The Resources Conservation Commission supports the Citv Council's efforts
to reach a fair and equitable franchise agreement between Iowa City and Iowa -
Illinois Gas and Electric Company. We recommend that the Citv reconsider
the issues of a 1� franchise fee as well as re -opening negotiations with the
utility company. The Resources Conservation Commission maintains that the
franchise fee is an iptegral part of the City's plan for an aggressive broad
based energy conservation program for our City. The proposed
fee must be implemented for the following reasons:
1.) There is a need for a community based energy conservation program. Iowa
City's available programs provide help to approximately one-tenth of the homes
requiring weatherization.
2.) There is a need to limit the flow of energy dollars from Iowa Citis
to Iowa -Illinois Gas and Electric and the company's payments to energy suppliers
out of the Iowa City area.
3.) The fee would fund an industry devoted to conservation. The 1'. fee could
garner approximately S375,000. Using economic multipliers, this money represents
the equivalent of a one million dollar a year business locating in Iowa City
and staying for many years. The franchise fee represents a significant opportunity
to bring jobs and economic development to Iowa City.
4.) Based on the City Attorney's opinion, the 1% fee would not be a supplement
to the general fund.
5.) Iowa -Illinois Gas and Electric has not pursued an aggressive conservation
program, but they have complied with the minimum standard for conservation
established by the Iowa Commerce Commission.
6.) The collected fee would be used to fund projects to make Iowa City residents,
businesses and the municipality more energy efficient and more attractive
to new people and businesses seeking to locate in Iowa City.
7.) While the fee would be charged to the rate payers, there are long-term
benefits for all residents of Iowa City. The fee represents an investment
in the future.
_ Our final recommendation concerns the length of the agreement. In conjunction
with the proposed fee, we support a 10 -year franchise with a 5 -year re -opener
clause available on demand by one party. If no fee can be agreed upon, then
we recommend that the City grant no franchise to Iowa -Illinois Gas and Electric
Company.

CONGREGATE HOUSING
As you know, the city Council authorized the employment of a
consulting firm, Mayzima, of Atlanta, to do a feasability study
for assisted living housing in Iowa City, to attempt to ascertain
the interest in this type of housing, and/or the demand of another
type of housing for the elderly in this community.
A 54 item questionnaire has been prepared by the firm, after
having submitted it to the City staff and the ad hoc committee
working with them in this project. This is approximately the same
length as the one done by Mr. Munson, from which he received a
statistically good return.
Mailing of the questionnaire was delayed because of difficulty
in securing the mailing list from the Heritage Council on Aging,
which has the list of approximately 5800 senior citizens in Johnson
County. MayZema has now received the list and the questionnaires
should reached about 3,000 households within the next few days.
The replies to the instrument are requested by April 29.
The contract with the consultants provides that the final
report will be submitted to the City Council by July 1, 1985.
one of the reasons for hiring professional consultants was
that the report can be used to attract potential developers for
an elderly housing project, whether it be assisted -living housing,
senior citizen housing, or a combination thereof.
The ultimate fate of "congregate housing" in Iowa City lies
with the results of this survey, and decisions in the immediate
future, i.e. the next month or so, are not forthcoming.

AGREEMENTS: The utility company,corporation,applicant, permit holder or licensee. (hereinafter referred to as the permit holder)
agrees that the following stipulations shall govern under this permit.
I. The location, construction and maintenance of the utility installation covered by this application shall be in accordance with the
current Iowa Department of Transportation Utility Accommodation Policy.
2. The installation shall meet the requirements of local municipal, county, state, and federal laws, franchise rules, and regulations.

or maintenance work, on either existing or newly acquired right-of-way, that is likely to conflict with the installation belonging to the
permit holder in order that the permit holder may arrange to protect its facilities.
5. The State of Iowa and the Iowa Department of Transportation assume no responsibility for damages to the permit holders
property occasioned by any construction or maintenance operations on said highway.
6. The permit holder shall take all reasonable precaution during the construction and maimcnunce of said installations to protect and
safeguard the lives and property of the traveling public and adjacent property owners.
7. The permit holder agrees to give the Iowa Department of Transportation forty-eight hours' notice of its intention to start
construction on the highway right-of-way. Said notice shall he made in writing to the Engineer whose name is shown below.

