Dear Graham:
As you may have read in recent newspaper accounts, the City Council
received a citizen complaint, copy of letter attached, concerning itin-
erant food vendors. The primary concern of the City Council was
two -fold:
1. These businesses are opening on a very short-term basis, possibly
i without proper inspection, licensing, and/or apparent tax responsi-
bility, and
i
2. That they may be avoiding the stringent health and weights and
measures requirements that other businesses selling similar products
are required to satisfy.
i
Of primary concern at this time is the health issue, that is are they
y required to meet health standards. I would appreciate your thoughts as
Ij to how the City and County Health Department might cooperate in some
type of enforcement effort to ensure the health-related issues of such
i itinerant food vendors. I believe that, collectively, with our respec-
tive field personnel, we should be able to identify these businesses and
perform inspections, to at the very least determine that they have been
properly licensed. I am assuming that licensing requirements for
health-related issues would be a County responsibility, but I can assure
you that our field personnel would be more than willing to identify and
report such businesses so that proper inspection can be performed.

attention the fact that there are paddlers who come into town who
sell seafood from the back of a truck who are not inspected or
licensed in any manner.
These paddlers are competition for me, yet they do not have
the expenses that Goldie's Seafoods has. These peddlers do not
live in Iowa City and do not pay taxes as Goldia's Seafoods does.
They do not employ local people as Goldie's Seafoods does. They
do not display the health certificate showing inspection by the
Iowa Department of Inspections as per Chapter 170 of the Uniform
Iowa Code as Goldie's Seafood does. They do not pay the state
fees for food establishment licenses as Goldie's Seafoods does.
They do not display the seal showing their scales verified by the
Iowa Department of Agriculture, Weights and Measures Department.
Our scales are verified yearly by the Department of weights and
measures.
I strongly recommend that peddlers not be allowed to do
business in Iowa City unless they obtain the proper licenses and
are inspected as other businesses are. I recommend an ordinance
be passed by the city council that requires these transient
businesses to have an Iowa City peddlers license by bringing all
their inspections and licenses to the appropriate city
department for review.
I don't mind competition on an equal basis. I strongly
recommend that peddlers wishing to do business in this city
incur the same costs and obtain the same licenses to operate as
local businesses.
The police department should visit these transient
businesses and give fines if they do not comply.

Re: Parking Prohibition on Oakcrest Street
As directed by Section 23-16 of the Municipal Code of Iowa City, this is
to advise you of the following action:
ACTION:
Pursuant to Section 23-234 of the Municipal Code of Iowa City the City
Traffic Engineer will direct the installation of NO PARKING ANY TIME signs
on the north side of the 800 block of Oakcrest Street. The zone of no
parking will change the currently installed NO PARKING 8 AM TO 5 PM and
create a zone approximately 150 feet long in front of the apartment com-
plexes addressed as 815 and 823 Oakcrest Street. This action will take
place on or shortly after July 29, 1987.
COMMENT:
This action is being taken to facilitate a layover point for the City's
transit system. Currently the City's bus lays over on the south side of
the 800 block of Oakcrest Street. In the evening hours after 5 PM vehi-
cles are parking opposite this layover point. This creates a situation
where it is difficult for traffic to pass the standing bus. The creation
of the no parking anytime zone will promote free flowing traffic in the
area of the bus layover.

Pursuant to Section 23-234 of the Municipal Code of Iowa City, the City
Traffic Engineer will direct the installation of a NO PARKING HERE TO CORNER
on the south side of the alley, north of Plaza Centre One, from a point ten
feet west of the alley's intersection with the Dubuque Street right-of-way
west to the Dubuque Street right-of-way. This action will take place on or
shortly after April 8, 1987.
COMMENT:
This action is being taken to ensure a clear space for the sprinkler system
hydrants in the Plaza Centre One building. The prohibition will be placed
upon the building with the permission of the Plaza Centre One building.
Prohibition will ensure that firefighters would have clear space to attach
hoses to the sprinkler system in the Plaza Centre One building.

importance just because these other factors are difficult to quantify.
Several points need to be made here: One, nothing is set in stone until
it is actually built. This suggests that past the point of letting bids
the job is still open to change. This requires direction and an act of
will by the Council. There are those that will argue that changing will
involve vast sums, of which the city has little more to spare. I say,
that given the lowest bid and the necessity of having to work together,
on the basis of a change order process, the contractor selected can work
with the City and Architect to revise the plan with no loss of time.
There is the interval of time from the awarding of contracts, through
demolition, before construction commences during which change details
can be worked out.
As to cost, the cost of extra design time, and its mostly time
we are talking about here, will be offset by the savings in materials,
labor and construction time. Do not be misled or scared by those who
out of hand say without researching the details that these factors cannot
offset each other. I am confident that upon close inspection, given
a high level of goodwill among the parties involved that such redesign
can be achieved with very little extra cost, if any. What it takes
is the willingness to think a little harder, and squeeze a little more,
the money will be there, ifthere is vision on your part.

heard. I believe that those of us who have raised this issue are correct
in being concerned because we are the very people who directly support
the city aquatic program. We are the folks in the pool at lunch time
swimming laps, teaching lessons, encouraging others to take advantage of
Iowa City's cultural opportunities.

