Comment: See attached Engineer's Report. f. Setting Public Hearings. (1) Set a public hearing for November 17, 1987, to consider an ordinance amending Chapter 31 of the Code of Ordinances of the City of Iowa City, Iowa, by adding provisions for requiring escrow control deposits as a condition to the issuance of a building permit. Comment: The proposed amendment offers the option of a one-time contractor's continuous escrow deposit as an alternative to the present require- ment of $500 per lot deposit. This money would be collected by the City as a condition to the issu- ance of a building permit in order to cover the costs of clean-up of dirt and debris from public rights-of-way when a contractor does not clean up work. A memorandum explaining the purpose of the amendment is included in the Council's packet. g. Correspondence. (1) Memoranda from the Traffic Engineer regarding: (a) Loading zone on the west side of the 100 block of North Madison Street. Comment: This application allows Iowa Illinois Gas & Electric Company to relocate a gas line which now passes through a storm intake. A copy of the application is attached. Consider setting a public hearing for November 17, 1987, on an amendment to the Zoning Ordinance to re- quire a demonstration of special circumstances for the granting of certain special exceptions. Comnent: The proposed amendment applies only to spe- cial exceptions to modify yard requirements. At their October 1, 1987, meeting, the Planning and Zoning Commission recommended by a vote of 4-1 (Scott voting no) to approve the amendment. This recommendation is consistent with that of staff. Action: hil b. Consider setting a public hearing for November 17, 1987, on an amendment to the CI -1 zone to permit light manufacturing, compounding, assembly or treatment of articles as a provisional use and as a special excep- tion. Comment: The proposed amendment will permit light manufacturing, compounding, assembly and treatment of articles as a provisional use in the CI -1, Intensive Commercial Zone, provided that the floor area for each occupant engaged in these uses does not exceed 5,000 square feet. The amendment will also permit light manufacturing uses which occupy up to 10,000 square feet as a special exception. The Planning. and Zoning Commission recommended denial of this amendment by a vote of 2-3 (Scott, Cooper and Clark voting no) at their October 15, 1987, meeting. This recommendation is in opposition with that of the staff. Expedited action is requested in response to inquiries regarding the availability of buildings for economic develop- ment. (first consideration) Comment: At its September 17, 1987, meeting, the Planning and Zoning Commission recommended approval of an ordinance permitting accessory apartments within certain residential zones by a vote of 5-2 (Clark and Dierks voting no). At the Commission's recommendation, accessory apartments, which are temporary accessory dwelling units located within an owner -occupied sin- gle-family dwelling, have been restricted such that one of the units must be occupied by either an elderly person 62 years of age or older or a handicapped indi- vidual. A public hearing was held October 20, 1987; no comments were received. Action: d. Consider an ordinance vacating a walkway between Lots 1 and 2 of Cambria Court Subdivision. (passed and 0 0, adopted) Comment: On November 7, 1983, in conjunction with approval of the amended preliminary and final Planned Area Development and Large Scale Residential Develop- ment plan for Lots 94 and 95 of Ty'n Cae Subdivision, Part 2, the City agreed to vacate a ten foot wide walkway located within a 20 foot wide sanitary sewer and storm sewer easement on Lot 95 of that development. Lot 95 was subsequently resubdivided as part of the Cambria Court Subdivision. The agreement, however, did not comply with statutory procedures and therefore did achievenot vacation othe walkway. is necessary tocompletetheintent of thehis vacatdionaofethe walkway which crosses Lots 1 and 2 of the Cambria Court Subdivision. The Planning and Zoning Commission recom- mended approval of this ordinance by a vote of 5-0 at their October 15, 1987, meeting. Comment: This resolution provides for the disposition of the dedicated walkway by quitclaim deed to Lots 1 and 2 of Cambria Court Subdivision. Disposition of the walkway is dependent upon final adoption of the ordi- nance to vacate the walkway included in Item d. Action: 2a/..) � A- 4J �` f. Consider a recommendation of the Planning and Zoning Commission that signs be posted in the circle area of Cambria Court that prohibit parking. Comment: At its January 15, 1987, meeting, by a vote of 6-0, the Commission recommended to Council that "no parking" signs be placed in the Cambria Court turna- round to discourage the use of the turnaround for parking by individuals accessing Willowcreek Park. At its October 15, 1987, meeting, the Commission, by a vote of 4-0, affirmed its position regarding this recommendation. If Council finds that 'no parking" signs are appropriate in this location, staff should be directed to install these signs. Action: g. Consider a resolution approving the preliminary Large _42 (a`c3 Scale Non -Residential Development (LSNRD) plan for Lots 2 and 3 of the Highlander Development First Addition (Northgate Corporate Park). S-8701. Comment: At its October 15, 1987, meeting, the Plan- ning and Zoning Commission recommended, by a vote of 4-0, approval of the preliminary LSNRD plan submitted by Southgate Development Company for Lots 2 and 3 of the Highlander Development First Addition. The devel- oper proposes to construct an office building not to exceed 60,000 square feet on the lots. This recommen- dation is consistent with that of staff included in a report dated October 15, 1987. Comment: In conjunction with the proposed LSNRD plan for Lots 2 and 3 of the Highlander Development First Addition, the Commission recognized that increased development of Northgate Corporate Park will precipi- tate the need for roadway improvements on Highway 1, north of I-80, to accommodate traffic accessing Northgate Corporate Park, the Highlander Inn complex and National