Item No. 2 - CONSIDER SETTING A PUBLIC HEARING FOR APRIL 9, 1985, ON A RESOLUTION TO DISPOSE OF A PORTION OF THE HIGHWAY I WEST RIGHT-OF-WAY ADJACENT TO RUPPERT SUBDIVISION PART ONE AT 809 HIGHWAY 1 WEST. Comment: On November 6, 1984, Council agreed to accept approximately 1.11 acres of Highway 1 West right-of-way adjacent to Ruppert Subdivision Part One, if the right-of-way was vacated and conveyed by the Iowa Department of Transportation for the construction of a frontage road for the Mary Hartwig Inc. Auto Center. The City has now received a patent for this right-of-way, property. In November 1984 Council also agreed to consider conveying a small portion of excess right-of-way (approximately 9,000 square feet) not required for the pro- posed frontage road to Mary Hartwig Inc. This matter is being expedited because there has been such a delay in receiving the patent from the State, and Mr. Hartwig desires to begin construction as soon as possible. However, because Mr. Hartwig was unavailable at the time this comment was written, it is not possible to state the agreed to price for purchase of the parcel. The amount will be available at an early date. It is reconnended that the property sale also be approved on April 9. A map showing the excess right-of-way to be conveyed is attached. Moved by Zuber, seconded by Dickson, to set a public hearing on 4/9/85, on a resolution to dispose of a portion of the Highway 1 West right-of-way adjacent to Ruppert Subdivision Part One at 809 Highway 1 West (Mary Hartwig Inc. Auto Center). The City Manager stated the applicant's attorney has notified the City that an offer to buy the parcel will be in the mail and hoped Council would proceed with the property sale on the same night the public hearing is held.
