The residents of Hanover Court (20 family units) and Tulane Court
(16 family units) remain unanimously opposed to the plan to establish Scott
Blvd. as an Industrial Road linking the Industrial Park to I-80 via Rochester
.Avenue and the Local Road I-80 interchange. Three times since 1983 our
representatives have spoken against the proposal at public hearings.
Although opposing Scott Blvd. as a truck route we have repeatedly
supported the need for a link to 1-80 from the Industrial Park but have urged
an alternative route for valid reasons.
We have been directed by our residents to again protest making Scott
Blvd, a truck route. The safety of children and adults alike should be of
overriding concern to the Council. Fronting on this road are 2 modular home
parks where children are served by school buses; a large soccer field, where
at times cars are parked solidly on both sides of the road for 2 to 3 blocks;
several apartment houses where children live; a day care center for small
children; a Systems Unlimited home for handicapped young people and the
Iowa City Care Center. There are several hundred single family homes,
duplexes and condominiums adjacent to the route and home construction is
continuing. Much of the area from Muscatine Avenue to Rochester has become a

We believe it is a grave mistake for the City to establish Scott Blvd.as
an Industrial Road for the above reasons. Furthermore, the contour of the
land for the new section beyond Court Street is unsuitable for a truck
route. Scott Blvd. now marks the eastern boundary of the city limits but
thio will not always be true as the city expands to the east. Thus today's
mistake will only be compounded in the future.
THIS ROUTE WOULD ELIMINATE THE SAFETY HAZARD AND THE OTHER OBJECTIONABLE
FACTORS AND PRESERVE THE AREA AS A DELIGHTFUL SAFE PLACE FOR LIVING AND
RAISING FAMILIES.

We urge the City Council to consider this or some other alternative route
before future generations are locked into a truck route which will risk lives
and damage an attractive, growing residential area. After all Iowa City is
famous for its quality of life and this has been a major factor in attracting
industry to locate and expand here. The area in question is ideal for the
development of homes to serve people who might come here to work in industry
located in the Industrial Park.

That seams like a good deal for the city and we know

Re: Scott Boulevard
Dear Mr. Mayor and Mr. Helling,
We are property owners living just a few hundred feet
east of the proposed alignment of the extension of Scott
Boulevard from Court Street north to Rochester. We under-
stand the importance of the completion of Scott Boulevard
to the city of Iowa City, but are particularly concerned
about the location of the road as it will be extended from
Court Street north to realign with the original Scott
Boulevard right-of-way at or north of Washington Street.
This letter is for the purpose of making our concerns known
to each of you at this early stage in the planning process
and to request being informed of any meetings at which in-
formal discussion or formal action may be taken on the
Scott Boulevard project.
More specifically, we have had the opportunity to
review a plat prepared by the engineers employed by the
City showing the proposed location for Scott Boulevard
extended north from the Court Street intersection. We have
also inspected the engineer's markers on the site. My wife
and I find the location quite objectionable and a significant
divergence from our expectations based on the informal
Council action taken in March when the project was turned
over to the City Staff. The right-of-way as shown on the

plat connects with the original alignment significantly
past the Washington Street intersection resulting in Scott
Boulevard proceeding further north before it begins its
turn back towards the west. Additionally, this proposed
route appears to be inappropriately located on the natural
terrain and will result in significant grading and excava-
tion at an additional cost to the City. Furthermore, this
route will require the acquiring of substantially more
right-of-way than earlier proposals included. Finally, we
are concerned about potential safety problems that the .
proposed route may cause at the intersection of Washington
Street and Scott Boulevard because of the unlevel topog-
raphy.
It is our belief that the alignment originally reviewed
by the Council in March is preferable to the alignment now
shown on the plat recently prepared for the Engineering
Department. However, it is our firmer conviction that a
more appropriate location for the right-of-way would be to
angle Scott Boulevard west towards the original alignment
of Scott Boulevard immediately after the intersection with
Court Street. This alternative would avoid many of the
terrain difficulties, would make the intersection of
Washington Street and Scott Boulevard at the same grade,
would result in the City having to acquire much less right-
of-way and has other merits in terms of the manner in which
the area has been and will continue to be developed.
My wife and I request that each of you make note of
the situation at this time. We suggest that the Engineer-
ing Department should take a look at alternatives to the
most recently platted alignment. In speaking with Frank
Farmer he had indicated that the proposed route was
arrived at because of the wishes of the property owner
through which a substantial portion of the street will run.
However, in discussing this matter with the property owner
it would appear that this is, in fact, not the case and
that the property owner is flexible about the location of
Scott Boulevard.
We would very much appreciate it and we request to
be notified when the Council will be either informally or
formally addressing matters relating to Scott Boulevard so

that we may be included in the planning discussions before
a decision point is
reached. In the meantime we would ask
that this matter be placed upon the
agenda of either the
Councils informal work session on the 30th of June or
the formal
meeting on July 1, 1986. Please let us know.

