Setting Public Hearings. (1) Consider resolution setting public hearing on August 11, 1987, on plans, specifications, form of f37' 18(o contract and estimate of cost for construction of the Heinz Road Improvements Project. Comment: This project will extend Heinz Road east to Scott Boulevard and will involve the construc- tion of approximately 1,810 linear feet of 28' wide P.C.C. pavement with associated storm sewer. The engineer's estimate for this project is $250,000.00. e. Motions. (1) Consider a motion to approve disbursements in the amount of $6,012,402.44 for the period of June 1 thru June 30, 1987, as recommended by the Finance Director, subject to audit. f. Resolutions. (1) Consider resolution accepting the paving for P, -1.I Hunters Run Subdivision Parts 2 & 3, Phase I1. Comment: See attached Engineer's Report. I dF8 1 lg� (2) Consider resolution authorizing the Mayor to sign and the City Clerk to attest an agreement with Hunters Run Development Co. concerning Duck Creek Drive overwidth pavement. 1 Comment: This portion of Duck Creek Drive is located in Phase II of Hunters Run Subdivision, Parts 2 & 3. The width of this section of street is 31 feet, whereupon, this Agreement involves the reimbursement of the center 3 feet. The City's estimate cost is $5,075.00. (3) Consider resolution accepting the work for the Curb Ramp Installation Project. o Comment: See attached Engineer's Report. .P' Agenda Iowa City City Council Regular Council Meeting July 28, 1987 Page 4 g. Correspondence. (1) Letter from Richard Haendel, owner of Goldie's Fresh Seafood Company, requesting the Council to consider regulating the peddlers who come into Iowa City and sell seafood and other food items from the back of trucks. The Johnson County Health Department advises that these trucks are required to obtain and display a temporary food establishment permit from the State of Iowa De- partment of Inspection and Appeals, and also to display a sticker on their scale that shows it has been checked by the State within the past year. However, there is no local enforcement of these requirements. (2) Memoranda from the Traffic Engineer regarding: (a) parking prohibition on Oakcrest Street. (b) parking in the alley north of Plaza Centre One. (c) parking in front of 722 East College Street. (3) Memoranda from the Civil Service Commission sub- mitting certified lists of applicants for the following positions: �a Senior Accountant/Accounting Division b; Meter Reader/Water Division (c) Maintenance Worker I/Streets. (Z-8706) Comment: At their July 2, 1987 meeting, the Planning and Zoning Commission recommended denial of a request submitted by Emmit George to rezone 528 Iowa Avenue from RNC -20 to CB -2 by a vote of 1-4 on an affirmative motion (Wallace voting yes). This recommendation is consistent with that of the staff. The rezoning application is brought before the Council at the applicant's request. Action:! b. Consider an ordinance to rezone property at 410 Iowa Avenue from P to CB -2. (Z-8705) (passed and adopted) Comment: On June 18, 1987, the Planning and Zoning Commission recommended by a vote of 5-0 approval of a request submitted by United Action for Youth (UAY) to rezone property located at 410 Iowa Avenue from P to CB -2. The Commission's recommendation is consistent with that of staff included in a report dated June 18, 1987. A public hearing was held June 30, 1987; no comments were received. Consider an ordinance to vacate a portion of the north -south alley between Benton Street and Ralston Creek, west of Gilbert Street. (V-8702) (passed and adopted) Comment: At its June 4, 1987 meeting, the Planning and Zoning Commission recommended denial of a City -initi- ated request to vacate a portion of the alley described above by a vote of 2-4 on an affirmative motion. A majority of the Commission felt that the opportunity to retain open space in the area should not be forfeited through the vacation of the alley and subsequent rede- velopment of the adjacent lots. This