(1) CONSIDER A RESOLUTION OF INTENT TO CONVEY ~"7 ~- APPROXIMATELY 200 SQUARE FEET OF BENTON STREET RIGHT- OF-WAY TO KATHLEEN A. STEVE, AND SETrING A PUBLIC HEARING ON SAID CONVEYANCE FOR NOVEMBER 19, 2002. Comment: The City Council is considering pass and adoption of an ordinance vacating approximately 200.63 square feet of Benton Street right-of-way. The adjacent property owner, Kathleen Steve, has made an offer to acquire the property, subject to easements for existing utilities and the condition that it be maintained as a grass area, in exchange for approximately 228 square feet of her property adjacent to Maiden Lane. The Public Works Department wishes to acquire said 228 square foot piece in connection with the Maiden Lane right-of-way. This resolution declares the City Council's intent to convey the above property, subject to easements for existing utilities and the condition that it be maintained as a grass area, in exchange for approximately 228 square feet of Ms. Steve's property adjacent to Maiden Lane. This resolution also sets a public hearing on the proposed conveyance for November 19, 2002. e. Resolutions. _~-/_~ (1) CONSIDER A RESOLUTION AUTHORIZING THE MAYOR TO SIGN AND THE CITY CLERK TO ATTEST TO THE RELEASE OF LIEN REGARDING A MORTGAGE FOR THE PROPERTY LOCATED AT 347 SOUTH GOVERNOR STREET, IOWA CITY, IOWA. Comment: The owners of the property located at 347 South Governor Street received assistance through the City's Housing Rehabilitation Program totaling $3,231.40. The financing was in the form of a conditional occupancy loan. The loan has been paid off; thus the lien can now be released. ~'~/'= (2) CONSIDER A RESOLUTION AUTHORIZING THE MAYOR TO SIGN AND THE CITY CLERK TO ATTEST THE RELEASE OF A SANITARY SEWER EASEMENT LOCATED ON PROPERTY LOCATED AT 2264 SOUTH RIVERSIDE DRIVE. Comment: The City possesses a Sanitary Sewer Easement on property located at 2264 South Riverside Drive. A party purchasing the property, Forest Park Partners, has requested the release of the easement. The Public Works Department recommends the easement be released because it is no longer necessary as a result of construction of the Willow Creek Interceptor Sewer. This resolution authorizes the release of the easement. Comment: Prairie Garden IHA Limited Partnership is applying to the Iowa Finance Authority for financial assistance in the form of Low-lnceme Housing Tax Credits for the construction of 14 affordable housing units for families. Prairie Garden IHA Limited Partnership has asked the City Council for a resolution of support to assist them in meeting the scoring criteria for the Low-Income Housing Tax Credit program. (5) CONSIDER A RESOLUTION SUPPORTING THE DEVELOPMENT OF AFFORDABLE HOUSING IN IOWA CITY. Comment: Prairie Garden IHA Limited Partnership is applying to the Iowa Finance Authority for financial assistance in the form of Low- Income Housing Tax Credits for the acquisition and rehabilitation of a property to provide three affordable housing units for families, a computer learning center, management office and community space. Consider a motion setting a public hearing for November 19 on an ordinance amending City Code Section 14-6K-1, the Sensitive Areas Ordinance, regarding requirements for Sensitive Areas Overlay Rezonings and Sensitive Areas Site Plans. Comment: At its October 17 meeting, by a vote of 5-0 (Shannon, Hansen absent), the Planning and Zoning Commission recommended approval of the proposed amendments to the Sensitive Areas Ordinance. The amendments will generally require approval of the Sensitive Areas Site Plan by staff unless an applicant seeks modification of a Sensitive Areas Buffer or seeks modification of other zoning requirements. Staff recommended approval in a memo dated September 5, 2002. Action: b. Comment: For Items #5e and 5f, the City Council considered final adoption of two ordinances vacating several small portions of right-of-way along Front Street between Burlington and