And then when March 1 appears, who knows what may happen when Gramm-Rudman goes into effect? We have'people on waiting lists even tho our bottom income level is wgy below the poverty level. In particular, I am interested in the alley paving project between Dodge and Johnson Streets south of Bowery. I represent James and Loretta Clark who own a multi -family residential building which uses this alley as access to its parking lot. For many, many months we have been interested in and working toward having the alley hard surfaced. This alley is lined with multi -family residential housing. Most of these properties have their only access to the parking lots from this alley. The fashion in which they were constructed prohibits access off of either Johnson or Dodge Streets. This alley becomes nearly impassable in times of wet weather and chuckholes a foot deep, five feet wide and five feet long are not at all uncommon. This presents a major inconvenience and problem for the tenants. The bulk of this alley is a type of no man's land. Around the turn of the century, deeds to properties in the area began leaving a twenty -foot no man's land in the center of the block. This was apparently a crude attempt to create a public alley. There has never been a dedication or formal conveyance to the city of most of the alley. 9 j 4 I Mayor and City Council January 23, 1966 Page 2 While this area was comprised of single-family residences, the alley was not as heavily used and not subject to the extreme rutting which is now a problem. The multi -family uses have dramatically increased the vehicular traffic and caused problems for both owners and tenants. Personally, and on behalf of the Clarks, applaud the city's efforts to pave this alley. The Clarks are more than willing to make a contribution through a special assessment to having the alley paved. I have personally spoken with a number of other owners along the alley who are similarly willing to accept a special assessment to improve the entire area. I also know that there are several owners in this area which will give quit claims to the city to help in the creation of a truly public alley. In the past, I have spoken with Frank Farmer, City Engineer, and Assistant City Attorney Richard Boyle regarding this alley. I have volunteered my services to help the city understand the legal status of the alley and to negotiate with adjoining owners to obtain conveyances to the city. I have communicated with all of the owners in this area in the past and am willing to continue to do so if I may be of help to the city in furthering this project. I urge you to give favorable consideration to pursuing this paving project as speedily as possible. At the present time we cannot extend service to your area. Sunrise Mobile Home Village is outside the city limits, and sufficient funding is not available even for expansion of services within the city limits. The lingering possibility of transit service reductions within the City would preclude any expansion to service unincorporated areas at this time. To extend the route beyond Bon Aire would require adding at least one bus. At this time there is not enough time on the Lakeside/Mark IV route to allow for additional service area coverage. This is next to 601 Granada Court, the property of Mr. and Mrs. Richard Breazeale. Over the years we have been painfully aware of the severe problems of drainage of storm water and trash in this area. The problem has been most severe in the property of our neighbors but has also affected US. Not only is there a most unsightly flooding of the lower lying properties, but there is considerable damage to lawns, public sidewalks and ice build-up during winter. The tatter brings an attending increased risk for the public, for the property owners and even for the city. My neighbors have called attention to this problem on numerous times and we were gratified to see that the city recognized the issue and commissioned an appropriate study. Let me urge you to consider seriously the best possible recommendation from that study, and to do so with such a priority that it will be indeed possible to remediate this problem. The following our response to that report dated To provide some background, we purchased our house in 1970, when it was four years old. We were advised that an official city drainage ditch ran along the south side of our house and thus expected to have water flow along that ditch during heavy rains. We were not, however, prepared for what actually happened. With moderate to heavy rains we found that the flow of water was uncontrolled, flooding large parts of our back yard (after flowing through the back yards of 601 and 605 Granada Court) and continuing to flow past our house to properties on the north and west. At times, we recall that the basements at 700 Manor Drive and 601 Granada Court were flooded, and we believe that others were flooded, as well. We are unsure as to what determined when the water flowed in such a way as to flood those basements, but the flow has been variable and thus uncontrolled. Note that none of this water is in an official drainage ditch. We were advised by our attorney that any action on our part to control the flow of water could make us responsible for future damage caused by the flooding. Some time after we bought our house we learned that what, in fact, happens is the city collects water from a substantial area of Manville Heights and dumps it on a hillside to run down into Parkview Terrace. Over the years we have come to understand that the City's view is that they have no obligation to control or to correct the ensuing problems. This came as a surprise to us: it had previously been our expectation that the City acts honorably, in the sense that, if they allow an area to be developed, they ensure a competent level of city services. Instead, the position appears to be that Parkview Terrace was developed with this