RESOLUTION RESCINDING RESOLUTION NO. 84-213 APPROVING THE FINAL PLAT
OF BDI FIFTH ADDITION, A SUBDIVISION OF JOHNSON COUNTY, IOWA.
WHEREAS, on July 31, 1984, the City Council of the City of Iowa City, Iowa,
passed and approved Resolution No. 84-213 which approved the final plat of
BDI Fifth Addition; and
WHEREAS, due to a change in circumstances, the owner, Business Development,
Inc., did not record the final plat for BDI Fifth Addition at the Office of
the County Recorder of Johnson County, Iowa, as required by Resolution No.
84-213; and
WHEREAS, Business Development Inc. now wishes to redesign the configuration
of lots on the final plat for BDI Fifth Addition;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF IOWA CITY,
IOWA:
1. That Resolution No. 84-213 is hereby rescinded.

WHEREAS, the owners, Clifford M. and Ramona L. Bell, have filed with the
City Clerk of Iowa City, Iowa, an application for approval of the final
plat of C.R. Bell's Subdivision; and
WHEREAS, the proposed subdivision is located in Johnson County and within
Iowa City's two-mile extraterritorial jurisdiction; and
WHEREAS, the Department of Planning and Program Development and the Public
Works Department have examined the proposed final plat and have recom-

portion of the tract northerly toward
Snyder Creek.
ANALYSIS
The final subdivision plat for C.R. Bell's Subdivision generally conforms
with the design proposed in the preliminary plat for this 12 -lot subdivision
which was approved by the City Council on July 14, 1987. The number of
access drives from the county road, however, has been reduced on the final
plat and the name of the subdivision has been changed from Bell's Subdivi-
sion, as noted on the preliminary plat, to C.R. Bell's Subdivision. The name
change is needed to distinguish this subdivision from another county subdivi-
sion with the same name.
With approval of the preliminary plat, the subdivider was enabled to provide
individual access drives for Lots 1 and 12; access to the remaining ten lots
was to be obtained by way of three shared access drives. The final plat
differs from the preliminary plat in that private access to Lot 1 has been
eliminated and the access drive shared by the lots in the western half of the
subdivision has been moved westerly to incorporate access to Lot 1. The
concern expressed by the City during preliminary platting regarding the
proximity of access to Lot 1 and the county road/Old Highway 6 intersection
is addressed by the proposed location of this access drive; this drive is not
located within the west 100 feet of the frontage of Lot 1 as prescribed on
the preliminary plat.
The final plat indicates that the easterly and westerly access easements as
they intersect with the county road have been increased in width by five feet
to thirty feet. The traveled surface is expected to be approximately twenty
feet in width.
A ten -foot utility easement is shown on the final plat along the perimeter of
this subdivision; it is to serve as a non-exclusive easement reserved for all
utilities which may serve this subdivision.
Stormwater calculations which have been submitted are satisfactory. An
easement for the drainage swale which leads from Lot 1 to the stormwater
storage area has been noted on the plat. The presence of this easement will
assure that no structures or septic systems which may interfere with the flow
of stormwater to the basin will be constructed or installed within this
,. drainage route. The location of the proposed easement is subject to City
review and approval.
While percolation test and soil boring information filed by the subdivider
with the Johnson County Health Department satisfies the requirements of the
County Sewage Regulations, it should be noted that the size and configuration
of the proposed lots restrict the possible locations of septic systems on the
lots. The presence of a stormwater detention basin easement over a signifi-
cant portion of several lots further constrains the flexibility of septic

The location of Snyder Creek in proximity to this subdivision should be noted
on the plat. No legal papers for the proposed development have been submit-
ted to date. City review and approval of those documents must be obtained
prior to subdivision approval.
STAFF RECOMMENDATION
Staff recommends that the final plat of C.R. Bell's Subdivision be deferred
but that upon resolution of the deficiencies and discrepancies noted below,
the plat be approved.
DEFICIENCIES AND DISCREPANCIES
1. Obtain approval from the City of the proposed location of the drainage
iswale easement.
2. Note on the final plat that the placement of septic system drainage
fields within the stormwater detention basin is prohibited.
3. Reflect the location of Snyder Creek on the final plat.

a 32,160 square foot commercial recreational facility with the greatest
amount of floor area devoted to indoor tennis courts. In 1983, the appli-
cant received a building permit to construct a 2,880 square foot addition.
Commercial recreational facilities are a permitted use in the CH -1, High-
way Commercial Zone.
The present facility is required to provide 59 parking spaces on-site.
According to the applicant's plan, a total of 91 parking spaces are cur-
rently provided. The proposed addition will require the provision of 76
additional parking spaces calculated as follows:

