Comment: This resolution sets the public hearing for approving the Capital Projects budget for FY87 and FY88 on May 12, 1987. Detailed information on, the budget will be available for public inspection on May 7, 1987. (3) Consider a motion setting a public hearing for May 12, 1987, to receive citizen comments on the program description for the proposed use of $93,000 in rental rehabilitation grant funds for 1987. Comment: The Department of Housing and Urban ; Development requires that prior to the filing of a program description of the Rental Rehabilitation Program, citizens be given the opportunity to comment on the Program. (4) 'g"S-7'Q6 Consider a resolution setting a public hearing on May 12, 1987, on plans, specifications, form of contract and estimate of cost for the construction of the South Wastewater Treatment Facility Pro- ject. This project will involve the construction of a five million gallon per day wastewater treatment facility at the northeast quarter of Section 35 East Lucas Township (Langenberg Farm). (first consideration) Comment: At its March 5, 1987, meeting, the Planning and Zoning Commission recommended, by a vote of 6-0, approval of amendments to the RDP zone which would, among other things, limit the amount of manufacturing permitted in the zone and provide for a master plan and development standards as part of the rezoning in ex- change for limitations on public review during develop- ment of the park. A public hearing was held April 21, 1987; no comments were received. Action: -g4J� k (-Li e.0/h c. Consider an ordinance to amend the Zoning Ordinance to define fitness centers and health spas. (first consid- eration) Comment: At its meeting of April 2,1987, the Planning and Zoning Commission, by a vote of 6-0, recommended approval of this amendment. This recommendation is consistent with that of the staff. The term fitness centers and health spas" is used in the amended RDP zone and is not defined in the Zoning Ordinance. The proposed definition distinguishes fitness centers from other commercial recreational uses. A public hearing was held April 21, 1987; no comments were received. Consider an ordinance to amend Chapter 22 of the Iowa City Code of Ordinances, concerning the elimination of the requirement for licensing manufactured housing parks. (first consideration) Comment: On March 19, 1987, by a vote of 6-0, the Planning and Zoning Commission recommended approval of amendments to the Manufactured Housing Park Ordinance, Chapter 22. As the result of recent changes in state law, the registration and licensing of manufactured housing parks is now prohibited. A second change in Chapter 22 would require any alteration or addition to an existing manufactured housing park to be brought into compliance with all the provisions of this ordi- nance. A public hearing was held April 21, 1987; no comments were received. Action: 14�"%/6 e. Consider an ordinance to amend the Flood Hazard Overlay Zone of the Zoning Ordinance. (passed and adopted) Comment: The Federal Emergency Management Agency has issued new rules pertaining to the management of devel- opment in floodplains, particularly as they apply to mobile homes. Adoption of these rules into local ordinances is required by July I to continue participa- tion in the Floodplain Insurance Program. The proposed amendment incorporates these new rules and is taken directly from a model ordinance provided by the Iowa Department of Natural Resources. At its April 2, 1987, meeting, the Planning and Zoning Commission recommended approval of the proposed amendment. Action: Agenda Iowa City City Council Regular Council Meeting May 5, 1987 - 7:30 P.M. Page 7 Consider an ordinance to amend Section 36-65 of the Zoning Ordinance regarding the regulation of fences and hedges. (first consideration) Comment: The proposed ordinance amends the fence and hedge requirements to allow fences and hedges in loca- tions and at heights which have been determined not to obstruct visibility or to affect the use and enjoyment of property. This ordinance also provides for a spe- cial exception procedure which specifically modifies the location and height requirements of the fence regulations. At the March 19, 1987, meeting, the Planning and Zoning Commission, by a vote of 5-1 (Clark voting no), recommended approval of the location and height requirements and the special exception provi- sions in the proposed ordinance. This recommendation is consistent with that of staff. By a vote of 6-0, the Commission recommended that a provision proposed by staff which would require that permits be obtained for the construction or erection of all fences be excluded from the ordinance. The ordinance included in the Council packet did not contain the permit provision. The staff's version of the amendment is available from the City Clerk. A public hearing was held an this item on April 21, 1987; no comments were received. Action: - 0 Consider an ordinance to amend Section 36-58(c)(3)a.3. 