HomeMy WebLinkAbout1985-01-22 ResolutionRESOLUTION NO. 8S-17 RESOLUTION AUTHORIZING AND DIRECTING THE SOLICITATION OF OFFERS AND RECEIPT OF BIDS TO PURCHASE CERTAIN LAND FOR PRIVATE REDEVELOPMENT, KNOWN AS PARCEL "A-1" LOCATED IN THE LOWER RALSTON CREEK AREA OF IOWA CITY; SETTING A PUBLIC HEARING FOR FEBRUARY 26, 1985, ON THE PROPOSED SALE AND CONVEYANCE OF SAID LAND; AND DIRECTING THE CITY CLERK TO PUBLISH NOTICE OF SUCH ACTIONS. WHEREAS, the City of Iowa City, acting as the Grantee/Municipality pursuant to the provisions of Title 24 CFR, Part 570, and provisions of Chapter 403, Code of Iowa, has used Community Development Block Grant funds for land acquisition and clearance to facilitate improvements to the Lower Ralston Creek Area of Iowa City, and WHEREAS, the City of Iowa City wishes to offer a remaining parcel of land for private redevelopment. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF IOWA CITY, IOWA: 1. That, until 10:00 AM, February 25, 1985, the City Manager and/or his designee is hereby authorized and directed to solicit offers to purchase certain city -owned land known as Parcel A-1, fronting on Benton Street (near Dubuque Street intersection) legally described as the East 1/2 of Lot 36 of White's Subdivision of Outlot 4 of the County Seat Addition to Iowa City. 2. That a public hearing is hereby set for Tuesday, February 26, 1985, at 7:30 PM in the Council Chambers, Iowa City Civic Center, 410 E. Washington Street, Iowa City, Iowa, at which time and place the City Council will consider the sale and conveyance of said parcel A-1 for private redevelop- ment. 3. That, as required by law, the City Clerk is hereby authorized and directed to publish notice of solicitation of offers to purchase and notice of public hearing on the proposed sale and conveyance of said parcel. The correct date for submitting bids is February 25, 1985. bj2/4 14�7 TME PROPOSAL All bids submitted to the City should consist of two (2) copies of each item detailed below. Bids should be submitted no later than 10:00 AM, February 25,**** 1985, at which time the proposals shall be opened. After that time, no new proposals will be accepted and no modifications to those submitted will be allowed unless specifically requested the City. All bids must be submitted in substantially the same format as the forms furnished by the City and must be complete in all respects. Any additions, deletions or modifications of the Offer to Purchase must be justified and explained in full detail in the narrative statement attached to the offer. Prospective purchasers/developers may obtain a complete bid packet from the Office of the City Clerk upon request. Materials and forms to be included in the proposal are: 1. An Offer to Purchase. 2. A bid security deposit of $500 (cashier's or certified check or money order payable to the City of Iowa City). 3. A written narrative describing the proposed development (i.e., use, size, cost, appearance, etc.). 4. A sketch or site plan of the proposed project development. 5. A development schedule (not to exceed two years). 6. A Redeveloper's Statement of Qualifications and Financial Responsibility. Concurrent with the opening of the bid period for purchase and development of Parcel A-1, the City has given public notice of its intent to enter into an agreement or contract for the sale of the parcel. If the City Council approves the resolution on the January 22 agenda, the staff will proceed according to the following schedule: January 23 City Clerk publishes notice of public hearing and request for offers to purchase. A 30 -day bid period is required. February 25 Deadline for receipt of offers to purchase. February 26 City Council holds public hearing to consider proposed sale and offers to purchase. Thereafter, the City Council may consider entering into an agreement to sell the parcel to a designated party. As stated in the attached Prospectus, the sale of Parcel A-1 would-be subject to the following stipulations: 1. The minimum sale price for the parcel is $13,000 based on a November 1982 appraisal. A $500 bid security deposit is required. 2. The allowed use of the parcel is any use consistent with its current CI -1 (intensive commercial) zoning classification. 3. The parcel must be developed within two years of the conveyance of the property. bjl/4 1,97 I INTRODUCTION The City of Iowa City is seeking a purchaser/developer for property located on the south side of the 200 block of East Benton Street in the Lower Ralston Creek Area, south of the Iowa City central business district. This property is known as "Parcel A-1" and consists of the east one-half of Lot 36 in White's Subdivision of Outlot 4 of the County Seat Addition to Iowa City, Iowa, and measures 60 feet by 65 feet more or less. The City desires to have this parcel developed in a manner consistent with the Iowa City Zoning Ordinance and the Iowa City Comprehensive Plan. THE PARCEL Location: The map on the following page shows the location of Parcel A-1 on the south side of Benton Street, between Dubuque and Gilbert Streets. Surrounding Land Uses: North - commercial, north of Benton Street South - commercial East - unpaved alley and vacant land adjacent to Ralston Creek West - commercial Parcel Size and Topography: This parcel is approximately 3,900 square feet in size. The topography of the site is generally level and is situated above the adjoining street grades. Minimum Bid Price: $13,000 Zoning: Current zoning is CI -1 (Intensive Commercial) which is intended for a variety of commercial sales and service uses. Prospective developers are encouraged to consult the Iowa City Zoning Ordinance for more detail. Permitted Uses: Any use which conforms to the CI -1 classification in the Iowa City Zoning Ordinance. Utilities: City water and sewer, and telephone, electricity, and natural gas services are available to the site. Access: It is intended that vehicular access to this parcel be gained from the alley to the east of it, although there is a 65 foot frontage on Benton Street. Condition of Site: The City makes no representation as to the surface or subsurface conditions of this site. Bids must be submitted by 10:00 AM on February 25, 1985, at the City Clerk's Office, Iowa City Civic Center, 410 E. Washington Street, Iowa City, Iowa 52240. Bids received in the City Clerk's Office after this time will not be considered. All bid documents become public information, and after the opening of the bids there will be no attempt to withhold the names of those submitting proposals. All materials submitted to the City shall become the exclusive property of the City and may be utilized as the City deems proper. During the period when proposals are being accepted, no official oral interpre- tation or clarification of this offering will be made. Requests for official interpretation or clarification must be submitted in writing. All replies to such requests will be issued as addenda to this prospectus and sent to all concerned parties. Upon receipt of the bids, City staff will review and evaluate proposals. The City Council may, after recommendation from the staff, designate a successful bidder. Designation of the successful bidder will be made by the City Council as expeditiously as possible, on or after February 26, 1985. The City ex- pressly reserves the right to reject any or all bids received and to waive any irregularities in bids and bidding procedures. During the course of review and evaluation of the bids, the City may wish to meet with one or more of the bidders for further clarification of the bids. The City reserves the right to initiate such meetings. These meetings may be conducted on an individual or collective basis involving one or more of the prospective developers. Following the receipt of bids, the City also reserves the right to negotiate with bidders concerning the terms and conditions of their bids as long as any of the agreed upon changes do not materially effect the conditions stated in this prospectus. Unless this period is extended by the City, the bidder so designated will be required to enter into a real estate contract within sixty (60) days after the designation of the successful bidder. If the real estate contract has not been executed before the conclusion of this sixty day period, the City reserves the right, at its sole option, to rescind the designation of the bidder or to extend the time allowed for the negotiation and execution of the contract. Should the City exercise its option to rescind the bidder's designation, the City may initiate negotiations with one or all of the other bidders who submitted a proposal, or the City may begin a new selection process.