The occupant load is determined based upon occupancy ratios provided in
the Uniform Building Code. According to Section 36-58(a)(5)c.2. of the
Zoning Ordinance, the amount of required parking for participatory type
recreational uses is two-thirds (2/3) the occupant load. The four (4)
future outdoor tennis courts will require 21 parking spaces based upon an
occupant load of 32.
Two (2) conversions are proposed within the existing building. An exist-
ing raquetball court is proposed to be converted into a nursery and three
(3) tanning booths. The difference in required parking is calculated as

The required number of parking spaces within the existing building as a
result of the conversions is 39 spaces: 59 (existing) + 10 - 30 = 39
spaces. The total for all uses within the existing building, proposed
addition and future tennis courts is 136 spaces. One-third (1/3) of these
spaces (45) may be designated for compact vehicle spaces only. A summary
for all uses is illustrated as follows:

The parking plan shows a total of 136 parking spaces in compliance with
the construction, design and location requirements of Section 36-58(c) of
the Off -Street Parking Requirements. All aisles are designed for two-way
traffic except for the easternmost aisle serving the compact vehicle
spaces in row E which has a 17 foot aisle width. Three (3) handicapped
parking spaces are being provided on the north side of the proposed addi-
tion. One-third (1/3) of the parking spaces, 45, are designated for
compact vehicle spaces and will be properly signed.
Stormwater management for the site is currently being provided by a deten-
tion basin located in the northeast portion of the site. The Public Works
Department has determined that the stormwater management plans and calcu-
lations are acceptable although additional information is needed to verify
the capacity of the outlet structure. Public Works also indicates that the
applicant may need to secure a permit from the Iowa Department of Trans-
portation to use a portion of Highway 1 right-of-way as a stormwater
detention area. The applicant is communicating with IDOT to determine if
a permit is necessary.
Since the proposed addition increases the total floor area by more than
ten (10) percent, compliance with the Tree Regulations is required, Sec-
tion 36-73(a)(1)b. As a corner lot, right-of-way trees must be planted at
a ratio of one (1) tree for every 60 feet of lot frontage. Having a total
lot frontage of 1,312.07 feet, 22 trees are required to be planted adja-
cent to the right-of-way. Fifteen (15) trees are to be planted for this
purpose which, in combination with existing trees within and adjacent to
the right-of-way, will provide 22 right-of-way trees. Compliance with the
parking area tree standards is also required for the expanded parking
area, Section 36-73(b)(1)b. The parking plan shows compliance with the
number and location of parking area trees.
The plan currently shows a fire hydrant located on the north side of the
building supplied by a six (6) inch water main. The Fire Marshal would
like the fire hydrant relocated to either the east or south side of the
building to provide for better access. The applicant shows the fire
hydrant to be relocated to the northeast corner of the proposed addition
which is acceptable to the Fire Marshall.
Access to the site is currently provided through the Howard Johnson's
parking lot. At the time the facility was initially constructed in 1977,
it was owned by E.J. Mueller who also owned the Howard Johnson's Motel to
which this site is adjacent.
Economic Impact: Economic impact is a measure of the public costs and
benefits associated with a proposed project. The emphasis of this portion
of the report will focus on the economic impacts of the proposed addition
only. Public benefit can be measured in terms of tax revenue generated
and the jobs created. The liabilities or public costs are not always
o, quantifiable but can be recognized through direct public construction
costs (i.e. overwidth paving, sewers, etc.) and indirect public costs
through the additional public services demanded by the proposed project.

STAFF RECOMMENDATION
In light of the deficiencies and discrepancies listed below, staff recom-
mends that the request be deferred. Due to the potential for considerable
time delay in securing a permit from IDOT, if required, the staff would
recommend that upon resolution of the minor
question. deficiencies noted in items 1
and 3, this request be approved subject to resolution of the IDOT permit

1. Submission of revised stormwater management calculations verifying the
capacity of the outlet structure.

evidence of ownership and giving the intended time schedule for com-

of intent of the Final Large -Scale Non -Residential Development for Iowa City
Tennis and Fitness Center, Iowa City, Iowa.