problem and that, therefore, the City has no responsibility. This attitude is implied in the Engineering Division's second paragraph, which states that the problem existed prior to construction of the house at 601 Granada Court. We wonder what City services would ever be provided if this attitude were implemented across the board? The Ralston Creek project is a current salient instance of the City correcting a pre-existing problem. Thus, the attitude expressed appears to be a way of ignoring the problem, rather than a statement of a consistently Implemented City policy. There are two aspects of the Engineering Division memo that require comment. Neal Berlin January 19, 1986 Page 2 been no development in this watershed since the house was constructed at 601 Granada Court. Since we moved here in 1970 (after 601 Granada Court was constructed), we know of at least two houses constructed in the watershed. Both of these houses are located adjacent to Park Road, where the previously vacant land was available to absorb considerable ground water prior to its reaching Park Road. It was our impression that the problems with the water became more severe with this infill construction. Second, the report fails to discuss various other undesirable aspects of the uncontrolled dumping of water from Manville Heights into Parkview Terrace: I. At present, a considerable portion of the water flows between the houses at 601 and 605 Granada Court and then follows a path along the public sidewalk until it reaches the driveway at 605 Granada Court. As a result of this water flow, not only are there incredible deposits in the backyard of 601 Granada Court but the sidewalk in front of 605 Granada Court deteriorates more rapidly. 2. The drainage ditch forms a large pool of water between our property and 605 Granada Court, which has attracted children to run and jump or slide into this small pool. The drainage ditch is, in effect, an attractive nuisance, carrying a risk of injury to children. (It should be noted that sediment deposits have filled into parts of this ditch, making it shallower, broader, and less effective for its stated purpose.) 3. The City made no provision for the drainage ditch south of our house to carry water to the street--i.e., the ditch ends at the sidewalk. From here, the flow of water is uncontrolled and a portion of it runs beneath the sidewalk. The subsequent erosion of the sail beneath the sidewalk has caused the sidewalk to break and to settle unevenly. We have tried to fill this cavity beneath the sidewalk with soil but have been unable to keep up with the erosion. We have had to pay for repairs to the sidewalk. 4. As a result of the problem just described, in winter we are unable to keep the sidewalk free of ice, since a portion of the drainage water flows on top of the sidewalk during a thaw or rain. 5. We have followed trash flow from Park Road to its settling point in yards on Granada Court (especially 601's yard). This observation highlights the possibility of unsanitary and/or unhealthy deposits in yards where children play. 6. The uncontrolled flooding of our back yard deprives us of the opportunity to develop and use it as we would like. In addition to these immediate consequences of the flooding from Manville Heights, there is a related and continuing problem at the intersection of Granada Court and Manor Drive. There is a large depression in the street at this intersection which, combined with the absence of a storm sewer inlet at this point, causes standing water much of the year and a large area of rough ice in the winter. Again, we have seen children playing in this water in the summer, and it represents a hazard to drivers and pedestrians alike in the winter. Additionally, the necessity of driving through this (sometimes salty) water to reach our home promotes rust. We mention this problem because it would be eliminated by proposal 3 in the report. There is a comment in the report that solving this problem benefits only a limited number of residents: We do not see it that way. The water comes from IO.B acres in Manville Heights, involving a large number of residents, and it affects 6-12 residents in Parkview Terrace to varying degrees. This brings us to the problem of distributing the costs. As we understand the politics, it would be hard to assess a small number of residents for the cost of any of the options, especially the more desirable options 2 and 3. To us, the obvious solution is to distribute this cost among all affected residents, including especially those whose water creates the problem in the first place. Our view is that option number 3 is the best and most equitable option, since it would generally improve the drainage problem in the broad area and would distribute the cost among an even larger group of residents. In the event that there are those who do not agree with us that this is a Manville Heights problem, we propose a fourth option. Close off the three water intakes at Park Road and Magowan and adapt the curb so that no water flows down the hill to Parkview Terrace but, instead, all of it flows west along the surface of Park Road. This is surely less expensive than the other options and would keep the water closer to its point of origin. Once that was done, we suspect that it would be viewed as a larger problem, not one affecting only a few residents in Parkview Terrace. To summarize our major point, the notion that the City has a controlled water flow through an official drainage ditch is a myth. The flow of water has been uncontrolled and the City has done nothing to correct the subsequent problems. In addition, there is a small but nevertheless significant risk of injury to children, icing of public sidewalks, and damage to private property from this uncontrolled flow of water for some 20 years. Given that the neighborhoods involved are affluent, it surely would work no real hardship on the residents to correct