Dear Mr. Mayor and Council Members:
This letter is being written on behalf of Hallmark
Homes, Inc, to request that the City Council vacate that
portion of Peterson Street right-of-way which has been
shown on the plat of Vista Park Village currently on
file with the City.
Once vacated, Hallmark Homes, Inc. would propose
to acquire that portion of the right-of-way vacated at
a price equal to the assessed value of the property
lying immediately east of the right-of-way (approxi-
mately $100) subject to existing easements for utilities.
The developer, Hallmark Homes, Inc., would also
request as a part of the subdivision approval that the
City agree to bear the off site costs of the Peterson
Street paving between Shamrock and the south line of
the Iowa City Housing Project.
The developer realizes that it is the general policy
of the City to require the cost of internal subdivision
improvements to be borne by the developer, but we do not
believe that any firm policy exists relative to off site
improvements and that, indeed, those off site improvements
-z-
should be dealt with on a case by case basis. The
developer believes that that approach would be particu-
larly appropriate in the case of Vista Park Village.

Historically, Peterson Street was to be a City project
financed by special assessment. Since the current Council
consensus is not to reactivate that project, and since the
Iowa City Housing Project was developed immediately east
of Peterson Street without any requirement that the Peter-
son Street paving be extended to the south line of that Pro-
ject, the developer believes that there are sufficient
reasons for the City to favorably consider participating
in that paving at this time. The developer does not
believe that the City's participation in the cost of the
off site paving would establish any precedent or override
any long established policy of the City with respect to
off site subdivision improvements.

Final decisions have been made on the distribution of funds for this +
round of the Iowa Community Development Loan Program. We regret to f
inform you that the application submitted by the City of Iowa City for
the reinforcement of a building foundation was not among those funded.
This certainly does not reflect negatively on your project. The Office ! I,
for Planning and Programming received twenty-two applications requesting
a total of over $3.8 million. As only $1.8 million is available at this
time, many worthwhile projects could not be funded.

In accordance with Dick Boyle's instructions, we are herewith requesting Council
consideration and approval to change the existing sidewalk grade for construction
of a new replacement sidewalk along the front of the referenced building project.
We have reviewed the proposed change with Chuck Schmadeke and Denny Gannon
and they believe that the proposed change would be acceptable from the City's engineering
viewpoint. The purpose of the change is to permit the construction of new stairs leading
up to the entrance patio of the commercial area of this building. As I believe you
are aware, these steps were shown on the approved L.S.R.D.; however, due to the building
having been constructed on the property line (as permitted in this zoning classification)
the steps would be on the public right-of-way. The steps are necessary due to the
difference in elevation between the existing sidewalk grade and the first floor elevation
of the new building. This difference in elevation resulted from the necessity to provide
surface drainage eastward, to the alley, for the parking area behind the building.
Based upon the preliminary requirements outlined by Dick Boyle, the property
Owners would agree to indemnify the City from liability related to the stairs as well
as provide a maintenance agreement acceptable to the City.
Assuming there are no problems with the Owner's request for Council consideration,
we would appreciate being placed on the Council's aggenda at the earliest possible
date. The construction of the commercial area is essentially complete and the stairs
are necessary as a second exit. Should you have any questions or require any additional
information, please call at your convenience. Thank you.

in Iowa City.
The City Council announces Advisory Board/Commission vacancies 90 days prior•to the
date the appointment will be made. This period provides for a 30 -day advertising period
and a 60 -day training period for new members. The training period allows new members to
become familiar with the responsibilities and duties of the advisory board/commission
before becoming a full voting member.

The duties of the Broadband Telecommunications
Commission include serving as a review board to
resolve disputes between any subscriber or poten-
tial subscriber and the cablevision company;
reviewing and auditing reports by the cablevision
company to the City as required by the Cable
Television Ordinance; working with the public,
the media, the City, and the Cablevision company
for the purpose of making recommendations on
various issues; engaging in other activities
pursuant to the effective monitoring and evalua-
tion of the CATV system in the City.

According to chapter 331.906 of the Code of Iowa, every two
years the County Auditor convenes a convention of representatives
from town councils for the purpose of selecting a new member for
the County Compensation Board. The Compensation Board tradition-
ally meets during the month of October, and in a series of meet-
ings, recommends what the salaries of county elected officials
should be.
All city councils in Johnson County shall send a representa-
tive to the convention who is either a mayor or a member of the
city council.
The purpose of the convention, which will be held at 7:30
p.m-, September 25, 1985, at the Johnson County Courthouse in
Iowa City, will be to appoint a member from among the Johnson
County mayors and councilpersons who will serve through June of
1989.
For the next meeting of your town council, please place an
item on the agenda for the council to appoint a representative
who is either the mayor or a member of the council. The council
should appoint a person who will definitely be able to attend.
If there is not a quorum, the meeting will need to be res-
cheduled, and those who did attend will have wasted their valu-
able time.
Please inform the representative chosen by the council and
provide the Auditor's Office with a copy of the person's name.

Dear Ms. Carr:
At the compensation convention on September 25, 1985,
representatives from town councils elected Dave Roberts and
representatives from school boards elected Jane Miller, both to
four year terms on the Johnson County Compensation Board. Mr.
Roberts replaces Don Saxton, and Ms. Miller, replaces Don
Showalter, whose terms expired this year.
With these new members, the Compensation Board is made up of
the following persons:

The Compensation Board traditionally meets in the autumn to
make a recommendation on the 'salaries of elected county
officials. The recommendation is due, by statute, in December.