OWNERSHIP
Iowa City Tennis and Fitness Center is currently owned by John Balmer, Bob
Downer, Herb Lyman and J. C. Hickman, all residents of Iowa City. The
property, consisting of 7.06 acres as shown on the Amended Preliminary and
Final LSNRD plans, is also owned by the aforementioned.
DESCRIPTION OF PROPOSED DEVELOPMENT
The development being proposed is a 6,968 square -foot addition to the existing
36,340 square -foot facility. The addition will provide additional facilities
including a new lap swimming pool, Nautilis weight room, sauna and swimming
pool deck area. An additional four outdoor tennis courts are also planned in
the near future.
The lap swimming pool will be approximately 1,950 square feet, the deck area
approximately 320 square feet, the sauna 88 square feet, and the Nautilis area
approximately 2,140 square feet. One existing racquetball court will be
o converted to a nursery (approximately 700 square feet) and three tanning booths
(64 square feet each). When the new Nautilis area is operational, the existing
area used for Nautilis will be converted for use as a tennis court.

TION ON BEHALF OF THE CITY OF IOWA CITY WITH THE DEPARTMENT OF
TRANSPORTATION, UNITED STATES OF AMERICA, FOR A GRANT UNDER
SECTION 9 OF THE URBAN MASS TRANSPORTATION ACT OF 1964, AS
AMENDED, FOR TRANSIT CAPITAL ASSISTANCE FUNDING, AND DESIGNATING
THE CITY MANAGER AS THE CITY OFFICIAL AUTHORIZED TO EXECUTE AND
PROCESS SAID APPLICATION.
WHEREAS, the City of Iowa City has a municipal transit system and wishes
to purchase three 40' buses including fareboxes, a downtown information
kiosk, and 50 on -route schedule signs; and
WHEREAS, the Secretary of Transportation is authorized to make grants for
mass transportation projects; and
WHEREAS, the contract for financial assistance will impose certain obliga-
tions upon the applicant, including the provision by it of the local share
of project costs; and
WHEREAS, it is required by the U.S. Department of Transportation in accord
with the provisions of Title VI of the Civil Rights Act of 1964, that in
connection with the filing of Section 9 applications for assistance under
the Urban Mass Transportation Act of 1964, as amended, the applicant give
assurance that it will comply with Title VI of the Civil Rights Act of
1964 and the U.S. Department of Transportation requirements thereunder;
and
WHEREAS, it is the goal of the applicant when procuring construction
contracts, supplies, equipment contracts, or consultant and other services
in connection with Section 9 projects, that minority business enterprise
be utilized to the fullest extent possible, and that definitive procedures
shall be established and administered to insure that minority businesses
have the maximum feasible opportunity to compete for contracts.
NOW, THEREFORE, be it resolved by the City Council of the City of Iowa
City, Iowa, as follows:

The annual Street Finance Report forms for fiscal 1987 have been
mailed to the Office of City Clerk in your city. This report is
required by the Code of Iowa, Chapter 312, Section 14, and is due by
September 10, 1987. The Iowa Department of Transportation must
certify to the State Treasurer those cities not complying with this
section of the Code. Once notified, the Sta
withhold Road Use Tax fund te Treasurer will
money from the city until such time as
they submit a Street Finance Report to the Iowa Department of Trans-
portation. Withheld funds will not be returned to the city. This
report provides the Iowa Department of Transportation and the Federal
Highway Administration with a documented record of street receipts
and expenditures in Iowa cities.
To insure that your city complies with this section of the Code,
Please urge your city clerk to promptly send two copies of the
completed forms to the District Transportation Planner for your area.

WHEREAS, Holiday Wrecker Service, Inc. has submitted the best proposal for

WHEREAS, it is in the public interest that the City of Iowa City, Iowa,
(hereinafter the City), enter into a contract with Holiday Wrecker Serv-
ice, Inc. for towing and storage service, a copy of which is attached to

STATEMENT OF QUALFICATIONS (See General Specifications, Competency of
Bidder, Paragraphs 5 and 6):
Holiday Wrecker Service, Inc. is located at 211 - 10th Street East in Coralville
Industrial Park. We have been in the towing business for over 18 years. We have
built our reputation on service and equipment. Out service, equipment and facilities
are second to none.
A member and founder of the T.R.P.I. (Towing and Recovery Professionals of Iowa)
and a member is good standing of the T.R.A.A. (Towing and Recovery Association of
America), Holiday prides itself on•the professionalism of our staff. We are dedicated
to improving our image, as we are continually updating our equipment and educating
our staff in the latest technology of the towing industry.
Holiday offers a wide range of specialized towing equipment, providing light and
heavy duty towing. From 1 -ton to larger heavy duty units. We also offer roll back
flatbeds, semi tractors, trailers, lowboys and hydraulic cranes. We also use for
loading situations, an endloader and bobcat. A car crusher is utilized to recycle un-
wanted vehicles. Equipment is inspected on a daily basis in order to insure maximum
efficiency, with safety equipment mandatory on all units.
Holiday owns storage facilities at three joint locations, which are more than
adequate to service this contract. Our facilities offer maximum security for.vehicles
stored inside or outside. An auction area is also provided for unclaimed vehicles.
Our equipment and experienced personnel are capable of handling all types of situ-
ations, emergency and non -emergency, at any given time.
Holiday is a financially sound and dependable company. We currently provide ser-
vice to all law enforcement agencies in the area, plus the private sector.
All personnel.and staff at Holiday are dedicated to the towing industry, this being
proven thru their everyday performance.

