The applicant shall take all reasonable precautions during construction and future maintenance to protect and safeguard the lives and property of the traveling public and shall save the State and the Iowa Department of Transportation harmless of any damage or losses that may be sustained by the traveling public on account of such construction or maintenance operations. 2. The applicant shall hold the State and the Iowa Department of Transportation harmless of any damage that may result to said highway because of the construction or maintenance of the facility, and shall reimburse the State or the Iowa Department of Transportation foranyexpenditures that the State of Iowa or the Department of Transportation may have to make on said highwayon account of said applicant's construction. 3. The applicant, and his contractors, shall carry on construction and maintenance with serious regard to the safety of the public. I Traffic protection shall be in accordance with Part %,I of the current Iowa Department of Transportation Manua! on Uniform TraIf c Control Devices for Streets and Highways. The Department will loan the required signs to the applicant who shall be responsible for placing the signs and covering or removing when not in use. Flagging operations are the responsibility of the applicant. The applicant shall return the signs upon completion of the construction operation. 4. The applicant shall seed and mulch all disturbed areas within the highway right of way and shall be responsible for the vegetative as such as driveways or shouldersand sodded waterways and plantings which cover until it becomes well established. WHEREAS, the City Council of the City of Iowa City established by Resolu- tion 83-187 and amended by Resolution 83-409 a development policy in East and Northeast Iowa City to limit development in those areas pending resolution of sewage treatment and collection problems; and WHEREAS, the City Council established by Resolution 84-96 a commitment to rescind said policy no later than May 1, 1985; and WHEREAS, the City Council has resolved to eliminate the sewage treatment and collection problems which precipitated the development policy. WHEREAS, the City of Iowa City has a municipal transit system; and WHEREAS, the Secretary of Transportation is authorized to make grants for mass transportation projects; and WHEREAS, the contract for financial assistance will impose certain obligations upon the applicant, including the provision by it of the local share of project costs; and WHEREAS, it is required by the U.S. Department of Transportation in accord with the provisions of Title VI of the Civil Rights Act of 1964, that in connection with the filing of Section 9 applications for assistance under the Urban Mass Transportation Act of 1964, as amended, the applicant gives an assurance that it will comply with Title VI of the Civil Rights Act of 1964 and the U.S. Department of Transportation requirements thereunder; and WHEREAS, it is the goal of the applicant that minority business enterprise be utilized to the fullest extent possible in connection with Section 9 projects, and that definitive procedures shall be established and admini- stered to ensure that minority businesses shall have the maximum feasible opportunity to compete for contracts when procuring construction con- tracts, supplies, equipment contracts, or consultant and other services. That the City Manager of Iowa City is authorized to execute and file an application on behalf of the City of Iowa City with the U.S. Department of Transportation, to aid in the financing of transit operations pursuant to Section 9 of the Urban Mass Transportation Act of 1964, as amended. 2. That the City Manager of Iowa City is authorized to execute and file with said application an assurance or any other document required by the U.S. Department of Transportation effectuating the purposes of Title VI of the Civil Rights Act of 1964. 3. That the City Manager of Iowa City is authorized to furnish such additional information as the U.S. Department of Transportation may require in connection with the application. 4. CIT CLERK Reoalvad A Approved Ij By Tho Legal De erhrant RESOLUTION NO. 85-103 RESOLUTION ESTABLISHING A COMMITMENT TO PROVIDE FINANCIAL SUPPORT TO THE JOHNSON COUNTY COUNCIL OF GOVERNMENTS WHEREAS, financial support is necessary to assist the participating members in studies and planning, make recommendations to public agencies, coordinate planning for the various governmental units and provide such services as are agreed to by the Johnson County Council of Governments, herein referred to as "JCCOG," and its members; and WHEREAS, Section 1, Article VII of the Amended Articles of Agreement of the JCCOG requires that member agencies adopt a resolution of financial support, including a commitment to contribute the requested assessment for the two succeeding fiscal