CONSIDER SETTING A PUBLIC HEARING FOR SEPTEMBER 16, 1986. ON AN APPLICATION TO REZONE PROPERTY LOCATED AT 19 EVANS STREET FROM RNC -20 TO CO -1. Comment: On August 21, 1986, the Planning and Zoning Commission recommended to deny the rezoning request submitted by Dr. William Dull, on an affirmative mo- tion, by a vote of 0-5. It was the Commission's find- ing that the requested rezoning is inconsistent with the land use designation of the 1983 Comprehensive Plan Update; would be contrary to the residential character of the surrounding neighborhood; and, would permit commercial office uses whose impacts would conflict with the continued use and enjoyment of existing resi- dences mendation risuconsistent with thanding the site. t Commission's a report dated August 7, 1986. (first consideration) Comment: At its July 24, 19860 meeting, the Planning and Zoning Commission recommended by a vote of 4-1 (Horowitz voting no) adoption of a Zoning Ordinance amendment which would prohibit the internal illumina- tion of more than 25 percent of an awning. This recom- mendation is consistent with an amendment proposal submitted by the staff. Page 5 ITEM NO. 6 - PUBLIC HEARING ON THE PROPOSAL TO ISSUE NOT TO EXCEED $4,500,000 INDUSTRIAL DEVELOPMENT REVENUE BONDS (MILLARD WAREHOUSE, IOWA CITY PROJECT). Comment: The public hearing was opened at the August 26, 1986, meeting and adjourned to this meeting. The public hearing is now being held to receive input regarding the proposal to issue the bonds. ITEM NO. 7 - CONSIDER A RESOLUTION TO PROCEED WITH THE ISSUANCE AD SALE ,�R� OF NOT TO EXCEED $4,500,000 AGGREGATE PRINCIPAL AMOUNT OF INDUSTRIAL REVENUE BONGS (MILLARD WAREHOUSE, IOW CITY PROJECT), SERIES A OF THE CITY OF IOWA CITY, IOW. Comment: This resolution authorizes proceeding with the bond issue. ITEM N0. 8 - PUBLIC HEARING TO CONSIDER AN ORDINANCE ANENDING CHAPTER 1 OF THE MUNICIPAL CODE ADDING PROCEDURES AND PENALTIES FOR MUNICIPAL INFRACTIONS. Comment: This ordinance allows certain Code violations to be treated as civil offenses (municipal infractions) pun- ishable by civil penalty (fine) and the establishment of an infraction citation approach (sometimes referred to as the "traffic ticket" approach). I i I ITEM NO. 13 - RECOMMENDATIONS OF BOARDS AND COMMISSIONS. a. Consider recommendation of Riverfront Commission that Council approve amendments to Resolution No. 73-158 and the 1980 Riverfront Commission bylaws to enable the Commission to extend its charges to tributaries of the Iowa River in Iowa City, such as Ralston Creek. The specific amendments requested by the Commission are cited below in bold print: 1. Resolution No. 73-158. Resolution Establishing a ver ron Goon ss on for the City of Iowa City, Iowa, and Establishing the Membership, Terms, Duties, Powers and Authority of said Comnission. Item 4: The Comnission shall investigate, study, review and analyze Riverfront needs within the floodplain areas along the Iowa River and its tributaries, and shall investigate and determine what rules and regulations are needed and what policies should be established relating to the Riverfront in Iowa City, Iowa, and shall study and Investigate and make reconnendations relating to the problem of clearing, planting, and construction of riverbank and creekbank areas and the problem of providing green areas in floodplains along the Riverfront. Comment: Saab-Scania submitted the only bid for the three buses which are being purchased by the Transit System. A memorandum regarding this matter is included in the information packet. This resolution authorizes the City Manager to enter into a purchase agreement with Saab-Scania. Bylaws, December 1980 Article IV Section 4: Periodically, the Commission shall review the policies and programs of the City, relating to the River, the Riverfront, and including the tributaries, such as Ralston Creek and make such recommendations to the City Council as are deemed necessary. Comment: A memorandum attached to the agenda from Riverfront Commission Chairperson, Ray Helmer, relates the reasons for the Commission's recommendation to include tributaries within its advisory authority and requests an opportunity for the Commission to meet with the Council to discuss the recommendation. Your agenda also includes a memorandum from PPD Director, Don Schmeiser, asking that Council defer consideration of the matter until City T.ommission�ittee reorganiza- tion issues are resolved. Page 9 ITEM N0. 