a. Consider setting a public hearing for October 7, 1986,
on an amendment to the Zoning Ordinance to permit small
animal clinics as a provisional use in the CC -2 zone.
Comment: At its meeting of September 5, 1986, the
Planning and Zoning Commission recommended by a vote of
6-1 (Jordan voting no) adoption of an amendment to the
Zoning Ordinance to permit small animal clinics as a
provisional use in the CC -2 zone. The staff concurs
with this recommendation.

b. Consider setting a public hearing for October 7, 1986,
on an amendment to the Zoning Ordinance to clarify the
definition of roomer and of rooming unit.
Comment: The Planning and Zoning Commission, at its
September 5, 1986, meeting, recommended by a vote of
7-0 approval of an amendment to the Zoning Ordinance to
delete reference to the rooming house operator as the
family from the definition of roomer and to make the
definition of rooming unit consistent with the Housing
Code. This recommendation is consistent with that of
the staff.

c. Consider setting a public hearing for October 7, 1986,
to permit planned development housing plans on tracts
less than two acres but greater than one acre.
Comment: The Planning and Zoning Commission recom-
mended, at its September 5, 1986, meeting, approval of
amendments to the Planned Development Housing Overlay
Zone (OPDH) to permit the use of this clustering tech-
nique on tracts of land which are less than two acres
but greater than one acre, where the land is surrounded
by existing development, is characterized by environ-
mentally sensitive or natural features, has older
structures on the tract or in the area, or has scenic
assets. The ordinance requires notice be given to
surrounding property owners and specific criteria be
met. The Commission's recommendation was on a vote of
7-0.

d. Public hearing on an application to rezone property
located at 19 Evans Street from RNC -20 to CO -1.
Comment: On August 21, 1986, the Planning and Zoning
Commission recommendeddenial of the rezoning request
submitted by Dr. William Dull, on an affirmative mo-
tion, by a vote of 0-5. It was the Commission's find-
ing that the requested rezoning is inconsistent with
the land use designation of the 1983 Comprehensive Plan
Update; would be contrary to the residential character
of the surrounding neighborhood; and would permit
i commercial office uses whose impacts would conflict
with the continued use and enjoyment of existing resi-
dences surrounding the site. The Commission's recom-
mendation is consistent with that of staff included in
a report dated August 7, 1986. A memo concerning this
item is included in the Agenda packet.

Commission:
(1) That a budget of ;1,000 for FY1988 be approved for
the R.C.C. (;300 for speakers; $450 for service of
the Probeye infrared imager; and $250 for promo-
tional and educational literature to hand out to

the general public).
(2) That the City provide office space and telephone
for member use.
(3) That members receive a copy of the Coralville Mill
Dam Study. q
Comment: The City Council sbeu]d address the first two
items during budget discussions. Copies of the Mill
Dam Study will be furnished to RCC members as soon as
it is available.

(ai„ ITEM NO- 11 - CONSIDER A RESOLUTION AUTHORIZING ABANDONED BICYCLE SALE.
_Comment: The Police Department will hold a Fall Bicycle
Auction on Sunday, October 26, 1986, in Chauncey Swan Park.
This auction is necessary to provide more space for the
anticipated winter accumulation. Approximately 150 bicy-
cles are presently stored and will be subject to sale.

ITEM NO. 12 - CONSIDER AN ORDINANCE AMENDING THE FIRE CODE TO PROVIDE
THAT EACH DAY A VIOLATION CONTINUES SWILL BE A SEPARATE
OFFENSE. (second consideration)
Canmpnt: The only change is the last sentence, which
reads, .
exist after conviction constitutes a separate offense."
This change would concur with the 1985 CODE OF IOWA, CHAP-
TER 100.35 STATE FIRE MARSHAL SECTION. The staff agrees
that this change is necessary for proper enforcement of the
Fire Code.

ITEM NO. 13 - CONSIDER AN ORDINANCE MENDING CHAPTER 1 OF THE NINICIPAL
CODE ADDING PROCEDURES AMD PENALTIES FOR NNIICIPAL
INFRACTIONS. (first consideration)
Comment: This ordinance allows certain Code violations to
be treated as municipal infractions punishable by a civil
penalty and the establishment of an infraction citation
approach (sometimes referred to as the "traffic ticket"
approach) The primary objectives of this amendment are to
improve the efficiency and effectiveness of Code enforce-
ment. Staff recommends that Council waive the readings and
give this item final consideration.
