CONSIDER A RESOLUTION SETTING A PUBLIC HEARING ON FEBRUARY 19, 2008 TO DISCUSS THE PROPOSED OPERATING BUDGET FOR THE FISCAL YEAR JULY 1, 2008 THROUGHI JUNE 30, 2009, THE PROPOSED THREE-YEAR FINANCIAL PLAhI, AND ALSO THE MULTI-YEAR CAPITAL IMPROVEMENTS PROGRAM THROUGH FISCAL YEAR 2012. Comment: This resolution sets a public hearing on February 19, 2008 to discuss the FY2009 Proposed Operating Budget, the three-year Financial Plan for FY2009 - FY2011 and multi-year Capital Improvements Program (CIP) through Fiscal Year 2012. Detailed information on the budget will be available for public inspection on February 8, 2008. off, a-~ 2. CONSIDER A RESOLUTION SETTING A PUBLIC HEARING FOR APRIL 1, 2008 ON THE IOWA CITY HOUSING AUTHORITY'S ANNUAL PLAN FOR FISCAL YEAR 2008 AND DIRECTING CITY CLERK TO PUBLISH NOTICE OF SAID HEARING. Comment: Set a Public Hearing, which is a requirement before the approval of the Annual Plan can occur. The Public Housing Authority is required to update the Annual Plan under the Quality Housing and Work Responsibility Act of 1998 ("QHWRA"). The Streamlined Annual Plan will advise HUD, residents and members of the public of the lo~wa City Housing Authority's mission for serving the needs of low income and very low- income families, and the Housing Authority's strategy for addressing those needs for the next year. The QHWRA requires''#hat the plans be made available to the public for review not later than #5 days before the public hearing is to take place. CONSIDER A RESOLUTION AUTHORIZING THE MAYOR TQ SIGN AND THE CITY CLERK TO ATTEST A STORM WATER DETENTION FACILITY EASEMENT AGREEMENT PERTAINING TO LqT 21, HIGHLANDER DEVELOPMENT, SECOND ADDITION IN IOWA- CITY, IOWA. Comment: Pursuant to the original subdivision of Highlander Development, Second Addition, as each lot in the additign was developed, the owner was required to provide stormwater management. Upon reviewing the site plan for the development of Lot 2!1, Staff determined that a stormwater detention basin was required. Owner has submitted a plat indicating the location for said basin, which S1laff has approved. Staff has also reviewed and approves the associated easement agreement. o~~ 3a 2. CONSIDER A RESOLUTION ACCEPTING THE WORK FOR THE FIRE STATION #2 WATERMAIN RELOCATION PROJECT. Comment: The project has been completed in substantial accordance with the plans and specifications. (Item "a" will proceed as outlined in the City Attorney's memo of 2/28/07 entitled "Rezonings, Due Process and Ex pane communications.") a) CONSIDER AN ORDINANCE CONDITIONALLY REZONING APPROXIMATELY 4.40 ACRES OF LAND AT 2815 ROHRET ROAD FROM LOW-DENSITY SINGLE FAMILY RESIDENTIAL (RS-5) TO COMMERCIAL OFFICE (CO-1) (REZ07-00016) (DEFERRED FROM 1/29 - FIRST CONSIDERATION ) Comment: At its January 2, 2008, meeting, by a vote of 6-0 (Shannon absent), The Planning and Zoning Commission recommended approval of this rezoning subject to conditions to ensure that the property develops in a manner that is compatible with the surrounding residential neighborhood. Staff recommended approval in a report dated December 20. Approval will allow this property to be developed with office space in accordance with the concept site plan submitted. AND PROTECTION, "CHAPTER 3, ENTITLED "FALSE FIRE ALARMS," TO PROVIDE THAT FEES FOR FALSE ALARMS BE SET BY RESOLUTION, TO CLARIFY WHEN A FALSE ALARM FEE IS ASSESSED, TO ELIMINATE THE REQUIREMENT TO SUBMIT CERTAIN INFORMATION, AND TO AMEND DEFINITIONS. (PASS AND ADOPT) Comment: Section 7-3 of the City Code provides for fees for false fire alarms and for not responding promptly to reset a false fire alarm. This ordinance simplifies those requirements to assist property owners in complying and the fire department in enforcing the ordinance. The ordinance also defines some additional terms and deletes terms that are not needed and provides that fees be set by resolution rather than by ordinance. CONSIDER A RESOLUTION ESTABLISHING FALSE ALARM AND OTHER FIRE DEPARTMENT FEES. b b-- ,31 Comment: This should be considered only if the ordinance amending false alarm fees is passed and adopted. ITEM 10. o Q - 3 a- ITEM 11. o~~ 33 City of Iowa City Page 5 CONSIDER A RESOLUTION ESTABLISHING FEES FOR INSPECTION SERVICES AND A SCHEDULE FOR MAINTENANCE INSPECTIONS FOR THE IOWA CITY HOUSING AND INSPECTION SERVICES DEPARTMENT AND RESCINDING RESOLUTION NUMBERS 95-360 AND 05-280. CONSIDER A RESOLUTION NAMING A PUBLIC STREET NORTH ~ WEST BRANCH ROAD PUBLIC SQUARE TO ST. PATRICK DRIVE. Comment: St. Patrick's Church is relocating to the north of a new public square along the Lower West Branch Road extension on the east side of Iowa City. In recognition of the relocation and that St. Patrick's Church will be the sole land use on the north side of this road, the City is naming the street "St. Patrick Drive." Action: CONSIDER A RESOLUTION AUTHORIZING THE REIMBURSEMENT OF CERT FIXED FEES FOR RELOCATING HISTORICALLY SIGNIFICANT STRUCTURES Comment: In an effort to encourage the preservation of historic structures in Iowa City, Council desires to establish a policy for reimbursement of certain fixed moving fees for relocating structures determined by the Iowa City Historic Preservation Commission to be of historical significance. These reimbursements would be paid for with the HPC's budget. This Resolution authorizes reimbursement for certain fixed fees assessed for the relocation of qualifying structures. Action: I /,~ ~~ Comment: This increases rental permit fees approximately 9% to cover inspection division expenses and places all rental units on a two-year inspection cycle. CONSIDER A RESOLUTION APPROVING EARLY RELEASE OF FUNDS ~ g^ 3 ~ RETAINED PURSUANT TO CHAPTER 26 AND CHAPTER 573, CODE OF IOWA, FOR THE MORMON TREK BOULEVARD EXTENSION -WILLOW CREEK TO OLD HWY 218 PROJECT. Comment: Iowa Bridge & Culvert, LC, the general. contractor for this project, has requested that the City release a portion of the funds which were retained for the project pursuant to Chapters 26 & 573, Code of Iowa. These chapters provide that cities may release all or part of the retainage after ninety-five percent (95%) of the work under the contract is completed. The general contractor has notified all subcontractors of this request per the code. There is approximately $20,000 worth of work left to complete. Per Chapter 26, Public Works is recommending holding 200% of the value of the remaining work or $40,000 and releasing the remaining $139,970.92. Action: ITEM 13. ANNOUNCEMENT OF VACANCIES.
