RESOLUTION SETTING A PUBLIC HEARING ON FEBRUARY 19, 2008 TO
DISCUSS THE PROPOSED OPERATING BUDGET FOR THE FISCAL YEAR
JULY 1, 2008, THROUGH JUNE 30, 2009, THE PROPOSED THREE-YEAR
FINANCIAL PLAN, AND ALSO THE MULTI-YEAR CAPITAL IMPROVEMENTS
PROGRAM THROUGH FISCAL YEAR 2012.
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF IOWA CITY, IOWA, that a public
hearing on said proposal should be and is hereby set for February 1.9, 2008, at 7:00- p.m. in
Emma J. Harvat Hall of the Iowa City City Hall, 410 East Washington Street, Iowa City, Iowa, or if
said meeting is cancelled, at the next meeting of the City Council thereafter as posted by the City
Clerk, and that the City Clerk be and is hereby directed to cause notice of said public hearing to
be published as provided by law, to permit any taxpayer to be heard for or against the proposed
FY2009 Operating Budget and the Proposed FY2009-FY2011 Financial Plan and also the multi-
year Capital Improvements Program through Fiscal Year 2012.

RESOLUTION NO. 08-28
RESOLUTION SETTING A PUBLIC HEARING FOR APRIL 1, 2008 ON THE
IOWA CITY HOUSING AUTHORITY'S ANNUAL PLAN FOR FISCAL YEAR
2008 AND DIRECTING CITY CLERK TO PUBLISH NOTICE OF SAID
HEARING.
WHEREAS, the City Council of the City of Iowa City functions as the Iowa City Housing Authority
and the Department of Housing and Urban Development requires adoption of an updated Annual
Plan; and,
WHEREAS, the Iowa City Housing Authority is required to update the Annual Plan under the
Quality Housing and Work Responsibility Act of 1998 ("QHWRA"); and,
WHEREAS, the Annual Plan provides details about the Housing Authority's immediate and
ongoing operations, program participants, programs and services, and the strategy for handling
operational concerns, residents' concerns and needs, programs and services for the next year.;
and,
WHEREAS, the QHWRA requires that the plans be made available to the public for review not
later than 45 days before the public hearing is to take place.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF IOWA CITY,
IOWA, THAT:
1. A public hearing for the Iowa City Housing Authority's Annual Plan for Fiscal Year 2008
should be and is hereby set for 7:00 PM, April 1, 2008, in Emma Harvat Hall of City Hall,
410 E Washington Street, Iowa City, Iowa or if said meeting is cancelled, at the next
meeting of the City Council thereafter as posted by the City Clerk.
2. The City Clerk is hereby authorized and directed to publish notice of the public hearing for
the above named proposal in a newspaper published at least once weekly and having a
general circulation in the City, in accordance with applicable laws.

RESOLUTION AUTHORIZING THE MAYOR TO SIGN AND THE CITY CLERK TO
ATTEST A STORM WATER DETENTION FACILITY EASEMENT AGREEMENT
PERTAINING TO LOT 21, HIGHLANDER DEVELOPMENT, SECOND ADDITION IN
IOWA CITY, IOWA.
WHEREAS, pursuant to the Code of Ordinances of the City of Iowa City, Iowa, ADIO Investments
LLC [hereinafter "Owner"] submitted a site plan for development of Lot 21, Highlander
Development Second Addition in Iowa City, Iowa; and
WHEREAS, under said plan, additional infrastructure was installed to service the development,
and certain easement rights must be acquired to ensure the continued operation of the newly
installed public infrastructure; and
WHEREAS, City staff has approved the location of the newly installed public infrastructure
servicing this development, as well as the associated easement agreements; and
WHEREAS, the easement agreements require City Council approval; and
WHEREAS, the execution of said easement agreements is in the public interest and advances the
public health, safety and welfare of the citizens of Iowa City, Iowa.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF IOWA
CITY, IOWA, THAT:
The Mayor is hereby authorized to sign and the City Clerk to attest the Storm Sewer
Easement Agreement for Lot 21, Highlander Development Second Addition, Iowa City,
Iowa.
2. The City Clerk is hereby authorized and directed to certify a copy of this Resolution and to
record the same with the above-referenced Easement Agreement in the Johnson County
Recorder's Office at the expense of Owners.

