RESOLUTION NO. 87.285
RESOLUTION AUTHORIZING THE MAYOR TO SIGN AND THE CITY CLERK TO
ATTEST AN AGREEMENT BETWEEN JOHNSON COUNTY, IOWA, AND IOWA CITY,
IOWA, AMENDING THE DEVELOPMENT STANDARDS FOR SUBDIVISIONS WITHIN
THE JURISDICTION OF THE JOHNSON COUNTY/IOWA CITY FRINGE AREA
POLICY AGREEMENT.
WHEREAS, in December, 1983, pursuant to Resolution 83-404, the City Coun-
C" of Iowa City entered into an agreement with the Board of Supervisors
of Johnson County under authority of Chapter 28E of the Code of Iowa which
sets forth development policies for the two-mile extraterritorial juris-
diction of Iowa City; and
WHEREAS, said agreement provides for amendments as necessary; and
WHEREAS, the City and the County have mutually agreed that the development
standards for subdivisions within the fringe area should be directly
related to the anticipated annexation of any portion of the fringe area.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF IOWA CITY THAT:
I. The Mayor is authorized and directed to sign and the City Clerk to
attest the attached amendment to the Fringe Area Policy Agreement
between Johnson County and Iowa City, establishing a

This Agreement is entered into pursuant to Chapter 28E of the Code of Iowa
by and between Johnson County, Iowa, a municipal corporation, and the City

This Agreement is entered into pursuant to Chapter 28E of the Code of Iowa

DESIGN STANDAR
For all areas, the foil Wing design standards shall apply and shall
supersede any previousl state standards under the "Implementation"
sections of the Area Pol cies.
Level 1. Full City s eet standard shall be applied to areas which have

urban cross-section with street const uction of full depth concrete 28
feet wide for local streets and 31 feet or collector streets. All tele-
phone and electric utility service lines all be underground.
Level 2. A min' um rural development stand4d for streets shall apply to
ti�reas for future potential annexation -10 years). This entails a
rural cross -se tion with a three inch compact d stone base and chipseal
surface 22 fe t wide.
Level 3. Pr sent County local street improvement s andards shall apply to
all other reas within the two-mile fringe of Iow City. The current
County sta dard is three inches of crushed rock 22 fee wide.
This amepdment to the Agreement shall be filed with Secretary of the State
of Iowa,/ and with the Johnson County Recorder in compliance with Chapter

RESOLUTION AUTHORIZING FILING OF A COMMUNITY DEVELOPMENT BLOCK GRANT
PROGRAM STATEMENT FOR 1988 UNDER THE HOUSING AND COM14UNITY DEVELOPMENT ACT
OF 1974, AS AMENDED, INCLUDING ALL UNDERSTANDINGS AND ASSURANCES CONTAINED
THEREIN AND DESIGNATING THE CITY MANAGER AS THE AUTHORIZED CHIEF EXECUTIVE
OFFICER FOR THE GRANT.
WHEREAS, the City of Iowa City, Iowa, is an eligible unit of general local govern-
ment authorized to file a Program Statement under the Housing and Community Devel-
opment Act of 1974, as amended; and
WHEREAS, the 1988 Community Development Block Grant Program Statement has been
developed so as to give maximum feasible priority to activities which will benefit
low and moderate income persons and aid in the prevention or elimination of slums
and blight; and
WHEREAS, the City of Iowa City, Iowa, has provided the residents of the community
with opportunities to comment on the Program Statement; and
WHEREAS, the City Council of Iowa City, Iowa, believes that the public interest
will be served by filing said Program Statement with the United States Government.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF IOWA CITY, IOWA,
that the City Manager of Iowa City be and is hereby:
1. Directed to file with the U.S. Department of Housing and Urban Development a
Program Statement for 1988 Community Development Block Grant (CDBG) funds
under the Housing and Community Development Act of 1974, as amended, to in-
clude those projects which are listed on the exhibit attached hereto; and
2. Authorized and directed to provide the necessary understandings and assurances
required by the Department of Housing and Urban Development in connection with
said Program Statement; and
3. Designated as the Chief Executive Officer to act in connection with the Pro-
gram Statement and to provide additional information as may be required.

