Commission proposes that a preliminary
review of streambank stabilization applications be conducted by City
Engineering before forwarding the applications on to the Department of
Natural Resources and the U.S. Army Corp of Engineers for permit approval.
The Commission would appreciate the Planning and Zoning Commission's
