AGREEMENTS: The utility company,corporation,applicant, permit holder or licensee, (hereinafter referred to as the permit, holder) agrees that the following stipulations shall govern under this permit. 1. The location, construction and maintenance of the utility installation covered by this application shall be in accordance with the current Iowa Department of Transportation Utility Accommodation Policy. 2. The installation shall meet the requirements of local municipal, county, state, and federal laws, franchise rules, and regulations, regulations and directives of the Iowa State Commerce Commission, Utilities Division, the Department of Water, Air and Waste Management, all rules and regulations of the Iowa Department of Transportation, and any other laws or regulations applicable. 3. The permit holder shall be fully responsible for any future adjustments of its facilities within the established highway right of way caused by highway construction or maintenance operations. 4. The Iowa Department of Transportation shall give the permit holder at least 48 hours notice of any proposed construction or maintenance work, on either existing or newly acquired right-of-way, that is likely to conflict with the installation belonging to the permit holder in order that the permit holder may arrange to protect its facilities. 5. The State of Iowa and the Iowa Department of Transportation assume no responsibility for damages to the permit holder's property occasioned by any construction or maintenance operations on said highway if permit holder has been notified in accordance with stipulation number 4 above or if the facilities is not located in accordance with this permit. 6. The permit holder shall take all reasonable precaution during the construction and maintenance of said installations to protect and safeguard the lives and property of the traveling public and adjacent property owners. 7. The permit holder agrees to give the Iowa Department of Transportation forty-eight hours' notice of its intention to start construction on the highway right-of-way. Said notice shall be made to the Engineer whose name is shown below. B. The permit holdcragrces to at all times give the Iowa Department of Transportation timely notice of intention to perform routine maintenance within the right-of-way. The permit holder, and its contractors, shall carry on the construction or repair of the accommodated utility with serious regard to the safety of the public. Flagging operations are the responsibility of the permit holder. The original placement of signs and removal on completion of the work shall be accomplished by the permit holder. 11. Operations in the construction and maintenance of said utility installation shall be carried on in such a manner as to cause i 12. The permit holder shall idemnify and save harmless the State of Iowa, and the Iowa Department of Transportation from any and all causes of action, suits at law or in equity, or losses, damages, claims, or demands, and from any and all liability and expense of whatsoever nature for, on account of, or due to the acts or ommissions of said Permit holder's officers, members, agents, representa- tives, contractors, employees or assigns arising out of or in connection with its (or their) use or occupancy of the public hilghway under this permit. 14. Non-compliance with any of the terms of the Iowa Department of Transportation policy, permit, or agreement, may be considered cause for shut -down of utility construction operations or withholding of relocation reimbursement until compliance is assured, or revocation of the permit. It seems that often when I read the newspaper, the local government is requesting an increase of money for services or higher property and school taxes. Those of us who are retired and on fixed incomes, find it increasingly difficult to meet the demands of more government spending. I have no way of increasing my pension payments but have to continually pay more in taxation. I am opposed to further taxation on property. Therefore, I think the talk should shift to cutting back, holding the line on spending and doing some saving. Something drastic should be done about bicyclists. Sometimes I drive in the early morning and I can't see them until I nearly hit them. They do not have reflectors on the bikes. They are also a menace during the daylight hours, running stop signs, riding on the wrong side of one way streets and } ignoring traffic rules. They should adhere to the rules of the road the same as auto drivers. This is a serious problem requiring immediate attention. A car driver hitting a cyclist usually is the loser in the case. Early morning joggers are another problem. They don't wear reflective clothing and sometimes use the street as their track. While driving toward a street light, these joggers can't be seen until you are right on top of them. I have had several near misses. They do not belong on the road way. Not even in the daytime. The City Council has recently decided to restrict any property tax increase to a maximum of 6% for the next fiscal year. Because of in- creased costs of City operations, particularly in the area of insurance premiums, a tax increase of 6% or less for next year will require sub- stantial budget cuts and corresponding reductions in service levels in Mass Transit and some other areas. You may also be aware that Governor Branstad has recommended a freeze on the amount of revenue cities can raise through property taxes. If this limitation is imposed, substan- tial additional cuts will have to be made. The police continue to receive complaints regarding, bicyclists and joggers in the street. Bicyclists are required by law to conform to all traffic rules. Police officers do enforce violations by bicyclists when they are observed. Joggers are not prohibited from using the streets as long as they do not obstruct traffic. They are encouraged to wear