STATEMENT OF OBJECTIVES - 1988 CDBG ENTITLEMENT FUNDS
On Tuesday, November 10, 1987, the Iowa City Council held a public hearing on
the draft objectives and budget for the use of Community Development Block
Grant funds in 1988.
The Committee on Community Needs (CCN) reviewed all the 1988 requests for
CDBG funds and made a recommendation to the Iowa City Council on the use of
those funds. It was the consensus of CCN and the City Council that the
objectives listed below would best serve Iowa City's community development
and housing needs, benefit low and moderate income persons, and help to
eliminate or prevent slums and blight.
1. Preserve, rehabilitate, weatherize and make accessible to elderly and
Physically disabled persons, older rental and owner -occupied housing
units through grants, low interest loans and forgivable loans.
2. Research a means of implementing a

3. Preserve and improve the City's targeted neighborhoods through storm
drainage improvements.
4. Assist physically disabled persons through improved accessibility by

5. Reduce blight and provide for the physical, mental and emotional well-
being of low-income disadvantaged youth andadults through constructive
employment in renovating a Youth Services Facility.
i 6. Enhance the physical, mental, educational and emotional well-being of the
City's low to moderate income residents by assisting human service agen-
cies in the delivery of supportive services.
7. Dispose of City property acquired for Lower Ralston Creek Improvements.
8. Efficiently plan for and administer all CDBG activities.
9. Provide for project contingencies.

DESCRIPTION OF 1988 PROGRAM STATEMENT
I. SUBRECIPIENT ACTIVITIES
Low Income Home Ownership Assistance - CDBG funds in the amount of
wi a useo contract or a consultant to research the
need for a program to assist lower income families in purchasing
homes. Recent City studies show that there may be an adequate supply
Of low cost housing on the market, however, lower income families
cannot afford to make upfront costs such as downpayments. If a need
is determined, the consultant will develop a program to be admini-
stered by a Community Development Corporation or similar organiza-
tion. This project meets the national objective of benefitting low
and moderate income persons.
II. DISPOSITION

Lower Ralston Creek Redevelopment Area. The $3,000 will cover ap-
praisals, bid documents and advertising. This project meets the
national objective of eliminating slums and blight.
III. PUBLIC WORKS AND FACILITIES
Benton Street Storm Draina a Pro'ect - Last year $145,000 in CDBG

the north side of Douglas Street to the proposed 8 foot by 4 foot RCB

IV. PUBLIC SERVICES
Aid to A encies - A number of Human Service Agencies have been funded
Ty the City of Iowa City for several years using federal General
Revenue Sharing Funds. In FY87 support for the agencies was approxi-
mately $189,000 of which approximately $90,000 were CDBG monies.
Since General Revenue Sharing monies are no longer available a de-
crease in level of service of the agencies will occur unless other
sources of funding are found. The City of Iowa City is allocating
15% of the 1988 CDBG Metro Entitlement Funds ($90,000) to help main-
tain the service levels of the agencies listed below. The agencies
which will be funded are:

Elderly Services Aoency - The Elderly Services Agency helps people 62
years of age and older in Johnson County to remain in their homes as
long and as safely as possible. Agency programs include chore and
respite care, outreach and advocacy, information and referral, as
well as the newer programs of shared housing and small housing repair
for low and moderate income elderly.
Mayor's Youth Emplo ment Pro ram - Since 1968, the Mayor's Youth

taged youth in Iowa City. Young people between the ages of 14 and 19
who meet the eligibility guidelines gain supervised work experience
designed to assist them in completing their secondary education and
prepare for self-sufficiency as adults.
United Action for Youth - United Action for Youth, founded in 1970,
is a community based youth service agency which offers crisis inter-
vention, confidential counseling, creative activities, and other
support services to youth and their families. UAY's program compo-
nents include an outreach counseling program and a creative arts
workshop.
All three agencies benefit principally low and moderate income per-
sons and therefore meet the national objective.
REHABILITATION
Housinn Rehabilitation - The housing rehabilitation program provides
assistance in the orm of grants, no and low interest and deferred
payment loans to low and moderate income homeowners. CDBG funds in
the amount of $300,000 will be used for six programs designed to
preserve the City's older housing stock and revitalize older neigh-
borhoods; make necessary health and safety related repairs and im-
provements; improve the accessibility of older homes for persons with
physical disabilities and make homes more energy efficient. This
program addresses the national objective of providing assistance
primarily to low and moderate.income residents.
Small Repair program for Low Income Elderly and Handicapped -$4,000
in LDBG funds will re used to assist elderly and handicapped homeown-
ers with emergency repairs and make their homes safer and more acces-
sible. During the past four years, projects for this program have
included, repairing bannisters, railings, steps, ceilings, roofs and
gutters, minor plumbing repairs, replacing torn linoleum floors, and
installing toilets. The small repair program for elderly and handi-
capped persons principally benefits low and moderate income persons.
Youth Services Facilit Exterior Renovation - The Mayor's Youth
mp oyment gency wor s with severs agencies, including the Iowa
Conservation Corps, to provide job training and employment for young
people between the ages of 14 and 19 years of age. Funds i,n the
amount of $6,800 will finance the exterior renovation of 'newly
acquired Youth Services facility. The project will be accomplished plished