Computer Systems. Comment: On October 20, 1987, the CCN met to formulate recommendations for 1988 CDBG projects and funding alloca- tions. The CCN recommendations and additional information are incorporated in the 1988 CDBG Pro act Resource Book, as well as the October 20, 1987, CCN minutes, which were forwarded to Council in the November 10, 1987, packet. Action: ZI,D ITEM N0, 11 - CONSIDER A RESOLUTION APPROVING IOYA CITY'S 1988 THROUGH 1993 STREET CONSTRUCTION PROGRAM, Comment: The Iowa Code requires that cities receiving allotments of Road Use Tax Funds submit to the Iowa Depart- ment of Transportation for review, a five-year program of proposed street construction and reconstruction for its total system of streets. This report must be submitted to the IDOT by December 1 of each year. The report submitted to the IDOT in no way binds the Council to these projects or the timing, and modifications can be made. A copy of the report is attached. Action: Agenda Iowa City City Council Regular Council Meeting November 10, 1987 Page 11 ITEM NO. 12 - CONSIDER A RESOLUTION REGARDING THE ACQUISITION OF PARCEL IN CONJUNCTION N WITH THE NEST BENTON STREET BRIDGE IIpROYE- LENT PROJECT. Comment: The Cedar Rapids and Iowa City Railway Company has agreed to the terms of purchase offered by the City as to Parcels E, F and G and as to the purchase of temporary construction easementsParcels JdHowever agreement hasnotbeen reachedwithCRANDICand IowaElec- tric regarding the acquisition of one remaining parcel of land, Parcel H, due to disagreement over the status of Iowa Electric's Power line. TO EXECUTE AND ATTEST A �IEll - REVISED AGREEMENT WITH THE CEDAR RAPIDS AND IOYA CITY RAILROAD (CRANDIC) FOR THE REMNIYAL OF THE NEST BENTON STREET CROSSING JUST EAST OF THE IOWA RIVER BRIDGE, FOR THE REMOVAL OF CERTAIN STORAGE TRACKS LOCATED NORTH OF WEST BENTON STREET AND WEST OF CAPITOL STREET, AND FOR THE RECONSTRUCTION AND REALIGNMENT OF A SPUR TRACK IN AND ADJACENT TO THE RAILROAD CROSSING AT CLINTON STREET IN AND NEAR LAFAYETTE STREET IN IOWA CITY. ALL IN CONJUNCTION WITH THE WEST BENTON STREET BRIDGE IMPROVEMENT PROJECT. Comment: The City and CRANDIC negotiated an Agreement regarding certain railroad crossings, spur tracks, and storage tracks being removed or realigned in conjunction with the bridge improvement project. The Council author- ized execution of that Agreement in August, but CRANDIC recently asked for one further revision relating to the City's review of their plans for the reconstruction of the Clinton/Lafayette Street crossing. City and CRANDIC staff o developed new language regarding this issue and CRANDIC has Prepared and executed the Agreement containing the revised language. Due to this revision, the Council will have to authorize execution of the revised Agreement. City staff supports /the execution of that Agreement as revised. November 10, 1987 Page 12 ITEM NO. 14 - CONSIDER A RESOLUTION RECLASSIFYING POSITIONS IN THE EpUIP- LENT DIVISION AND THE CDBG DIVISION AND AMENDING THE AFSCME PAY PLAN. Comment: By letter of understanding with AFSCME Local 183, the City has agreed that AFSCME positions be reviewed by the Job Evaluation Committee to determine their correct classification within the compensation system. The Commit- tee has reviewed two positions based on current job duties. Due to the expansion of the Rental Rehab Program the Rehab Officer's duties have increased from dealing with 18 pro- jects per year to responsibility for approximately 42 rehab projects per year and advising on 10-15 additional pro- jects. In addition, the Rehab Officer now supervises other staff who assist with the caseload. The position duties and responsibilities have been reviewed and it is recommended that the position move from Grade 12 to Grade 14. The additional cost for FY88 is $626. When the Transit facility opened, a Maintenance Worker III - Parts Clerk was hired to handle the parts and perform data entry. As the division has become more computerized, the position accepted additional data entry responsibili- ties. This position is now being reviewed based on the duties performed. As a result, it is recommended that the position in the transit facility be retitled Parts/Data Entry Clerk and moved from Grade 5 to Grade 6. The addi- tional cost for FY88 is $491. BY AMENDING SECTIONS 1-21 AND 1-22 THEREIN TO IMPLEMENT THE AMENDMENTS AUTHORIZED BY HF 318 OF THE 72ND GENERAL ASSEMBLY OF THE STATE OF IOWA RELATING TO MUNICIPAL INFRACTIONS. (first consideration) Comment: During the 1986 legislative session, the Iowa Legislature enacted legislation which authorized cities to enforce certain of their ordinances by filing municipal infractions, which are civil proceedings, rather than by filing criminal misdemeanor charges which was the only enforcement tool formerly available. Under this new proce- dure, the City can not only obtain a higher penalty, but the court can also order the violator to comply with par- ticular code sections and can authorize the City to take corrective action. During the 1981 legislative session, the Legislature expanded the list of violations which are subject to this new procedure. The subject ordinance brings our municipal code provisions on municipal infractions into line with the new provisions of the Iowa Code. (first consideration) Comment: This ordinance and the two which follow standardize the City's requirements and procedures regard- ing indemnity and insurance for plaza, park, and street use permits. Under the new procedure, persons or organizations desiring to use City Plaza, parks, or streets must fill out and sign an application which includes an indemnity agree- ment holding the City harmless from liability. The appli- cant will also have to submit proof, of insurance in the amount of $300,000 for pe�t1 injury and $50,000 for property damage. Other g mental agencies sponsoring such events would be exempt from the insurance requirement. As to all other users, the City Manager would have the discretion to waive the insurance requirement, or increase it, depending on the degree of risk involved in the pro- posed activity involving use of City Plaza or street prop- erty.
