FCC NOTICE OF INQUIRY
COMMENTS SOUGHT IN THE ANNUAL
ASSESSMENT OF THE STATUS OF COMPETITION
IN THE MARKET FOR THE DELIVERY OF VIDEO
PROGRAMMING (MB DOCKET NO. 06-189)
One aspect of the Notice of Inquiry of particular importance
to local governments concerns the impact that the local
franchising process has on competition and whether the
process acts as a barrier to competition. As a result, the
National Association of Telecommunications Officers and
Administrators (NATOA) is asking that municipalities file
Comments in the Commission's franchising proceeding
(MB Docket No. 05-311)
(The City has sent comments to the FCC in response to this NPRM)

Plaintiff
vs.
CITY OF BETTENDORF,
IOWA,
Defendant
Case No. 107001
PETITION
Jury Demanded
KRAGNES CASE:
DES MOINES
• Lisa Kragnes sued in 2004 claiming the franchise fee is
an illegal tax.
• A judge's decision on utility franchise fees would mean
Des Moines could lose nearly $13 million/year in
R ~ revenues.
• The March court case could affect how a handful of other
cities collect the franchise fee. Bettendorf, Cedar Rapids,
Davenport, Dubuque, Sioux City and Waterloo face
separate lawsuits, some of which involve cable utility fees.
• Officials have estimated that a loss in court could cost the
owner of a home assessed at $100, 000 an extra $224 per
year unless spending is cut drastically.
