ITEM NO. 4 - PLANNING AND ZONING NATTERS
a. Consider setting a public hearing for September 29,
1987, on an ordinance to vacate the north -south alley
between Davenport and Bloomington Streets, east of Reno
Street. (V-8703)
Comment: At its September 3, 1987, meeting, the Plan-
ning and Zoning Commission will consider and forward a
recommendation to Council concerning the City -initiated
request to vacate the alley described above. Informa-
tion about this request for vacation is contained in
the September 3, 1987, staff report to the Planning and
Zoning Commission. The applicant and staff request
expedited action on this matter. Staff recommends
vacation and disposition of the alley.

b. Consider a resolution to set a public hearingftf�or the
disposition of the north -south alley between Davenport
�7•a it Street and Bloomington Street, east of Reno Street and
west of Hickory Hill Park.
Comment: This 16 -foot wide alley right-of-way consists
of a 10 -foot wide strip of gravel and numerous trees
and bushes which restrict travel and visibility. This
alley is adjacent to six properties, including the
Nicholas Peet residence at 1225 East Davenport Street.
The Peets are the only property owners using the alley
for garage access. This alley is not needed to provide
public access. The Peets have stated that this alley
poses a traffic problem in that (1) it is frequently
used as a shortcut from Bloomington Street to Davenport
Street, (2) numerous vehicles recklessly travel through
the alley at high speeds, creating a safety hazard, (3)
said vehicles create a serious noise disturbance to
adjacent property owners. The Peets have submitted a
request to purchase this alley and have agreed to pay
$500 for the acquisition of the entire alley. In turn,
the adjacent property owners have agreed to accept
title by quit claim deed to half that portion of the
alley abutting their property. A public utility ease-
ment should be reserved over the entire alley. Please
refer to the location map attached.

Public hearing on a resolution authorizing the Mayor to
sign an agreement between Coralville and Iowa City
regarding annexation and subdivision review.
Comment: In June of 1986, an agreement between Coral-
ville and Iowa City prescribing the limits of annexa-
tion for each City expired. An amended agreement is
proposed which sets the same limits for annexation,
but, requires the inclusion of Iowa City's findings in
the subdivision approval for any subdivision which is
located in Coralville's statutory extraterritorial
jurisdiction and in Iowa City's agreed area of annexa-
tion. The Coralville City Council will consider this
agreement at its September 22 meeting. The staff
recommends that the public hearing be continued to
September 29, 1987.

d. Public hearing on an ordinance to amend Section
36-23(c) of the Zoning Ordinance to permit light manu-
facturing, compounding, assembly or treatment of arti-
cles as a provisional use in the CI -1 zone.
Comment: The proposed amendment will permit light
manufacturing, compounding, assembly and treatment of
articles as a provisional use in the CI -1, Intensive
Commercial Zone, provided that the floor area for each
occupant engaged in these uses shall not exceed 5,000
square feet. The Planning and Zoning Commission recom-
mended approval of this amendment by a vote of 3-2
(Scott and Cooper voting no) at their August 20, 1987,
meeting. Expedited action is requested in response to
inquiries regarding the availability of buildings for
economic development.

Zoning ordinance to permit light manufacturing, com-

f. Consider a resolution approving the preliminary plat of
Prairie View Estates, Part Two, a county subdivision
located immediately north of I-80 and east of Prairie
du Chien Road. (5-8717)
Comment: At its August 20, 1987, meeting, the Planning
and Zoning Commission recommended, by a vote of 5-0, to
approve the preliminary plat of Prairie View Estates,
Part 2, subject to the submission of the required legal
papers providing for the future improvement of the
north and east ends of Devon Drive and stipulating that
Devon Drive shall remain open to the public and acces-
sible to adjacent properties to provide for its con
-
tinuation. The legal papers have been submitted and
are currently under review by the Legal Department. The
Commission's recommendation is consistent with that of
staff included in a report dated August 20, 1987.

Consider a resolution approving the amended preliminary

plat of Dean Oakes Second Addition. (5-8718)
Comment: On June 1, 1987, Council approved the pre-
liminary plat of Dean Oakes Second Addition, a 14 lot,
single-family residential subdivision located north and
west of Quincent Street extended. The developer has
redesigned the configuration of lots along the west
side of the proposed alignment of Quincent Street
resulting in a subdivision of 17 lots. On August 20,
1987, the Planning and Zoning Commission recommended,
by a vote of 5-0, approval of the amended preliminary
plat of Dean Oakes Second Addition. This recommenda-
tion is consistent with that of staff included in a
report dated August 20, 1987.

