ORDINANCE VACATING PORTIONS CF SCOTT WJZARD PM
LMR VEST BRANCH ROAD WHICH WILL M LONGER BE USED
AFTER CCMPLETICN OF THE SCOTT BONLEVAND PAVING
IMPROVBEMS PUIECT, RVLSE III.
WHEREAS, in conjunction with the Scott Boulevard
Paving Inprovenatts Project, mull parcels of the
present right-of-way, and of Lowe- West Brandi Road,
all as described below, will no longer be needed for
road purposes; and
HIM, it is in the public interest that those
parcels of right-of-way be vacated and returned to
private ownership in order to avoid problens of
maintenance and to put then back on the tax rolls;
and
WfI:FAS, the City wishes to exchange those par-
cels for lard and easenents needed for the Scott
Boulevard Paving Inrprovenents Project (the "Pro-
ject"); and
ffJFAS, the City Council finds that the public
interest will be served by vacating those parcels,
such vacation to be effective Won acceptance of
work on the new road.
NOW, TFEREFORE, BE IT ORDAINED BY THE CITY MN_
CIL OF IOVA CITU, IOWA, THAT:
SECTION I. VACATION. The following parcels of land
ocain Otisi y, Johnson County, Iowa, shall be
vacated for road purposes by the City of Iowa City,
to wit:
Parcel 1: Camtencing at a 5/8 inch iron pin
fouTE—at—the SouUuest Corner of the Northwest
Quarter of Section 7, Township 79 North, Page 5
West of the 5th Principal Meridian- thence N
00035'42" E (a lecorded Bearing) along the Vest Line
of said Northwest quarter of Section 7, 207.25 feet,
to its intersection with the Centerline of Existing
Lower West Branch Road; thence S 5/039'18" E, along
said Centerline of Existing Lower West Brandt Road,
58.81 feet to a Point which is 50.00 feet nomally
distant Easterly of said West Line of the Nortimest
Quarter of Section 7; thence N 00035'42" E, 38.81
feet to a Point on the Northerly Right -of -Way Line
of said Existing Lower Vest Branch Road, which is
50.00 feet normally distant Easterly of said West
Line of the Northwest Quarter, and is 33.00 feet
ntonnally distant Northeasterly of said Cetterlire of
Existing Lower West Branch Riad, and which Point is
the Point of Beginning; thence S 57039'18" E, along
said Northerly Right -of -Way Line of Existing Lower
Vest Branch Road, 127.13 feet, to a Point which is
33.00 feet normally distant Northeasterly of said
Lower Vest Branch Road Centerline; thence North-
westerly 114.61 feet, along a 233.00 foot radius

chord bears N 71044'46" W, to a Point which is 50.00

Said tract of lard contains 1,222 square feet, nmre

Parcel 2: Camcing at a 578 inch pin found at

SECTION 1SECTION I; All ordinances and parts of
ordinances in conflict with the provision of this
ordinance are hereby repealed.
SECTION III. SEVEPABIIITY: If any section, lrovi-
ston or part o e mance shall be adjudged to
be invalid or unconstitutional, such adjudication
shall not affect the validity of the ordinance n
chole or any section, provision or part thereof not
adjudged invalid or unconstitutional.
SECTION IV. EFFECTIVE RATE: This ordinance becane

by law, and the vacatipublication as providon
ons shall becane effective at
such time as there is recorded in the office of the
Johnson Canty Recorder a certified copy of the
resolution of the city Council of Iaa City accept-
ing the paving work on the Scott Boutzvard Paving
�Provenents Project, Phase III.
