Consider setting a public hearing for November 10, 1987, on an amendment to the Zoning Ordinance to require a demonstration of special circumstances for the granting of certain special exceptions. Comment: The proposed, amendment applies only to special exceptions to modify yard requirements. At their October 1, 1987, meeting, the Planning and Zoning Commission recommended by a vote of 4-1 (Scott voting no) to approve the amendment. This recommendation is consistent with that of the staff. Action:�,7 ta, b. Consider setting a public hearing for November 10, 1987, on an amendment to the CI -I zone to permit light manufacturing, compounding, assembly or treatment of articles as a provisional use and as a special exception. Comment: The proposed amendment will permit light manufacturing, compounding, assembly and treatment of articles as a provisional use in the CI -1, Intensive Commercial Zone, provided that the floor area for each occupant engaged in these uses does not exceed 5,000 square feet. The amendment will also permit light manufacturing uses which occupy up to 10,000 square feet as a special recommended denial of tthis n amendment byna vote of 2-3 (Scott, Cooper and Clark voting no) at their October 15, 1987, meeting. This recommendation is opposition with that of the staff. Expedited in action is requested in response to inquiries regarding the availability of buildings for economic development. Action: d Agenda Iowa City City Council October 20, 1987 Page 6 C. Public hearing on an ordinance to amend the Zoning Ordinance to permit accessory apartments in residential zones. Comment: At its September 17, 1987, meeting, the Planning and Zoning Commission recommended approval of the ordinance permitting accessory apartments within certain residential zones by a vote of 5-2 (Clark and Dierks voting no). At the Commission's recommendation, accessory apartments, which are temporary accessory dwelling units located within an owner -occupied single-family dwelling, have been restricted such that one of the units must be occupied by either an elderly person 62 years of age or older or a handicapped individual. Action: h„ &M4 J 4� ,p d. Public hearing on an ordinance vacating a walkway between Lots 1 and 2 of Cambria Court Subdivision. Comment: On November 7, 1983, in conjunction with approval of the amended preliminary and final Planned Area Development and Large Scale Residential Development plan for Lots 94 and 95 of Ty'n Cae Subdivision, Part 2, the City agreed to vacate a ten - foot wide walkway located within a 20' wide sanitary sewer and storm sewer easement on Lot 95 of that development. Lot 95 was subsequently resubdivided as part of the Cambria Court Subdivision. The agreement, however, did not comply with statutory procedures and therefore did not achieve vacation of the walkway. This ordinance is necessary to complete the intended vacation of the walkway which crosses Lots 1 and 2 of the Cambria Court Subdivision. The Planning and Zoning Commission will consider this City -initiated ,o. walkway vacation at its October 15, 1987, meeting. Consider a resolution of intent to dispose of a �1 vacated walkway between Lot 1 and 2 of Cambria Court Subdivision and to hold a November 10, 1987. Public hearing there on Comment: This resolution sets a public hearing on the disposition of the dedicated walkway which is the subject of items d and e. The resolution for disposition proposes disposing of the dedicated walkway by quit claim deed to Lots 1 and 2 Cambria Court Subdivision. Disposition of the walkway will follow final adoption of the ordinance to vacate the walkway. Action: g. Consider an ordinance to rezone property at 528 Iowan 4Gati.� Avenue from RNC -20 to CB -2. (V-8706) (first consideration) Comment: At their July 2, 1987, meeting, the Planning and Zoning Commission recommended denial of the request submitted by Mr. Emmit George to rezone 528 Iowa Avenue from RNC -20 to CB -2 by a vote of 1-4 on an affirmative motion (Wallace voting yes). This recommendation is consistent with that of the staff. The rezoning application is brought before the Council at the applicant's request. A public hearing was held on October 6, 1987, with comments received from the applicant in favor of the rezoning and from Mr. Steven Greenleaf representing the University of Iowa Credit Union opposed to the rezoning. o• M Agenda Iowa City City Council October 20, 1987 Page 8 ai-r I --1)' 11 If the Council is in favor of this rezoning, the appropriate response is an affirmative vote on this ordinance. Comment: On September 29, 1987, the City Council approved inttconcepthe ersect withHigla d AveStr nue. The subdivision et provides for the extension of Boyrum Street and the development of Lots 1 and 2 to the west of the street. The Planning and Zoning Commission recommended denial of these plats by a vote of 2-5 on an affirmative motion at a meeting held May 1, 1986. Comment: This resolution authorizes the execution of a two-year agreement with University Heights for transit service. Comment: The Rental Rehabilitation Program was contacted by the Iowa State Bank & Trust Company requesting that the City approve a subordination agreement for Malvina and Manly Sorensen on their rental property located at 708 Iowa Avenue, Iowa City. The Iowa State Bank & Trust Company currently has a first real estate mortgage on the property with the City's Rental Rehabilitation lien in a second position. The Sorensens would like to refinance this first mortgage in the amount of $27,000.00. The Iowa State Bank & Trust would have a security of 69% of the appraised value of $39,000. The City's Rental Rehabilitation Lien is in the amount of $5,000.00. Action: 6p �1 ITEM N0. 13 - CONSIDER A RESOLUTION AUTHORIZING THE MAYOR TO SIGN A 10TH ake4al_ AMENDMENT TO THE 1975 AGREEMENT WITH VEENSTRA & KIMM INC. `(r - ai5_ ADJUSTING GIN E FINAL IN L 6INDIRECCTTS 6, 71D 8. COSTS- (OVERHEAD) AMOUNT AS PROVIDED Comment: This 10th Amendment to the 1975 Veenstra & Kimm Agreement is necessary for the City to receive 75% Federal participation in the final payment for design services for the City's wastewater facility improvements (see attached memo). Action: _Yil_-q) 0ta 0 ,o• a Agenda Iowa City City Council October 20, 1987 Page 14 ITEM NO. 14 - CONSIDER RESOLUTION TO PROHIBIT PARKING AT ALL TIMES ON THE EAST SIDE OF SUNSET STREET FROM ITS INTERSECTION WITH IOWA HIGHWAY 1 NORTH TO A POINT 100 FEET NORTH OF ABER AVENUE. Comment: A questionnaire was submitted to the affected residents of Sunset Street in September, 1987, by the Traffic Engineering Division. Thirty-two questionnaires were sent out to the neighborhood, of which 17 were returned. Of the 17, 8 favored the prohibition and 9 were opposed to the prohibition (see attached letters). The Traffic Engineering Division has reviewed the intersection of Ashley Drive and Sunset Street and has determined that there is an ample opportunity to turn onto Sunset Street from Ashley Drive with sufficient sight distance both to the north and to the south to complete the turning maneuver in a safe manner. A review of the accident experience indicates that there have been no reported accidents at the intersection of Ashley Drive and Sunset Street in calendar year 1985, 1986 or the first three quarters of 1987. Based upon the observations of the intersection and the history of the intersection, it is operating satisfactorily in its current configuration at the present time.
