Iowa -Illinois Gas & Electric Co. for Burlington
Street (Highway A1) just west of Gilbert Street.
Comment: This will allow Iowa -Illinois to install
a gas service across and along the north side of
Burlington Street to feed the new building at 310
Burlington Street and the new building on the
northwest corner of Burlington Street and Gilbert
Street. The gas service will be bored under
Burlington Street although the telephone company
will have to locate their duct under Burlington
Street with an open cut. A copy of the applica-
tion is attached.

a. Consider setting a public hearing for November 4, 1986,
on an ordinance to rezone property located at 401 South
Gilbert Street from CC -2 to CB -2. (Z-8606)
Comment: At its meeting of October 2, 1986, the Plan-
ning and Zoning Commission recommended by a vote of 5-1
(Wallace voting no) approval of a request to rezone
property located at 401 South Gilbert Street from CC -2
to CB -2, subject to the condition that off-street
parking for residential dwellings developed in excess
of two dwelling units be provided on an off-site loca-
tion within 300 feet of the property. The Commission
further recommends that the City enter into a covenant
that runs with the land that binds this condition.
These recommendations are consistent with that of the
staff included in a report dated September 18, 1986.

b. Public hearing on an ordinance to vacate an alley
between South Gilbert Court and South Van Buren Street,
in Block 3, Lyon's First Addition.
Comment: On September 18, 1986, the Planning and
Zoning Commission recommended approval of the vacation
of an unimproved alley extending between South Gilbert
Court and South Van Buren Street, by a vote of 7-0.
Pursuant to Section 409.25 of the Code of Iowa, upon
vacation of an unimproved alley containing no utili-
ties, the property automatically reverts to abutting
property owners. The Commission's recommendation is
consistent with that of the staff included in a report
dated September 18, 1986.
Action:
c. Public hearing on an ordinance to amend Section
36-58(b)(4) of the Zoning Ordinance concerning the
parking regulations.
Comment: At the request of the City Council, the
Planning and Zoning Commission reconsidered a proposed
ordinance amendment to Section 36-58(b)(4) of the
off-street parking regulations at its meeting of Sep-
tember 18, 1986. By a vote of 7-0, the Commission
recommended approval of the amendment which clarifies
the number of parking spaces to be provided upon a use
conversion where the present use is deficient in park-
ing. References to trees and other natural features as
a limitation to the provision of additional parking
spaces have been deleted.

d: Consider an ordinance to amend the Zoning Ordinance to
permit small animal clinics as a provisional use in the
CC -2 zone. (first consideration)
Comment: At its meeting of September 5, 1986, the
Planning and Zoning Commission recommended by a vote of
6-1 (Jordan voting no) adoption of an amendment to the
Zoning Ordinance to permit small animal clinics as a
provisional use in the CC -2 zone. Staff concurs with
this recommendation. A public hearing on this amend-
ment was held October 7, 1986. No comments were re-
ceived on this proposed amendment.

e. Consider an ordinance to amend the Zoning Ordinance to
clarify the definition of roomer and of rooming unit.
(first consideration)
Comment: The Planning and Zoning Commission, at its
September 5, 1986, meeting, recommended by a vote of
7-0 to approve an amendment to the Zoning Ordinance to
delete from the definition of "roomer" reference to the
rooming house operator as the family and to make the
definition of "rooming unit" consistent with the Hous-
ing Code. This recommendation is consistent with that
of the staff. On October 7, 1986, a public hearing on
this amendment was held. No comments regarding this
amendment were received.

f. Consider an ordinance to permit Planned Development
Housing plans on tracts of less than two acres but
greater than one acre in size. (first consideration)
Comment: The Planning and Zoning Commission recom-
mended, at its September 5, 1986, meeting, approval of
amendments to the Planned Development Housing Overlay
Zone (OPDH) to permit the use of this clustering tech-
nique on tracts of land which are less than two acres
but greater than one acre, where the land is surrounded
by existing development, is characterized by environ-
mentally sensitive or natural features, has older
structures on the tract or in the area, or has scenic
assets. The ordinance requires that notice be given to
surrounding property owners and that specific criteria
be met. The Commission's recommendation was on a vote
of 7-0. At a public hearing held on October 7, 1986,
Al Wells spoke in favor of this proposed ordinance. Mr.
Wells, President of Al Wells Construction, Inc., re-
quests that the Council expedite consideration of this
I ordinance. A letter from Mr. Wells is included in the
Council packet.

g. Consider a recommendation from the Planning and Zoning
Commission to revise elements of the Capital Improve-
ments Program (CIP).
Comment: At its October 2, 1986, meeting, the Planning
and Zoning Commission reviewed the FY87-91 Capital
Improvements Program (CIP) and recommended that consid-
eration be given to revising the CIP for FY88-92 as
follows:
(1) Eliminate the signal on Sunset and Benton
streets.
(2) Add a deceleration lane on westbound Highway
1/Sunset Street in addition to the planned sig-
nal.
(3) Reconsider the appropriateness of the signal at
Benton Street and Mormon Trek Boulevard in rela-
tion to its impact on traffic flows from and to
Walden Ridge and Quik -Trip.
(4) Move the construction phase of Rohret Road to
FY91.

