WHEREAS, in conjunction with the Scott Boulevard Paving Inprovenatts Project, mull parcels of the present right-of-way, and of Lowe- West Brandi Road, all as described below, will no longer be needed for road purposes; and HIM, it is in the public interest that those parcels of right-of-way be vacated and returned to private ownership in order to avoid problens of maintenance and to put then back on the tax rolls; and WfI:FAS, the City wishes to exchange those par- cels for lard and easenents needed for the Scott Boulevard Paving Inrprovenents Project (the "Pro- ject"); and ffJFAS, the City Council finds that the public interest will be served by vacating those parcels, such vacation to be effective Won acceptance of work on the new road. NOW, TFEREFORE, BE IT ORDAINED BY THE CITY MN_ CIL OF IOVA CITU, IOWA, THAT: SECTION I. VACATION. SECTION IV. EFFECTIVE RATE: This ordinance becane eve ton by law, and the vacatipublication as providon ons shall becane effective at such time as there is recorded in the office of the Johnson Canty Recorder a certified copy of the resolution of the city Council of Iaa City accept- ing the paving work on the Scott Boutzvard Paving �Provenents Project, Phase III.
