Public hearing on an amendment to the Zoning Ordinance to require a demonstration of special circumstances for the granting of certain special exceptions. Comment: The proposed amendment applies only to spe- cial exceptions to modify yard requirements. At their October 1, 1987, meeting, the Planning and Zoning Commission recommended by a vote of 4-1 (Scott voting no) to approve the amendment. This recommendation is consistent with that of staff. The parcel is located within Area 4 of the Johnson County/Iowa City Fringe Area Policy Agreement. The Commission found that this request is consistent with the recently amended devel- opment policy for that portion of Area 4 located east of Highway 1 and north of the Iowa City corporate limits. Consider an ordinance to amend the Zoning Ordinance to permit accessory apartments in residential zones. (second consideration) Comment: At its September 17, 1987, meeting, the Planning and Zoning Commission recommended approval of an ordinance permitting accessory apartments within certain residential zones by a vote of 5-2 (Clark and Dierks voting no). At the Commission's recommendation, accessory apartments have been restricted such that one of the units must be occupied by either an elderly person 62 years of age or older or a handicapped indi- vidual. Consider a recommendation of the Planning and Zoning Commission concerning a request submitted by William Boyd to rezone a 41.05 acre lot within Highland Heights Subdivision, located east of Highway 1, approximately two miles north of Iowa City, from A-1 (Rural) to RS -3 (Suburban Residential). Consider a resolution authorizing the Mayor to sign an amendment to the Johnson County/Iowa City Fringe Area �7 =Z Agreement regarding development standards for subdivi- sions in the extraterritorial jurisdiction of Iowa City. Comment: At a meeting held October 8, 1987, the Fringe Area Committee recommended to the City Council and the Board of Supervisors adoption of revised development standards for subdivisions within two miles of Iowa City's corporate limits. These standards have been reviewed by the Iowa City and the Johnson County Plan- ning and Zoning Commissions and have received their approval. The Iowa City Commission recommended six inches of stone on roads in rural developments and the Fringe Committee and the County Zoning Commission recommended three inches of stone for such roads. The agreement amendment before the Council includes the provision for three inches of stone. The Board of Supervisors is scheduled to consider these standards at its November 19th meeting. Action: ad". -14 ITEM N0. 5 - PUBLIC HEARING TO CONSIDER AN ORDINANCE AMENDING CHAPTER 31 OF THE CODE OF ORDINANCES OF THE CITY OF IOWA CITY, BY ADDING PROVISIONS FOR REQUIRING ESCROW CONTROL DEPOSITS AS A CONDITION TO THE ISSUANCE OF A BUILDING PERMIT. Comment: The proposed amendment offers the option of a one-time contractor's continuous escrow deposit as an alternative to the present requirement of $500 per lot deposit. This money would be collected by the City as a condition to the issuance of a building permit in order to cover the costs of clean-up of dirt and debris from public rights-of-way when a contractor does not do the clean-up work. A copy of the proposed ordinance was included with the agenda for the November 10 Council meeting. (first considera- tion) Comment: See item above. Action: rAq &KQ,) j VA.n ITEM NO. 7 - PUBLIC HEARING ON AN ORDINANCE ADOPTING THE 1987 NATIONAL ELECTRICAL CODE, AS AMENDED. THIS CODE SHALL BE KNOWN AS THE IOWA CITY ELECTRICAL CODE. Comment: The Iowa City Electrical Board has reviewed 1987 National Electrical Code and has suggested several amend- ments to accomodate local conditions and practices. Sev- eral deletions in the 1987 N.E.C., Note No. 3 to tables 310-16 through 310-19, dealing with three -wire, single- phase residential service, Article 310-23 through 310-31 dealing with conductor sizes, Article 333 dealing with armored cable, and Article 600-4 dealing with listing requirements for signs, and some changes in the amendments, one dealing with exposed ramex in basements and garages and another one is dealing with expired licenses, will require the applicant to take the electrical exam and pass to regain license. Agenda Iowa City City Council November 17, 1987 Page 9 ITEM NO. 14 - CONSIDER A RESOLUTION AUTHORIZING FILING OF A COMMUNITY DEVELOPMENT BLOCK GRANT PRDGRAN STATEWNT FOR 1988 UNDER THE HOUSING AND COMMUNITY DEVELOPMENT ACT OF 1974, AS AMENDED, INCLUDING ALL UNDERSTANDINGS AND ASSURANCES CON- TAINED THEREIN AND DESIGNATING THE CITY MANAGER AS THE AUTHORIZED CHIEF EXECUTIVE OFFICER FOR THE GRANT. Comment: The City Council held a public hearing on a proposed Program Statement on November 10, 1987, and con- sidered citizen comments on the Community Development Block Grant (CDBG) funding allocation for 1988. A summary de- scription and comments an requests received by the Commit- tee on Community Needs (CCN) along with CCN and staff recommendations were forwarded to Council in the 1988 CDBG Pro'ect Resource Book prior to the public hear ing.-7assage of the reso ution wi 1 permit filing of the Program State- ment and Budget with the Department of Housing and Urban Development, and will indicate Council's approval of pro- jects to be funded through the 1988 CDBG program budget. Comment: The alleys involved in this project run south off Bowery between Dodge and Lucas, to a point 254 lineal feet south of the south end of the existing alley paving, and the Original Town, Block 62 alley between Washington and College from Linn to Gilbert. The attached memo explains the changes in more detail. Action: cD Ae�& ITEM NO. 19 - CONSIDER A RESOLUTION ADDIIG TWO FULL-TIME POSITIONS IN THE ASSISTED HOUSING DIVISION, DEPARTMENT OF HOUSING AND 4.Z3_( ac11 INSPECTION SERVICES. Comment: The Assisted Housing Division has added 167 units since the last increase in staff, October, 1984. Additional staff is required to administer these units. Money for salary and benefits for these positions will come from the above federal programs and will not affect the City budget. A memo fully describing the positions and justification is included with the Council agenda. The Housing Commission and the staff recommend adoption of the Resolution. Under the new schedule, senior citizens will be allowed to adopt animals without paying the fee normally required.
