I am considering buying the property at 406 Grant St. in Iowa City.
I plan to do extensive remodeling to the house which would require
that the current building codes be met. To meet those requirements,a
driveway measuring 181x19lwould have to be built on the property. The
lot onwhich the house now sits is not large enough to accommodate this.
A few years ago the City purchased the lot to the north of the 406
Grant St. property for $189500. This was done to facilitate the
reconstruction of the Muscatine Ave.bridge,and flood control to
Balston Greek. At this time a house was located on the property and
was subsequently removed,leaving the lot vaeant,as it is today.
I would like to buy a small portion of the City's lot to enable
me to install adequate off street parking. The area that I am offering
to purchase is 151x200of the southwest oorner(see drawing). I am
offering a price of $.70 per square foot. I arrived at this figure by
dividing the value of the land,$4625.00(25% of the total amount paid,
$181500)by the square footage of the lot,6575sq.ft. My total offer
then for the 151x201seotion is $210.00.

As General Manager of a new establishment in the downtown area, I
find some concern regarding an obvious statement and trend I see
developing. I feel that I should vocalize my viewpoint regarding
this matter. This concerns the recent statements and apparent
direction of some members of the City Council towards sidewalk
cafes. via all the reports of discussion I have been getting,
which I must admit are third hand, I have been lead to believe
the sentiment of the council appears to be that establishments
such as the Holiday Inn --Iowa City and Bushnell's Turtle who have
distinctive sidewalk cafes are more or less being charged with
the fact that they have an unfair advantage over competing
downtown businesses as a result of these outdoor cafes.
Lets look at this thought from a slightly different viewpoint.
Anyone who owns their land and chooses to develop it as a
sidewalk cafe is more than welcome to. Because we did not
develop the full extent of our lot into a building, warehousing
or whatever, does that mean this is an unfair advantage to other
establishments who chose to develop their property in another
manner and pursue year round business?
I would assume that the reverse would be true of the current
sentiments. If every establishment around the city is able to
set up a sidewalk cafe on city owned property it would be an
unfair advantage for Mr. Zastrow and Dr. Johnson who are the
owners of the previously mentioned businesses. Again, I can very
easily find disagreement with the city on this issue and think
that if this was opened up for a number of individuals, instead
of preserving Iowa City's dignified and distinctive environment,
we would be opening up our community to a carnival like
atmosphere. Will dress shops also be able to utilize ten feet in
front of their businesses for display and sales? Are restaurants
the only establishments being allowed to do this? Will we have
jewelry stores doing this? Will art shops be allowed ?
What about retail shops sandwiched between cafes?

I wanted to give you the additional benefit of my thought, as
proprietor of an establishment with a sidewalk cafe, who chose to
develop the land in this manner. Please remember the owners of
the Holiday Inn and Bushnell's Turtle have a large investment,
which needs to be payed off by our dedication and perseverance to
these businesses, and we pay our proper and fair shares of
property taxes on these establishments. We are dedicated to the
preservation of our establishments and the business they bring
into the area for the betterment of Iowa City. Would someone
setting up a four month venture on another person's property be
as dedicated? Our establishments are out of the public right of
way, helping to prevent Iowa City from becoming an overlaid and
crowded area. Would this also hold true with the proposals I
have heard most recently?

Dear Mayor McDonald and Council Members:
As you know, I represent Drs. Terence and Glenys
Williams, owners of property located in Section 30,
Township 79, North, Range'6 West of the 5th P.M. in
Iowa City, Johnson County, Iowa. This'property has come
to be known as the Melrose Lake property. It is my
understanding that on June 4, 1985; the City Council
gave final approval to an ordinance amending the Iowa
City zoning ordinance and effecting a downzoning of
the Williams property. The City Council changed the
zoning category applicable to the Williams property from
RM -12 to RS -8.
It is my client's contention that the action of
the City Council'in'downzoning their property has accom-
plished a "taking" of the Williams property in violation
of the laws of the State of Iowa as well as provisions
of the United States Constitution. Specifically, we
believe that the City's action has constituted a taking
of plaintiff's property without due process of law and
further in violation of the Fifth Amendment to the United
States Constitution which prohibits taking of private
property for public use without just compensation. In
addition, the constitution of the State of Iowa prohibits
taking of private property without just compensation
first being made.
We cannot tell you at this time the amount of
damages sustained by plaintiff. We previously have pro-
vided the Council with expensive economic information
concerning this property. We fear that the Council's

action not only will substantially constitute a taking of
the Williams property but that substantial consequential
damages resulting from that taking will also occur. My
client's.will look to the City, through the courts, for
reimbursement of .those damages.
Accordingly, please consider this letter as a notice
under the provisions of,Chapter'613A of the Code of Iowa
of the Williams tort claian's against the City as a result
of the City's wrongful actions outlined above. Specific=
ally, this letter is'intended as a tort claim notice under
Section'613A.5 of the Code of Iowa.