The signatures below are in regard to the renovation plans for the bathhouse
at the City Park Pool. We understand the plans approved last winter
specify roofing over the changing rooms. As regular users of the pool,
we feel this is a huge mistake.
Since the bathhouse is in total sun, a roof over the changing rooms
would require the installation of a sophisticated and expensive
ventilation system. The sun and open air ventilate, keep the floor
dry and most important, disinfect without charge.
The open changing rooms have always afforded some roofed areas where
swimmers can seek protection during flash rains. Since the pool is
closed during any lengthy periods of inclement weather, the roof
makes no sense at all. (This since fact differentiates the City Park
Pool from the pool planned for Mercer Park, which will be open all year.)
In the interest of low cost maintenance, material not affected by
weather could replace the wood presently used in the exposed areas.

blue sky, sun, the moon and stars, and sometimes to the ascent of
a hot ai-r. balloon.
At a time when city funds are limited, it makes sense for the City
Council and the Parks and Recreation Commission to reconsider plans

We feel that changing rooms left open to the sun and air will better
serve the swimmers and save money as well.

In addition to the remarks in the above cover letter, I would
¢ like to say that the present design for a new bathhouse seems
to totally ignore:
1) the fact that the pool is open --there is
little rationale for closed dressing rooms.
2) the Recreation Center has received many com-
plaints about the indoor pool's poor ventilation and
dressing room conditions in the heat of this summer. There
is no reason to create these same problems at the City
Park Pool.
I 3) the public park pools in Cedar Rapids have
gone to self service with lockers. It has created
havoc with a surplus of clothing stored all over the
swimming area. This was also a problem at the Mercer Park
!i Pool. Especially children find lockers difficult.
4) the employment,but more important something
to do for teenagers to; young to find other employment,
is valu*able to the city, i.e. the number of basket
employees brings probably ten friends (who hang out at
the pool) to every one young person employed. This is
hoalthy by comparison to hanging out aimlessly downtown.
It may even cost more than lockers/(which I doub§) but it
is. better value for the taxpayer's money.
In conclusion, it looks to me that the Aquatic Director, or the
powers that be at the Recreation Center, did not make a
thoughtful evaluation (on the list of requests) of the architect's
plans for a new bathhouse. Nor have they responded to our
requests last summer for re-evaluation.
I
simply a brainstorming of the aquatic employees would have told
the directors that an open dressing room system and basket
checkers is by far preferable to the plan purposed. These
employees find it awkward to sign the petition included, but
encourage our protest.
It seems a crime to go ahead with plans for a building, knowing
before it is ever started that it will create less service than
what we purpose. I am willing to serve on any board to re-evaluate
the plan. Many of the signers below have also offered their help.

Re: Z-8706. Request to rezone 528 Iowa Avenue from RNC -20 to CB -2.
Mr. Emmit J. George has made application to rezone the site of his law
office at 528 Iowa Avenue from RNC -20 to CB -2. The architectural firm of
Robert Burns and Associates has entered into an agreement with Mr. George
to purchase the property if rezoned. The 4,620 square foot site, located
adjacent to the University of Iowa Credit Union, was the subject of a
rezoning request last year when the Iowa City Crisis Intervention Center
(Crisis Center) sought CB -2 zoning to purchase the property from Mr.
George, In a'Staff Report dated March 24, 1986 (attached), staff origi-
nally recommended approval of the rezoning based on the assumption that
the law office was a legal non -conforming use. During the process of that
rezoning action, however, it was discovered that Mr. George and his part-
ner, Mr. Joseph Johnston, never legally established the law office when
they purchased the property in 1981. Although office uses were permitted
in the R3 -B zone under the previous Zoning Ordinance, they never secured a

and that it did not comply with the parking requirements, staff could no
longer support a conversion of use. In a Memorandum dated April 25, 1986
(attached), staff revised its original recommendation to denial.
Had Messrs. George and Johnston legally established the law office under
the previous Zoning Ordinance, rezoning now would not be necessary to
allow Robert Burns and Associates to occupy the property. Section
36-13(g)(1) of the RNC -20 zone indicates that "all uses or buildings which
were conforming prior to December 13, 1982, shall be construed to be
conforming under the terms of this ordinance." However, there is some
question as to whether it could legally have been established since it
appears the required number of parking spaces could not have been provided
at the time,

would contravene the purpose of the RNC -20 zone and the reason why the
RNC-20/CB-2 zone boundary was established where it was. A review of these

tion is a "Statement Regarding Current Use and History" as submitted by
Mr. George in support of the application.

