'iCQA&J City Clerk 0 ayor /S37 kd RESOLUTION NO. RESOLUTION SETTING FORTH REASONS FOR THE DENIAL OF REZONING OF PROPERTY LOCATED AT 19 EVANS STREET. WHEREAS, Dr. William Dull has submitted an application to rezone property located at 19 Evans Street from RNC -20 to CO -1; and WHEREAS, the Department of Planning and Program Development analyzed the l application in its Staff Report dated August 7, 1986, and recommended i denial of the application, and WHEREAS, on August 21, 1986, the Planning and Zoning Commission, on an affirmative motion to recommend the rezoning, voted none in favor, five against, for the following reasons: 1. It is inconsistent with the City's Comprehensive Plan; 2. The request would constitute illegal spot zoning, by zoning the sub- ject property to permit uses different from the uses permitted on adjacent properties; 3. The proposed rezoning is inconsistent with established land use pat- terns and would be incompatible with the use and enjoyment of sur- rounding residential properties; and WHEREAS, the City Council has examined the report of the Department of Planning and Program Development, and Planning and Zoning Commission ac- tion, and concurs with their findings. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF IOWA CITY, IOWA, THAT: I The application to rezone property located at 19 Evans Street from RNC -20 to CO -1 is disapproved on the basis of the following: 6 1. It is inconsistent with the City's Comprehensive Plan, as set forth in the 1983 Comprehensive Plan Update; 2. The request would constitute illegal spot zoning; and 3. ATTEST: MAYOR TRh 14 al Approved i RESOLUTION N0: 86-296 RESOLUTION AUTHORIZING ABANDONED BICYCLE SALE WHEREAS, the Police Department of the City of Iowa City, Iowa has during the past months stored a number of bicycles which have been abandoned by their owners; and WHEREAS, the Police Department has made every effort to locate the owners of these bicycles and has been unsuccessful in its efforts; and WHEREAS, the total number of bicycles which have been accumulated have now become a storage problem, and the same are a burden on the City of Iowa City; and WHEREAS, it is in the public interest that said bicycles be sold at public auction to the highest bidders. NOW, THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF IOWA CITY, IOWA: 1: That the Police Chief- is hereby authorized and directed to sell the abandoned bicycles at public auction to the highest cash bidder there- fore, and that Notice of said sale shall be published in the Iowa City Press -Citizen once each week for two consecutive weeks, the date of last, publication being no more than one week prior to the day of the sale. 2: That the proceeds from the sale of these bicycles shall be paid into the Public Safety Fund portion of the budget of the City of Iowa City Iowa, after first deducting therefrom the costs of the sale: It was moved by McDonald and seconded by strait the Resolution be adopted, an upon roll call there were: AYES: NAYS: ABSENT: X AMBRISCO X BAKER X COURTNEY X DICKSON X MCDONALD x_ STRAIT X ZUBER Passed and approved this 16th day of September 1986.
