Comment: This project consists of a lift station and force main to transport landfill leachate to the sanitary sewer on the Johnson County property and eliminate the need for hauling the leachate by tank wagon from the landfill. The estimated cost of this project is $132,388.00. (2) Consider resolution setting public hearing for July 29, 1986,on plans, specifications, form of contract, and estimate of cost for the construc- tion of the Bridge Deck Repair Project (Phase I). Comment: This project involves the repair of the decks and sidewalks on the following bridges: Dodge Street Bridge over the Heartland Rail Corp. tracks, Gilbert Street Bridge over Ralston Creek, and Burlington Street Bridge over Ralston Creek. (First Consideration) Comment: On June 5, 1986, the Planning and Zoning Commission, by a vote of 6-0, recommended approval of an ordinance amendment that would permit religious institutions within the RR -1 zone as a provisional use subject to the additional regulations of Section 36-55. This recommendation is consistent with that of the staff. A public hearing was held July 1, 1986; two comments were received in opposition to the proposed amendment. CONSIDER AN ORDINANCE TO AMEND SECTION 36-58(8)(4) OF THE ZONING ORDINANCE REGARDING USE CONVERSIONS AND THE REQUIRED NUMBER OF PARKING SPACES. (First Considera- tion) Comment: By a vote of 3-3, the Planning and Zoning Commission failed to approve a motion recommending approval of an amendment regarding the number of addi- tional parking spaces to be provided upon a use conver- 1 - Sion. The amendment eliminates the expression ! "physical limitation" which was found to be ambiguous 4 and states that as many additional parking spaces shall be provided as the lot will accommodate; however, no j tree having. a minimum diameter of 10" measured at q feet above grade shall be required to be removed. A public hearing was held July 1, 1986. Comments were received in favor of this ordinance from representa- tives of the Sigma Tau Gamma Fraternity. CONSIDER AN OR INANCE TO VACATE A PORTION OF HOLLYWOOD BOULEVARD FROM 400 FEET EAST OF BROADWAY STREET TO THE EAST PROPERTY LINE OF THE IOWA STATE BANK. (V-8602) (Second Consideration) Comment: The Planning and Zoning Commission, at its May 15, 1986, meeting, recommended by a vote of 4-0 that a portion of Hollywood Boulevard be vacated as public right-of-way and that the vacation take effect I' upon the completion and opening of Broadway I Street/Highway 6 intersection. This recommendation is consistent with that of the staff. No comments were received at the June 17, 1986, public hearing. Comment: Acquisition of a strip of land along the west wall of the Paul -Helen Building is necessary to allow encroachment of the new brick facade onto the eastern edge of the minipark. This strip will cover one and one-half feet west of the eastern lot line of the park and no more than four feet (east -west) by eighteen feet (north -south) to permit placement of the Old Armory arch as an entryway. Comment: See comment above. Action:D% ITEM NO. 7 - PUBLIC HEARING ON A PROPOSAL TO LEASE CITY PROPERTY KNOWN AS THE UNION BUS DEPOT, 404 EAST COLLEGE STREET, TO BOBBY J. AND KAREN K. ROREI FOR JtN INITIAL TERM OF TWO YEA, WITH THREE TWO-YEAR RENEWAL OPTIONS. Comment: On June 17, 1986, the City Council passed and approved Resolution No. 86-186, approving the assignment of the lease of the Union Bus Depot property from Phillip E. Spelman to Bobby J. and Karen K. Rorex. Said lease will expire on November 30, 1986, and Mr, and Mrs. Rorex have proposed to thereafter lease said property from the City. The lease which they have proposed is for an initial term of two years, with three two-year renewal options. Staff of the Legal and Finance Departments have reviewed and approved the proposed lease and have recommended its execu- tion. WITH THREE TWO-YEAR RENEWAL Comment: The resolution subject hereof approves a new lease of the Union Bus Depot property to Bobby and Karen Rorex, who recently acquired the bus depot business from Mr. Phillip Spelman. ANO UPON THE CITY'S PROPOSAL TO ADOPT A PUBLIC i. UTILITIES REGULATORY ORDINANCE. i Comment: The gas and electric franchises held by Iowa - Illinois Gas and Electric Company expired in August of 1984. Negotiations on new franchise ordinances were re- cently concluded between City and Company representatives, and the Company has petitioned the City Council to adopt the renegotiated gas and electric franchise ordinances now on file in the City Clerk's office. A public utilities regulatory ordinance has also been prepared for Council i consideration and is now on file in the City Clerk's of- fice. This public hearing is being continued from the Council meeting of July 1, 1986. Comment: A public hearing on the amended 1986 CDBG budget was held on July 1, 1986; no comments were received. Since then, there has been one additional minor change to the budget as outlined for that meeting. The total CDBG funds budgeted for the Human Services Coordinator have been reduced from $25,021 to $23,869. The Committee on Commu- nity Needs (CCN) will review the final amended budget at its meeting on July 15, 1986; no additional public hearing is required.