through the Iowa Conservation Corps Sunnier Program, which will pro-
vide exterior painting and repair experience for the participating
youth. This project benefits primarily low and moderate income
youth.
V1. REMOVAL OF BARRIERS TO THE HANDICAPPED
Curb Ramp Installations - The lack of curb ramps at street and side-
walk intersections makes it difficult for individuals with physical
disabilities to gain access to many of the City's public and private
facilities. CDBG funds in the amount of $5,000 will be used to
install approximately 24 curb ramps. CDBG funds, allocated in 1985
and 1986, financed the installation of 37 curb ramps throughout the
City's older neighborhoods. This project will benefit low and moder-
ate income persons.
VII. GENERAL ADMINISTRATION
Program Administration - Program administration funding of 5100,000
will be use o provide effective and professional coordination,
management and monitoring of the 1988 CDBG projects. The City's
Rental Rehabilitation Program will also be administered by the CDBG
staff.

STATEMENT OF OBJECTIVES:
On November q, 1986, the Iowa City Council held a public hearing on the draft
objectives and budget for the use of Community Development Block Grant
funds in 1987. Later, the CCN recommended approval of certain amendments to
the original budget following the notification about the late release ofC1987
CDBG funds. A public hearing was held on June 2, 1987, and
Council subse-
quently approved the amended budget on that same date.
The Committee on Community Needs (CCN) reviewed all the 1987 requests for
CDBG funds and made a recommendation to the Iowa City Council on the use of
the funds. CCN and the City Council felt that the objectives listed below

Replacement and Rehabilitation Program in Iowa, and

and $53,018.11 from Project No. BHF -0001-5(32)--2L-52 in a custodial
account, and
WHEREAS, the Surface Transportation and Uniform Relocation Assistance Act of
1987 provides for less than full pro rata reimbursement for eligible
project costs, and
WHEREAS, the STATE wishes to liquidate the funds held in custody.
NOW, THEREFORE, BE IT AGREED:
1. Upon execution of this Agreement by the CITY and STATE, the STATE shall
prepare a warrant in the amount of $378,752.33 to release funds held
for Project No. BRM -4072(1)--8N-52 and a second warrant in the amount
of $53,018.11 to release funds held for Project No.
BHF -0001-5(32)--2L-52.
2. The total of the two warrants, $431,770.44, shall be an advance payment
against the $650,000 in Federal -aid Bridge Replacement and Rehabilita-
tion Program funds provided in Agreement 85-F-092 for Project No.
BRM -M -4044(1)--8B-52.
3. When Project No. BRM -M -4044(1)--8B-52 is let to contract and the STATE
places the project under agreement with the FHWA, the Federal -aid
Bridge Replacement and Rehabilitation Program funds shall be limited to
$218,229.56.
4. The STATE shall pass on to the CITY all the Federal -aid Bridge Replace-
ment and Rehabilitation Program funds as they are received from the
FHWA for Project No. BRM -M -4044(1)--8B-52.
5. In all other respects the obligations of the CITY and STATE shall
remain as specified in Agreement No. 85-F-092.

Benton Street Bridge Widening Project
The Iowa Department of Transportation (IDOT) has been maintaining
a custodial account of funds claimed from the Federal Highway
Administration (FHWA) for bridge replacement projects where
Federal -aid fund requirements exceeded $650,000. The fund was
set up by the IDOT as a means of complying with the city brisingleransportation
andge
replacement program rule to limit reimbursements for a
Project ($650,000) and FHWA regulations (Surface T
and Relocation Assistance Acts of 1977 d 1982) which required
reimbursement of the full 80% pro rata share for all eligible
costs. However, the Surface Transportation and Relocation
Assistance Act of 1987 contains language which provides Federal -
aid funding at less than the full pro rata share. The need for
the custodial account no longer exists and the IDOT desires to
liquidate the accumulated funds as soon as possible. one of the
quickest ways to disburse the account is to advance funds to
projects which are soon to be let to contract such as the Benton
Street Bridge Widening Project.
The attached agreement will allow the IDOT to advance to the City
of Iowa City the amounts of Federal -aid earned by the Iowa Avenue
Bridge Reconstruction and the Burlington Street Bridge
Reconstruction Projects over and above the $650,000 reimbursed
for each project up to the 80% pro rata share. Note that the
advance payment will be in lieu of an equal amount of Federal-aidreimbursement once construction begins on the Benton Street
Bridge Widening Project.