12. The permit holder shall idcmnifyand save harmless the State of Iowa. and the Iowa Department of Transportation from any and
all causes of action, suits at law or in equity, or losses, damages, claims, or demands, and from any and all liability and expense of
whatsoever nature for. on account of, or due to the acts or ommissions of said Permit holder's officers, members, agents, representa-
tives, contractors, employees or assigns arising out of or in connection with its (or their) use or occupancy of the public highway under
this permit.
13. Non-compliance with any of the terms of the Iowa Department of Transportation policy, permit, or agreement, may be
considered cause for shut -down of utility construction operations or withholding of relocation reimbursement until compliance is
assured, or revocation of the permit. The cost of any work caused to be performed by the State in removal of non -complying
construction will be assessed against the permit holder.
14. A copy of the approved permit shall be available on thejob site at all times for examination by Department of Transportation
officials.
15. This permit shall terminate 20yearsfrom date of approval for gas and water mains outside t he corporate limits of municipality
in accordance with the Code of Iowa. Chapter 320. Renewal may be requested.

Dear John:
I've been pleased with the initiative shown by many of Iowa's
communities to assist existing industries and promote economic
development. I am convinced that local initiative with state
assistance will be crucial to the development of our state. Local
programs mobilizing civic and business leaders to call on all
industries each year; the organization of business labor councils;
industry recognition programs and the present effort to eliminate
the sales tax on machinery and equipment have been most impressive.
Each of these contribute to maintaining our economic base and have,
or will, assist many of our employers to expand in Iowa.
Recently, when Firestone officials indicated that they might close
their plant in Des Moines, this office mobilized a Task Force
representing state, county and city governments, as well as rep-
resentatives of organized labor and the chamber of commerce. This
Task Force identified the problems confronting Firestone and devel-
oped public/private solutions to help keep the plant operating in
Iowa. That effort was successful in keeping the plant open and now
we are working on plans to increase employment at the facility.
I want to make similar economic emergency teams available to you, if
a similar need arises in Iowa City. By working together the state
and local community may be able to retain existing jobs and attract
new jobs to Iowa.
If your community would be interested in such a partnership to save
existing or create new jobs, please let me know. we will work with
you to develop a working group with broad-based representation that
could be called into action when needed.
Please let me know if you would like to pursue this effort.

Ladies and 'Gentlemen:
Our company would appreciate your consideration of a
change in the new sign code.
A provision is needed to allow a zoning allotment for
one standard size billboard structure in in i-1 zone
on highway 1 west and one structure in a CH -1 zone on
highway 1 north.
We are not requesting the change to allow standard size
structures in all the I-1 and CH -1 zones but feel a need
to service the Iowa City merchants on at least two high-
ways in Iowa City.
The sign structures originally located at 1400 north
Dodge St. have now been removed and any posting of Co-op
outdoor advertising posters is limited to highway 218
south across from the fairgrounds.
This is a definite hardship in our business relations
to satisfy demand for good traffic patterned locations.
We have worked with various committees studying signage
over the years and feel our case is justified.

Re: Seventh Avenue Court Sidewalk
To Iowa City Council Members:
The letter attached was given to me by my tenant. It is
unbelievable that the questionnaire which is referred to in
the letter was not mailed to the property owners that would be
affected by this project. It is ry understanding that it
was mailed only to residents of the area.
There are ten houses on the north aide of Seventh A••onue
Court, two of which already have sidewalk in front of their
property which connects to nothing. None of the properties
on the south side of the street have an address of Seventh
Avenue Court. So it would appear that if sidewalks are
necessary, they should be placed on the Bide of the street
where people live.
A sidewalk on the south Bide of Seventh Avenue Court
would be in the back or side yard of every property involved.
Four of these properties have sidewalk at the front of their
property, namely Seventh Avenue, E Street and 6th Avenue.
WHO NEEDS A SIDEWALK IN THEIR BACKYARD?
If Seventh Avenue Court is such a busy street that a
few people cannot walk down it to the park, then it cert—
ainly is not safe to expect all the people living on the
street to oroes to the other side to get to the sidewalk.
There is now sidewalk access to Creekside Park from
the west by way of Seventh Avenue and E Street.
I urge you to take a good long look at this project
before giving approval for installation of sidewalk on the
south Bide of Seventh Avenue Court. I own property at
1724 E Street and 1731 E Street that would be affected.

