IMPLEMENT THE AMENDMENTS AAUTHAMENDING ORIZED2BYNHFF 318ND 2OF THE 72ND
GENERAL ASSEMBLY OF THE STATE OF IOWA RELATING TO MUNICIPAL
INFRACTIONS. (passed and adopted)
Comment: During the 1986 legislative session, the Iowa
Legislature enacted legislation which authorized cities to
enforce certain of their ordinances by filing municipal
infractions, which are civil proceedings, rather than by
filing criminal misdemeanor charges which was the only
enforcement tool formerly available. Under this new proce-
dure, the City can not only obtain a higher penalty, but
the court can also order the violator to comply with par-
ticular code sections and can authorize the City to take
corrective action. During the 1987 legislative session,
the Legislature expanded the list of violations which are
subject to this new procedure. The subject ordinance
brings our municipal code provisions on municipal
infractions into line with the new provisions of the Iowa
Code.
