Setting Public Hearings. (1) Consider motion setting public hearing on March 25, 1986, on applications for four (4) units Section 8 Existing Housing Vouchers. Comment: An application for Section 8 Existing Housing will be submitted for approval for four units to be utilized in conjunction with the Rental Rehabilitation Program. This is in re- sponse to an Invitation from Department of Housing and Urban Development dated February 10, 1986. Section 403A.28requires that notice of Public Hearing be published at least 15 days prior to date set for hearing. Since the application must be submitted as soon as possible;' it is requestedthat the application.•....... (2) Consider motion to approve disbursements in the amount of $2,875,399.26 for the period of January 1 thru January 31, 1986, as recommended by the Finance Director, subject to audit. f. Correspondence. (1) Letter from the City Manager regarding his depar- ture from Iowa City. (2) Petition signed by 500 people (residents of Iowa City and non-residents) requesting that an ice skating rink be built in the lot adjacent to the Holiday Inn. Consider setting a public hearing4on an amendment to the zoning ordinance to revise the definition of monu- ment signs and to permit monument signs in the CB -10 zone. Comment: On February 6, 1986, the Planning and Zoning Commission recommended by a vote of 6-0, approval of an amendment to clarify the definition of monument signs as it applies to all zones, and provide greater flexi- bility when specifying the intended sign height and area of monument signs in the CB -10 zone. Consider an ordinance to amend the zoning ordinance pertaining to the location requirements of signs lo- cated in the triangular area at street intersections. (first consideration) Comment: On January 15, 1986, the Planning and Zoning Commission recommended by a vote of 7-0, approval of an amendment to delete the triangular area setback re- quirement at street intersections in those zones not requiring a minimum front yard. This recommendation is consistent with that of staff. Both Commission and staff found the rationale for prohibiting sign place- ment on private property at street intersections was not appropriate in those zones not requiring a minimum front yard. Consider an ordinance to amend the zoning ordinance concerning' the grace'•period and nonconforming roomers in the RS -5, RS -8, RS -12 and RM -12 zones. (second consideration) Comment: At its meeting of December 19, 1985, the Planning and Zoning Commission recommended approval of this amendment by a vote of 7-0. The amendment clari- fies the intent of the special provisions subsections of those zones with regard to the grace period and its applicability to illegal uses. Consider an ordinance to amend the zoning ordinance to incorporate the City's current sewage and industrial waste control regulations by reference. (second con- sideration) Comment: At its meeting of December 19, 1985, the Planning and Zoning Commission recommended by a vote of 7-0 approval of an amendment to delete the City's sewage discharge requirements from the zoning ordinance and replace them with language referencing appropriate sections of the Code of Ordinances. The purpose of the amendment is to eliminate duplication and ambiguities by placing the City's sewage discharge regulations in one part of the Code of Ordinances. A public hearing was held January 28, 1986; no comments were received. Action: 07 e ,� cz,47`/ g6 -3ap/ e. Consider an ordinance to rezone 2.10 acres located west of Old Highway 218, south of Eagle's parking lot and " north: of Ernest : Street .. from CC -2 to ' P. (Z-8508)' ? (second consideration) Comment: At a meeting held December 19, 1985, the Planning and Zoning Commission recommended, by a vote of 6-1 (Jordan voting no) approval of the 2.10 acre rezoning from CC -2 to P. The Iowa City Community School District recently acquired the property to be used by the construction education classes. The zoning, ordinance states that all land owned and/or acquired by a governmental entity, including the school district, should be rezoned to the Public Zone. Consider a recommendation of the Planning and Zoning Commission on the rezoning of 5.2 acres in the County from C-1 to C-2. (See C48603). Comment: By a vote of 6-0 the Planning and Zoning Commission recommended at its February 6, 1986, meet- ing, that the City Council submit a finding to the Johnson County Board of Supervisors that the requested rezoning of 5.2 acres located north of I-80 and west of Dubuque Street is inconsistent with the policy for Area 2 of the Fringe Area Policy Agreement. This recommen- dation is consistent with that of staff as noted in the attached memorandum dated January 30, 1986. I'm here to ask you to ask you to stop spending it. I represent a group of concerned taxpayers. They're concerned that... This City is heading straight for where the federal government is and where the state government is. Strait: Are you going to identify those taxpayers? Poula: ...hired anonymously... but there is nothing sinister...they are friends and neighbors... during this time of presentation ... cannot cover many areas of concern this group has...the airport will take some of my time simply as an example and I want you to know where I'm going when I'm done with the airport. There is some specific areas I will cover both in terms of capital expenditures and departmental issues. ...Want to make clear..no personal attack intended by me and my people on any person in the City, any departments or any person- nel... if going to discuss budget specifics we have to discuss some- thing specific... pg. 257 of your budget - not sure anybody brought it - George do you have yours? - pg. 257 airport budget... it's my under- standing over $800,000 worth of bonds have been sold to extend the runway...am I correct on that... was asked to ask Council what's going to be the source of repayment of that and what is its cost. Zuber: FAA funds if they get back into compliance... 