ANALYSIS
Mr. George's predicament notwithstanding; the RNC-20/CB-2 boundary line
was purposely set in order to protect established residential
to the east. The boundary line separating these two zones Could have been
drawn down the center of Johnson Street properties
ultimately subjected residential properties on the eastgside ofso uJohnson
Street to the negative impacts associated with the commercial uses of the
CB -2 zone. By maintaining like uses on both sides of a street, the sta-
bility of the remaining area (or neighborhood) is retained. That is why
transitions between potentially incompatible zoning districts should
occur, preferably along alleys and rear lot lines of properties, in this
case those properties fronting on the west side of Johnson Street. Another

Mr. David Hayes with Robert Burns & Associates appeared before the Commis-
sion at the March 2, 1987; informal meeting requesting feedback on a
Proposal to rezone the site to the CB -2 zone so that it could be used as
their offices; After review of the Commission's original recommendation
of denial, the Commission again expressed their reluctance to rezone the
property.

Me applicant and Joseph C. Johnston purchased the property
at 528 Iowa Avenue by assumption of real estate contract on July
17, 1981. In the year Preceeding the sale the property had been
used as an art museum and for multi -family residential or
boarding house.
The Property is currently zoned RNC -20, pursuant to the Iowa
City Zoning Ordinance effective December 20, 1983. The prior
zoning designation was R3H, which was the zoning designation at
the time the current owner acquired the property.
UPon taking possession of the property in July, 1981 mr.
George and Mr. Johnston remodeled and made improvements for the
Purpose of use as a law office. The use of the property as a law
Office was permitted under the prior zoning designation, and the
owners were given permits to effective changes and improvements.
Copies of Electrical Applications and Permits dated June August 12,

C. Surrounding Property
This property is not zoned consistently with any of the
surrounding property. On the west it is bordered by the
University Credit Union, which property is zoned CB -2. On the
north it is bordered by a large apartment complex which is zoned
RM -44. To the east it is bordered by a tto-story single-family
dwelling which is substantially similar in appearance, which
property is zoned RM -44. South of -the property and across Iowa
Avenue it is bordered by two-story'residential-rental property
which is zoned RM -44, and tvo-story residential building, zoned
CB -2 and used as a real estate office. Attached hereto is a
Location Map delineating the property and surrounding property.

The current zoning of this property of RNC -20 does not serve

This is an update to the March 24, 1986, Staff Report regarding the request
by the Crisis Intervention Center for CB -2 zoning at 528 Iowa Avenue. As we
have learned, the present use of the property as a law office is illegal. At
the time of the preparation of the March 24th Staff Report, it was assumed
that the law office was a conforming use in the RNC -20 zone. It was based
upon that assumption that staff had recommended approval contingent upon the
use of the property by the Crisis Center operation only. This was done for
two reasons. First, conditioning the rezoning to the Crisis Center operation
would allow for the continuation of a similar type of land use activity
having similar impacts. Second, as a conforming land use, the law office
could be converted to the Crisis Center with fewer parking spaces being re-
quired than if a new use were to be established. This would provide an
incentive to retain the existing 2 -story residential structure since razing
it and building a new structure would require full compliance with the
parking requirements.
Since the law office is an illegal use, any new use established on the prop-
erty will require full compliance with the parking requirements. It was for
this reason that staff lifted the condition, recommended in the March 24th
Staff Report, that the use of the property be limited to the Crisis Center

The ICCIC is a non-profit organization offering two primary services or
programs: the Crisis Intervention Program and Food Bank. The Crisis
Intervention Program provides a 24 hour hotline service and a walk-in
counseling, information and referral service from 11:00 a.m. to 11:00 p.m.
daily. The Food Bank operates Mondays, Wednesdays and Fridays from 12:00
P.m. to 5:00 p.m. Services do not include food preparation, emergency
shelter or retail sales. Under the current ordinance, the area devoted to
the Crisis Intervention Program is classified as an office use, and the
Food Bank program as a personal service establishment. Both office and
personal service establishments are permitted as