average charge for our service in towing a car is $42 and not $69 as

abandoned vehicles in accordance with the procedures of Section 321.89,
Code of Iowa,

GENERAL SPECIFICATIONS
FOR
VEHICLE TOWING SERVICE CONTRACT
SCOPE:
The City of Iowa City, Iowa, requests bid proposals for towing and storage
of vehicles impounded pursuant to Section 23-21 and Section 23-301 of the
Code of Ordinances of the City of Iowa City, Iowa, the disposition of
abandoned vehicles pursuant to Section 321.89 of the Code of Iowa; to-
gether with other such towing as may be designated by the City. The term
of the contract will commence on August 1, 1987, and will be for three (3)
years with an option to extend the contract an additional term of three
(3) years if both parties mutually agree in writing to such extension by
June 1, 1990, and the terms, conditions, and specifications of the con-
tract remain the same.
PURPOSE:
The specifications are designed to ensure prompt, adequate, reasonable,
and uniform cost for towing and storage services for the City and the
public at the request of the City. The contractor and its employees shall
be required to provide services authorized in the towing industry courte-
ously and with that attitude that their service is an extension of the
City Government, and that their dealings with the public shall be carried
out with the utmost respect for the citizens with whom they cone in con-
tact.
GENERAL:
Proposals will be considered only from firms regularly engaged in the
towing business and who can produce evidence that they have an
established, satisfactory record of performance for a period of one year
or more; have satisfactory financial support, required equipment and
organization sufficient to ensure that they can satisfactorily execute the
services if awarded a contract under the terms and conditions herein
stated. The term "equipment and organization" as used herein shall be
construed to mean a fully equipped and well-established company as deter-
mined by the City of Iowa City.
COMPETENCY OF BIDDERS:
1. Bidder must have all necessary State licenses and permits as may be
required to operate the type of requisite business. The Contractor
shall provide with this bid a current copy of the "Truck Operator
Freight Tariff Naming Local Commodity Rates for Wrecker Service Be-
tween Points in Iowa" filed with the Iowa Department of Transporta-
tion.
2. The bidder is presumed to be familiar with all laws, ordinances, rules
and regulations that may in any way affect the work. Ignorance on the
part of the bidder will in no way relieve the bidder from responsibil-
ity.

3. The bidder must provide a list of at least three (3) business refer-
ences including address, phone number and contact name. Preferably,
these references would include current contracts with other entities
similar in the requirements to the City of Iowa City.
4. An Award Committee will be established to review all the bids, bid-
der's facilities, equipment, etc., prior to the award of the contract
and make appropriate recommendations to the Purchasing Agent of the
City of Iowa City. Specific factors that will be considered by the
City include, but are not limited to:
A. Technical capability of the Contractor to accomplish the scope of
the work required in the Request for Proposal. This includes
holding all proper licenses, performance history on past and
current government or industrial contracts and responsiveness of
the Proposal in clearly stating an understanding of the work to be
done.
B. Demonstrated availability of the necessary manpower (both supervi-
sory and operational personnel) facilities and necessary equipment
to accomplish the scope of work in the Request for Proposal.
C. Financial capability of the Contractor to perform in accordance
with the proposal requirements, evidenced with financial position
and resources that assures the ability to complete the contract
and prices offered.

2. INDEMNIFY AND HOLD HARMLESS:
Contractor further agrees to indemnify the City and hold it harmless
against:
1) Any and all losses and liabilities for bodily injury, death, or
property damage arising out of, or as a consequence of, any work
performed under the contract;
2) Any and all expenses related to claims or lawsuits resulting from
the above, including court costs and attorney(s) fees; and
3) Any and all penalties and damages incurred by reason of contrac-
tor's failure to obtain any permit and license under, or comply
with any applicable laws, ordinances, or regulations.
3. PERFORMANCE BOND:
Contractor shall furnish the City of Iowa City a performance bond in
the amount of $2,500.00 payable to the City of Iowa City to insure the
faithful performance by the contractor of the terms and provisions
described below. Said performance bond shall be delivered to the City
within ten (10) working days following the award of any contract. Said
bond must be executed by a sure y—i company for recognized standing
authorized to do business in the State of Iowa and having a resident
agent in the State of Iowa. Said surety company shall hold a current
certificate of authority as an acceptable surety on federal bonds, in
accordance with the United States Treasury Department Circular No. 570
as currently revised.
The Performance Bond will be retained by the City during the term of
the contract and must be good for any extension(s) that may be subse-
o quentl approved or a new bond issued to the City to cover any exten-
sion(s� prior to the expiration of the old bond. A letter from your