Prentiss Streets as well as the west half of the 100 block of West Prentiss Street, and the second ordinance vacating the right-of-way comprising the east half of the 100 block of West Prentiss Street, the 100 Block of West Harrison Street and the 20' wide alley between the 100 Blocks of West Prentiss and West Harrison Streets for the purpose of facilitating redevelopment of the adjacent and subject properties by The University of Iowa. (Pass and Adopt) ~-" Comment: At its August 15 meeting, by a vote of 6-1 (Shannon voting no), the Planning and Zoning Commission recommended approval of the proposed va~tion, subject to creation of utility easements where necessa~, and subject to agreement by The University of Iowa that it will comply with the Iowa City Historic Prese~ation Ordinance regarding the Cannon-Gay House, a National Register-listed house and designated Iowa City Historic Landmark at 320 Melrose Avenue. Consider a resolution approving the final plat of Silvercrest Residential Community, Part 2, Iowa City, Iowa. (SUB02-00017) Comment: At its October 3 meeting by a vote of 7-0 the commission recommended approval of this subdivision subject to staff approval of legal papers and construction drawings prior to City Council consideration of the final plat. The construction drawings and legal papers have been approved. This subdivision will allow the development of an 8-lot, 12.17-acre subdivision located south of American Legion Road and east of Scott Boulevard, allowing four 24-unit apartment buildings and four 4-unit townhouse style buildings in the Silvercrest senior housing development. Staff recommended approval in a report dated October 3. Action: ~/_~,-z zC~L,,~.,¢~¢... ITEM 6. PUBLIC HEARING REGARDING PROPOSEI~ AMENDMENTS TO IOWA CITY'S 2001-2006 CONSOLIDATED PLAN (CITY STEPS). Comment: The U.S. Department of Housing and Urban Development requires an annual public review of the CITY STEPS plan. The Housing and Community Development Commission held a public meeting on October 17, 2002. In addition, public meetings were held at by the Local Homeless Coordinating Board (October 9, 2002) and by Neighborhood Centers of Johnson County (October 16, 2002). The CITY STEPS Plan was adopted by Council in 1999. Copies are available at the City Clerk's Office, the Public Library, and the Department of Planning and Community Development. Action: November 5, 2002 City of Iowa Cit~/ Parle 9 ITEM 7. CONVEYANCE OF 656 SOUTH GOVERNOR STREET TO GARY HUGHES. Comment: The City condemned the property located at 656 South Governor Street as a public nuisance. The City has entered into a contract for the sale of the property to Gary Hughes for demolition of the currently existing structure and construction of a new residential structure. The contract sale price is $26,000.00. The contract is contingent upon formal approval by City Council. This resolution authorizes the City's conveyance of the above property to Gary Hughes for $26,000, for demolition of the currently existing structure and construction of a new residential structure. a.PUBLIC HEARING Action: -~ ~ b. CONSIDER A RESOLUTION AUTHORIZING Action: ITEM 8. CONVEYANCE OF 707 WALNUT STREET Comment: The City condemned the prope~y located at 707 Walnut Street as a public nuisance. The Ci~ has entered into a contract for the sale of the prope~y to Edwin Teagle for rehabilitation of the currently existing structure. The contract sale price is $65,000.00. The contract is contingent upon formal approval by Ci~ Council. CONSIDER AN ORDINANCE AMENDING TITLE 14, CHAPTER 8, ENTITLED ~'AIRPORT ZONING" BY REPEALING THE EXISTING CHAPTER IN ITS ENTIRETY AND REPLACING SAME WITH A CHAPTER REGULATING AND RESTRICTING THE USE AND HEIGHT OF STRUCTURES AND OBJECTS OF NATURAL GROWTH IN THE VICINITY OF THE IOWA CITY MUNICIPAL AIRPORT BY CREATING APPROPRIATE ZONES AND ESTABLISHING BOUNDARIES THEREOF: DEFINING CERTAIN TERMS USED HEREIN: REFERRING TO THE IOWA CITY MUNICIPAL AIRPORT ZONING MAP, AS