years, NOW, THEREFORE, BE IT RESOLVED BY THE CITY OF IOWA CITY, IOWA, that the City does hereby agree to provide financial support to the JCCOG for the fiscal years 1986 and 1987 in an amount agreed upon by the JCCOG for its member agencies upon consideration of the fiscal year budgets for each year. WHEREAS, the City Council of the City of Iowa City did, by Resolution No. 84-88, dated April 24, 1984, authorize and enter into an agreement with the Johnson County Citizen's Committee for the Handicapped to use Community Development Block Grant funds to prepare and publish an accessibility guide for the Iowa City-Coralville area, and WHEREAS, the Johnson County Citizen's Committee for the Handicapped has requested an extension of said agreement to complete the accessibility guide. The Johnson County Citizen's Committee for the Handicapped would like to make a request for another extension to complete the Accessibility Guidebook for which we received CDBG Funds. We would like to have six months extension. The survey portion of the project is 85-90% complete The extreme winter weather and a broken arm in late January from which I am still recuper- ating, were the two primary reasons for the delay in my progress. During a recent board meeting of the Citizen's Committee, the 1985 Chairperson,Pat Simmons, volunteered her help and asked other board members to do the same. She designated Mona McElderry to evalulate the project and assist me in the project. We will ask help from other members at our next meeting March 25th. We would greatly appreciate a six month extension beyond our March 31, 1985 deadline. We feel a lot can be accomplished with "Spring" weather approaching and summer to finish the booklet. Expenses on the project so far are listed below. They have not changed since July 1, 1984 report. Thank you for your understanding. WHEREAS, The City of Iowa City, Iowa, acting as the Local Public Agency, entered into a contract for a Loan and Grant with the United States of America for the implementation of an Urban Renewal Project known as the City -University Project No. R-14; and WHEREAS, the City of Iowa City, Iowa, has pursuant to the provisions of Title 24, Part 570, Section 570.801(c) of the Code of Federal Regulations, trans- ferred Community Development Block Grants to said Urban Renewal Project, and transferred control of certain real property acquired in carrying out said Urban Renewal Project to the City Council of the City of Iowa City from the City Council acting as the Local Public Agency by Resolution No. 76-446, dated December 14, 1976, and by Resolution No. 77-312, dated August 9, 1977; and WHEREAS, the City Council of Iowa City, Iowa, did by Resolution No. 85-26, authorize the solicitation of offers to purchase land for private redevelop- ment for Parcel 65-2b; and WHEREAS, the offer to purchase land for private redevelopment was received and opened by the City of Iowa City on March 4, 1985. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF IOWA CITY, IOWA, that pursuant to the authority granted by Chapter 403 of the 1981 Code of Iowa, Section 570.801(c), Title 24, Part 570, Code of Federal Regulations, and pursuant to the procedures in the Prospectus Parcel 65-2b, the following developer is designated as the preferred developer of Urban Renewal Parcel 65-2b: SMALL-MEARS BUILDING COMPANY. BE IT FURTHER RESOLVED that this designation is subject to the following conditions: 1. The developer shall submit to the City all construction plans as defined in Section 301 of the proposed Contract for Sale of Land for Private Redevelopment. 2. The Contract for Sale of Land for Private Redevelopment shall be executed on or before July 1, 1985. BE IT FURTHER RESOLVED that the City Manager and staff are hereby authorized and directed to carry out land disposition procedures in accordance with Iowa law and as set forth in the Prospectus/Parcel 65-2b. ' 1 OR ATTEST: I CLERK I l i i Recehred & Approved By The 4 -imenf fi•gf 7V City of Iowa City MEMORANDUM Date: April 2, 1985 To: City Manager and City Council From: Chuck Schmadeke Re: Parking Surface Materials On May 5, 1982, the City Council adopted an ordinance prohibiting the placement of loose rocks, stones, gravel, or similar loose substancesas surface material in the area between the traveled or paved area of the street right-of-way and the abutting property line. The ordinance was adopted to keep rocks, etc. from being thrown through store windows. It now appears that the ordinance is too restrictive and should be enforced only in those areas where there is heavy pedestrian traffic. Rocks are a desirable surface material in the parking area adjacent to streets with heavy vehicular traffic because they are aesthetically pleasing and yet easy to maintain. The revised ordinance includes the area bordered by Church Street, Dodge Street, Bowery Street, and Madison Street. tp2/10 0 7a9
