Re: The Sports Column Application
Dear Mayor and Members of the City Council:
The undersigned represents Patricia Stach Chase and Carl Stach who are
the owners of a business building located at 10 S. Dubuque Street adjacent
to the property occupied by The Sports Column. (See plat drawing attached).
The purpose of this letter is to register the objections of Mrs. Chase
and Mr. Stach to the application by The Sports column for an outdoor service
area to the rear of the business building which it occupies.
The abutting property owners received a proposed statement of consent to
this application. Attached thereto was a drawing of the proposed improvements
to be placed in the "outdoor area". A copy is also attached to this letter.
As the Council knows from past problems with the area located behind and
immediately east of those business buildings located in the north half of
Block 66 which front on Dubuque Street, the ownership of this tract is cloudy.
It appears certain that this area is not a dedicated public alley. It further
appears that the owners of those buildings which abut this area have acquired
easement right of ways over the use of the property, the exact extent of which
is also cloudy.
It is apparent from the proposed attached plans that the applicant in-
tends to close this "alleyway" at both the north and south ends which will
eliminate any practical usage of our clients' rights thereto.
Our clients object to the granting of the application for the following
reasons:
1. The City Council has no jurisdiction to grant to the applicant a
right to utilize the portion of the "alleyway" since this "alleyway" is not a
public alley and since the applicant cannot demonstrate that it has exclusive
ownership of said property.

2. In the event the applicant attempts to close the "alleyway" in the
manner indicated in the plans and specifications, our clients will have no
choice but to commence appropriate legal action to prevent the same.
3. Downspouts from the adjacent buildings to the "alleyway" pour sub-
stantial amounts of water into this area, which drains towards the public al-
ley. This surface water flow will be blocked by the intended improvements of
the applicant.
4. The "alleyway" at the present time is utilized by our clients, and we
believe by other property owners abutting this same alleyway, for vehicular
access to the rear portion of their buildings for a variety of legitimate pur-
poses. The intended use of the application will prevent the same.
The Stach family has owned their property since 1910. Over the years
they have attempted to secure from the City some recognition of City responsi-
bility for this area and the City has declined to undertake any responsibil-
ities for control of parking, traffic flow and removal of cars parked illegal-
ly in the area. Certainly now the City cannot and should not grant a permit
to the applicant to use this area for the sale of alcoholic beverages. Please
deny the requested application.

Dear Friends:
I am writing as pastor of The First Christian Church, 217 Iowa Avenue, to request that
the application of The Sports. Column for the operation of an outdoor service area
immediately adjacent to their location at 12 S. Dubugue be denied.
This type of operation would only add to the clutter in the area around our facility and
would increase the likelihood to outdoor urination in the area.
Specifically, this would be an incompatible situation not only on Sunday morning, but
the many other times that church functions are held.
The First Christian Church occupies the spot where the first church in Johnson County
was built. We recognize that the usage of the area has changed through the years, but
we still think that the City Council can and should do all that it can to preserve the
dignity of our surroundings.
Please deny tills request.

To the Iowa City City Council:
I am writing about the application by The Sports Column
to operate an outdoor service. As a member and currently
the moderator for First Christian Church, 217 Iowa Ave.,
I have some serious questions about the propriety of
granting this request.
Because there are several taverns so close to our church
we already have to deal witha number of annoying problems,
like trash and broken bottles, and people urinating on our
property. This is especially aggravating to find on Sunday
mornings when we come for worship. I'm sure that an out-
door tavern would add to this situation.
It would also increase the noise level and the number of
intoxicated persons who would pass by the church either
on the street or in the alley. I'm sure this would be
annoying and intimidating to many of our people who come
to evening meetings, as well as to church on Sunday mornings.
It would be even more frightening to have fights and arrests
which seem to happen frequently in Iowa City taverns.
I hope that you will not grant this application in this
neighborhood.

Dear Council Members:
I am writing regarding your letter of June 16, 1987 about the
Sports Column located at 12 S. Dubuque Street.
The Clifford Building Partnership owns properties at 2 and 4
S. Dubuque Street, as well as 4 apartments above these properties
(207 1/2, Iowa Avenue).
We wish to inform the council members to dens the approval of the
outside service area behind 12 S. Dubuque St. for the following
reasons:
1. Serving alcoholic beverages and serving people outside would
cause a noise problem into the late hours of the night.
2. The present alley would be obstructed for our use and
accessibility to all properties along the alley. This alley
is for delivery purposes. It also would obstruct the fire
departments use of the alley.
3. The alley contains many fire escapes. It needs to be open for
fire egress for all properties.
4. This alley has trash containers and has been difficult to keep
clean. It is not a favorable outdoor activity area.
5. This alley has a very poorly maintained surface.
The previous owner of 2 and 4 S. Dubuque St, fought a similiar
action in September of 1982, when the Copper Dollar wanted an
outdoor beer garden. Note enclosed copy of letter.
The Deadwood Tavern will probably be next to apply. There are
enough beer establishments now.
Please vote no to this application. The streets and alleys of
Iowa City look bad enough without this additional usage.