AMENDED, WHICH MAP IS ADOPTED BY THIS ORDINANCE: ESTABLISHING AN AIRPORT ZONING COMMISSION: ESTABLISHING AN AIRPORT ZONING BOARD OF ADJUSTMENT: PROVIDING FOR ENFORCEMENT: AND IMPOSING PENALTIES. (FIRST CONSIDERATION) Comment: At its September 9, 2002 meeting, the Iowa City Airport Zoning Commission recommended approval of this ordinance. The ordinance updates the language of the Airport Zoning Code and provides zoning protection for the projects anticipated by the Airport Master Plan. After the ordinance is approved by the City Council, it will be forwarded to the Johnson County Board of Supervisors for approval. CONSIDER AN ORDINANCE AMENDING AN ORDINANCE AMENDING CITY CODE TITLE14, ENTITLED "UNIFORM DEVELOPMENT CODE," CHAPTER 5, ENTITLED "BUILDING AND HOUSING," ARTICLE E, ENTITLED "HOUSING CODE" TO REQUIRE THAT ALL LANDLORDS AND TENANTS EXECUTE AN INFORMATIONAL DISCLOSURE AND ACKNOWLEDGEMENT FORM AND BY DELETING THE REQUIREMENT THAT THE CITY PROVIDE WRITFEN NOTICE OF HOUSING VIOLATIONS BEFORE ISSUING A MUNICIPAL INFRACTION. (PASS AND ADOPT) Comment: This ordinance amends the Housing Code to require that landlords and tenants sign a form acknowledging specified information including the maximum occupancy of the rental unit, the names of all tenants, the City's web site, the "disorderly house" code provision, and responsibility for snow removal and lawn mowing. Staff estimates that it will take three years to determine the maximum occupancy for each of the approximate 15,000 rental units. Both the maximum occupancy and the form will be available on the City's web site. The ordinance also amends the Housing Code to delete the requirement that the City provide written notice before a municipal citation is issued, although staff anticipates that it will continue to provide written notice in nearly every situation. This ordinance resulted from a recommendation by the Neighborhood Housing Relations Task Force with subsequent amendments suggested by the Greater Iowa City Apartment Association. Staff and the neighborhood representatives of the Task Force previously requested this item be expedited. CONSIDER A RESOLUTION ADOPTING AN ASSESSMENT SCHEDULE OF -~ ~'~ UNPAID MOWING, CLEAN-UP OF PROPERTY, SNOW REMOVAL, SIDEWALK REPAIR, AND STOP BOX REPAIR CHARGES AND DIRECTING THE CLERK TO CERTIFY THE SAME TO THE JOHNSON COUNTY TREASURER FOR COLLECTION IN THE SAME MANNER AS PROPERTY TAXES. Comment: The City has the authority under Iowa Code §364.13B to assess the nuisance abatement costs in the same manner as a property tax. This resolution allows the City Clerk to certify to the Johnson County Treasurer the abatement cost to be assessed against the property. This assessment is being pursued only after the City took many steps to resolve the matter. The City notified the homeowners to abate the nuisance (for example, to remove snow from the sidewalk) and after the homeowner did not take action to abate the nuisance, the City abated the nuisance and billed the owner. After being billed at least twice, these owners still have not paid the abatement costs. The City sent a letter to the homeowner giving them notice that this resolution would be on the agenda, a copy of which is attached to the resolution. No interest will be charged if the owner pays within 30 days of passage of the resolution. Attached is an exhibit to the resolution is a list of the properties that will be assessed and the amount that will be assessed. Action: ITEM 12. CONSIDER A RESOLUTION AMENDING THE BUDGETED POSITIONS IN ~"~ THE LANDFILL DIVISION OF THE PUBLIC WORKS DEPARTMENT BY DELETING ONE FULL-TIME SCALEHOUSE OPERATOR POSITION AND ADDING ONE FULL-TIME RECYCLE CLERK - LANDFILL POSITION AND AMENDING THE AFSCME PAY PLAN BY ADDING THE POSITION OF RECYCLE CLERK- LANDFILL. Comment: Changes in the duties of one position in the Landfill Division have resulted in the need to reclassify one Scale House Operator 3osition. Staff memorandum included in Council packet.