COMMENT:
A postcard survey was conducted which polled the opinion of the residents of
Arbor Drive. 21 of the responding residents favored the removal and 5 were
opposed to the removal. 14 of the respondents preferred the removal from the
west and south sides. 10 preferred removal from the east and north sides. 2

The Iowa City Council will hold a Public Hearing Tuesday
June 16th, on the proposed rezoning of 6.46 acres of undeveloped
land located between Scott Blvd and Peterson Street, one-eighth
mile south of Court Street. This land is currently RS -5, the
lowest density residential zoning; the recommendation is to
approve a zone, OPD -H, which allows for more dense type of
residential development. As a neighborhood we have serious
reservations about this change.
At the May 2nd Planning and Zoning Commission meeting we
were told the proposed development of Vista Park Village would
be similar /compatible with the existing lots and structures in
the area. OPD --H zoning allows a dwelling unit to be built on an
8,000 square foot lot. Attached is a plat map and accompanying
fact sheet of the Court Hill IIA subdivision which clearly shows
the existing lot sizes of the adjacent neighborhood are larger
than 8,000 s.f. The May 2 P&Z meeting exposed a misunderstanding
among several commission members regarding the size of the
lots. In actuality, most of the lots are less than 8,000 s.f.
with a range of 5,325 - 6,500 s.f. The largest lot is #1 which
is 11,212 s.f. The Planning a zoning Commission has permitted
several variances from standard procedures in order to allow the
proposed subdivision to meet the minimum density for RS -5 zoning:
A. They allowed the inclusion of open spaces in
computing average square footage lot size.
B. The amount of the dedicated R -O -W was reduced to
allow the overall dwelling unit density (total land area minus
street right-of-way area) within the planned development be
computed on the basis of least restrictive use.
C. Structures do not have to comply with setback
requirements from the areas without sidewalks but only from the
back of the street curb.
PARKING: The Planning and Zoning Commission has compromised on
the width of the street in Vista Park. City requirement is 28
feet but Vista Park will be 25 feet. The rationale for this
reduction is to allow the street to be consistent with similar
residential streets in the Court Hill addition. Furthermore this
allows the mathematical computations permitting the higher
density development to conveniently work.
What is not mentioned is the effect this has on parking,
street maintenance and safety. In a development where structures
will be basementless with only a single car garage it would not
seem unreasonable to expect residents to use the garage space for
storage. This in turn results in vehicles being parked in the
drives and on the street. As past experience has shown, the
accumulative amount of vehicles in a neighborhood combined with
the restricted amount of parking space eventually forces

residents to park in the R -o -W areas or on lawns. Next we have
enforcement problems.
On -street parking is always a problem for City maintenance.
With a reduction in the size of the street, snow removal
equipment can not operate as effectively (risking damage to cars
on street and thereby increasing the City's liability and
insurance); refuse collection vehicles and personnel must operate
in a more confined area making their job more difficult and again
unnecessarily exposing children to potential hazards by not being
able to follow acceptable safety standards for dangerous and
heavy equipment such as a garbage truck. Finally, public safety
vehicles, specifically fire trucks, would have a match more
difficult time maneuvering in an area where small streets are
reduced in width even more because parked cars exist. Again, it
is not unusual to find parked vehicles, jockeying for limited
parking space, to crowd accessibility to fire hydrants.
P&Z says this is similar to the Court Hill neighborhood.
The only similarity is the width of the street. Parking is
permitted on both sides of the street - not a recommended
solution. Most houses in Court Hill have a basement and two car
garages thereby greatly relieving the burden of vehicle storage
spilling into the street.
Front yard setbacks have been reduced allowing only 20'
between garages and curb or sidewalk. Assuming garages will
became storage areas eventually forcing alternate parking of
vehicles and a homeowner has two cars, does this 20' setback
prohibit parking both vehicles in the drive? Certainly, if two
cars are parked in a 20' area overlapping the sidewalk,
impedanent of pedestrian traffic occurs. This will always be the
case when friends visit, relatives spend a few days or social
activities are undertaken.
HONDGENIM OF THE NEIGHBORHOOD SIMCTURES: The units proposed
in this development range from 900 to 1000s.f. excluding single
car attached garages. However, it is important to note these
structures do not have basements. The vast majority of hones in
the Arbor Hill subdivision have either finished basements (thus
qualifying as taxable living areas), daylight basements, or
raised basements. The habitable living space in the homes is
greater than 1450s.f.
Although the modification (reduction) of setbacks to permit
a zero lot line is rationalized to provide more useable private
open space than conventional developnent, this justification only
emphasizes all the more that OPD -H rezoning is the wrong kind of
developnent for this area. A less dense type of subdivision
should be seriously considered.
TRAFFIC FLOW: With the addition of 30 new dwelling units the
developer has proposed Peterson Street be completed. This would
connect Arbor Drive - Peterson - Shamrock. It also effectively
creates the potential for a "race track" effect. Additional
traffic flow on Arbor Dr. & Shamrock streets with undersized
widths and on -street parking permitted for both sides, can
jeapordize the safety of the residents. No mention has been
made of any traffic control devices (i.e. stop signs).
One solution is to open the proposed development to Scott
Blvd. This would certainly curtail the heavier traffic flow
expected in the residential area.
iDCPRA0MINAR7 VOTE: Attached is a petition signed by property
owners within 200' of the boundaries of the proposed development
whose property equals 20% of the total of Vista Park village.
This petition as directed by State Statute requires an
extraordinary vote of the total Council for a change in the
current zoning.
PETERSON STREET: The developer has proposed the residents of
Arbor Hill subdivision be special assessed to pay for the
construction of Peterson Street - an undeveloped portion of r -o -w
between Shamrock & Arbor Dr. This street is essential to the
development. As residents and taxpayers we vehemently oppose
this.
Any costs incurred in the proposed development should be
borne by the developer. If the assessment route is undertaken,
then the City, as an adjacent property owner, as well as property
owners in the neighborhood, would be required to finance a
sizeable portion of this improvement. if the developer
recommends the City solely fund the Peterson St. improvement,
then