PERTAINING TO LOT 21, HIGHLANDER DEVELOPMENT
SECOND ADDITION IN IOWA CITY, IOWA
THIS AGREEMENT, made and entered into by and between ADIO Investments,
LLC (Owners), and the City of Iowa City, Iowa (the City) which expression shall include
their successors in interest and assigns.
WITNESSETH:
It is hereby agreed as follows:
For the sum of $1.00 plus other valuable consideration, the receipt of which is
hereby acknowledged, Owners hereby grant and convey to the City an easement for the
purposes of grading, installing, maintaining and servicing a storm water detention facility
or portion thereof, and for excavating for and the installation, replacement, maintenance
and use of such storm water lines, pipes, mains, conduits and drainage ways as the City
shall from time to time elect for conveying storm water to or from such facility, with all
necessary appliances and fittings for the use in connection with said lines, together with
adequate protection therefore, and also aright-of-way over and across the areas designated
on the Storm Water Detention Facility Easement (Exhibit "A") attached hereto and
:ncorpcrated herein anal referrer] to herein as "easement area."
Owners further grant to the City:
1. The right of ingress and egress thereto over and across the easement area.
2. The right of grading said easement area and to extend the cuts and fills for such
grading into and onto said lands along and outside of the said easement area, to such extent
as the City may find reasonably necessary in connection with the installation of easement
improvements.
3. The right from time to time to trim, to cut down and clear away any and all trees
and brush on said easement area which now or hereafter in the opinion of the City may be a
hazard to said easement area or which may interfere with the exercise of the rights
hereunder in any manner.
The City shall each promptly backfill and compact any trench made by it, and repair
any damages caused by it within the easement area. The City shall indemnify Owners
against loss or damage which may occur in connection with the negligent exercise of the
easement rights by the City. Except as expressly provided herein, the City shall have no
responsibility for maintaining the storm water facility easement area.
The easement granted herein shall be for storm water detention service for Lot 21 in
Highlander Development Second Addition.
Owners and their successors reserve the right to use said easement area for the
storm water management requirements for Lot 21 of Highlander Development Second
Addition and for other purposes that will not interfere with the City's full enjoyment of the
rights hereby granted; provided that the Owners shall not erect or construct any building,
fence, retaining wall or other structure, drill or operate any well or diminish or
substantially add to the ground cover on said easement area or make any other use of the
easement area that reduces the facility's capacity to detain storm water.
Owners hereby covenant with the City that they are lawfully seized and possessed of
the real estate above described, and that they have a good and lawful right to convey it, or
any part thereof.
Nothing in this Agreement shall be construed to impose a requirement on the City to
install the storm water detention facility improvements at issue herein. Nor shall Owners
be deemed acting as the City's agent during the original construction and installation of
said improvements. Parties agree that the obligation to install the improvement(s) herein
shall be in accordance with City specifications, and the obligation shall remain on Owners
until completion and acceptance of such completed improvements by the City, as by law
provided.
The Owners shall thereafter maintain the storm water facility easement area. The
maintenance shall include maintaining the groundcover, keeping the easement area free of
debris that may interfere with the proper functioning and draining of the detention facility,
and maintenance of the outlet and the outlet line within the detention facility in the
easement area. The City shall have no obligation for storm water detention facility
easement maintenance.
The provisions hereof shall inure to the benefit of and bind the successors and
assigns of the respective parties hereto, and all covenants shall apply to and run with the
land and with the title to the land.

and Carter and Associates of Coralville, Iowa, dated August 24, 2007, be accepted; and
WHEREAS, the Engineer's Report and the performance and payment bond has been filed in the
City Clerk's office; and
WHEREAS, the final contract price is $93,709.81.

