Consider setting a public hearing for December 22, 1987, on an ordinance to rezone from RS -5 to RS -8 property at 612 and 620 Kirkwood Avenue and from P to RS -8 property at the corner of Kirkwood and Dodge Street. Comment: At their November 19, 1987, meeting, the Planning and Zoning Commission recommended by a vote of 6-0 approval of a request to rezone the site of the old Kirkwood Schoolhouse from P to RS -8. They also recom- mended approval of the rezoning of two adjacent proper- ties, west of the schoolhouse, from RS -5 to RS -8. These recommendations are consistent with that of the staff. Action: 0 6za Consider setting a public hearing for December 22, 1987, on an ordinance to vacate a portion of Clinton Street abutting the site of the National Guard Armory (V-8705). Comment: The Planning and Zoning Commission recom- mended at their November 19, 1987, meeting by a vote of 6-0 vacation of a portion of the Clinton Street right-of-way. The National Guard has requested the vacation to permit lease of the property by the Guard for additional parking. The recommendation of the Commission is consistent with that of the staff. Consider an ordinance to amend the Zoning Ordinance to require a demonstration of special circumstances for the granting of certain special exceptions. (first consideration) Comment: The proposed amendment applies only to spe- cial exceptions to modify yard requirements. (second consideration) Comment: The proposed amendment will permit light manufacturing, compounding, assembly and treatment of articles as a provisional use in the CI -1, Intensive Commercial Zone, provided that the floor area for each occupant engaged in these uses does not exceed 5,000 square feet. The amendment will also permit light manufacturing uses which occupy up to 10,000 square feet as a special exception. The Planning and Zoning Commission recommended denial of this amendment by a vote of 2-3 (Scott, Cooper and Clark voting no). This recommendation is in opposition with that of the staff. Consider an ordinance to amend the Zoning Ordinance to j1'R7 32JF`1 permit accessory apartments in residential zones. (passed and adopted) Comment: At its September 17, 1987, meeting, the Planning and Zoning Commission recommended approval of an ordinance permitting accessory apartments within certain residential zones by a vote of 5-2 (Clark and Dierks voting no). At the Commission's recommendation, accessory apartments have been restricted such that one of the units must be occupied by either an elderly person 62 years of age or older or a handicapped indi- vidual. Action:„�o bey �- f. Consider a resolution approving the preliminary subdi- 31 i• 9` vision plat of Pleasant Valley Estates, located ap- proximately one mile south of Iowa City off of Sand Road. (S-8723) Comment: The Planning and Zoning Commission recom- mended by a 6-0 vote approval of the preliminary plat for Pleasant Valley Estates, a 12 -lot County subdivi- sion. This recommendation is consistent with that of the staff; all deficiencies noted in the staff report have been resolved. Action: U g. Consider a recommendation to the Coralville City Coun- cil concerning the rural subdivision of Riverview Estates, Part 2. (CS -8703A) Comment: At their November 19, 1987, meeting, the Planning and Zoning Commission recommended by a vote of 5-1 (Dierks voting no) that the Coralville City Council be advised that the preliminary plat of Riverview Estates Part 2 be approved only if certain deficiencies on the plat are resolved. Riverview Estates Part 2 is within the two-mile extraterritorial jurisdiction of Coralville in an area where Iowa City provides review and comment on plats. Comment: On May 12, 1987, Youth Homes, Inc. entered into an agreement with the City of Iowa City to use Community Development Block Grant (CDBG) funds to acquire, rehabili- tate and utilize a facility for the Girls' Group Home and to remodel the Emergency Shelter for Youth. Although Youth Homes is proceeding with the Emergency Shelter rehabilita- tion, they have experienced difficulty locating a suitable site for the Girls' Group Home. Approval of this amendment will give Youth Homes reasonable time to locate and acquire a suitable structure which meets the City's zoning require- ments. Comment: This Resolution is required to finalize the as. sessment proceedings as set up by bond counsel. Action: ���. ITEM NO. 13 - CONSIDER AN ORDINANCE 'STREETS. SIDEYALKS. AID PUBIAMENDING PLACES. 