RESOLUTION AMENDING THE PURCHASING MANUAL
WHEREAS, the City Council of Iowa City adopted a Centralized
Purchasing Division in 1974, and
WHEREAS, the City Council established Purchasing Policies and
Procedures for the City of Iowa City, Iowa, and
WHEREAS, the City Council deems it in the public interest to amend

Section 1.03 Departments
City departments are responsible for meeting the goals and objectives
established by the Council and are provided budget funds to obtain these
goals. With the approval of the Director of Finance and the concurrence
of the City Manager, departments may initiate internal reallocation of
their budget funds as needed within the guidelines established by the
Finance Department. Although the City Council has established goals and
levels of expenditures for each program, appropriation is not a permit nor
a directive to expend funds unless the need for the item continues to
exist at the time for purchase and the price of the item is within the
parameters of the budget. In addition, this criteria must be weighed
ultimately against the availability of funds and the relationship of the
department goals to overall City priorities. For proper management con-
trol it is necessary that expenditures be authorized prior to purchase.
This authorization will be in the form of a signature by purchase requisi-
tion, small order requisition, check request, memo payment or other ap-
proved form for goods and services in question. Purchase requisitions are
considered authorization for both ordering and payment unless the invoice
amount exceeds the requisition by the greater of 10% or $250. In
instances where additional justification is required an internal depart-
mental memorandum, budget revision or budget amendment form will be re-
quired.
The signature of a division head, assistant department head, or individual
working in an ongoing comparable level of authority is required before
processing requisition for operational items of less than $1,000. This
does not include direct purchase of furniture, outside printing, and items
that are available within the Civic Center central supply room. A depart-
ment head's signature is required for requisitioning any item or service
greater than $1,000. The Purchasing Agent will maintain the master list-
ing of approved signatures including approved acting designees. That
listing will be used by Accounting/Purchasing to verify authorized indi-
viduals and they do have the right to refuse ordering/payment without an
authorized signature. Signature stamps are not to be used. At a minimum,
first initial and last name will constitute a proper signature; initials
only are not acceptable. These authorizational limits are to be considered
the overall maximum City standards and the individual department heads may
wish to establish their own internal authorizational limits as long as
they are within the City standards. Any requests for an exception to the
above should be sent to the Purchasing Agent in memo form; following
review with the Director of Finance, the Purchasing Agent will notify the
department of approval or disapproval of the request.

regulations.

WHEREAS, the City of Iowa City Animal Control Division provides certain
services to the community regarding animal control and licensing of ani-
mals kept by residents of Iowa City; and
WHEREAS, pursuant to Section 7-25 of the Code of Ordinances of the City of
Iowa City, the City Council may by resolution adopt fees, regulations, and
guidelines for the provision of said services and for the licensing of

I. Reclaim fee for impounded dogs, cats, and other animals:
a) First reclaim within a given calendar year:

cats and other pet animals: $5.00
b) Second reclaim within a given calendar year:

6. The license fee for neutered male and spayed female animals shall be
$5 per year; the license for unaltered animals of either sex shall be
$15.00 per year; senior citizens will receive 50% discount on these
license fees.
7. Adoption Fees:
a) Adoption fees are set in the following amounts:
(1) dogs - $25.00
(2) cats - $15.00
b) In addition to paying the fee established in a above, persons
adopting an unaltered animal shall make the following deposit with
the animal shelter;

c) Upon the submission of written proof from a licensed veterinarian
that the unaltered adopted animal has been altered, the animal
shelter shall return the money deposited pursuant to b) above,
subject to the following conditions;
(1) if the animal was six (6) months of age or older at the time
of adoption, proof that the animal was altered within thirty
(3) days of adoption,
(2) if the animal was less than six (6) months of age at the time
of adoption, proof that the animal was altered within thirty
(30) days of the date on which it became six (6) months of
age.

ria of the adoption of a pet animal, be required to pay an animal
adoption fee to the City of Iowa City, provided that a pet suit-
able for adoption is available from the animal shelter. Persons
so qualified shall not be required to pay for housing, food or

neutering of the pet, costs of required vaccinations and any
veterinary costs, and such persons shall be required to make the
deposit set forth in b) above.
8. The animal shelter may waive the time periods established herein for
good cause shown.
