HomeMy WebLinkAbout1987-06-30 Ordinance.P' AN ORDINANCE MENDING THE ZONING ORDINANCE BY CH"- ING THE USE REOJLATIONS OF CERTAIN PROPERTY LOCATED AT 410 IOWA AVENIE. *SEAS, the property located at 410 Iva Avenue is presently zoned P; and WfREAS, the applicant is seeking to purchase the property from the State Historical Society of Ias to establish a private use requiring the property to be rezoned; and WEREAS, the Comprehensive Plan for the City of Iara City shows mixed lard uses in the area includ- ing the site; and WEREAS, properties abutting the property at 410 Iowa Avenue are zoned CB -2; and 40EAS, the existing development surrounding the property at 410 Iowa Avenue is for uses compatible with mixed commercial and residential uses; and WHEREAS, mixed lard uses are the most appropriate use for this area for vhich the CB -2 zone is consis- tent. NOW, THEREFORE, BE IT OMAINED BY THE CITY COUN- CIL OF THE CITY OF IOVA CITY, IOWA: SECTION I. ZONING AMEWNT. The purchase is supported in part with e7 Community Development Block Grant funds from Iowa City and will require an impact study prior to the release of CDBG funds from 0` the Department of Housing and Urban Development. Since the seller is the state of Iowa, the sale requires the final approval u of the state Executive Council and approval of the state Attorney O General prior to closing. UAY is seeking to expedite the process to the extent possible and N is requesting that Planning and Zoning consider this rezoning 04 request in one meeting instead of two on June 18th. A tele- phone line also runs through this alley. Transportation: The alley right-of-way is not needed to provide access to any property except urban renewal parcels A-2 and A-3 which the City is offering for sale. Physical characteristics: The topography is nearly level. 90?1' of urban renewal Parcel A-3 from the north boundary of Parcel A-3 to Ralston Creek. Purpose: To make the alley available for purchase. Location: North of Kirkwood Avenue, east of Dubuque Street, south of Benton Street, and west of Gilbert Street. Size: 952.5 square feet (15' right- of-way width and 63.5' average length). Physical characteristics: The topography is nearly level. 90?1' .P' W G ANALYSIS John Cruise is requesting for the law firm, Barker, Cruise, Kennedy, Houghton & Foster, the vacation of that portion of the alley along the east side of urban renewal Parcel A-3 from the north boundary of Parcel A-3 to Ralston Creek. (See Attachment la: Location Map and Attachment 2: Letter of Re- quest.) The lands surrounding this segment of the alley are vacant urban renewal Parcels A-2 and A-3 which are being offered for sale by the City. As Mr. Cruise explains in his letter, his firm hopes to purchase the alley when vacated to incorporate it into building and parking plans for a proposed office development. No matter who purchases the property, vacating the alley to allow its purchase with urban renewal parcels A-2 and A-3 should increase the value and marketability of the parcels. This would put the alley back on the tax rolls and take this property out of the City's domain to maintain for perpetuity. Regardless of whether the urban renewal parcels are sold, the alley should be vacated. The portion of the alley to be vacated is unimproved and does not provide access to any other property except urban renewal parcels A-2 and A-3. The City has a sanitary sewer line which runs through the alley. A telephone line also traverses the area. An easement will need to be established for these public utility lines. STAFF RECOMI4ENDATION Staff recommends that the vacation of the alley be approved as requested, subject to the provision of a utility easement over the alley. ATTACHMENTS 1.