31 ENTITLE ORDINANCES OF THE CITY OF IMA CITY.'IOWA THE CODE OF SECTION 31-11 MEIN TO ADO A PROVISION FOROYREQUIRING N EROSION CONTROL DEPOSIT AS A CONDITION TO THE ISMUCE AN BUILDING PERMIT. (second consideration) MMANCE OF A Comment: The proposed amendment offers the option of a one-time contractor's continuous escrow deposit as an alternative to the present requirement of E500 per lot deposit. This money would be collected by the City as a condition to the issuance of a building permit in order to cover the cost of clean up of dirt and debris from public rights-of-way when a contractor does not do the clean up work. Staff recommends that Council waive the necessary readings and vote for passage. Comment: This resolution establishes the amount of the escrow deposit as an individual deposit of $500 per lot or, in lieu thereof, a $1,000 continuous deposit to cover work on more than one lot at any given time. / Action: � a� Cho/ )'/01� Val ITEM NO. 15 - CONSIDER AN ORDINANCE ADOPTING THE 1987 NATIONAL ELECTRICAL CODE, AS AMENDED. SAID CODE SHALL BE KNOWN AS THE IOWA ai Q�7 33$O CITY ELECTRICAL CODE. (passed and adopted) Comment: The Electrical Board of Appeals has reviewed the 1987 National Electrical Code and has suggested several amendments to accommodate local conditions and practices. The 1987 N.E.C. is to replace the 1984 N.E.C. Action:%/i�iL1J h� y s o• Y Agenda Iowa City City Council December 1, 1987 Page 11 ITEM NO. 16 - CONSIDER AN ORDINANCE MENDING CHAPTER 7 OF THE CODE OF ORDINANCES OF THE CITY OF IOWA CITY, IOWA, BY REPEALING SECTION 7-36 THEREOF AND ENACTING IN LIEU THEREOF A NEW Rii- SECTION 7-25, AND BY REPEALING SECTION 7-57 THEREOF AND ENACTING IN LIEU THEREOF A NEW SECTION 7-57, PROVIDING FOR THE ESTABLISHMENT OF FEES FOR BOARDING, RECLAIMING AID ADOPTIONS OF IMPOUNDED ANIMALS, AND FOR ACCEPTANCE OF ANIMALS SURRENDED FOR ADOPTION OR DISPOSMLL. AHD PROVIDING FOR THE SETTING OF THE AMOUNTS OF SUCH FEES AN FOR THE ADOPTION OF REGULATIONS AND GUIDELINES FOR THE COLLECTION OF SUCH FEES BY RESOLUTION. (passed and adopted) Comment: This ordinance provides for the establishment of a wide range of fees for the provision of animal control services, and provides that the amount of those fees shall be set by the City Council by resolution. The ordinance also provides that the Council can adopt regulations and guidelines for the administration and collection of those fees by resolution. The resolution which follows this item on the agenda adopts a Schedule of Fees, Regulations and Guidelines for the Provision of Animal Control Services and for Licensing. Under the new schedule, senior citizens will be allowed to adopt animals without paying the fee normally required. Comment: After the above ordinance is passed and adopted, Council may consider this resolution. Staff recommends approval. Action: .1. Y Agenda Iowa City City Council December 1, 1987 Page 12 ITEM NO. 18 - CONSIDER AN ORDINANCE AMENDING CHAPTER 1 ENTITLED 'GENERAL PROVISIONS' OF THE CODE OF ORDINANCES OF THE CITY OF IOWA CITY, IOWA, $7 335a N TO IMPLEY IMPLEMENT THE AMENDMENTS AAUTHAMENDING ORIZED2BYNHFF 318ND 2OF THE 72ND GENERAL ASSEMBLY OF THE STATE OF IOWA RELATING TO MUNICIPAL INFRACTIONS. (passed and adopted) Comment: During the 1986 legislative session, the Iowa Legislature enacted legislation which authorized cities to enforce certain of their ordinances by filing municipal infractions, which are civil proceedings, rather than by filing criminal misdemeanor charges which was the only enforcement tool formerly available. Under this new proce- dure, the City can not only obtain a higher penalty, but the court can also order the violator to comply with par- ticular code sections and can authorize the City to take corrective action. During the 1987 legislative session, the Legislature expanded the list of violations which are subject to this new procedure. The subject ordinance brings our municipal code provisions on municipal infractions into line with the new provisions of the Iowa Code. (passed and adopted) Comment: This ordinance and the two which follow standardize the City's requirements and procedures regard- ing indemnity and insurance for plaza, park, and street use permits. Under the new Procedure, persons or organizations desiring to use City Plaza, parks, or streets must fill out and sign an application which includesan indemnity agree- ment holding the City harmless from liability. The appli- cant ance in the amount would $300,00o efor peto rsonamit lrinjuroof y and Insur$50,000 for property damage. Other governmental agencies sponsoring such events would be exempt from the insurance requirement. As to all other users, the City Manager would have the discretion to waive the insurance requirement, or increase it, depending on the degree of risk involved in the pro- posed activity involving use of City street or plaza prop- erty. The same discretion would be vested in the Parks and Recreation Director with regard to insurance requirements for permits to use park facilities. ND 33 IOWA, By AMENDING SECTIONS 33-46 A-166, MIND BY REPEALING SECTION 33-167 THEREIN TO PROVIDE A UNIFORM PROCEDURE FOR BILLING AND COLLECTION OF SEWER AND WATER SERVICE ACCOUNTS, (first consideration) Comment: The subject ordinance amends Chapter 33 to make uniform the provisions and procedures for billing and collecting city sewer service and water service accounts. As to users with multiple accounts at multiple service locations, the ordinance provides for discontinuance of service at all such locations if one or more accounts become delinquent. Finally, the ordinance formalizes a number of billing, accounting, and collection practices which have traditionally been utilized by the Finance Department.