90% - is that right John? - 90% cost would be covered by FAA. McDonald: That would be future... future projects - as far as ... bonds that have been sold - no - that would not be repair by the FAA. Poula: Bonds would be paid by taxpayers - ok - on any future projects, is there any thought by Council to put up a or referen- dum like I understand you've done with the Mercer Park Swimming Pool ... has this been discussed among Council? Ambrisco: Have something specific in mind? Poula: No...on future airport projects - limited airport projects - my understanding from reviewing your budget is that the enterprise department of the City is normally self-supporting. For example, Parking breaks even, Pollution Control makes money, Water operations makes money, Refuse Collection needs 20% of its budget for taxpayer support, Transit is about 10% taxpayer support, and the sixth one in that department, the Airport, is asking for 50% of its budget this year to be paid for by its taxpayers and the group I represent is very resentful of this because less than 2% of the population uses that facility and they feel that it should be put on a pay as -you -go basis, just like this Council and its predecessors have done with the parking facility in the not too far distance past. The Airport was on a pay -as -it -went basis; due to some local political upheaval that whole system changed and now there is a substantial deficit going to the Airport and most of the population does not use the Airport. '�. ............. E I would point out that if there are the 50-60 planes based there which I believe it to be free, the Airport is consuming, excuse me, the owner of each airplane is achieving an approximate $1500 subsidy for the use of the Airport and the parking facility and my taxpayers don't think that is right, they think taxpayers' money should not be used for this purpose. In your budget it is indicated you pay an Airport Manager $33,000 and it is my further understanding that it's his main job to cut the grass and change the light bulbs out there. Yes, I'm very much aware that his job description provides that he shall be knowledgeable in FAA regulations. I don't think he deals with this on a day-to-day basis. I'm not saying we don't have FAA questions... it's like hiring any other consultant... if you need an expert in the field of FAA regulations, we believe you would go to somebody in the field as your questions arise, somebody that prac- tices daily with that body of law because it is a huge body of law and only an expert who uses it daily should be in the business... possibly sharing such an expert with several cities...don't think it's a four -hour -a -day job to be involved with these regulations... as questions come up, do it on a consultant basis, possibly with other cities. In summary, on the Airport issue, my people feel it should be self-supporting like your other issues and they do not feel they should be put upon to expend further funds for that specialty use. Zuber: You mentioned Transit, is that self-sufficient? Poula: No, Transit was about 10%. Zuber: 10% what? Poula: Taxpayer supported. Zuber: I think if you looked, it's considerably more; something like about 60% in terms of what we're getting from transit; in terms of fee support it's about 39%. Poula: I may have misread your budget, that was my reading as I went through. Zuber: That would be about a 600% error. Poula: I said I maybe made an error ... I would like to point out certain issues my people wanted you to be specifically aware of in certain departments. For example, traffic engineering has eight employees. There are 42 red lights in this community. They have a budget of almost one-quarter million dollars - we think that department should be looked over. Planning & Program Development has 15 employees, admittedly all were required when we were in the middle of urban renewal. Our times have changed... building has changed ... my people k want the Council to look at what these people do ... more importantly, what these people do not do in exchange for the salaries received from the taxpayers. Animal Control has four employees, $123,000 budget, according to your budget document. They taught ten seminars last year and reacted to three citizen generated responses for services per day ... maybe some cuts can be made there. Civil Rights, $28,000 position, three things happened last year according to the budget documents. This office responded to inquir- ies at a rate of less than one per day. I believe figure was 18 a month...2) oversaw two filed complaints a month ... 