any kind or nature whatsoever arising and/or growing out of the per-
formance of the services required by this contract.
4. EQUIPMENT:
A minimum of:
A. Four (4) Class A wreckers of 4 -ton capacity with truck GVW of
10,000 lbs., one (1) wrecker to be equipped with wheel lift.
B. One (1) Class C wrecker having 25 -ton pulling capacity with
extendable boon capacity of 25 tons or more. Vehicle must have
twin winches, air brakes with auxiliary air supply. The truck
must have a minimum of 25,000 lb. GVW;
C. One (1) car carrier with a minimum capacity of 10,000 GVW (Note:
May be included as part of A total);
0. One (1) set of motorcycle carrying straps for each Class A
wrecker.
The contractor will be required to have available at all times suffi-
cient equipment to perform all services required on a timely and
responsible basis. All equipment must be owned or exclusively leased
by the contractor. All equipment will be modern, commercially manu-
factured and in good mechanical condition and will be subject to
inspection at all times during the term of the contract. No vehicle
of the contractor shall be used as an emergency vehicle. The contrac-
tor agrees to have no markings on either vehicles, building or corre-
spondence that indicates or tends to indicate any official
relationship between the contractor and the City of Iowa City. All
towing vehicles must be equipped with two-way radios with a range —
extending to the Iowa City limits. Such radios will not be tuned to
any Police frequency.
The contractor further agrees that sufficient operable towing vehicles
and personnel will be available to adequately service the special
towing needs of the City occasioned by special events requiring tow-
ing including but not limited to declared emergencies or construction
projects, as advised by the Police Department, the City Manager's
Office or a ranking City official.
All wreckers shall be equipped with the necessary equipment to perform
emergency towing and recovery according to industry standards. All
Class A wreckers must have dollies. First-aid kits, brooms, shovels,
crowbar, and miscellaneous i shall comply with all laws, rules, and
regulations of any governmental agency having jurisdiction in the
premises including, but not limited to, licensing and minimum safety
requirements.

5. FACILITIES:

A
The contractor agrees to maintain .a business and storage facility
within the Iowa City/Coralville area, which storage area includes
reasonably secured short-term and long-term storage for 150 vehicles.
The facility must be accessible at a minimum of 8 a.m. to 8 p.m.,
seven days per week. The facility must have a reasonable business
appearance in accordance with applicable building and zoning regula-
tions and be owned or exclusively leased by the contractor.
The contractor will maintain a storage garage and/or outside storage
facilities complying with all provisions of applicable building and
zoning regulations sufficient to store all vehicles towed by him under
this contract until such vehicle(s) are claimed by the owner or other-
wise disposed of legally. Contractor's main storage area and outside
compound must be of not less than 150 vehicle capacity (meeting all
required specifications as outlined herein). Contractor must have
INSIDE storage capacity of not less than 1,000 square feet. Vehicles
which have been marked "HOLD" by the Police Department shall be stored
at such compound for whatever period of time necessary in order to
properly process the vehicle and any investigation involved. Person-
nel of the Police Department of the City shall be permitted access to
such vehicles at all reasonable times.
Storage facilities shall be subject to inspection and shall be ap-
proved by the City prior to the award of any contract. Storage fa-
cilities shall be subject to periodic inspections during the term of
the contract when deemed necessary by the Police Department of the
City. Notice of any discrepancies or deficiencies found by the Police
Department shall be submitted to the contractor in writing, and the
contractor shall remedy the same within five (5) days of receipt of
such notice. Upon failure of the contractor to remedy deficiencies,
the contract may be terminated at the option of the City.
Vehicles stored in enclosed area shall be stored under lock and key.
The contractor shall protect all stored vehicles and any evidence of
personal property contained therein from theft and damage in accor-
dance with all reasonable Police Department instructions and direc-
tives.
All outside storage facilities shall be enclosed with a solid wall or
a substantial wire fence not less than six (6) feet in height. Re-
quirements of fencing shall be fulfilled before aware of the bid. All
fences and walls shall be maintained in good repair throughout the
term of any contract awarded. Damage to such walls or fences shall be
repaired within 24 hours.
Special storage requirements necessitated by special events including
but not limited to declared emergencies or construction projects,
require the prior approval of the Police Department, the City Man-
ager's office or a ranking City official.

wise prohibited by law, for the acts of their employees while on

10. REPORT OF SERVICES:
The Agent agrees to keep an accurate record of all vehicles received
and disposed of under the terms of this Agreement. The City will
determine the sufficiency of the bookkeeping procedures. A report
upon request shall be sent to the City listing each car which was
impounded and its disposition during the requested period.