1��\`� 9 of the Zoning Ordinance regarding the location of parking areas in a C or I zone within five feet of an R zone boundary. (passed and adopted) Action: Comment: The proposed ordinance would allow existing parking areas within C or I zones which abut residen- tial zone boundaries and which have a permanent dust - free surface to remain within five feet of the residen- tial zone boundary if the parking area is screened from view by a solid fence which complies with the screening requirements and the fence and hedge requirements of the Zoning Ordinance. The Planning and Zoning Commis- sion, at its April 16, 1987, meeting, recommended recomme6dationhis consistent with that of the staff. Consider a recommendation of the Planning and Zoning Commission concerning a request submitted by Clifford Bell to rezone a tract located in the County from A-1, Rural to RS, Suburban Residential. (CZ -8705) Comment: At its April 16, 1987, meeting, by a vote of 5-0, the Planning and Zoning Commission recommended that a request to rezone an 11.36 acre parcel located approximately 1.8 miles east of Iowa City from A-1 to RS be denied. The Commission found that this request is inconsistent with the policy adopted for Area 5 of the Johnson County/Iowa City fringe area. This recom- mendation is consistent with that of staff in a memo- randum dated April 16, 1987. Action: oiJ onJ I. Consider fa recommendation from the Planning and Zoning' 7 Commission that the Fringe Area Committee reconvene to discuss development policies for Area 5 of the Johnson County/Iowa City Fringe Area. Comment: At its April 16, 1987, meeting, the Planning and Zoning Commission recognized that proposed improve- ments to Scott Boulevard and Local Road and construc- tion of the City's municipal sewage treatment facility may place development pressures on Area 5 of the fringe area. Area 5 is located immediately east of Iowa City's eastern corporate limits. In light of these anticipated pressures, the Commission recommended, by a vote of 5-0, that the Fringe Area Committee reconvene to discuss development policies for Area 5. Comment: This Resolution authorizes the City Manager to file an application on behalf of the City of Iowa City with the United States for a grant to aid in the construction of sanitary sewerage system improvements. At the present time, the City is requesting final payment from E.P.A. for the design work completed by Veenstra R Kinin Engineers. This request is for approximately $16,000.00. Alternate bid work 1 and 2 consists of preparing slab -on -grade surfaces and applying concrete sealer, and repainting all parking stall stripes throughout the entire ramp. Comment: House File 2397 (1986 Iowa Acts, Chapter 1175) 3t`h7-90 establishes a timetable for phasing out sanitary landfills in the State of Iowa. The fund balance for the Landfill fund needs to be increased to pay for researching feasible alternative disposal methods and subsequent action taken after the plan is complete. A 251 per ton increase to the r.;ty's landfill fee is proposed for July 1, 1987. Action: Ir.CdaRu� ITEM NO. 15 - CONSIDER A RESOLUTION AUTHORIZING AND APPROVING AGREEMENT BETWEEN THE CITY AND BUSINESS DEVELOPMENT. INC. (BDI) FOR FINANCING HEINZ ROAD CONSTRUCTION. Comment: The BDI Board of Directors has requested assis- tance in financing the local share of costs for construc-' tion of Heinz Road as part of the City's RISE project. The agreement in the Council packet has been negotiated with BDI. Page 14 ITEM NO. 16 - CONSIDER A RESOLUTION AUTHORIZING THE SUBMISSION OF AN OF 48-1-91 FORLON AN EIMER ENCYH SHELTER GIOWARANT ST AUTHORIZED ECONOMIC BY DEVELOPMENTBYHOME- LESS ACT OF 1986. Comment: Under the Federal Homeless Act of 1986, the State of Iowa has received $113,000 to be distributed to communi- ties in the State. The City of Iowa City is requesting a total of $25,000 to be used as follows: $10,930 to reno- vate the emergency shelters provided by Youth Homes, Inc. and the Domestic Violence Project (DVP); $2,200 to provide essential services through the Emergency Housing Project (EHP); $4,070 for payment of utilities, insurance and furnishings for DVP, and $7,800 for similar payments for EHP. A supplemental request for $15,000 to rehabilitate the Youth Homes Emergency Shelter is included, should addi- tional funding be available. Action: -4/`/Ie AZO ITEM N0. 17- CONSIDER A RESOLUTION AUTHORIZING ACQUISITION OF AVIGATION EASEMENTS BY NEGOTIATION OR CONDEMIATION IN CONNECTION WITH ,>I 8Y-ga THE RUNWAY 6-24 EXTENSION PROJECT AT THE IOWA CITY NINICI- PAL AIRPORT. Comment: The acquisition of these avigation easements over eight properties located in and/or near the clear zone of Runway 24 is part of the compliance project at the airport. Upon acquisition of the avigation easements, along with the opening of extended Runway 6-24 and the relocation of the threshold of Runway 17, the City should regain compliance status and become re -eligible for Federal funding at the airport. Comment: The West Benton Street Bridge Project will in- volve the widening of the bridge and the Benton Street approaches thereto. This includes the reconstruction of the Benton Street/Capitol Street intersection. Thomas and Marilyn Alberhasky own property on the'northeast corner of this intersection, where curbing and private parking lot improvements will have to be removed and relocated. A Mutual Benefit Agreement has been executed by the Alberhaskys giving the City the right to enter upon their property to perform this work, in return for which the City will agree to reconstruct the parking lot improvements affected by the project. Staff recommends approval of the Agreement. Action: _6".2,44- ITEM NO. 19 - CONSIDER AN ORDINANCE ADOPTING THE 1985 EDITION OF THE UNIFORM PLUMBING CODE, AS AMENDED. SAID CODE SHALL BE KNOWN AS THE IOWA CITY PLUMBING CODE. (first considera- tion) Action: Comment: The Board of Examiners has reviewed the 1985 Uniform Plumbing Code (UPC) and has suggested several amendments to accommodate local conditions and practices. The 1985 UPC is to replace the 1982 UPC. ITEM NO. 20 - CONSIDER AN ORDINANCE ADOPTING THE 1985 EDITION OF THE UNIFORM MECHANICAL CODE, AS AMENDED. SAID CODE SHALL BE KNOWN AS THE IOWA CITY MECHANICAL CODE. (first considera- tion) Comment: The Board of Appeals has reviewed the 1985 Uni- form Mechanical Code (UMC).
