S7 �� (1) Consider a resolution affirming an employee sus-
pension.
Comment: On November 12, 1986, employee #40733
was given a written warning for failure to report
for work and was advised that further instances
would result in more severe discipline. On April
9, 1987, employee #40733 did not report for work
as assigned and failed to inform his supervisor of
the absence. As a result, the employee was sus-
pended without pay for three days.
9. Correspondence.
(1) Letter from Jim Spratt regarding Highway 6. This
letter was furnished to the Council at its meeting
of April 7 and is being placed on the agenda to be
officially received and placed on file. Public
Works is preparing a reply for the Mayor's signa-
ture.
(2) Letter from Sister Jean Marie Brady of Regina
Elementary School requesting a school crossing
guard at Rochester and First Avenue for the next
school year. This position is not included in the
FY88 budget. If Council determines that this
request should be granted, the budget should be
amended in the amount of $2,450.
(3) Letter from the Broadband Telecommunications
Commission regarding the Heritage lawsuit.

Public hearing on an amendment to the Research Develop-
ment Park (RDP) zone.
Comment: At its March 5, 1987, meeting the Planning
and Zoning Commission recommended, by a vote of 6-0,
approval of amendments to the RDP zone which would,
among other things, limit the amount of manufacturing
permitted in the zone and provide for a master plan and
development standards as part of the rezoning in ex-
change for limitations on public review during develop-
ment of the park. The Commission has requested that
the readings not be waived for consideration of this
ordinance.

Comment: At its meeting of April 2, 1987, the Planning
and Zoning Commission, by a vote of 6-0, recommended
approval of this amendment. This recommendation is
consistent with that of staff in a memorandum dated
March 27, 1987. The term fitness centers and health
spas" is used in the amended RDP zone and is not de-
fined in the Zoning Ordinance. The proposed definition
distinguishes fitness centers from other commercial
recreational uses. Adoption of this amendment is
scheduled to coincide with adoption of the RDP ordi-
nance.

d. Public hearing on an amendment to the Zoning Ordinance
to amend the Flood Hazard Overlay Zone.
Comment: The Federal Emergency Management Agency has
issued new rules pertaining to the management of devel-
opment in floodplains, particularly as they apply to
mobile homes. Adoption of these rules into local
ordinances is required by July 1 to continue participa-
tion in the Floodplain Insurance Program. The proposed
amendment incorporates these new rules and is taken
directly from a model ordinance provided by the Iowa
Department of Natural Resources. At its April 2, 1987,
meeting, the Planning and Zoning Commission, by a vote
of 5-0, recommended approval of the proposed amendment.
This recommendation is consistent with that of staff.
Action:

Comment: See above item. Expedited consideration of
this ordinance will ensure compliance by July 1, 1987,
to enable continued participation in the Flood Insur-
ance Program.

f. Public hearing on an ordinance to amend Chapter 22 of
the Iowa City Code of Ordinances, concerning the elimi-
nation of the requirement for licensing manufactured
housing parks.
Comment: On March 19, 1987, by a vote of 6-0, the
Planning and Zoning Commission recommended to approve
amendments to the Manufactured Housing Parks Ordinance,
Chapter 22. As a result of a recent change in State
law, the registration and licensing of manufactured
housing parks is now prohibited. A second change would
require any alteration or addition to an existing
manufactured housing park to be brought into compliance
with all of the provisions of this ordinance. The
Commission's recommendation is consistent with that of
staff.*

Public hearing on an ordinance to amend Section 36-65
of the Zoning Ordinance regarding the regulation of
fences and hedges.
Comment: In response to Board of Adjustment actions to
modify minimum front yard requirements to accommodate
certain fences, the proposed ordinance amends the fence
and hedge requirements to allow fences and hedges in
locations and at heights which have been determined not
to obstruct visibility or to affect the use and enjoy-
ment of property. In addition, while adjustments in
the minimum yard requirements, via special exceptions,
have been made to allow fences which do not conform to
the setback requirements, the proposed ordinance takes
a more direct approach by providing for a special
exception to modify the location and height require-
ments of the fence regulations. At the March 19, 1987,
meeting, the Planning and Zoning Commission, by a vote
of 5-1-0 (Clark voting no), recommended approval of the
location and height requirements and the special excep-
tion provisions of the proposed ordinance. This recom-
mendation is consistent with that of staff. By a vote
of 6-0, the Commission recommended that a provision
proposed by staff which would require that permits be
obtained for the construction or erection of all fences
be excluded from the ordinance. The proposed ordi-
nance, attached to the agenda, does not contain the
permit provision. The staff's version of the amendment i
is available from the City Clerk.