Dear Mr. Merulla:
In January, 1985, you received a letter from the City of Iowa City
indicating that £23,200 in 1985 Community Development Block Grant (CDBG)
funds had been allocated to construct and repair sidewalks in your
neighborhood. Because CDBG funds may be used for these projects,
residents living in eligible neighborhoods would not be assessed the
cost of installing new walks.
Along with the letter, you received a questionnaire which you were asked
to return. The purpose of the questionnaire were to determine the
income eligibility of the neighborhoods and to assess residents'
interests in the construction of sidewalks adjacent to their yards.
Although several Seventh Avenue Court residents expressed reluctance at
the construction of a walk along this block, the Committee on Comnunity
Needs, a citizens' advisory body to the City Council which determines
housing and community development needs, has regarded a sidewalk in this
location to be a valuable pedestrian link to Creekside Park from other
locations within the Creekside neighborhood and has recommended that a
sidewalk be constructed on the south side of Seventh Avenue Court from
Seventh Street to Creekside Park. Plans and specifications for this
project will be drawn by the City's Public Works Department and resi-
dents will be given the opportunity to review those plans and to comment
on the proposed project at a public hearing. This project is tenta-
tively expected to begin this spring.

I am considering buying the property at 406 Grant St. in Iowa
City. The ajoining lot to the north is owned by the city. If the
purchase of the property goes through I would like to put a driveway
in to the north of the house. This would partially extend onto the
city's land. In addition,I would like to install a fence running east
from the north—east corner of the house to a point near the bank of a.
creek and then south to the neighbors fence. This installation would
also partially infringe on the city's land.
I am asking that the City grant an easement to allow these
improvements to be made. In exohangovI would agree to maintain the

Dear Council Members,
Enclosed are signatures supporting the existing ordinance to remove
the cottonwood tree at 48 Penfro Dr.
We would like to make several points concerning both petitions:
1) The petition "to save the tree" has 16 Penfro homeowners (2 of
which are for sale).
2) The petition to ENFORCE the ordinance has 14 Penfro homeowners.
3) Although the petition"to save" has Arbury signatures, several of
the homeowners are not affected at all. Homeowners #4 - #28 (11
signatures) are on the far side of the horseshoe drive and cannot

JC-ACCAN is a volunteer association created in 1979, at the recommendation

neglect, the enhancement of local preventive and rehabilitative services to
children and families, and the encouragement and development of innovative
services to children and families. Past projects of JC-ACCAN have included
a workshop on child sexual abuse, a resources fair for parents, and sponsorship
of several child abuse prevention projects in local human services agencies
and groups, Including United Action for Youth, Reps Victim Advocacy Program,
Domestic Violence Project, Community Coordinated Child Care, Mothers Are
People Too, the Iwa City Junior Women's Club, and Parents Anonymous.

tion to the City of Iowa City, Iowa, that they not be required to install a
sidewalk on the portion of their property which borders on Bloomington Street.
In support of this application, the following is stated:
1. Applicants David and Rita Frantz reside at 1320 Rochester Avenue,
Iowa City, Iowa.
2. The house on the property owned by Applicants fronts on Rochester
Avenue, but the lot extends so that the property also borders on the south side
of Bloomington Street.
3. Applicants have completely enclosed their property with a wooden
split -rail fence. Photographs of this fence are attached to this application.
4. Applicants have been notified that the City of Iowa City proposes
construction of a sidewalk which would necessitate the removal and relocation
of the split -rail fence. A map detailing the proposed sidewalk is attached
to this application.
5. As shown in the photographs and map attached to this application, the
property has an existing retaining wall and the proposed sidewalk location
would necessitate relocation of the retaining wall and filling in the land for
a foundation upon which the sidewalk could be built. This would be prohibitively
expensive -- and would probably also result in the sidewalk's cracking soon
after installation.
6. Applicants respectfully request that the proposed sidewalk not be
constructed for the following reasons:
a) There is a sidewalk along the north side of Bloomington Street
and requiring construction of one on the south side cannot be justified
based on usage and safety.
b) As indicated on the map submitted with this application, the lo-