3) responsible for overseeing the Women & Minority Business Enterprise contracts and in FY86 that total job overseeing $620 worth of business ... ok...1) some of these things look strange to people. One of the recommendations is reorganizational issues such as reviewing what are now full-time jobs, making them into the part-time jobs they really area ... I proba- bly ... making one person do more than one job... we think this is a total realistic approach to this. In terms of the City Manager and Civil Rights department, those were two that stuck out in our minds. lie feel there are many ways to stop spending and unless this Council finds some way to limit the increase of government... that taxpayers will not sit still further if anyone listening to my voice is likewise concerned as these taxpayers are, they can call my office at 354-4540 and we'll put them in touch with my people or drop a letter to 621 South Dubuque Street. Thank you folks for your time. Strait: Just one comment. I hope you are not being paid anonymously. Also, I know you as a person, also as I know you as a lawyer ... I would you as an individual would not subscribe to all of those statistics, particularly because statistics just point up one thing: in three or four areas there, you are talking about human concerns, of human needs, you have to always be vigilant about and I think I know you well enough to know that you're representing some anonymous clients, this fs now your personal position on these matters. Paula: Yes sir. Zuber: I would also have ... you gave your phone number and address. I would suggest that these people that are so damn concerned, when they get off their duff and run for City Council, I'm perfectly willing to let them run. I get sick and tired of people standing behind a cloak and giving me hell and giving the Council hell. When you look at the number of people that want to run for office and they are told and they are concerned... they are convinced they can do a good job but then someone hides behind a cloak and stands there and gives me hell ... I don't like it if I don't know who the hell they are and you can take it right back to them ... they can call me at my office or at my home any damn time. Paula: I think many of them have. 3 a Zuber: No they have not. Ambrisco: Mr. Poula, before you get away from me, I would just like to say whoever your represent, if they have done such a magnificent job of scrutinizing the budget and I can just tell you the amount of time and scrutiny, blood, sweat and tear that the staff of this City and these people that are sitting in front of you have done in trying to do the very best job you have... we are starting March 1 on the national search for a City Manager. If you have persons within your list of clients who feel they have the expertise, magic and numbers, please ask them to submit their application. It will be given full consideration. Poula: I have seen in the newspaper several times the name of your consult- ant, but never an address. How does anyone contact those people? Can you.... Ambrisco: Try the Civic Center, Iowa City, Iowa and I will guarantee we'll get it. Baker: I just want to get clear one recommendation. You were lumping to- gether Human Rights Division and City Manager. Was your group advo- cating a part-time City Manager? Poula: No - Airport Manager. Baker: Airport Manager. OK. Thank you. Dickson: Would you ever ... even though you don't want to let us - the public - know who these people are, would you allow the Council to know who these people are ... give those names to us? Poula: Certainly, I will ask my people if that meets with their permission. Dickson: I think a... Poula: My clients ask for anonymity and I think I'm legally bound to grant them that. They ask me to appear and speak, to discuss what matters and them out ... it wasn't sinister. .! 5 Ambrisco: You sure as hell know who we are and I think we are entitled to know who all these geniuses are who came forward with all these bright ideas. lie have been asking for citizen input ever since I've been on this Council and I know every previous Council has, and I think we are entitled to that kind of expertise, if it's available, from within. That's all that we ask..and brother, you've struck a few nerves here tonight. Strait: Also, I would add, Mr. Zuber got you on a 600% error and each one of us on the Council could grab a hold of statistics and knock holes in them, every item that you talked about... we are not sitting up here as stupid individuals. Ambrisco: Close this part of the so-called debate, we'll take your remarks in the fine manner in which they were prescribed. The City Council acts as the Housing Authority. The Housing Authority has been invited by the Department of Housing and Urban Development to submit an application for four Section 8 Existing Hous- ing vouchers to support the additional Rental Rehabilita- tion Grant Funds. These two programs will go hand-in-hand. These four units will be administered by the Iowa City Housing Authority and will merely be an extension of the Existing Section 8 Housing Program administered by the Housing Authority. Comment: In a letter dated February 4, 1986, Mr. Roffman requested that Council extend the time for obtaining a binding financial commitment for the development of Parcel C, until March 15, 1986. Council discussed this request at the informal Council meeting on February 10, 1986, and informally agreed to the requested extension. Comment: This Resolution will allow completion of disposi- tion of the vacated Melrose Avenue right-of-way in conjunc- tion with the new Law School. The University has agreed to provide adequate storm drainage through the site, and to maintain the retaining wall and steps. Comment: On January 21, 1986, an application was submitted to UMTA for a grant to partially finance the purchase of three demo buses which are for sale by Saab-Scania of America. The federal financing of this project would come from the UMTA Section 5 and Section 9 programs. UMTA has informed us that they require a separate Authorizing Reso- lution for each program even though it is a single project. This item is the Section 5 Authorizing Resolution. The Section 9 Authorizing Resolution has already been completed and submitted to UMTA.