15 - CONSIDER A RESOLUTION AUTHORIZING THE MAYOR TO SIGN AND THE CITY LERK TO ATTET AN AMENDING THE SEPTEMBER I 19 5,CAGREEMENTNT BETWE N ATHE CITTYY OF I CITY AND HOLIDAY WRECKER. Comment: Holiday Wrecker Service is requesting an increase in Standard Tow Rates from $30 to $35 per vehicle due mainly to increased insurance premiums over the last two years. The agreement allows for any fee or change of charges agreed upon 30 days on or before the anniversary date. Staff has been reviewing the request and considers it reasonable. Holiday Wrecker has not increased the Standard Tow Rate since 1981 and the Department of Trans- portation has established rules that allow for compensation not to exceed $35 per vehicle as outlined in the agreement. The increase will have minimal impact on the City of Iowa City since the majority of tows are for non -City owned vehicles, vehicles impounded or abandoned. Page 10 ITEM NO. 18 - CONSIDER AN ORDINANCE AMENDING THE FIRE CODE TO PROVIDE THAT EACH DAY A VIOLATION CONTINUES SHALL BE A SEPARATE OFFENSE. (first consideration) Comment: The only change is the last sentence, which reads, "Each day a violation occurs or is permitted to exist after conviction constitutes a separate offense." This change would concur with the 1985 CODE OF IOWA, CHAP- TER 100.35 STATE FIRE MARSHAL SECTION. The staff agrees that this change is necessary for proper enforcement of the Fire Code. Action: YItlV� /s%' e- zip .Qixb ITEM NO. 19 - CONSIDER AN ORDINANCE GRANTING TO IOWA -ILLINOIS GAS AND ELECTRIC COMPANY, ITS SUCCESSORS AMD ASSIGNS, THE RIGHT AND 31 4 1,0 FRANCHISE TO ACQUIRE, CONSTRUCT, ERECT, MAINTAIN AND OPER- ATE IN THE CITY OF IOW CITY, AN ELECTRIC LIGHT AND POWER SYSTEM FOR A PERIOD OF FIFTEEN YEARS AND TO FURNISH AND SELL ELECTRIC ENERGY TO SAID CITY AND ITS INHABITANTS. (passed and adopted) Comment: Final consideration of this ordinance was de- ferred from the Council meeting of August 26, 1986. The City has conducted a public hearing on the proposed Iowa - Illinois Gas and Electric Company franchises, and the City Council has given both franchise ordinances first and second consideration. Upon third consideration and passage of those ordinances, the Council will then have to request that the matter be put on the ballot for submission to the electorate in the November general election. (See Item No. 23.) You may recall, staff earlier recommended that final approval of the franchise ordinances not occur until the details of an agreement between the City and Iowa -Illinois, relating to the transportation of power from the proposed Coralville milldam power generation project, had been worked out. This agreement is on the agenda as Item No. 22. 'r Agenda Iowa City City Council Regular Council Meeting September 9, 1986 - 7:30 P.M. Page 11 Action: Due to the reorganization of State government, the Iowa Commerce Commission is now known as the Utilities Division of the Iowa Department of Commerce. Staff recommends that the franchise ordinances be amended to reflect this name change. Since this is not a substantive amendment, no further considerations will be required prior to passage. Copies of the changed pages are included in the Council packet. Page 12 -T ITEM NO. 22 - CONSIDER A RESOLUTION AUTHORIZING AND DIRECTING THE MAYOR Q1 D TO EXECUTE AND THE CITY CLERK TO ATTEST AN AGREEMENT FOR ELECTRICAL GENERATION, DISTRIBUTION AND SERVICE BETWEEN THE CITY OF IOWA CITY, IOWA, AND IOWA -ILLINOIS GAS b ELECTRIC COMPANY IN CONNECTION WITH A CITY PROJECT TO ESTABLISH A HYDRO -ELECTRIC GENERATION PLANT AT THE CORALYILLE MILLDAM SITE ON THE IOWA RIVER. The City is currently studying the feasibility of a hydro- electric generating project on the Coralville Milldam site on the Iowa River, With the power generated at that site to be used by the City at the Water Treatment Plant. The electric franchise ordinance just adopted by the City provides that Iowa -Illinois Gas and Electric Company Will, if requested by the City, transport or wheel the electrical energy generated at such a facility for use at other City facilities. The Company and the City have negotiated such an agreement with regard to the proposed hydro -electric generating plant at the Coralville Milldam site. The agreement is contingent upon voter approval of the electric franchise ordinance. Action: ELECTRIC FRANCHISES TO IOWA ITEM NO. 23 - RESOLUTION CALLING A SPECIAL ELECTION ON PROPOSITI011� TO GRANT GAS AND -ILLINOIS GAS AND ELECTRIC COMPANY. Comment: Chapter 364 of the Iowa Code provides that a city may grant a franchise by adopting a franchise ordinance but that no such franchise ordinance shall become effective unless approved at an election. The City Council has given third and final consideration and has adopted ordinances granting gas and electric franchises to Iowa -Illinois Gas and Electric Company. The resolution subject hereof calls an election on said franchise ordinances to occur in con- junction with the general election to be held on November 4, 1986.