Located at the boundary of the RNC -20, CB -2 and RM -44 zones, the site is
in a transitional area at the eastern fringe of the downtown. The area
west of Johnson Street has been in a gradual state of transition from
older, established single-family residential neighborhoods to a mixed land
use pattern of medium to high density residential and comnercial/office
land uses. The Short -Range Plan of the 1983 Comprehensive Plan Update
for the Inner City Area designates the west half of the block between
Johnson Street and Van Buren Street for Mixed Use development. (See
Exhibit A.) The east half of the block, including the site, is designated
for high-density Residential 25+ DU/A' development. According to the
Comprehensive Plan, blocks designated for Mixed Use development are"viewed
as transitional areas between high density residential neighborhoods and
strictly commercial uses. Single developments in this area may be exclu-
sively residential, exclusively commercial, or a mix of both uses." It is
the intent of the CB -2 zone, which coincides with the Mixed Use designa-
tion for this area, ". .to allow for the orderly expansion of the central
business district of Iowa City, to serve as a transition between the
intense land uses located in the central business district and adjoining

areas...This zone is intended to accommodate mixed land uses and requires
that the intensity of use be less than that permitted in the CB -10 zone."
The present CB-2/RNC-20 zone boundary was established to preserve existing
housing stock and established residential neighborhoods east of Johnson
Street from the intensive redevelopment associated with the downtown. The
rear lot lines of homes fronting on Johnson Street was chosen as the point
to hold the line in order to minimize the impacts between these two poten-
tially conflicting zones. The ICCIC site was included in the RNC -20 zone,
although already used as a law office, since it included a residential
structure.
Located adjacent to the CB -2 zone and Mixed Use designation of the Compre-
hensive Plan, the proposed rezoning would be a natural progression of the
CB -2 zone in this transitional area. Due to the nature of surrounding
land use patterns and zoning, CB -2 zoning would not appear to be inappro-
priate or imcompatible with surrounding land uses. An area zoned RNC -20
west of Johnson Street would be retained and continue to buffer residen-
tial neighborhoods east of Johnson Street. The two remaining
single-family residences east of the site will be screened according to
the Performance Standards of the Zoning Ordinance. An amendment to the
Comprehensive Plan is not required, since the site is at the border of the
CB -2 and RNC -20 zones and the RNC -20 buffer strip west of Johnson Street
would be preserved. In order to mitigate potential negative impacts on
remaining homes west of Johnson Street, staff feels it to be appropriate
to condition the rezoning to permit only the Crisis Intervention Center
operation.
Due to the small size and configuration of the site, parking will be
limited on-site. Conditioning approval to the Crisis Center operation
only will probably result in the retention of the residential structure
resulting in fewer required parking spaces.
STAFF RECOMMENDATION
Based upon the above analysis, staff recommends that the rezoning of the
property located at 528 Iowa Avenue from RNC -20 to CB -2 be approved,
contingent upon the property's use for only the crisis intervention pro-
gram and food bank operation.

On behalf of our client, the University of Iowa Community
Credit Union, we wish to make a formal protest of the proposed
rezoning of 528 Iowa Avenue from RNC -20 to CB -2.
This matter has been considered both this year and last by
the Planning and Zoning Commission. On both occasions the
proposed rezoning was denied. The University of Iowa Community
Credit Union continues to flourish as a financial .institution
placing heavy demand on their own parking that .is available there
at the Credit Union. In addition, other businesses are growing
to the east of the Credit Union which place greater demand upon
the parking there. The prospect of a business moving in at 528
Iowa Avenue can only exacerbate the current problem. The current
use, as I am sure that you are aware, is illegal. It is our
belief that it is in the interests of all of the property owners
in the area that the current zoning be maintained. Thus, 528
Iowa Avenue could be maintained as a buffer between the business
and residential zone that meets in that area.
For all of the reasons that we have state above, as well as
other reasons stated by our neighbors and the City Planning and
Zoning staff, we strongly urge you to deny the proposed rezoning
and maintain the premises as an RNC -20 zone.

MEMORANDUM

Re: Refund of Social Security Contributions
During the years 1976 through 1981 the City handled payments to employees
for sick leave use similar to all other compensation. In actuality, the
compensation for sick leave use was exempt from social security taxation
during that time period.
In February, 1984, the City entered into a contract with Management Re-
source Controls, a consulting firm who would do the necessary research for
retrieving the excess Social Security contributions.
A claim for a refund of $43,763.66 was filed in the summer of 1985, after
many hours of research and coordinated efforts with the Accounting and
Reporting Division of the Department of Finance. This week we received
the full amount of the refund, which is the combined contributions of the
City and the employees. Within the next month we will be processing
$21,881.83 in refunds to the employees. The consulting contract cost was
$9,846.82, resulting in a net refund to the City of $12,035.01.