THE UNIFORM CODE FOR THE ABATEMENT OF DANGEROUS BUILDINGS,
AS AMENDED. THIS CODE SHALL BE KNOWN AS THE IOWA CITY
ABATEMENT OF DANGEROUS BUILDINGS CODE.
Comment: The Board of Appeals has reviewed the 1985 Uni-
form Code for the Abatement of Dangerous Buildings. The
Board recommended Code changes substantially similar to
existing amendments presently in force. The 1985 Dangerous
Building Code is to replace the 1982 Dangerous Building
Code.

reviewed and discussed the proposed changes in the
City's Housing Rehabilitation Programs, including the
Rental Rehabilitation Program's Tenant Assistance
Policy. No action is requested since the City Council

ITEM NO. 16 - CONSIDER A RESOLUTION APPROVING AND AUTHORIZING AND DIRECT-
ING THE EXECUTION OF AN ADDENDUM TO THE CITY'S AGREEMENT

PROJECT MANAGEMENT SERVICES FOR THE WASTEWATER FACILITY
IMPROVEMENTS PROJECT, TO AUTHORIZE THE PERFORMANCE OF
ADDITIONAL DESIGN, INSPECTION, AND PROJECT MANAGEMENT
SERVICES IN CONJUNCTION WITH THE ORCHARD-DOUGLASS STORM
SEWER PROJECT.
Comment: See attached memo and letter. The proposed
location of the Orchard -Douglass Storm Sewer is along
Benton Street, parallel to the proposed Benton Street
(University Heights) Sanitary Sewer and as such it is in
the City's best interest that the responsibility for de-
sign, inspection and project management services for the
two projects be relegated to a single engineering consult-
ant.

ITEM NO. 17 - CONSIDER A RESOLUTION AUTHORIZING THE MAYOR TO SIGN AND THE
CITY CLERK TO ATTEST AN AGREEMENT WITH THE MAYOR'S YOUTH
EMPLOYMENT PROGRAM (NYEP) FOR THE USE OF 1987 COMUNITY
�i Fn DEVELOPMENT BLOCK GRANT FUNDS FOR THE MYEP/IOWA CONSERVA-
TION CORPS/SUMMER COMPONENT.
Comment: Adoption of this Resolution will permit the
Mayor's Youth Employment Program to proceed with purchasing
materials, supplies and contracted services to construct a
bank stabilization project on the west bank of Ralston
Creek between Washington Street and iStreet. This
streambank stabilization project will be constructed and
then maintained over the next three years by the Iowa
Conservation Corps/Summer Component. The amount of the
agreement is $11,770, which was allocated by Council under
the 1987 CDBG budget.

ITEM NO. 18 - CONSIDER A RESOLUTION AUTHORIZING EXECUTION OF AWAL
CONTRIBUTIONS CONTRACT BETWEEN THE CITY AND THE FEDERAL
GOVERNMENT RELATING TO FUNDS FOR PUBLIC HOUSING PROJECT

Comment: The City of Iowa City (Local Authority) executed
an Annual Contributions Contract KC9166 dated February 6,
1985. This document consolidated the three Public Housing
Projects into one Annual Contributions Contract. This
amendment changes the dollar amount for Project
IA05PO22005. Anticipated development costs were $582,982
which served as the basis for the Annual Contributions
Contract. Actual development cost certification for this
project has been completed and has been determined to be
$543,849.00. This represents a reduction (savings of
$39,133.00. The Consolidated Annual contributions must be
changed to reflect this new figure. The development cost
accounts are now considered closed. Staff recommends adop-
tion of the resolution.

ITEM NO. 19 - RESOLUTION ADOPTING THE ANNUAL BUDGET FOR FISCAL YEAR 1988
ENDING JUNE 30, 1988, FOR PUBLIC HOUSING PROJECTS 3, 4, 5.
Comment: Current regulations require adoption of the
Annual Budget by formal resolution. By Resolution No.
85-295 the City Council Authorized the execution of a
Consolidated Annual Contributions Contract and General
Depository Agreement which was approved by the Department
Of Housing and Urban Development effective October 18,
1985. The attached budget combines the receipts and expen-
ditures of the three Public Housing Projects referenced
above. The proposed budget reflects operating receipts at
$116,600 and expenditures at $108,505. The budget reflects
a positive cash flow and indicates a financially sound
operating and maintenance plan. Staff recommends adoption
of the resolution.