Dear Mr. Halling,
As a resident of Hanover Court, I wish to urge the City Council members
to reconsider developing Scott Blvd. into an industrial road connecting
the Industrial Park to Highway I-80, and to consider the ramifications
that would be caused by this development.
This route will prove to be a dangerous route for the children and elderly
living on the route --as well as for childreh playing in soccer games with
many, many cars parked on both sides of Scott Blvd. during the games,
and for children being picked up and dispersed from school buses.

You also need to keep in mind the threat of declining property values
for Hanover Court residents should you develop this route. f
I strongly urge you as a City Council member to consider the alternate
route that has been proposed by Fred Dorheim, Lew January and K—e�th
A on+ which is a conserable distance away from residential areas.

I am writing you to please beg of you, to reconsider the routing
Of Scott Boulevard. The routing you have decided on is not only a
hazard but a noise factor which brings it almost to bedroom windows
of people in Tulane Court and Hanover Court, as well as others along
the way. If this route had been known at the time of the building
of these homes, they would not have been built. The entire city
has been pleased with the building as it has grown Eastward.
There are too many elderly people and children in this entire
area to consider going ahead with the present plan. This area
has become a prime residential area and should be continued to
be considered as such.
Please consider the alternate route!

The City of Iowa City has decided to complete Scott Blvd, from Highway 6
to Rochester Avenue as an Industrial Road to link the Industrial Park to I-80

I own and operate Daves Cycle Accessories located
in Iowa City and am writing as a concerned citizen of this
community.
On June 8th I was operating my cycle going 25 mph in
which I was returning my cycle back to my shop_ I past by
an officer setting on Olympic Circle and when I reached my
shop two blocks away, he had his lights on as I was now in
my Parking lot. The officer got out of his car and said
that my exhaust pipes were too loud. I asked the officer
how much too loud the pipes were, and his response was "It
is too loud for my ears". After checking into the noise
ordinance, I found out that all the laws pretai.n to dec-
imal readings and then to find out that the city has no
decimal meters. To infovice the moise ordinance laws, it
is done by determining the amount of sound doc imals a
cycle or vehicles exhaust system emits. Which can only
be done by a meter. Without a meter, it is lefted up to
the officers ears, which is not complying with the cities
lawse as it is set up ea of today. Without a meter it is

I recommend
that if the City
of Iowa City plans on
inforcing the
noise ordinance laws,
that it should find
the funds to
buy as many meters as
it takes to fairly

Dear Mr. Luhman:
Thank you for your recent letter in regard to a citation issued to you on June 8,
1986, for improper equipment.
The citation was issued under Sec. 23-107, of the Code of Ordinances, City of Iowa
Cid. This section is titled, 'Improper Equipment' and is quoted below.
It shall be unlawful for any person to drive or move, or for the owner
to knowingly permit it to be driven or moved on any highway any vehicle
or combination of vehicles which is in unsafe condition as to endanger
any person, or which does not contain those parts or is not at all times
equipped with such lamps or other equipment... as required in the State
Code....
The Code of .Iowa at Sec. 321.436, titled 'Mufflers, prevention of noise,' states:
Every motor vehicle shall at all times be equipped with a muffler in
good working order and in constant operation to prevent unusual noise
and annoying smoke and no person shall use a muffler cutout, bypass or
similar device upon a motor vehicle on a highway,
You were not charged for a violation of the noise ordinance, but with an equipment
violation, the noise from your vehicle was the- probable cause alerting the officer
to a possible violation. Thus, the officer's actions were completely in accor-
dance with prescribed procedures and with legal requirements for proper enforce-
ment: The magistrate's court is the proper place to test the validity of your
argument regarding decibel meters. While the Police Department has two such de-
vices, they are used primarily to determine differences in a complaint of noise
level versus the ambient noise level of various locations.
Thank you for bringing this matter to the attention of the City Council.