As owner of the properties located at 2 and 4 South Dubuque
Street, Iowa City, Iowa,.I object to allowing the Copper Dollar
to use the alley behind these properties as a temporary beer garden
for football weekends. My reasons are as follows:
Note the last page of the petition presented to the Council.
As an lwner, I was not consulted in regards to this petition.
I see no other signatures of property owners. Is the
signature "Big B Cleaners" a legal signature?
Also note the attached letters of Irene'Wherritt of the
Women's Sports Company and Doug Sjoerdsma of the University
Camera Shop, leasers of 2 and 4 South Dubuque St. respectively.
An open air beer garden will cause a noise problem a good
portion of the night for the occupants in the apartments on
the second floor of the mentioned properties. The entrance
to these apartments is next to the alley at 2072 Iowa Ave.
This noise could well be a test of our noise ordinance.
This alley presently serves as a fire.lane. It is a fire
exit for both the Copper Dollar and the Deadwood Tavern. A
:,fire escape is built in the alley, plus other equipment such
as an air conditioner. Therefore, I do not feel it wise to
fence this area off.
i Because of the very poorly maintained surface and the poor
'lighting, I consider it hazardous to have such a gathering here.
The letter from Mr. David Poula reads, "all cleanup would be
accomplished by the Copper Dollar staff". My experience is.
that the Copper Dollar has not cleaned up around their premises,
the alley, or the refuse strewn along my properties, after
their regular Friday and Saturday nights and wonder if they
would do any better after a beer garden affair.

Dear Council Members,
I would like to express my concern over the proposed extension of Boyrum
Street to Highland.
The neighborhood I live in is a family, people -oriented neighborhood. My
neighbors and I would like to keep it that way. When I moved here in the summer
of 1969 I awoke to the crowing of a rooster and the lowing of a cow. Now there
are all kinds of .businesses across the highway and constant traffic on Highway
6 Bypass. This is progress and I don't object to it. What I do object to is
a road in front of my property and one behind it --we are talking feet, not }
acres or acres. There are many reasons why this should not be done:
1. It would be depriving us of enjoyment of our property.
2. There is alternate access to the property from Highland
already in existence.
3. The number of intersections with Highland and the ensuing
increase in traffic would make turns onto Highland unfeasable•
4. The increased traffic would make the neighborhood dangerous
for children.
5. There is no need for another fast food place as proposed.
There are 3 pizza restaurants, 2 grocery stores providing
meals, an Italian restaurant, Village Inn, not to mention
McDonalds around the corner, and 2 Chinese restaurants.
Any other business wouldn.'t need access from Highway 6 Bypass.
The bottom line is there is no need for the extension.
I would like to applaud the Planning and Zoning Commission for their responsible
action of turning down the request by a vote of 5 to 2.
Unfortunately I am unable to be at the meetings as I will be out of town and
cannot change my plans on such short notice.
I appreciate your attention to the matter and trust you will see the viability
of my concerns and take appropriate action.

As directed by Section 23-16 of the Municipal Code of Iowa City, this is to
advise you of the following action:
ACTION:
Pursuant to Section 23-234 of the Municipal Code of Iowa City, the City
Traffic Engineer will direct the installation of a NO PARKING CORNER TO HERE
sign on the north side of Highwood approximately 30 feet west of the inter -
Julysection with Lee Street. This action will take place on or shortly after
July 2, 1987.
COMMENT:
This action is being taken to improve the visibility of the sight distance to
the north at the intersection of Highwood Street and Lee Street.

Pursuant to Section 23-234 of the Municipal Code of Iowa City, this is to

Traffic Engineer will direct the installation of a NO PARKING HERE TO CORNER
sign on the west side of Lee Street approximately 40 feet north of the inter-
section with Highwood Street. This action will take place on or shortly
after July 2, 1987.
COMMENT:
This action is being taken to improve the sight distance to the north from
the intersection of Highwood and Lee Streets.
