M., on the 14th day of May , 1985 in the Council Chambers at the Civic Center in Iowa j City, Iowa, do hereby waive any and all requirements of the calling of a special meeting, pursuant to the Ordinances and Resolutions of the City of Iowa City, as to notice of time and place of the meeting and do hereby consent to the holding of said special meeting for the purpose of see attached agenda. Jensen Company to request that you postpone consideration of any rezoning of the Jensen property located on Harlocke Street in connection with your up- date and readoption of the Iowa City Zoning Ordinance. With the passage of House File 265, effective July 1st of this year, the Council will have at its disposal, for the first time, tools with which to condition its zoning decisions. With this in mind, Viggo M. Jensen Company has made a proposal to the Planning Staff to limit the development which can take place on the Jensen tract in such a manner that no more than 20 units could be developed on the Jensen tract utilizing Harlocke as a means of access. This type of covenant would effectively address the concern of the neighbors in that it would limit the generated byaaniRS 5 development ofsthe lentire traffic site. F 9 1 E 0 MAY 6 if,Fr, MARIAN K. KARR CITY CLERK (1) - 2 - It is my understanding from my review of House File 265 such a covenant can be made a condition of rezoning, or not rezoning as the case may be, and could clearly be enforceable by the City of Iowa City if the agreement i giving rise to the covenant were entered into after the i first of July, 1985. In addition, in order to satisfy any lingering concerns of the neighbors, Viggo M. Jensen Company would propose to draft the covenant in such a manner that it would also be ' enforceable by property owners within 200 feet of the i exterior boundaries of the Jensen property. It is my understanding that the Planning Staff would support this proposal as a reasonable compromise, which would protect the neighbor's against an unreasonable increase in the traffic along Harlocke and Weeber Streets and at the same time would preserve the Jensen tract for future develop- ment in accordance with the surrounding uses. Jensen Company EM May 13, 1985 �K o To the Iowa City Councilpersons: — /1�% I would like to express my concerns about the apartment complex for the elderly and handicapped to be financed with a HUD grant, if approved. I wish to raise objections based on the cost to the tax- payers and on the location of the proposal utilizing the S. Gilbert St. site. Granted, if we don't pursue these dollars, some other community will do so. Please stop and think about the burden on the taxpayers. our taxes (including government borrowed dollars) have been and will again be used to provide the HUD grant. Our taxes will also be used to subsidize th#ents paid by individuals (through Section 8 funds)...... which rents are used to pay back the grant we originally financed. NOW we are asked to sell a potential developer the site for a 10 story building -_at a cost which would represent a substantial loss in tax dollars (basically city services are paid by us too). There should be limits on my obligation to subsidize any proposed project! I further see little justification for a downtown pro- ject. If we are at all conscious of 'green space' for seniors, look at the lack around Ecumenical Towers. Remember too there is no grocery shopping downtown except at expensive conven- ience stores. There are few, if any, doctors' office downtown. The Senior Center is an asset but our excellent bus system makes it accessible to most people living away from downtown. This proposal does not address at all the need identified by those who desire congregate housing for the elderly. Therefore I urge support for the Planning and Zoning Commission recommendation not to rezone the S. Gilbert St. site. A residential location would be more desirable, should the council determine to support a HUD grant application. Thank you for your attention you have given this matter.