to enhance private profit? Has a precedent been set for this?
Is this the kind of precedent that should be set? Furthermore,
why should the neighborhood fund the street improvement to
contribute to the developer's profits? In section 36-47 of the
City code, paragraph (f) it states " . . . (the proposed planned
development) will not adversely affect nearby properties;". Any
assessment of the nearby properties certainly has an adverse
affect on then.
AFFORDABLE HOUSING: The Planning & Zoning Commission has
continued to compromise on issues based on the theme of promoting
affordable housing. However, are they overreacting to this and
in the process decreasing the quality of residential development.
The developer has compromised by dedicating the private streets
to Public property. He is required of course to do this and even
if he was not the.expense to the property owners of Vista Park
for maintenance would adversely affect "affordable housing
themes". Mr. Erdahl, how many phone calls do you think you would
receive if the snow plows and sanitation trucks stop on Peterson
and not service Vista Park.
The developer is not being required to put in a vegetative
buffer; or a 7" PCC street surface (current public road standards
in Iowa City require a 7 inch surface); or a 28' wide street.
Sidewalks are alloyed on only one side of the street. Are the
open spaces to be retained under private ownership and if so has

the developer proposed the procedures to be followed in
maintaining the area and the means for financing maintenance
costs (36-47 E3a)? If not, is this another compromise whereby
the City taxpayers are obligated to pay for the maintenance of
the open spaces? The developer wants to cram in as many dwelling
units as he can (5000+ s.f.) with structures that may lack
adequate storage and require variances in setback requirements to
acccmodate high density development. Finally he wishes us to pay
for the development of Peterson. The City's Planning staff has
offered alternatives to the developer, but he has ignored their
suggestions. Is this the attitude of an individual who is trying
to provide reasonable housingl or the attempt of a developer to '
take short-cuts wherever he can to increase his profits? {
ADVEMSING: Finally, I have noticed that these parcels are
being advertised in the newspaper. Perhaps this is common
procedure for real estate development. However, it certainly
seems as though the developer is taking a lot of us for granted.
We have serious concerns about the proposal and we hope you take
these concerns into consideration prior to making your decision.

Council on matters of interest to our community and its future. Applicants must reside
in Iowa City.
The City Council announces Advisory Board/Comission vacancies 90 days prior .to the
date the appointment will be made. This period provides for a 30 -day advertising period

TO THE FOLLOWING COMMISSION:
RIVERFRONT COMMISSION
One vacancy - Unexpired term
June 18, 1985 - December 1, 1986
It is the duty of members of the Riverfront Commis-
sion to investigate, study, review and analyze the
riverfront needs and to meet such needs within the
City of Iowa City; to investigate and determine
what rules and regulations are needed and what
policy should be established relative to the river -
front in -Iowa City; to study, investigate and arks
recommendations relating to clearing, Planning and
construction of riverbank areas and for providing
green areas and flood plains along the riverfront.
Iowa City appointed members of boards and commis-
sions must be qualfied voters of the City of Iowa
City.
This appointment will be made at the June 18, 1985,
meeting of the City Council at 7:30 P.M. in the
Council Chambers. Persons interested in being con-
sidered for these positions should contact the City
Clerk, Civic Center, 410 East Washington. Appli-
