Resolution authorizing filing of application with the Environmental Protection
Agency, United States of America, for a Grant under the Federal Water Pollution
Control Act Amendments.
WHEREAS under the terms of the Federal Water Pollution Control Act Amendments,
the United States of America has authorized the making of grants to authorized
applicants to aid in the construction of specific public projects,
NOW, THEREFORE, be it resolved by the City Council of the City of Iowa City,
Iowa
1. That City Manager Stephen Atkins be and he is hereby authorized to
execute and file an application on behalf of the City of Iowa City,
Iowa, with the United States for a grant to aid in the construction of
Sanitary Sewerage System Improvements.

directed to furnish such information as the Environmental Protection

specifications and must be
accompanied in a Sealed envelope,
separate from the one containing

contract as a surety in the State
of Iowa, in a penal sum of 5% of
the bid. The bid security shall be
made payable to the TREASURER OF
THE CITY OF IOWA CITY, IOWA, and
shall be forfeited to the City of
Iowa City as liquidated damages in
the event the successful bidder
fails to enter Into a contract
within ten (10) days and post bond
satisfactory to the City insuring
the faithful performance of the
contract and maintenance of said
work, if required, pursuant to the
provisions of this notice and the
other contract documents. Checks
of the lowest two or more bidders
may be retained for a period of
not -to -exceed fifteen (15) days
until a contract is awarded or
rejection made. Other checks will
be returned after the canvass and
tabulation of bids is completed and
reported to the City Council.
Payment to the Contractor will be
made as specified in the "Standard
Specifications", Article 1109.06.
The successful bidder will be
required to furnish a bond in an
amount equal to one hundred percent
(100%) of the contract price, said
bond to be issued by a responsible
surety approved by the City Council
and shall guarantee the prompt
payment of all materials and labor
and protect and save harmless the
City from claims and damages of any
kind caused by the operation of the
contract, and shall also guarantee
the maintenance of the repairs for
a period of two (2) years and the
maintenance of the deck sealer for
a period of five (5) years from and
after its completion and acceptance
by the City.
The following limitations shall
apply to this project:

WHEREAS, the Iowa Department of Economic Development plans to

provide shelter to the homeless, and Provide grants
WHEREAS, the Domestic Violence Project, Emergency Housing Project, and Youth
Homes. Inc. are private, non-profit organizations which

RESOLUTION NO. 87-92
RESOLUTION AUTHORIZING ACQUISITION OF AVIGATION EASEMENTS BY
NEGOTIATION OR CONDEMNATION IN CONNECTION WITH THE RUNWAY 6-24
EXTENSION PROJECT AT THE IOWA CITY MUNICIPAL AIRPORT.
WHEREAS, the City Council has approved funding for the Runway 6-24 Exten-
sion Project at the Iowa City Municipal Airport in conjunction with re-
turning the airport to compliance status; and
WHEREAS, as an integral part of said project, it is necessary to acquire
avigation easements over eight (8) privately -owned properties located in
and/or near the clear zone of Runway 24 at the Iowa City Municipal Air-
port. The certificates of title including the legal descriptions of the
properties for which the easements are to be acquired are attached hereto
and incorporated herein as Exhibits A -H.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF IOWA CITY, IOWA,
that the Airport Manager be and is hereby authorized and directed to
negotiate the acquisition of said avigation easements, as herein
described, necessary for public improvements at the Iowa City Municipal
Airport in connection with the Runway 6-24 Extension Project, which pro-
ject this City Council deems to be for a public purpose and in the public
interest.
AND BE IT FURTHER RESOLVED that in the event the Airport Manager is unable
to acquire said easements by negotiation, the City Attorney be and is
hereby authorized and directed to institute and conduct condemnation
proceedings pursuant to State law to acquire said avigation easements.

RESOLUTION NO. 87-93
RESOLUTION APPROVING AND AUTHORIZING AND DIRECTING THE MAYOR AND CITY CLERK TO
EXECUTE AND ATTEST, RESPECTIVELY, A MUTUAL AGREEMENT WITH THOMAS R. AND
MARILYN J. ALBERHASKY IN CONNECTION WITH THE WEST BENTON STREET BRIDGE PRO-
JECT.
WHEREAS, the City of Iowa City, Iowa, has undertaken a project to widen and im-
prove the West Benton Street Bridge; and
WHEREAS, the performance and completion of said project will necessitate acquisi-
tion by the City of certain temporary rights and properties abutting said street,
and will necessitate either the removal and reconstruction, or the removal, of
certain private improvements lying upon and/or immediately abutting said
right-of-way; and
WHEREAS, the completion of said project and the removal and reconstruction of said
private improvements with inure to the benefit of both the City of Iowa City and
the owners of the affected properties abutting the West Benton Street Bridge; and
WHEREAS, Thomas R. and Marilyn J. Alberhasky, owners of property abutting West
Benton and Capitol Streets, have executed a Mutual Benefit Agreement conveying a
temporary construction easement to the City of Iowa City, Iowa, in consideration
for the City's removal and reconstruction of certain private improvements abutting
said private parking lot measuring 14 1/2' x 104'; and
WHEREAS, the City Council has been advised and does believe that it would be in
the best interest of the City of Iowa City, Iowa, to enter into said Agreement
with Thomas R. and Marilyn J. Alberhasky; and
i NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF IOWA CITY, IOWA
! that the Mutual Benefit Agreement attached hereto and made a part hereof is hereby
approved as to form and content.

i AND BE IT FURTHER RESOLVED that the Mayor and City Clerk are hereby authorized and
directed to execute and attest, respectively, said Mutual Benefit Agreement for
and on behalf of the City of Iowa City, Iowa.

Now, therefore, in consideration of the mutual benefits hereby conferred,
the parties do hereby agree as follows:
I. Thomas R. Alberhasky and Marilynn J. Alberhasky, Grantors, do hereby
convey to the City of Iowa City, Iowa, Grantee, a temporary construc-
tion easement for the purpose of entering upon that portion of Gran-
tors' property described and shown on Exhibit "A" attached hereto, for
the purpose of removing and repaving a portion of their private park-
ing lot, as necessitated by said project. The portion of the parking
lot to be removed and repaved is approximately 14-1/2'x104' in size
and is enclosed in said temporary easement. The replacement slab
shall be 6" think, reinforced with 6x6x10 Ga. W,W,F., and tied into
bars spaced at 30" on centers.

removal and reconstruction of private improvements as aforesaid,
4. Upon completion of the removal, repaving and restoration work as
aforesaid, Grantor agrees to assume and shallhave responsibility for
the maintenance of the reconstructed private improvements located upon
Grantors property or public right-of-way abutting thereto.