11. POSTING AND PROVIDING OF CHARGES:
The Contractor shall provide the City with a rate sheet, suitable for
posting, listing all current rates or fees for services to be pro-
vided, plus method of payment. Said rate sheets must be prominently
posted in the!Office of the Contractor herein. Schedule of fees (for
authorized towing) must be approved by the City Manager prior to
posting, and must be ,readily apparent and visible to the general
public. Any fee or change of charges may be made only on the anniver-
sary date of each year.
12. COLLECTIONS/CHARGES/AMENDMENTS:
The City of Iowa City will not be responsible for the collection or
payment of any charges for service rendered by reasons of its having
dispatched the service relative to subject contract unless such serv-
ice is applicable to City -owned or leased equipment. All such serv-
ices rendered shall be charged to the owner of the towed vehicle or
other lawful claimant of possession. However, charges relative to
towing of City -owned or leased vehicles will be forwarded monthly to
the City Accounting Department for payment and such invoices will
identify the vehicle towed, location from which towed, applicable
rates and/or hours and dates involved, and City vehicle number.
Any fee or change of charges may be made ONLY 30 days on or before the
anniversary date of each year to be negotiated and agreed upon by both
parties. Any modification to the contract will be made in the form of
an amendment, to be negotiated and agreed upon by both parties.
13 COMPENSATION:
In the case of the vehicles towed from public highways which are not
reclaimed, the City agrees to reimburse the Contractor for its actual
expenses of towing and storage of vehicles, not to exceed $35 per
vehicle for towing and not to exceed $3.00 per day for a maximum of 45
days for storage per vehicle. In addition, the Contractor shall be
reimbursed for the actual costlof the vehicle or $10 per vehicle,
. whichever is less. Actual expenses shall not include costs paid by
any reclaiming owner.

In the case of vehicles towed for accumulated parking violations, the
Contractor agrees that reimbursement shall be limited to the towing
and storage fees paid by the owners of the vehicles or the proceeds
from the disposition of abandoned vehicles.
14. IMPOUNDED VEHICLES:
Should any owner or person entitled to possession of an impounded
vehicle seek to reclaim the same from Contractor, Contractor shall
provide such owner or such person lawfully entitled to possession with
an itemized statement of all charges relating to the impounding of
such vehicle.
15. NOTIFICATION:
The City will notify, within ten (10) days by certified mail, the last
known registered owner or known lienholders at their last known ad-
dress, that the abandoned vehicle has been taken into custody.
If the identity of the last registered owner cannot be determined or
if the registration contains no address for the owner, the City shall
provide notice by publication.
16. RELEASE OF VEHICLES AND PERSONAL PROPERTY:
The Contractor agrees to release the vehicle to its owner upon au-
thorization from the city and the payment of towing and storage costs
by the owner. At the time of release, the Contractor shall provide
the owner with a receipt itemizing towing and storage costs. All
discrepancies and settlements are the responsibility of the owner and
the Contractor.
17. DISPOSAL OF VEHICLES:
The Contractor agrees to coordinate with the City to expeditiously
handle all procedures for the disposal of abandoned automobiles pursu-
ant to Section 321.89, Code of Iowa together with Rules 761 Chapter
480, Iowa Administrative Code, if the registered owner fails to re-
spond to the initial notice referred to as the ten day letter. This
procedure shall include all filing of reports with the State of Iowa
as well as prompt auctioning of any vehicle involved.
18. TERMINATION:

Either party may terminate this contract with a thirty (30) day writ-
ten notice.
Termination of this Agreement does not release the Contractor from the
responsibility of proper disposal of vehicles located at the storage
facility according to Section 321.89, of the Code of Iowa.