(5) Move signalization of the Kirkwood Avenue and
Dodge Street intersection from FY88 to FY89.
The Commission's recommendation was on a vote of 6-0. A
memorandum regarding this item is included in the
agenda packet.

h. Consider: --a recommendg_tion from the Planning and Zoning
Commission that Commission representatives become
members of the American Planning Association (APA) and
that membership dues be paid by the City of Iowa City.
Comment: The Planning and Zoning Commission recom-
mended at its October 2, 1986, meeting, by a vote of
6-0, that members of the Commission join the American
Planning Association (APA) in order to obtain the
publications and educational materials provided by the
APA. With impending review of the City's Comprehensive
Plan, this information will be useful for long-term as
well as new Commission members. • The dues will be
included in the operating budget proposal for the Urban
Planning Division for approval by the Council.

ITEM No. 10 - RECOMENDATIONS BY BOARDS AND COMMISSIONS.
a. Consider recommendation of the Committee on Community
Needs that the City Council approve increasing the
project limit of the residential accessibility grants
from $3,000 to ;5,000.
Comment: On September 16, 1986, CCN reviewed the
request to raise the project limit for residential
accessibility grants from $3,000 to $5,000. This
recommendation was forwarded to the City Council and
the City Council took action on October 7, 1986.
b. Consider recommendation of the Resources Conservation
Commission that the City Council make a public state-
ment in support and recognition of the "1986 Homeowner
Energy Fair" on November 8, 1986, in the Old Capitol
Center sponsored by the Resources Conservation Commis-
sion.
c. Consider a recommendation from the Historic Preserva-
tion Commission that a concrete patch in the 200 block
of Davenport Street be removed and replaced with brick
pavers.
Comment: At its September 10, 1986, meeting, the
Historic Preservation Commission recommended that a
conendcoftthea200 blockigof Davenport Str eete removed

replaced with brick pavers, consistent with the brick
surface of the street in that block. Council may wish
to refer this item to the appropriate City department��

IOW CITY RAILWAY CO. AND STATE OF IOWA (IOWA DEPT. OF
TRANSPORTATION RAIL AND VATER DIVISION).
Comment: This agreement is for installation and maintenance
of railroad -highway crossing signals on Gilbert Street in
Iowa City, Iowa. The State pays 90% and the railroad pays
10%. The City must initially finance 81% of this project.
This 81% will be reimbursed to the City after completion
of construction. Both railroad traffic and vehicle traffic
warrant signalization of this crossing. Cantilever flashing
lights will be provided over the paving.

3Z\ ITEM NO. 12 - CONSIDER RESOLUTION AUTHORIZING THE MAYOR TO EXECUTE AND
THE CITY CLERK TO ATTEST THE LICENSE AGREEMENT BETWEEN THE
CITY OF IOW CITY, IOWA, AND ACCESS IOWA CITY, INCORPO-
RATED.
Comment: This license agreement would replace the agree-
ment entered into with Multi -Mentions on September 9, 1986.
Multi -Mentions has served written notice of termination of
the license agreement to which it was party, with such
termination to be effective upon the execution of the new
agreement with Access Iowa City, Incorporated. The .license
agreement is for the use of the access system referred to
as IGIV which is a system designed for use by cable TV
customers to independently access central data base utiliz-
ing a telephone and a computer software/hardware package.

do 3a� ITEM NO. 13 - RESOLUTION APPROVING AND AUTHORIZING AID DIRECTING THE
MAYOR AID CITY CLERK TO EXECUTE AND ATTEST, RESPECTIVELY, A
LICENSE AGREEMENT BY AND BETWEEN THE CITY OF IOW CITY,
IOW, AND THE UNITARIAN UNIVERSALIST SOCIETY OF IOW CITY
TO PROVIDE FOR THE DRAINAGE OF STORM AND SURFACE WATERS
FROM CERTAIN PROPERTIES.
Comment: The Unitarian Church at 10 South Gilbert in Iowa
City is presently engaged in a project to improve the
church. One element of said project is to construct a
handicapped accessible entryway into the church on the east
side of the church building immediately adjacent to the
City's parking lot. Due to the topography of the church
property, the only drainage available to the church for
said ramp and entryway would be onto and across the City's
parking lot and the church has requested that the City
grant it permission to drain its property in that manner.
The proposed License Agreement which was negotiated with
the church, and which the church has executed, would grant
permission for such drainage over City property, but would
require the church to maintain the area so as not to create
an excessive icing problem on the City's parking lot.
Furthermore, the 'church would be required to indemnify and
hold the City harmless for any damages resulting from such
drainage. Finally, the license would be revocable by the
City at any time if the City determined that it was no
longer in its interest to maintain this arrangement.

ITEM NO. 14 - CONSIDER ORDINANCE A EJIDING SECTION 23-189 OF THE MUNICIPAL
CODE OF IOWA CITY TO CHANGE SPEED LIMITS ON PARTS OF GIL-
BERT STREET. (first consideration)
Comment: The proposed ordinance is being submitted to
alter the speed limit on South Gilbert Street. The pro-
posed ordinance will cause the speed limit on Gilbert
Street south of Highway 6 to be 30 miles an hour from
Highway 6 south to a point 1,800 feet south of the inter-
- - sections This point is approximately the southerly limit
of current commercial development. From that point south
to the south City limits, the speed limit will be made to
be 35 miles per hour. The proposed change will resolve
inconsistencies between the existing ordinance and the
on -street condition.