MEMORANDUM

Re: Z-8501. City -Initiated Rezoning Request for Subsidized Housing
At its informal meeting of April 16, 1985, the City Council expressed its
willingness to consider conveyance to Ecumenical Housing Corporation of City -
owned property located_ south of Washington Street, east of Gilbert Street and
north of the bus depot. The conveyance is to provide land for the construction
of 75 units of Section 202 subsidized elderly and handicapped housing.
The project, which will be owned and operated by a non-profit corporation
organized by Ecumenical Housing Corporation, is dependent upon acquisition of
funds from the U.S. Department of Housing and Urban Development. Application for
the funds is due on May 15. The application must show that the project site is
properly zoned for the intended use. The property is currently zoned P since it
is owned by the City; housing owned by anyone other than a government would not
be permitted in the P zone. On April 23, 1985, the City Council set a public
hearing for May 7, 1985 on the rezoning of this area (approximately 38,400 square
feet) from P to CB -2. Elderly housing is a provisional use in the CB -2 zone.
On May 7, the Council intends to hold a public hearing on the ordinance to rezone
the property and consider passage of the ordinance. At that meeting the Council
also intends to consider a resolution authorizing execution of an option agree-
ment for sale of the land. The actual conveyance will not take place until after
HUD makes its determination regarding funding. If the award is made to Ecumeni-
cal Housing Corporation, the property will be conveyed at that time. Prior to
construction of this project at large-scale residential development plan will be
required, at which time construction and design plans will be reviewed and the
provision of parking can be evaluated. Any concerns regarding this development,
such as parking or the height of the building, should be raised now to permit
Ecumenical Housing Corporation to design their project to meet these concerns.
Rezoning of this property at this time will not permit development of the land
under CB -2 zoning unless the Council conveys the land or chooses to lease the
property. The City will retain complete control of any development here until
that control is released through conveyance. If the Ecumenical Housing project
does not materialize, the City may rezone the property to P, or convey the land
to some other party.
Attached is a location map, minutes of the Council discussion regarding this
item, and a brief description of the project submitted by representatives of
Ecumenical Housing Corporation.

Berlin stated that Metcalf & Eddy will complete their final report in May or
June and a new timetable will be developed. In response to Strait, Berlin
said Arthur Young Company will present a financial workshop to the City and
Metcalf & Eddy prior to the final report.
In response to Baker, Harry Boren stated the operating costs of the existing
facility is an estimated $1 million. In reference to alternatives #8 and
#11, Erdahl said comparison of margins and what is salvageable for future use
needs to be addressed. Input was received from Dick Gibson. Gibson said
alternatives #8 and #6 could be eliminated. In response to Erdahl, Jaworski
said the sewer technology will not change drastically in the next 20 years.
Schmadeke said that if the City stays at the existing site, additional land
south of Iowa City should be secured for future expansion. Berlin noted a
letter was received from Noel Willis, alternatives 02 and #11 should be
continued to be studied, and flexibility is important. Jaworski stated
Metcalf & Eddy will give a constructability evaluation and financial evalua-
tion in Phase III and Metcalf & Eddy is under contract to evaluate three
alternatives.
Council directed Metcalf & Eddy to continue studying alternatives 02, #8, and
#11.
CORPORATION - SECTION 202 HOUSING ON U
Dr. W.P. Morris, President of Ecumenical Housing Corporation, appeared and
read a letter requesting Council consideration of an elderly housing project
in U Smash 'Em and a portion of Chauncey Swan. McDonald explained a $2.7
million HUD grant is available to help fund an ecumenical housing project;
the grant application deadline is May 15; and Ecumenical Housing Corporation
needs a commitment from Iowa City to allow construction of the project on the
U Smash 'Em lot and in Chauncey Swan park area. In response to Berlin,
Morris stated HUD requires a commitment of an option to buy or other legal
document saying the site is available. Council raised concerns about the
design of the project, the impact on congregate housing and parking. Morris
explained HUD said Ecumenical Housing and Congregate Housing cannot be
combined and the housing grant money can only be used for housing for well,
independent elderly persons. Also, Ecumenical Housing is tentatively planning
to build a ten -story, 75 unit building. HUD has specified the building must
be a cost containment design.
Berlin inquired about the City's legal commitment for the site. Jansen
stated the City would have a contract for sale, with the price and a contin-
gency stating that if Ecumenical Housing Corporation did not get the grant,
they would not be obligated to purchase the property; an option can be given
but a public hearing is needed for a contract for sale; the option should
include a dollar value; the option would be contingent upon a public hearing;
and encumbrances on the land need to be considered. Berlin said the City
should contact HUD. Berlin stated that the City may not be able to set a
lower price on the land due to parking bond obligations and the City will
study alternatives to assist Ecumenical Housing.

