Consider setting public hearing for September 8, 1987, on a resolution authorizing the Mayor to sign an agree- ment between Coralville and Iowa City regarding annexa- tion and subdivision review. Comment: In June of 1986, an agreement between Coral- ville and Iowa City prescribing the limits of annexa- tion for each city expired. An amended agreement is proposed which sets the same limits for annexation but requires the inclusion of Iowa City's findings in the subdivision approval for any subdivision which is located in Coralville's statutory extraterritorial jurisdiction and in Iowa City's agreed area of annexa- tion. Action a2Q ows..� b. Consider a resolution rescinding Resolution No. 84-213 �•�\� approving the final plat for BDI Fifth Addition. Comment: On July 31, 1984, Council approved Resolution No. 84-123 which approved the final plat for BDI Fifth Addition. Due to a change in circumstances, the subdivider, Business Development, Inc., chose not to record the final plat for this subdivision. The subdivider now wishes to redesign the configuration of lots for this tract of land. Rescission of the resolu- tion approving the original design will assist in avoiding confusion as to which subdivision design prevails. Consideration of the revised final plat for this subdivision follows this item. Action .o• Y Agenda Iowa City City Council Regular Council Meeting August 25, 1987 Page 5 c. Consider a resolution to approve the preliminary and R I•,D�d0 final plat of BDI Fifth Addition. Comment: At its July 2, 1987, meeting, the Planning and Zoning Commission recommended, by a vote of 5-0, approval of the preliminary and final plat for BDI Fifth Addition, a 12 -lot industrial subdivision located north and south of Heinz Road extended subject to approval by the City of the legal documents and of construction plans for Heinz Road. The Commission also recommended that the sidewalk requirement be waived for this subdivision. These recommendations are generally consistent with that of staff. In order to preserve the ability of Scott Boulevard to carry large volumes of traffic, staff recommended, however, that access to Lots 11 and 12 of the subdivision be limited to a single access drive from Scott Boulevard. Due to the configuration of Lots 11 and 12 and the restricted size of the access drives that would be permitted, the Commission did not support this recommendation. This item was deferred from the August 11, 1987, Council meeting pending approval of construction plans for Heinz Road. Action:AI,,ko.V/ W,-3)' �r d. Consider a resolution approving the final plat of C.R. c$h37 Bell's Subdivision, a 12 lot residential subdivision located in Johnson County, approximately 1.8 miles east of Scott Boulevard. (S-8715) Comment: At its August 6, 1987, meeting, by a vote of 5-0, the Planning and Zoning Commission recommended approval of C.R. Bell's Subdivision, a 12.32 acre resi- dential subdivision. This recommendation is consistent with that of staff included in a report dated August 6, 1987. SYSTEM AT THE Comment: This project will involve the construction of a 16 million gallon per day wastewater treatment facility at the existing wastewater treatment plant site. The Engi- neer's estimate is $9,200,000.00 (nine million, two hundred thousand dollars). Comment: This project will extend Heinz Road east to Scott Boulevard and will involve the construction of approximate- ly 1,810 linear feet of 28' wide P.C.C. pavement with associated storm sewer. The Engineer's estimate for this project is $250,000.00. RISE funds will pay for a portion of this project. This item was deferred from the August 11, 1987, Council meeting. Action: `D 6 "AV ITEM NO. 12 - RESOLUTION AUTHORIZING AND DIRECTING THE FILING OF AN AP- PLICATION ON BEHALF OF THE CITY OF IOWA CITY WITH THE �7 aa5 DEPARTMENT OF TRANSPORTATION, UNITED STATES OF AMERICA, FOR A GRANT UNDER SECTION 9 OF THE URBAN MISS TRANSPORTATION ACT OF 1964, AS AMENDED, FOR TRANSIT CAPITAL ASSISTANCE FUNDING, AND DESIGNATING THE CITY MANAGER AS THE CITY OFFICIAL AUTHORIZED TO EXECUTE AND PROCESS SAID APPLICA- TION. Action: Comment: This resolution is for a grant application JCCOG filed in behalf of Iowa City Transit in June 1987. The City Council informally approved the application at that time. Comment: The Code of Iowa requires that these reports are submitted to the Iowa Department of Transportation by September 10, 1987. They provide the Iowa Department of Transportation and the Federal Highway Administration with 1) a documented record of street receipts and expenditures in Iowa cities, and 2) a status report on street construc- tion programs. Comment: The City has been negotiating to acquire proper- ties and temporary construction easements on properties owned by the Cedar Rapids and Iowa City Railroad (CRANDIC) in conjunction with the West Benton Street Bridge Improve- ment Project. Those properties lie immediately north and south of West Benton Street just east of the Iowa River Bridge. Based