h. Consider a recommendation of the Planning and Zoning
Commission concerning a request submitted by Rapid
Creek Farms Partnership to rezone 141 acres located
east of Highway 1, approximately 1.5 miles north of
Iowa City from A-1 (Rural) to RS (Suburban Residen-
tial). (CZ -8711)
Comment: At its August 20, 1987, meeting, the Planning
and Zoning Commission, by a vote of 5-0, recommended
that a request to rezone the 141 acre tract from A-1 to
RS be approved. The tract is located within Area 4 of
the Johnson CountylIowa City Fringe Area Policy Agree-
ment. The Commission found that this request is con-
sistent with the recently amended development policy
for that portion of Area 4 located east of Highway 1
and north of Iowa City corporate limits. This recom-
mendation is generally consistent with that of staff
included in memoranda dated June 18, 1987 and August 6,

ITEM MO. 5 - PUBLIC HEARING ON PLANS, SPECIFICATIONS, FORM OF CONTRACT
AND ESTIMATED COST FOR THE CONSTRUCTION OF THE EXCESS FLOW
TREATMENT SYSTEM AT THE EXISTING WASTEWATER TREATMENT
FACILITY.
Comment: This project will involve the construction of a
16 million gallon per day wastewater treatment facility at
the existing wastewater treatment plant site. Final cost
estimates will be provided by the Project Manager prior to
the Council meeting. 1

ITEM NO. 12 - RECOM$ENDATIONS FROM BOARDS AND COMMISSIONS.
a. The Committee on Community Needs recommends that the
City Council allocate funds from the $69,000 received
from the sale of Parcels A-2 and A-3 in the Lower
Ralston Creek Redevelopment area as follows: $25,000
grant to the Handicare Pocket Park Project; $26,000 to
the Crisis Center/Food Bank Facility in the divided
form of a $13,000 grant and a $13,000 no -interest loan;
and the remaining $18,000 to be carried over to the
1988 CDBG Program Year.
Comment: At their August 18, 1987 meeting, CCN re-
viewed requests for proposals on the use of the $69,000
received from the sale of properties located in the
Lower Ralston Creek Redevelopment area. Crisis Center
presented a request for funding to complete the neces-
sary construction requirements to occupy their newly
acquired building. If Council approves this funding
recommendation, an amendment to the original Crisis
Center agreement will be submitted to Council at .a
later date for their approval. Handicare Inc. pre-
sented a request for funding to complete the Handicare
Pocket Park Development Project. Please refer to item
H3 -e(1). A more detailed discussion of the requests
and the CCN's recommendation is contained in the August
18, 1987, CCN minutes, a copy of which is included as
agenda item 3-b(4).

Comment: Luana J. Hunter received a Forgivable Loan in
August 1983 through the City's Housing Rehabilitation
Program in the amount of $7,800.00. The City has received
a doctor's verification that Luana J. Hunter has an
incapacitating illness, and should no longer reside in her
residence. Mrs. Hunter has accepted an offer on the prop-
erty with the closing scheduled mid-September 1987. The
lien needs to be released so the new owner can have clear
title.

Chapter 5. Under the proposed amendment, those fees would
continue to be authorized in Chapter 5, but the amounts of

Comment: In addition to changing the way in which the
various parking fees and penalties are to be set, this
ordinance amends Section 23-249 of the Code to change the
City's procedures with regard to the reservation of metered
parking spaces by construction contractors. Currently, the
City has the responsibility to remove vehicles illegaYly
parked in such spaces, and has the liability attendant to
that function. Under the proposed amendment, the contrac-
tor reserving the space would be responsible for proper
signage of the meter space and for removing unauthorized
vehicles, and would be required to agree to accept liabil-
ity for proper signage and for such removals.

Comment: The only provisions of the Code of Ordinances
which deal with public transportation are currently found
in Chapter 2. The fares for public transit service are not
currently authorized or set in the Code, and it would not
be appropriate to do so in Chapter 2, since that chapter is
reserved primarily for outlining the City's administrative
service. Staff is therefore recommending that Article XI
of Chapter 2, entitled "Department of Public Transporta-
tion," be repealed, and that a new chapter, Chapter 30,
entitled "Public Transportation," be enacted in its place.
Item 26 is the ordinance repealing Article XI of Chapter 2,
and Item 27 is the ordinance enacting the new Chapter 30.
Chapter 30 would provide for the administration of the
Department of Public Transportation, would provide for
certain regulations and prohibitions in the provision of
Public transportation services, would provide that public
transit fares be set in the amounts provided in the Sched-
ule of Fees, Chapter 32.1, Article IV, of the Code, and
would authorize the City Manager to enter into agreements
for use of Public Transportation Department facilities,
equipment, and {operators.
