WHEREAS, the City Council has approved funding for the Runway 6-24 Exten- sion Project at the Iowa City Municipal Airport in conjunction with re- turning the airport to compliance status; and WHEREAS, as an integral part of said project, it is necessary to acquire avigation easements over eight (8) privately -owned properties located in and/or near the clear zone of Runway 24 at the Iowa City Municipal Air- port. WHEREAS, the City of Iowa City, Iowa, has undertaken a project to widen and im- prove the West Benton Street Bridge; and WHEREAS, the performance and completion of said project will necessitate acquisi- tion by the City of certain temporary rights and properties abutting said street, and will necessitate either the removal and reconstruction, or the removal, of certain private improvements lying upon and/or immediately abutting said right-of-way; and WHEREAS, the completion of said project and the removal and reconstruction of said private improvements with inure to the benefit of both the City of Iowa City and the owners of the affected properties abutting the West Benton Street Bridge; and WHEREAS, Thomas R. and Marilyn J. Alberhasky, owners of property abutting West Benton and Capitol Streets, have executed a Mutual Benefit Agreement conveying a temporary construction easement to the City of Iowa City, Iowa, in consideration for the City's removal and reconstruction of certain private improvements abutting said private parking lot measuring 14 1/2' x 104'; and WHEREAS, the City Council has been advised and does believe that it would be in the best interest of the City of Iowa City, Iowa, to enter into said Agreement with Thomas R. and Marilyn J.