bright, reflective clothing so that they can easily be seen by motorists during night time hours. It is unfortunate that the major problem with both bicyclists and jog- gers is that they sometimes use very poor judgment at the risk of their own safety. However, because of the relatively few accidents involving bicyclists or joggers, enforcement in these areas is not as high a priority for the police as are some other more critical areas. Officers are instructed to cite violators where appropriate but some bicyclists and joggers seem to exhibit a much higher degree of conformity to the law when a marked patrol car or uniformed police officer is nearby. The City will continue to cite bicyclists and joggers where circumstances warrant. To substantially increase this effort would, however, require additional officers which would have to be funded through a tax increase. While I understand that the graves are hand dug and that they take more time to open and close, I believe that other factors should be taken into consideration before deciding to raise the fee by such a large amount. As a bereaved parent whose infant is buried in Oakland Cemetary, I believe I can speak for many other parents who may experience the tragedy of infant death. Most parents are young with very limited financial resources. Many bereaved parents will already be saddled by high hospital bills related to the child's birth and hospital care. They are totally unprepared to deal with the cost of burial. It is rare that any sort of insurance will cover the cost of infant burial. It can be a very difficult time financially, not to mention emotionally. The City of Iowa City would do well to follow the lead of the Funeral Directors here in town who go out of their way to keep the cost of infant burial to a minimum. A copy of the report is enclosed. A more comprehensive analysis of the data has yielded some additional information which should be of particular interest to the City Council. The following is a chart which details the responses to the question: "Which shopping center do you visit least often and why?" From the chart you can see that of the respondants who indi- cated that they shop least at Old Capitol Center, 70 8 said that parking was the reason. It should also be noted that no respondants indicated that parking was a reason for choosing to shop least at any of the other centers. Clearly, parking is still a major problem in Downtown Iowa City. This concerns the plantings of arbor vitae along the sidewalk and west property line of 708 West Park Road. As these plantings develop, they will obscure adequate vision of the many dangerous traffic situations which arise along this street particularly during winter weather. These plantings will compound the problems already imposed by heavy traffic, a steep grade, and a bad, blind spot along this part of the street. There have been many accidents as west -bound traffic slides down into east -bound vehicles which are, in turn, attempting to maintain their momentum as they speed up and around others stalled on the ice. Even with the present size of these plantings, people approaching Park Road from 728 W. Park Road and from Normandy Drive will have extremely restricted vision of the west -bound traffic which often slides out of control, down the hill. For people approaching from 702 W. Park Road, vision of east -bound traffic will become severely restricted as soon as the plantings show significant growth. With a sloping drive, this will compound the already dangerous situation where the terrain along the street blocks adequate vision of or by west -bound, arterial traffic. As the planting progressed, one of us (Francis Frees) alerted the residents of 708 W. Park Road that the arbor vitae were being situated, contrary to law for this type of new plantings without a permit, on city property. Another of us (Beatrice Frees) reminded them of the traffic hazard as well as other problems that were being introduced. After the planting was completed, we appealed to them both orally and in writing (see enclosed reproduction) that all the danqers which they introduced be corrected. These plantings will render futile much of the progressive removal of plant life and other changes which we have reluctantly pursued on or in front of our property in order to reduce traffic dangers. We do not consider the residents of 708 West Park road to be adequately responsive to our concerns for safety'. In addition to the facts outlined above, we have the fallowinq understanding of the situation. If any of this is incorrect, we would appreciate your apprising us of such. Orn/ 1. Any accident or death which may arise from the situation could place the City, its taxpayers, and its officials under tremendous financial and criminal liability. 2. The residents of 70B W. Park Road have not complied with the City's request to correct their wrongs. 3. Each of these plantings may rapidly grow to a 15 -foot height and a 4 -foot diameter. 4. Any and all delays will aggravate the situation and render removal of the plantings more difficult. 5. The time for patience has past. b. The property is zoned as CO -1. At present the zoning code does not specifically allow the placement of a photography studio in a CO -1 zone. The staff indicated that its original intent was to allow such a business in that zone and that they would favor a change of ordinance to permit such use. We also discussed a problem with the parking requirements for a photographic studio. Because a photographic studio is classified as a personal service, the requirement for parking spaces is set at a ratio of 1/150 sq. ft. of floor space. This may be appropriate for personal services per se, but it is far too restrictive for a photographic studio. Based on present parking needs and expected future needs I believe that the studio that is being proposed would be well served with 4 parking spaces.