19. NON -EXCLUSIVENESS OF SERVICES:
The owner or person in possession of any vehicle which has been in-
volved in an accident or whose vehicle has been incapacitated in any
other manner shall be given the opportunity of contacting a wrecker or
tow truck company of his/her own choice if the disabled vehicle does
not create a hazardous condition and a reasonable response time can be
expected. Said person shall further be given the opportunity of
having such vehicle towed to a garage or compound other than that of
the contractor.
20. SERVICE:
The Contractor will furnish towing service for the removal of vehicles
as defined in this document and/or storage space for said vehicles
when required by the City of Iowa City whenever such services are
dispatched or required by the City's Police Department, or in the case
of City -owned or leased vehicles, dispatched by either the Police
Department, or other authorized representative of the City. Such
service shall be available on a 24-hour basis year-round.
Should the Contractor receive a call beyond his "immediate capacity"
to handle, he may call another qualified operator, hereinafter consid-
ered a subcontractor, to supplement his service in towing only. It
will be the responsibility of the contractor to only employ subcon-
tractors who meet the same required criteria as the contractor, i.e.,
as to equipment, personnel, insurance, etc.
"Immediate capacity" shall be defined as circumstance involving natu-
ral disasters, multiple accident scene, above and beyond unusual
inclement weather conditions, and/or when the contractor's equipment
has been fully extended ork service for the City of Iowa City. In such
cases, the Police Department dispatcher shall be so advised at the
time of the call.
21. CLEAN-UP:
The Contractor when towing vehicle(s) from the scene of an accident,
will be responsible for removing from the street all broken glass and
other matter that may be in the street as a result of the accident.
22. COMPANIES AND OTHER INTERESTS:
If the Contractor has any interest in an automobile or truck body
repair, paint shop, salvage or recycling business, he will submit with
his bid proposal a listing of the shops in which he holds an interest.
Contractor will submit, and keep current, such information to the City
in writing and the failure to do so may result in the immediate termi-
nation of this towing contract.
23. COMPLIANCE WITH LOCAL, STATE AND FEDERAL LAWS:
Contractor shall comply with all applicable local, State and Federal
laws.

24. NON -ASSIGNABILITY AND SHAREHOLDERS:
This Agreement shall be binding upon the successors and assigns of the
parties hereto; provided, however, that no assignment shall be made
without the written consent of the parties to this Agreement.
25. NON-DISCRIMINATION:
The Contractor agrees not to commit the following practices:

26. ADDITIONAL CONTRACTOR'S RESPONSIBILITY:

out in these specifications will be the responsibility of the Contrac-
tor and must be all inclusive in the charges as bid herein.

A. Show Up Fee
This fee will be charged to the customer if he or
she decides that service is not needed after Truck
has arrived. This fee is $20.00.
B. Towing service for autos and light trucks (under
one (1) ton)
(1) The fee for a standard tow of a vehicle within
the Iowa City-Coralville city limits will be Thirty
(30) dollars.
(2) The fee for a wheel lift tow within the Iowa
City-Coralville city limits will be Forty (40) dollars.
C. Winching Fee
This fee applies any time a vehicle needs to be winched
before further movement. This fee is Forty (40) dollars
per hour with a one half (]/2) hour minimum.
D. Flatbed Service
On request, a flatbed will be provided for a fee of
Fifty (50) dollars plus Thirty (30) dollars per man
for any extra labor involved in loading badly damaged
vehicles, with a one quarter (1/4) hour minimum.
E. Out of Town
Any out-of-town miles will be charged at normal towing
rates for the tow plus one dollar and fifty cents (1.50)
per mile out of the city limits.

Any tows requiring dollies will add Twenty (20) dollars
per tow.

The fee for a Class C 25 Ton Wrecker within the
Iowa City-Coralville city limits will be Seventy-
five (75) dollars per hour.
B. Out of Town Miles

III. Miscellaneous
A. Labor
Any labor other than normal will be charged at
Thirty (30) dollars per hour, per man, in quarter
(1/4) hour increments. This service includes clean-
ing up loose parts, sweeping up glass, or any work
that needs to be done before a vehicle can be towed.

WHEREAS, the City of Iowa City has undertaken a project to widen the West
Benton STreet bridge spanning the Iowa River and has been negotiating to
acquire certain parcels and easements located immediately north and south of
West Benton Street on the east side of the Iowa River; and
WHEREAS, pursuant to negotiations with the property owner of the subject
properties, Cedar Rapids and Iowa City Railroad, and pursuant to further
review by City appraisers, it has been determined that the offers heretofore
made by the City for acquisition of certain parcels and easements should be
increased, and compensation offered for other damages occasioned by said
acquisitions.