RESOLUTION ESTABLISHING FALSE ALARM AND OTHER FIRE DEPARTMENT
FEES.
WHEREAS, Ordinance No. 08-4297provides that Fire Department fees for false alarms and
other matters shall be set by resolution; and
WHEREAS, the City Council finds that the "Fees for Fire Department Services", which is
attached and incorporated herein, are based on the actual administrative costs incurred by the
Fire Department.

RE: False Alarm and Other Fire Department Fees
As an appendix to General Policy 023-Response Charges and Billing, the department
has developed a document entitled, "Fees for Fire Department Services." This document
provides an outline of fees, based on actual costs, and general guidelines to follow for
response cost recovery for excessive false fire alarm response, hazardous materials
incident response, and response to confined space/specialty rescues not covered by
contractual agreement.
The "Summary of Costs" section of the document outlines the applicable administrative,
individual personnel, and individual unit equipment rates. The per hour personnel rates
were determined by referencing actual salary and benefits expenses provided by the
finance department, while the equipment rates were established through consultation with
the equipment division. The City of Iowa City Public Records Policy already establishes
the administrative costs associated with cost recovery. Additionally, the summary
outlines the per hour cost associated with typical department response levels.
The document further illustrates the fee schedules for each identified cost recovery

Re: Proposed Adjustment in Fee Schedule for Rental Permits
In 2002, the City Council directed the Housing Inspection Division to fully fund its budget through rental permit fees.
Prior to this date, the policy had been to partially subsidize the division through the General Fund. Once the
division assumed the policy of being completely self-supporting, it became mandatory to monitor the budget
carefully, project increased expenses and balance those expenditures with appropriate permit fees.
In order to make the division self-supporting, fees have been increased periodically to reach the required revenue
stream:
August 2002: 45% fee increase
July 2003: 45% fee increase
July 2006: 10% fee increase
After the initial very significant increases in 2002-03, the division is now in a "maintenance" period in which less
drastic fee increases are needed. Modest fee increases are now required every two to three years to cover
inflationary increases, such as employee wages/benefits, vehicle and equipment expenses, and technology costs.
At this time, the Division therefore needs to increase revenue in the amount of $54,000 to balance its budget for
FY09, and not require a subsidy from the General Fund to cover its expenses. The following describes what staff is
proposing to cover this $54,000 shortfall.
Fee Increase Proposal
The Housing & Inspection Services Department proposes the following strategy to accomplish its fully-funded goal:
a 4.5% annual increase in rental permit fees and to move single family/duplex structures from a 3-year to a 2-year
inspection cycle. Following is a detailed explanation of the two areas proposed for revenue generation.
#1: Increase rental permit fee schedule by 4.5%
1. Current fee schedule: $120 for structure; plus $16per unit; plus $6 per bedroom.
2. Propose to increase to $130 per structure; $17 per unit; $7 per bedroom
Sample of Fee Increase Impact Upon Typical 12-Plex with 2 Bedrooms Each Unit:

The projection on the previous page shows that the proposed permit fee increase alone does not
generate sufficient revenue to cover the entire projected deficit. Approximately $20,000 would still need
to be generated through other means. Proposal #2 would make up the rest of the deficit.
#2: Accelerate Single-Family/Duplex rentals from 3-year inspection cycle to 2-year inspection
cycle.
A two-year inspection cycle for single-family/duplex structures was originally recommended to City Council in 2003
by the Neighborhood Housing Relations Task Force Final Report with the full support of Housing & Inspection
Services staff. This recommendation was made because the Task Force concluded that with more frequent life-
safety/fire-safety inspections, the City would maintain better control over nuisance violations such as trash, litter,
illegal parking and other violations which are problematic with a significant number of single-family/duplex rental
structures in neighborhoods. This recommendation is again being made so that Housing & Inspection Services can
attain a higher level of control over incipient violations before they further deteriorate and become detrimental to
neighborhood quality of life and aesthetics. This proposal would therefore equalize the inspection cycle for all rental
units in Iowa City to the two-year cycle.