Morris explained that Iowa City amended the Housing Assistance Plan, January
1985, to state that goals for assisted housing for elderly was 18 units for
the elderly and new construction for the elderly is limited to 45 units.
HUD's economic marketing analysis division said the Housing Assistance Plan
needs to be amended to reflect current needs.
Council agreed to study the proposed selling of the site to Ecumenical
Housing Corporation. Berlin said a staff person and someone from the City's
Legal Department will work with Dr. Morris and contact HUD.
COUNCIL TIME:
1. McDonald said the Resource Conservation Commission has requested that the
gas and electric discussion be rescheduled from April 30 to May 14.
2. In response to Baker, Berlin said Schmadeke will obtain more information
about the Department of Water, Air and Waste Management/Iowa River
designation.
3. At the request by Dickson, Councilmembers agreed to reschedule the final
reading of the Melrose rezoning from April 23 to May 7.
4. Karr asked which Councilmembers will be attending the hydraulic demon-
stration,. McDonald stated Councilmembers should contact Karr about their
attendance of the demonstration.
5. Karr requested Councilmembers bring their code books to the City Clerk's
office for supplements and updating.
EXECUTIVE SESSION:
Moved by Dickson, seconded by Erdahl, to adjourn to executive session under
Section 28A.5.j Real Estate, to discuss the purchase of a particular real
estate only where premature disclosure would be reasonably expected to
increase the price the governmental body would have to pay for that property.
The minutes and the tape-recording of the session closed under this paragraph
shall be available for public examination when the transaction discussed is
completed. Affirmative roll call vote unanimous, 7/0, all Councilmembers
present. The Mayor declared the motion carried and adjourned to Executive
Session at 8:40 p.m.

SOME NOTES ON THE DEVELOPMENT OF A HUD 202 PROJECT
1. HUD has announced the availability of 42,752,000 for the
construction of 75 units of housing for the elderly or
handicapped in metropolitan areas of Iowa with a deadline nate
for a complete application of May 15, 1985.
2. Because of the need for such housing in the Iowa City
area and because of its success in the construction, development,
j and management of Ecumenical Towers, the Ecumenical Housing
Corporation plans to join with its Sponsor, the First Christian
' Church, to co-sponsor the creation of a new single asset borrower
corporation for the purpose of developing and eventually managing
a new HUD 202 project.
3. We believe the site on Gilbert Street between Washington
and College Streets is one of the last remaining downtown sites
for building such a project because of its proximity and
accessibility to the Senior Center which is a focal point for the
elderly in this community, transportation, churches, recreational
facilities, hospitals, banks, doctor's offices, service
providers, retail stores, theaters, and other necessary services
for residents.
4. In addition to the foregoing, important considerations
will be the reasonableness of the site cost per unit and
suitability of the property for the intended use and adequacy of
utilities and streets (i.e., the proposed site development
including number of units, location of building, parking, drives,
service, and recreation areas is suitable for the intended
occupants). Note: HUD requires that special attention be given

