AN OMINANCE VACATING TIE MID -BLOCK ALLEY EXTENDING
BEREEN SOUM GILOW COURT TVD SOUTH VAN ftM
SiREET IN BLOCK 3, LYON'S FIW ADDITION.
MEBEAS, Iowa Code (1985) Section 409.25(2)
authorizes city councils to vacate streets, alleys,
and other public lards which were dedicated ty plat
for at least ten years, but «biota are not open to
vehicular traffic or used for utility equipnent; and
METAS, upon recording of the vacation ordinance
the lard is deemed to have been conveyed to proprie-
tors of adjoining land; and
MfFFAS, the City Cancil finds that the alley
extending east and west betNeen Lots 1-4 and Lot 5
in Block 3, Lyon's First Addition to Iowa City, was
dedicated by plat more than ten years ago, and is
neither open to vehicular traffic nor used for
utility equipment.
NDW, THEREFORE, BE IT ORDAINED BY TIE CITY MjN_
CIL OF IOW4 CITY, IOM4, TWIT:
SECTION I. VACATION. Pursuant to authority con-
i n as section 409.25, the 20 -foot wide
alley extending east and wrest beb+een Lots 1-4 and
Lot 5 in Block 3, Lyon's First Addition to Iowa
City, Johnson County, Iowa, is hereby vacated.
SECTION II. OMERSHIP, The southerly ten (10) feet
o sal a ey ri Wray shall be dee ad to have
been conveyed to the proprietor of Lot 5 Block 3
Lyon's First Addition, and the personal representa-
tives, successors and assigns of said proprietor;
and one-fourth of the northerly ten (10) feet of
said alley shall be deemed to have been conveyed to
the proprietors of each of Lots 1, 2, 3, and 4 of
said Block 3, Lyon's First Addition, and to the
personal representatives, successes and assigns of
said proprietors.
SECTION III. REPEALER: All ordinances and parts of
oruinances n conflict with the provisions of this
ordinance are thereby repealed.
SECTION IV. SEVERABILITY: If any section, provi-
sion orf of th s Winance shall be adjudged to
be invalid or unconstitutional, such adjudication
shall not affect the validity of this ordinance as a
whole or any section, provision or part thereof not
adjudged invalid or unconstitutional.
SECTION V. EFFECTIVE DATE: This ordinance shall be
n effect after Its final passage, approval and
publication as required by law,

spaces to be provided prior to occupation of the
building or conmeucemnt of the principal use; and
WIEREAS, the Off -Street Parking Raquirenents
permit the conversion of a use without full canpli-
ance with the required nwber of parking or stacking
spaces under certain conditions; and
WHEREAS, said conditions need to be mended to
clarify the mrber of additional spaces provided
upon a use conwersion; and
WERFAS, the City of Ice City find the Ordi-
nance anenhwnt to accurately clarify the intent of
this povisions.
NOW, 1N UCFE, BE IT RESOLVED BY TI -E CITY OF
IQAA CITY:
SEMCN I. ApflU MS. That Section 36.58(b) (4) of
finances shall be anerded deleting
said Section and inserting in lieu thereof the
following:
(4) A use existing prior to the effective date of
this Chapter, for which the current required
nrtber of parking or stacking spaces is not
provided, rmy be converted to another use
without full cmrpliance with the required
nunber of parking or stacking spaces, presided
that:
a, If Section 36-58(a) would require a greater
nurber of parking or stacking spaces for
the me -ted use than were required for
the established use, the increased nmber
of parking or stacking spaces shall be p-o-
vided in corpliarce with Section 36.58(x) .
b, In addition to the nurber of spices re-
quired under subparagraph a, or if sxbpra-
graph a is rot applicable, as many
additional spaces shall be provided as the
lot will accmmodate,
SECTION II. IMAM: All ordinances and parts of
ordirkwes in contlict with the prwision of this
ordinance are hereby repealed.
