Setting Public Hearings. �(1) Consider setting a public hearing for November 18, 1986, on a resolution to remove Michael McDonald from the Iowa City Board of Adjustment. Comment: Pursuant to Chapter 2-100 of the Iowa City Code of Ordinances and Chapter 414.8 of the Code of Iowa, the Council has been apprised of the consecutive unexplained/unexcused absences of Michael McDonald from the meetings of the Board of Adjustment. Mr. McDonald was appointed by the Council for a term beginning January 1, 1986. Since his appointment, Mr. McDonald has had five consecutive unexcused absences from regular meet- ings of the Board. Since an active full Board is necessary to properly carry out the functions of the Board, the staff and the Board recommend removal of Mr. McDonald from his position and appointment of a new member. e. Correspondence. (1) Letter from Gary Sanders regarding the City Park pool. (2) Letter from Tom Walsh expressing appreciation for the Council's interest and involvement regarding the Herbert Hoover Highway. No reply is neces- sary. Page 5 c. CONSIDER AN ORDINANCE TO AMEND SECTION 36-58(b)(4) OF THE ZONING ORDINANCE CONCERNING THE PARKING REGULATIONS (FIRST CONSIDERATION). Comment: At the request of the City Council, the Planning and Zoning Commission reconsidered a proposed ordinance amendment to Section 36-58(b)(4) of the off-street parking regulations at its meeting of Sep- tember 18, 1986. By a vote of 7-0, the Commission recommended approval of the amendment which clarifies the number of parking spaces to be provided upon a use conversion where the present use is deficient in park- ing. References to trees and other natural features as a limitation to the provision of additional parking spaces has been deleted. No comments regarding this amendment were received at a public hearing which was held on October 21, 1986. Action: `Vle� I �al�uJ l5/ eu�n 30 1 d. CONSIDER AN ORDINANCE TO AMEND THE ZONING ORDINANCE TO PERMIT SMALL ANIMAL CLINICS AS A PROVISIONAL USE IN THE CC -2 ZONE (SECOND CONSIDERATION). Comment: At its meeting of September 4, 1986, the Planning and Zoning Commission recommended by a vote of 6-1 (Jordan voting no) adoption of an amendment to the Zoning Ordinance to permit small animal clinics as a provisional use in the CC -2 zone. Staff concurs with this recommendation. A public hearing on this amend- ment was held October 7, 1986. Page 6 CONSIDER AN ORDINANCE TO AMEND THE ZONING ORDINANCE TO CLARIFY THE DEFINITION OF ROOMER AND OF ROOMING UNIT (SECOND CONSIDERATION). Comment: The Planning and Zoning Commission, at its September 4, 1986, meeting, recommended by a vote of 7-0 to approve an amendment to the Zoning Ordinance to delete from the definition of "roomer" reference to the rooming house operator as the family and to make the definition of "rooming unit" consistent with the Hous- ing Code. This recommendation is consistent with that of the staff. On October 7, 1986, a public hearing on this amendment was held. No comments regarding this amendment were received. Action: 3 b f. CONSIDER AN ORDINANCE TO PERMIT PLANNED 61 DEVELOPMENT HOUSING PLANS ON TRACTS OF LESS THAN TWO ACRES BUT GREATER THAN ONE ACRE IN SIZE (SECOND CONSIDERATION). Comment: The Planning and Zoning Commission recom- mended, at its September 4, 1986, meeting, approval of amendments to the Planned Development Housing Overlay Zone (OPOH) to permit the use of this clustering tech- nique on tracts of land which are less than two acres but greater than one acre, where the land is surrounded by existing development, is characterized by environ- mentally sensitive or natural features, has older structures on the tract or in the area, or has scenic assets. The ordinance requires that notice be given to surrounding property owners and that specific criteria be met. The Commission's recommendation was on a vote of 7-0. At a public hearing held on October 7, 1986, Al Wells spoke in favor of this proposed ordinance. Mr. Wells requests that the Council expedite consideration of this ordinance. A letter from Mr. Wells was in- cluded in the Council packet for October 21, 1986. CONSIDER A RECOMMENDATION BY THE PLANNING AND ZONING COMTHEISSION ON A REQUEST FOR A COUNTYTO ESTABLISH A SAND OAND TIONAL U GRAVEL SE PERMIT IN THOPERATION ON THE EAST BANK OF THE IOWA RIVER, NORTH OF I-80 AND WEST OF DUBUQUE STREET. Comment: By a vote of 5-0-1 (Scott abstaining), the Planning and Zoning Commission recommended, at its October 16, 1986, meeting, the conditional use permit be denied, finding the proposed sand and gravel opera- tion to be inconsistent with the Fringe Area Policy Agreement for Area 2. Consider recommendations of the Design Review commit- tee: (1) That the City Council approve the installation of the Herbert Hoover Highway historical marker at the west end of the landscaped island at Clinton Street and Iowa Avenue and that the area's plantings be reviewed for low maintenance and possible changes to provide a better setting for the sign. Comment: The Design Review Committee reviewed the historical marker proposal because the sign would be placed in the downtown public right-of-way. An illustration of the type of sign and suggested text is included in the Council packet. Council action on the memorandum from the Traffic Engineer will authorize placement of the marker. A sepa- rate motion to approve the Committee's recommenda- tion will also authorize review of the plantings. (2) That the City Council approve the sign proposal for Technigraphics, contingent on the sign's meeting the City's sign regulations. Comment: Technigraphics, in Plaza. Centre One, has proposed a new exterior sign on the panel above its outside door. Because the building is an urban renewal development, the Design Review Committee reviewed the signage design and unani- mously recommended approval. A drawing of the proposed sign is included in the Council packet. Council can concur with this recommendation by y motion and thus allow issuance of a sign permit. j� (3) That the City Council approve a revised facade plan for the west wall of the Paul -Helen Build- ing. Comment: The redeveloper of the Paul -Helen Build- ing had proposed a revised facade plan in response to review by the Preservation Tax Incentives Regional Office of the National Park Service. Since Committee action, the facade plan has changed again, and a "new" design will be on the Committees agenda in November. Conment: William P. Pappas received a Deferred Payment Loan through the City's Rental Rehabilitation Program in the amount of ;3,300. The Rental Rehabilitation Program forgives 10% of the lien annually as long as the owner maintains title. Mr. Pappas transferred his property interest on or about the first of October 1986. Comment: In 1983, the late Richard O. Kratoska, the sur- veyor who prepared the plat of Oakes Meadow Addition to Iowa City determined that the storm water drainage easement along the west side of the subdivision was too wide on Lots 23 and 24. Recently, the property owners have requested that the plat be corrected to show the reduced width. This resolution is intended to accomplish that. Comment: During consideration of an LSNRD for Southway Park, Lot 3, Auditor's Plat 32, staff discovered that the original proprietor of Lot 3 had granted to the City a blanket utility easement over the entire parcel. The easement in not needed so the current owners have asked that it be released so they can complete development as shown on the approved LSNRD plan. The City Engineer has no objection.