A SPUR TRACK IN AND ADJACENT TO THE RAILROAD CROSSING AT CLINTON
STREET IN AND NEAR LAFAYETTE STREET IN IOWA CITY, ALL IN CONJUNCTION

WHEREAS, the City of Iowa City has undertaken a project to widen the Benton
Street bridge spanning the Iowa River (the West Benton Street Bridge Improve-
ment Project, hereinafter "the Project"), pursuant to which Project the
pavement, sidewalks and other associated public improvements on Benton Street
between the bridge and Capitol Street must be reconstructed in order to
facilitate the new bridge configuration; and
WHEREAS, said Railroad crosses Benton Street with the trackage for said
crossing and associated crossing signals located between the bridge and
Capitol Street, which crossing lies within the boundaries of the Project; and
WHEREAS, in order to accommodate the City's bridge widening project, it has
been proposed that the City and the Railroad (1) agree to the removal of the
railroad crossing on Benton Street west of Capitol Street, (2) agree to the
removal of certain storage tracks located in the expanded Benton Street
right-of-way west of Capitol Street, and (3) agree to the construction,
reconstruction and/or realignment of the existing crossings of Clinton Street
in or near LaFayette Street; and
WHEREAS, an Agreement for Removal or Realignment of Certain Railroad Crossing
Tracks, Spur Tracks, and Storage Tracks has been negotiated and prepared for
execution by the parties.
NOW, THEREFORE, BE, AND IT IS HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY
OF IOWA CITY, IOWA, that the Agreement for Removal or Realignment of Certain
Railroad Crossing Track, Spur Tracks and Crossing Tracks, attached hereto and

Re: Standardization of City Procedures for Setting Fees
Introduction:
On the Council agenda for the Tuesday, August 25 -meeting there will appear a
package of ten ordinances and three resolutions relating to City fees. The
primary purpose of this legislation is to increase the amount of a number of
City fees. However, another purpose of that legislation is to standardize the
way in which the City sets (i.e. adjusts the amounts of) City fees. In this
memo, I will explain wFa—F'we are proposing with regard to standardization of
the way in which fees are set.
Discussion:
The City's current practice regarding the establishment and setting of fees
is somewhat diverse. Most of our fees are established (authorized) by ordi-
nance in a specific chapter of the City Code, but a few have been estab-
lished only by resolution. Some of the fees established by ordinance are set
by ordinance, while others are set by resolution. Fees that have been estab-
lished by resolution are also set by resolution.
This situation does create somewhat of a problem in making an annual effort
to review and adjust fees, in that it requires the preparation and enactment
of many resolutions and ordinances in order to adjust all or even a majority
of the fees. Speaking from experience, a great deal of staff time is taken
to assemble the necessary data concerning current fees, and then to draft new
ordinances and resolutions repealing and rescinding prior ordinances and
resolutions, in order to enact new fee amounts.
Finally, as I indicated in a prior memo, the Iowa Code does require that fees
for certain City services (utilities and enterprises) be established and set
by ordinance.
The proposed package of legislation would serve to accomplish a number of
things. First of all, the proposed ordinances would serve to establish
(provide Council authorization for) all City fees in the City Code. Sec-
ondly, the proposed legislation would establish two methods for setting the
amounts of City fees. As with a number of other fees, the fees for beer and
wine permittees and for liquor licenses, for peddlers' and solicitors' li-
censes, and for taxicab operators would be set by resolution. Fees for solid
waste services, fees for parking and fines for parking violations, transit
system fares and fees, and utility fees and charges (sewer and water) would
be set by ordinance, as required by the Iowa Code.

Fees which are to be set by ordinance will be listed in a Schedule of Fees,
which will be found in Chapter 32.1 of the City Code, "Taxation and Reve-
nues, in a new article, Article IV. Ultimately, it is our goal that the
annual effort to review and adjust fees can be accomplished in two steps: (1)
the adoption of a single resolution adjusting the amounts of the fees set by
resolution, and (2) the adoption of a single ordinance amending Chapter 32.1
of the Code, Article IV, adjusting the amounts of the fees set by ordinance.
Recommendation:
The City Finance Department would like to be in a position to implement a
number of fee increases along with the September billing cycle. In order to
do that, the ordinances and resolutions subject hereof would have to be
adopted no later than the September 8 Council meeting. Consequently, staff
is recommending that Council give first consideration to the ordinances at
the August 25 meeting, and then waive second consideration, give third con-
sideration and pass the ordinances into law at the September 8 meeting. The
resolutions have been included in the packet for August 25, but action
thereon should be deferred until the appropriate ordinances have been adopted
on September B.

amounts therein stated are inaccurate in that the State has increased those
fees; and