recommendation is inconsistent with that of the staff who had recommended vacation and disposition of the alley to facilitate the sale and the Lower Ralston Creeredevelokmment Project. Consider an ordinance amending Section 27-44 of the Large Scale Non -Residential Development (LSNRD) Regula- tions. (passed and adopted) Comment: At its May 7, 1987 meeting, the Planning and Zoning Commission recommended approval of the amendment by a vote of 4-1 (Dierks voting no). The amendment would allow minor deviation in the size and siting of existing buildings shown on an approved final LSNRD plan. The amendment would apply only to existing developments approved prior to May 6, 1986. Consider an ordinance to amend Section 36-62(c)(3)b.2 N and 6-62(c)(6)b.2 of the Zoning Ordinance concerning signs permitted in the CH -1, CC -2 and CI -1 zones and in the I-1 and I-2 zones. (passed and adopted) Comment: The proposed ordinance amends the sign regu- lations to allow two monument signs, two free-standing signs or a combination of one monument sign and one free-standing sign on lots with a minimum frontage of 160 feet. The ordinance eliminates the retention of minimum distances between two monument signs or between a monument sign and a free-standing sign located on a single lot. This amendment is more lenient than the existing regulations. At its May 21, 1987 meeting, by a vote of 6-0, the Planning and Zoning Commission recommended approval of these amendments. This recom- mendation is consistent with that of staff. No com- ments were received at a public hearing held June 16, 1987. Action: }y1�11� (�� , 1 all nw f. Consider a resolution to accept the dedication ooh `�i 190 portion of Phoenix Drive in Southwest Estates Part 1. Comment: With the platting of Southwest Estates, Part I in 1985, land was set aside for the future dedication of a public street at such time as the land to the north developed. Southwest Estates, Part II is now developing to the north requiring dedication of the street at this time. Action: 0 ITEM NO. 5 - PUBLIC HEARING ON PLANS, SPECIFICATIONS. FORAa4e*_1 AND ESTIMATED COST FOR THE SCOTT BOULEVARD IMPROVEMENTS PROJECT, PHASE III. Comment: This project includes the construction of 9 -inch P thick non -reinforced P.C.C. pavement from Court Street to Rochester Avenue with associated reconstruction of adjoin- ing streets, installation of storm sewer and landscaping. The engineer's estimate for this project is $985,000.00. Action: _1l,g„22 abs p Agenda Iowa City City Council Regular Council Meeting July 28, 1987 Page 8 ITEM NO. 6 - CONSIDER RESOLUTION APPROVING PLANS, SPECIFICATIONS, FORM OF CONTRACT, ESTIMATE OF COST AND AUTHORIZING THE CITY I`ll MANAGER TO FIX TIME FOR RECEIPT OF BIDS FOR THE SCOTT BOULEVARD IMPROVEMENTS PROJECT, PHASE III AND ESTABLISHING THE AMOUNT OF BID SECURITY TO ACCOMPANY EACH BID, DIRECTING CITY CLERK TO PUBLISH NOTICE TO BIDDERS, AND FIXING THE PLACE FOR RECEIPT OF BIDS. Comment: This resolution allows the City Manager to set a bid date when all of the property needed to accommodate construction has been acquired. Necessary land acquisition with the property owners is still being negotiated. Action:�1� &J D ITEM NO. 7 - PUBLIC HEARING ON THE SALE AND CONVEYANCE OF LOWER RALSTON CREEK PARCELS A-2 AND A-3 TO I.C. LAW BUILDING PARTNER- SHIP. Comment: The I.C. Law Building Partnership has made an offer to purchase Lower Ralston Creek Parcel A-2 for $21,001, and Parcel A-3 for $48,001, which are the fair market values of these parcels. The City staff reviewed the purchase offers for Parcels A-2 and A-3 and find that all requirements have been met. A plan showing the pro- posed law office building to be constructed on the parcels is included in the Council packet. Action: Ae- p/ ITEM NO. 8 - CONSIDER A RESOLUTION APPROVING A CONTRACT FOR SALE OF LAND FOR PRIVATE REDEVELOPMENT WITH I.C. LAW BUILDING PARTNER- SHIP FOR THE PARCELS KNOWN AS A-2 AND A-3, LOCATED IN THE LOWER RALSTON CREEK AREA OF IOWA CITY, AND AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE THE CONTRACT AND DEEDS TO THE PROPERTY. Consider an appointment to the Resources Conservation Commission to fill an unexpired term ending January 1, 1988, plus a three-year term ending January 1, 1991. (Gary Goodwin resigned.) �y Action: b. Consider appointments to the Board of Examiners of Plumbers: (1) One vacancy for a representative of the public for an unexpired term ending December 31, 1987, plus a full two-year term ending December 31, 1989. (John Carmack resigned.) Action: a � t (2) One vacancy for a partial term ending December 31, 1988. This appointment is being made in response to a change in the Uniform Plumbing Code which provides for one additional representative of the public. The Code states that the term is for two years .."commencing on January 1 of the year of appointment." Therefore, this appointment is for a partial term. ITEM NO. 16 - CONSIDER A RESOLUTION AUTHORIZING THE MAYOR TO SIGN AND THE aCITY CLERK TO ATTEST THE RELEASE OF LIEN REGARDING A PROM- -4 ISSORY NOTE EXECUTED BY AURELIA SOLNAR. Comment: The lien in question was a $5,000, three-year, forgivable housing rehabilitation lien, of which one-third is forgiven each year provided the owner retains title to the property. Title to the property was transferred prior to expiration of the third year of the lien. Two-thirds of the lien ($3,750) was forgiven, the remainder ($1,250) has been returned to the City's Housing Rehabilitation program. All lien conditions have been satisfied and the lien can be released. Action: `�` a ITEM N0. 17 - CONSIDER A RESOLUTION AUTHORIZING THE EXECUTION OF A RE ` - VISED ANNUAL CONTRIBUTIONS CONTRACT, HOUSING VOUCHER PRO- a�QS GRAN NO. IA -05-V022-006. Comment: The City has applied for and has received ap- proval for approximately 62 units in the Housing Voucher Program. HuD will offer a revised Annual Contributions Contract. The revision will increase the ACC by $244,866 annually for five years. This will support between 56 and 62 units in the Voucher Program. Administration will be incorporated with the other Section 8 program now admini- stered by the Authority. The Housing Commission and staff recommend adoption of the resolution. Comment: On July 14, 1987, the City Council approved an amendment to the agreement with the Iowa City Crisis Inter- orderoforhe etr. A revision to this Crisis amendment Center to secure aloans foradditional rehabilitation costs. Approval of this revised amendment will allow the Crisis Center to complete the rehabilitation of the facility and continue their agency's services as soon as possible. Action: ITEM NO. 19 - CONSIDER A RESOLUTION AUTHORIZING EXECUTION OF AN AG vENENT� WITH THE IOWA DEPARTMENT OF TRANSPORTATION. 51* 19 7 Comment: The resolution and attached agreement are for a project which will provide for the use of Exxon petroleum overcharge funds administered by the State of Iowa to pay, in part, for a project which would install new traffic controllers and an interconnect system for the signalized intersections along U.S. Highway 6 from the intersection of U.S. Highway 6/U.S. Highway 218 and Iowa No. 1 east to the signalized intersection of U.S. Highway 6/Fairmeadows. (See attached memo.) Action: 0/Q;Z i ITEM NO. 20 - CONSIDER A RESOLUTION AWARDING CONTRACT AND AUTHO IZING � MAYOR TO SIGN AND CITY CLERK TO ATTEST CONTRACT FOR THE RENOVATION OF CITY PARK SWIMMING POOL. Comment: The bid opening for this project was held at 2:00 P.M., Thursday, July 23. It was necessary to consider various options in order to select the best overall bid. Therefore, it was not possible to prepare a recommendation in time to appear on this agenda. A staff recommendation will be presented to the City Council at or before its meeting of July 28. Action:. Because the pay plan was prepared prior to performance evaluations being completed, it is now necessary to adjust ranges to reflect this salary. This adjustment will cap the salary range maximums at the actual highest salary within the range.