to the estimated cost of the site and whether the number of units
proposed will result in a cost effective project.
5. In compliance with modest design and cost containment
objertives. the following factors will guide the development of
this project:
a. Architectural Treatment. The overall design concept
will be modest and will result in a project which will be
economical to construct and efficient to operate after
completion.
b. Typical Unit Design. The floor layouts and unit
designs will reflect economical and efficient use of
space, suitable for intended occupants.
C. Amenities and Special Spaces and Accommodations
Items proposed will be needed and suitable for the
occupants, and modest in concept.
b. The shape of the building will depend in large part on
the shape of the lot and its relationship to other buildings.
E.g., if the building lot is clear and large enough, a building
could be designed with 10 apartments per floor resulting in an
S -story building to accommodate 75 units. On the other hand, if
there can be only 6 units per floor, the building would be
10 -stories high. Other things being equal, the latter would cost
more to build than the former.
Also, the orientation of the building will depend in part
on its juxtaposition to the Wilson Building.
7. Under HUD's cost containment features, 25 percent of the
apartment units must be efficiencies (i.e., O -bedrooms) and the
remaining would be one -bedroom units. Thus, the building would

comprise 10 efficiencies of about 400 square feet each, and 57
one -bedroom units of about 500 square feet each.
B. In addition to the foregoing, at the Fund Reservation
stage there is a 5 percent limitation on Special Spaces and
Accommodations on a square foot basis.
9. It is probable that all entrances will be designed to be
wheelchair accessible and that in the apartments and elsehwere
throughout the building support for the special needs of elderly
and handicapped persons will be included.

I am Irene E. Murphy. I live in Ecumenical Towers up the street at 320 East
Washington.
I literally risked my life to come here tonight to appear before you to request
that you cast your votes in favor of rezoning the parcel of land the Ecumenical
Housing Corporation is interested in purchasing with the intention of erecting
a similar high rise to meet the need of providing adequate housing for the elderly
and handicapped who are on fixed incomes. If one is good - couldn't it be construed
that two would be better.
In order for me to reach this location of the scheduled public hearing for input
on the matter I had to cross the street which is the proposed site of the new high
rise building and which is cited as being too dangerous for the elderly to safely
navigate. That objection just doesn It wash — many of my fellow occupants in the
,., Towers have since day one been crossing Gilbert street to get to And from a
~, such places as the Iowa City Recreation Department Farmers' Market, to participate
in activities at the Iowa City Recreation Center, to shop at the Co-op, the
Salvation Army Store, and, on at least one other occasion to attend a meeting of the
City Council re the Beer Garden permit for Cabe's. To my knoaledg4 there have been
no pedestrian casualties so far and I pray that the record will stay that way.
I really don't buy the argument of the loss of 17 parking spaces - and the
attendant revenue realized from their use, or the loss of green space with the
blooming seasonal flowers for aesthetic reasons.
If ,you prevail and remain unyielding and insensitive to the community's needs
j in the area of providing decent housing for their senior citizens I have an alternate
j suggestion for at least the green area. I don't know how many could be accommodated
in the green space in question but if you can't see it in your heart to make the
space available to satisfy their needs while still living, you could assign as many '
permanent parking spacrs as possible in the area concerned and from their final
home the elderly can still perform a community service by pushing up the daisies for
the aesthetics effect desired, 917

To allay concern that it will be too close to the bus depot, to me personally
that has been a fringe benefit of residing in the present Towers. In the city of
Davenport thev have built a high rise right downtown. And it is just a quote
DANGEROUS unquote intersection from the Greyhound bus terminal. Since I do not

own a car, never have, have never learned to drive I haven't had to be concerned

with parking spaces and feeding meters or paying tickets, etc. I have to depend on
public transportation. So living in close proximity to the bus depot is a blessing

I count, in addition to the one of already being a tenant in an elderly housing complex..
It seems ironical that this matter about an elderly project should come to the
attention of the community on the heels of the featured article in a recent issue of
the Iowa City Press Citizen, headlined "Yes, they get no respect". Our senior citizens
deserve better than some are receiving. I conclude this with the thought - if you
continue to survive crossing the streets there's a distinct possibility that you
just might live lone enough to become one of us, although by the time you reach that
period of your life many of the elderly who could benefit from your decision will
no doubt be long gone and pushing up the daisies.
Please consider this among the other issues the Committee on Cem unity Needs
concerns itself with.
