BE IT DZDAINED BY TIE CITY COUNCIL OF IOWA CITY, IOWA, TWAT: SECTION 1. PURPOSE, The purpose of this ordinance is vnt i y's refuse collection service to those residential dwellings which are best suited to the provision of public refuse collection service. MMU I I. Chapter 15 of the Iowa t ma e on itl� "Garbage, Trash and rbfuse" is hereby amended as follows: Section 15-2 Definitions is hereby repealed and the following is adopted in lieu thereof: Ser. 15-2. Definitions. For the purposes of this chapter the following terms shall be deemed to have the meanings irdicated below: Bulky rubbish means non-putrescible solid wastes consis irg o carbustible and/or non-carbustible waste materials which are either too large or too heavy to be safely and conveniently loaded in solid waste transportation vehicles by solid waste collectors, with the equipment available. Collection means remval of solid waste Fran its place of storage to the transportation vehicle. Canrercial solid waste means solid waste resu lrg ram opera ton of any camercial, industrial, institutional, agricultural or other establishnert and multiple housing facilities with more than four (4) dwelling Units. Demolition and construction waste means waste s materia cons uc ion or estruction of residential, industrial or camnercial structures. Director means the city manager or his/her designed for storage of solid waste and with a capacity of twenty (20) to thirty-five (35) gallons. D,Rlling means a building which is wholly or partied or intended to be used for residen- tial occupancy. Deelling uIn means any habitable roan or group of adjoining habitable roans located within a dwelling and forming a single Unit with facilities which are used, or are intended to be used, for living, sleeping, cooking and eating of meals. las Ordinance No. 86-3284 Page 2 Garbage means putrescible animal or vegetable wastes resulting from the handling, preparation, cooking, serving or consumption of food. Hazardous wastes includes but is not limited to patho ogic� explosive wastes, pesticides, pesticide containers, toxic or radioactive materi- als. occupant mins any person, vho alone or jointly or severally with others, shall be in actual possession of any dwelling unit, or of any other improved real property, either as owner or tenant. PrXessiN means incinerating, cammposting, bailig, shredding, salvaging, canpactirg and other processes whereby solid waste characteristics are modified or solid waste quantity is reduced. Refuse means solid waste. Res�i ential solid waste means solid waste resulting frun the maintenance and operation of single family, duplex, tri-plex and four-plex dwellings, including solid waste frvn operation of a hone occupation meeting the requirements of the Zoning Ordinance. Roam uniunit_ means any habitable room or group of -adjoining habitable rooms located within a dwelling and forming a single unit with facilities which are used, or intended to be used, primarily for living and sleeping. A rooming unit shall have bath and toilet facilities available for exclusive use by the occupants or for communal use and, in addition, may have kitchen and dining facilities available for use by the occupants therein. For purposes of this chapter, two (2) rooming units shall be deemed the equivalent of one (1) dwelling unit. Solid waste means unwanted or discarded waste mete—aars in a solid or semisolid state, including but rot limited to garbage, ashes, street refuse, rubbish, dead animals, animal and agricultural wastes, yard vastes, discarded appliances, special wastes, industrial wastes and demolition and construction wastes. Solid waste container means a receptacle used by any person to sena waste during tle interval between solid vaste collections. Solid waste disposal means the process of discarding or getting rid of unwanted material. In particular the final disposition of solid waste. Solid waste management means the entire solid waste systemstorage, election, transportation, processing and disposal. Stora means keeping, maintaining or storing sol idover from the time of its production until the time of its collection. 74s td _A4 r- Ordinance ao. 36-3234 Page 3 Transportation means the transporting of solid waste frun the place of collection or processing to a solid waste processing facility or solid waste disposal area. Yard wastes means grass clippings, leaves, tree andu inmirgs. Subsection 15-62(a) is hereby repealed and the following is adopted in lieu thereof: (a) Psidantial Dlellings. Once per week, as reasonably possible, the City shall collect all residential solid waste resulting from the operation and maintenance of single-family, duplex, tri-plex, and four-plex dwellings, all as defined in the Zoning Ordinance, when each dwelling or dwelling unit is located on its an lot with frontage on a public street. The Director is authorized to adopt regulations pursuant to which the City nay contract to provide residential solid waste collection to other dwellings, and the Director is authorized to. enter into written agreennts to collect solid waste from other dwellings. This residential solid waste collection shall be mandatory and private collection shall not be allowed. The City may establish a reasonable fee for this service by resolution. The Director may exempt qualifying dwellings frown the applicability of this subsection if he/she finds that the dwelling and an adjacent establishment are part of one complex of buildings serving a unified purpose, and solid waste fron the dwelling is being collected along with commercial solid waste from the adjacent establishment. Those dwellings receiving City refuse collection service on the effective date hereof, and which would not receive such service under the terms of this ordinance, may continue to receive City refuse collection service, but if such service is voluntarily discontinued by the owner of any such dwelling, city refuse collection service shall no longer be available to such dwelling. SECTION III. REPEALER: All ordinances and parts of ordinances in contliEt with the provision of this ordinance are hereby repealed. SECTION IV. SEVERABILITY: If any section, Pr aision o• pa o inance shall be adjudged to be invalid or unconstitutional, such adjudication shall not affect the validity of the Ordinance as a whole or any section, provision or part thereof not adjudged invalid or unconstitutional. /0?5- tl Ordinance No. 86-3284 Page 4 SECTION V.