on negotiations to date and further review of the proposed acquisitions by the City's appraiser, staff is recommending adoption of the subject resolution author- izing the City Manager to make revised purchase offers to CRANDIC for these acquisitions, increasing the proposed purchase price for two of the parcels and providing for the acquisition of fee title to certain of those parcels by quitclaim deed. All parcels are shown on Exhibit A to the Resolution. The proposed purchase price increases are as follows: (1) Parcel F - fee title acquisition, purchase price increase from $975.00 to $1,536.00. (2) Parcel G - fee title acquisition, purchase price increase from $2,025.00 to $3,189.00. Action: �� (a) Pa coo itz 00 .o. .o• M Agenda Iowa City City Council Regular Council Meeting August 25, 1987 Page 12 ITEM NO. 16 - CONSIDER A RESOLUTION AUTHORIZING AND DIRECTING THE MAYOR AND CITY CLERK, RESPECTIVELY, TO EXECUTE AND ATTEST AN X8`1 aa9 AGREEMENT WITH THE CEDAR RAPIDS AND IOWA CITY RAILROAD (CRANDIC) FOR THE REMOVAL OF THE WEST RENTON STREET CROSS- ING JUST EAST OF THE IOWA RIVER BRIDGE, FOR THE REMOVAL OF CERTAIN STORAGE TRACKS LOCATED NORTH OF WEST BENTON STREET AND WEST OF CAPITOL STREET, AND FOR THE RECONSTRUCTION AND REALIGNMENT OF A SPUR TRACK IN AND ADJACENT TO THE RAILROAD CROSSING AT CLINTON STREET IN AND NEAR LAFAYETTE STREET IN IOWA CITY, ALL IN CONJUNCTION WITH THE WEST BENTON STREET BRIDGE IMPROVEMENT PROJECT. Comment: The West Benton Street Bridge Improvement Project will involve the construction of additional lanes on the north side of the Iowa River bridge, and the reconstruction of the West Benton Street bridge approaches on the east and west side of the river. The Cedar Rapids and Iowa City Railroad (CRANDIC) has established and operates a crossing track on West Benton Street in the bridge approach area on the east side of the river and within the confines of the project. The City initially requested CRANDIC to recon- struct that crossing to conform to the new grade and street width established as part of the bridge improvement pro- ject. CRANDIC, however, has instead proposed to remove that crossing, and to improve a nearby spur line near Clinton and Lafayette Streets so that it can make increased usage of the Benton Street crossing lying between Capitol and Clinton Streets. An agreement to that effect has been negotiated and prepared for execution by the City and CRANDIC, and staff is recommending approval by the Council. That agreement also provides for the removal of certain railroad storage tracks lying north of West Benton Street on property being acquired by the City, and remuneration of CRANDIC in the amount of $9,239.00. Comment: Item 19 provides for the amendment of Chapter 26 of the Code of Ordinances to change the way in which the fee for issuance of a peddler's or solicitor's license is set, provides for a change in the term of such license, and eliminates the fee reduction for renewals. Currently that fee is authorized in Chapter 26, and is set by ordinance amending Chapter 26. Under the proposed amendment, that fee would continue to be authorized in Chapter 26, but the amount of the fee would be set by resolution. Item 20 is the resolution changing the amount of that fee. Items 23 through 29, following, relate to certain fee increases, and to the City's procedures and policies regarding the setting and collecting of their fees. Many of those fees, although authorized by ordinance in a specific chapter of the Code, have been set by resolution. The following measures represent an effort to amend those chapters to provide that all those fees will be authorized by ordinance in the Code, and the amounts of those fees will be as provided in the "Schedule of Fees," which is itself to be adopted by ordinance and which is to appear in Chapter 32.1 of the Code in a new article, Article.IV. Comment: In addition to changing the way in which the various parking fees and penalties are to be, set, this ordinance amends Section 23-249 of the Code to change the City's procedures with regard to the reservation of metered parking spaces by construction contractors. Currently, the City has the responsibility to remove vehicles illegally parked in such spaces, and has the liability attendant to that function. Action: Comment: The only provisions of the Code of Ordinances which deal with public transportation are currently found in Chapter 2. The fares for public transit service are not currently authorized or set in the Code, and it would not be appropriate to do so in Chapter 2, since that Chapter is reserved primarily for outlining the City's administrative service. Staff is therefore recommending that Article XI of Chapter 2, entitled "Department of Public Transportation," be repealed, and that a new chapter, Chapter 30, entitled "Public Transportation," be enacted in its place. Item 26 is the ordinance repealing Article XI of Chapter 2, and Item 27 is the ordinance enacting the new Chapter 30.