this problem. MY classroom serves seventh through twelveth grade students with behavior disablities in the Iowa City School District and many of the smaller school districts in Johnson County. Adolescents who fall within this category traditionally exhibit low self-esteem and lack many of the appropriate good -worker qualities, thus making job -seeking and/or job -keeping very difficult. In the five years that I have been involved with the Mayor's Youth Employment program I have been impressed with the wide variety Of Jobs available , as well as the manner, In which the program works with the schools thus encouraging improved school attendance and improved school behaviors. He subsequently moved it to the 200 block of First Street and set it on the street. It has remained there since March 1985. I have repeatedly asked the building department and more recently the legal department to please have it moved. Their response has been that they cannot do anything.' Apparently Mr. Yocum has Mr. Berlin's staff completely intimidated. I£ any other private citizen had parked a building in one of the city's streets, I can assure you it would be long gone by now. The location of the building on First Street is such that it makes it impossible for the police to..patrol and check the Nagle Lumber Co. from the north. We have recently experienced some inventory shortages due to the fact the police cannot patrol adequately. The building also represents a serious fire hazard to the Nagle Lumber Co. and encourages vandalism. Washington Iowa City, Iowa 52240 Dear Bill, T Having just completed two terms as the chair of the Senior Center Commission I believe that I have particular insight into the role volunteers play at the Senior Center. Since I took my job very seriously I spent innumerable hours at the Senior Center - not only at scheduled meetings, but at'planning meetings, at Senior Center activities as a participant and as a representative of the advisory board at City and County functions. With all those hours I spent I was always very conscious of the difference between a volunteer and staff. I was there when it was con- venient for me and I did only that which either gave me pleasure or which I deemed important. The joy of being a volunteer is that you look at each task as an opportunity to add something to your own life whether that is a new skill, a friendship, or a chance to contribute talents and abilities you already possess. Thus I've used my administrative abilities as a Commissioner and as a member of the Nutrition Advisory Board. I've taken advantage of the chance to learn new skills as a member of the editorial board of the Senior Center POST, as a reporter and as a member of the paste-up team. And my enjoyment of serving the public in a direct one-on-one manner has been enhanced by my work as a server on the Congregate Meal food line. Only a person who does not volunteer at the Senior Center would imagine that people are slotted into jobs that are contrary to their tastes or inclination. In fact, the contrary is more to -the point. The painstaking procedure used by the Center to find a task which does'not superficially match the job just to the skill, but rather the job to the interest and need of the volunteer is truly impressive. Volunteering at the Senior Center is a highly satisfactory experience. The exhibits have made the meeting room a much more interesting area. When there is no exhibit up, people complain about the lack and note that the room looks so cold and dull. These exhibits are also proving to be a valuable learning experience - for many people who have never thought about art as a vita' an necessary part of living. They are learning that there ars as many approaches to visual experiences as there are people. They are learning to become more tolerant and understanding of new and varied approaches to the visual'interpretations of creative experiences. So r feel that 7 am making a contribution to the Senior Center, using my background and work experience as an artist and art professor. Needless to Bay, I am also being rewarded by being given the opportunity to get busy to do something myself. I am sure that if there were a coordinator 6f volunteers, we could explore more areae of creativity and perhaps find and so - courage more people who are painters and craftspersons. The exhibits have made the meeting room a much more interesting area. When there is no exhibit up, people complain about the lack and note that the room looks so cold and dull. These exhibits are also proving to be a valuable learning experience - for many people who have never thought about art as a vita' an necessary part of living. They are learning that there ars as many approaches to visual experiences as there are people. They are learning to become more tolerant and understanding of new and varied approaches to the visual'interpretations of creative experiences. So r feel that 7 am making a contribution to the Senior Center, using my background and work experience as an artist and art professor. Needless to Bay, I am also being rewarded by being given the opportunity to get busy to do something myself. I am sure that if there were a coordinator 6f volunteers, we could explore more areae of creativity and perhaps find and so - courage more people who are painters and craftspersons. Parking on Woodside Drive As directed by Section 23-16 of the Municipal Code of Iowa City, this is to advise you of the following action: ACTION: Pursuant to Section 23-234 of the Municipal Code of Iowa City, the City Traffic Engineer will direct the installation of NO PARKING CORNER TO HERE on the southeast side of Woodside Drive from its intersection with Wood- side Place to the point 60 feet northeast of the intersection. This action will take place on or shortly after February 18, 1986. COMMENT: This prohibition will eliminate one parking place on the southeast side of Woodside Drive.