Re: Lighting Assessment on the Davis Building

Gentlepersons:
I
Washington Park, Inc., a corporation owned by Bruce
Glasgow, received an assessment for lighting on June 16, 1970.
Within a few years, the street lights which were the subject of
the assessment were torn down as part of the downtown urban
renewal project. I believe that federal funds paid for the
replacement lights.
Many of the property owners paid the assessment only when
they sold the properties and had to clear title. At least one,
the Kelly Company, Inc., had a portion of the assessment waived
by the City when the City purchased the property.
Mr. Glasgow and Washington Park, Inc. are requesting that

the City waive the assessment on the Davis Building. At my

last information, this assessment consisted of a principal
amount of $1,125.41, interest of $275.73, and a penalty of
$562.73, for a total of $1,963.87. Undoubtedly the interest

and penalty have risen since that time.
The reasons in support of this request are as follows:
1. The lights were only in place for a few years and
there was no credit given or change in the assessment
when those lights were removed and replaced with
federally funded lighting:

This is in response to your letter to the City Council of June 23 1986
and to Mr. Foster's subsequent letter to me dated July 10, 1986, 23, 1986,

Thirty-three properties were assessed in conjunction with this project.
Of those, about one-third were owned or acquired by the City of Iowa
City. The City was responsible for the entire share of the assessed
amount for properties owned by it and for the remaining share on those
properties acquired after installation of the lighting. Replacement
lighting installed five years later was funded at least partially with
federal funds. As of this date, Washington Park, Inc. is the only
property owner of the original 33 which has not satisfied completely its
obligation under this assessment program.
I do not believe it is appropriate that the City waive any outstanding
obligation on this assessment for Washington Park, Inc. I would be
happy to discuss this matter further if you have questions or concerns.

Gentlepersons:
Washington Park, Inc., a corporation owned by Bruce
Glasgow, received an assessment for lighting on June 16, 1970.
Within a few years, the street lights which were the subject of
the assessment were torn down as part of the downtown urban
renewal project. I believe that federal funds paid for the
replacement lights.
Many of the property owners paid the assessment only when
they sold the properties and had to clear title. At least one,
the Kelly Company# Inc., had a portion of the assessment waived
by the City when the City purchased the property.
Mr. Glasgow and Washington Park, Inc. are requesting that
the City waive the assessment on the Davis Building. At my
last information,

$562.73, for a total of $1,963.87. Undoubtedly the interest
and penalty have risen since that time.
The reasons in support of this request are as follows:
1. The lights were only in place for a few years and
there was no credit given or change in the assessment
when those lights were removed and replaced with
federally funded lighting;

2. The' City has waived part of the assessment in one
instance where the property was purchased by the City
and was to serve a public purpose;
3. One of the major uses of the Davis Building has been
the housing of City offices. Since there has not
been the commercial traffic involved, the lighting
does not serve to enhance the commercial value of the
building, but instead simply provides lighting to a
busy, downtown street;
4. Mr. Glasgow has already paid $1,201.49 on this
assessment.

Re: Parking Prohibition on the Frontage Road South of Eagle's Food Store
As directed by Section 23-16 of the Municipal Code of Iowa City, this is to
advise you of the following action.
ACTION:
Pursuant to Section 23-234 of the Municipal Code of Iowa City, the City
Traffic Engineer will direct the installation of NO PARKING ANY TIME signs on
the west side of the frontage road south of Eagle's Food Store. The prohibi-
tion will extend from the entry from the highway south to the next access
Point to the highway. This action will take place on or shortly after July
2, 1986.
COMMENT:
The frontage roads have been constructed for the purpose of moving traffic
between the highway and abutting property. The City has received a complaint
regarding parking on the frontage road. The prohibition is being installed
so as to provide for free flowing traffic along the frontage road.

Re: Installation of a Protected Left Hand -Turn at Madison Street/Iowa
Avenue
As directed by Section 23-16 of the Municipal Code of Iowa City, this is to
advise you of the following action:
ACTION:
Pursuant to Section 23-30 of the Municipal Code of Iowa City, the City Traf-
fic Engineer will direct the installation of a protected left-hand turn for
traffic northbound on Madison, left -turning onto Iowa Avenue. This action
will take place on or shortly after January 9, 1986.
COMMENT:
This action is being taken to alleviate the congestion for this left -turning
movement created by the dispersal of traffic from the Burlington Street
bridge area. During the repair of the Burlington Street bridge and the
anticipated reconstruction of the University of Iowa's steam tunnel in the
intersection of Burlington Street and Riverside Drive, traffic will be dis-
bursed frau this intersection. The protected left-hand turn as proposed
above will accommodate the additional traffic caused by these two construc-
tion projects. At the end of the construction, the protected left-hand turn
signals will be removed.