"Additional revenue from the 2-year cycle will not begin to be realized until 2 years from adoption of new cycle. The
pro-rated annual amount is estimated to cover remaining $20,000 shortfall.
Conclusion
Staff projects the combination of Proposal #1 and Proposal #2 would cover the projected expenses of
the division in FY09 without generating a surplus. Staff recommends implementation of this increase by
May, 2008.
In order to continue balancing expenditures with generated revenues, regular periodic requests for fee
adjustments will be necessary every two to three years, on a 4% to 5% annual increase basis.

houses in the Melrose Neighborhood and our neighborhood has had, for example, serious

RESOLUTION ESTABLISHING FEES FOR INSPECTION SERVICES AND A
SCHEDULE FOR MAINTENANCE INSPECTIONS FOR THE IOWA CITY
HOUSING AND INSPECTION SERVICES DEPARTMENT AND RESCINDING
RESOLUTION NUMBERS 95-360 AND 05-280.
WHEREAS, the City of Iowa City Housing Code provides for inspection and licensing of all
multiple dwellings, fraternity/sorority houses, rooming houses, duplexes, and single-family rental
dwellings;
WHEREAS, payment of fees the inspections and licensing is necessary to offset the
administrative costs of such activities;
WHEREAS, Resolution No. 95-360 is the current maintenance inspection schedule and
Resolution No. 05-280 is the current fee schedule;
WHEREAS, the maintenance schedule for single-family rental units and duplexes should be
changed to every two years to address life/safety and nuisance issues more effectively; and
WHEREAS, the inspection fees should be increased to reflect the present administrative costs.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF IOWA
CITY, IOWA, THAT:
1. The fees for rental permits and reinspections as part of the Iowa City Housing Code are
as follows:

BRANCH ROAD PUBLIC SQUARE TO ST. PATRICK DRIVE
WHEREAS, a public square is planned along the Lower West Branch Road extension on the
eastside of Iowa City; and
WHEREAS, a new east-west street is located on the north side of the new public square; and
WHEREAS, St Patrick's Church has decided to relocate to the eastside of Iowa City north of the
public square after the 2005 tornado destroyed their original location; and
WHEREAS, in recognition of the relocation and that St. Patrick's Church will be the sole land
use on the north side of this road, the City desires to name the street "St. Patrick Drive"
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF IOWA CITY, IOWA,
THAT:
The street located north of Lower West Branch Road extension and on the north side of
anew public square is hereby named "St. Patrick Drive".
2. City staff is hereby directed to place a street sign reflecting this name designation, and to

RESOLUTION AUTHORIZING THE REIMBURSEMENT OF CERTAIN FIXED
FEES FOR RELOCATING HISTORICALLY SIGNIFICANT STRUCTURES.
WHEREAS, Iowa City adopted the 1997 Comprehensive Plan and set goals and policies
that guide the growth and development of the community; and
WHEREAS, one of the goals in the said plan is to protect the historical and natural
environment of the city; and
WHEREAS, the City also adopted the Historic Preservation Plan to set specific policies
to guide identification, protection, and appropriate development of the historic resources
in the city; and
WHEREAS, on certain occasions protection and preservation of historic structures may
involve moving the structure to a new location, and as a measure of encouragement to
protect the historic structures, Council desires to reimburse property owners for certain
fixed fees, provided the structure is listed on, or eligible to be listed on, the National
Register for Historic Places, or otherwise determined to be significant by the Iowa City
Historic Preservation Commission, and the rehabilitation of the structure is carried out
as per the Secretary of Interior's Standards for the Treatment of Historic Properties; and
WHEREAS, certain fees associated with moving a structure of this nature are variable
and thus uncertain, while some fees are fixed. Staff recommends Owners be reimbursed
for the certain fixed fees listed below.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
IOWA CITY, THAT:
1. Where a property owner relocates a structure within the corporate limits of Iowa
City and that structure is listed on, or eligible to be listed on, the National
Register for Historic Places, or otherwise determined significant by the Iowa City
Historic Preservation Commission, and the rehabilitation of the structure is
carried out as per the Secretary of Interior's Standards for the Treatment of
Historic Properties, the owner shall be reimbursed for the fees incurred by the
property owner for the following City permits:

RESOLUTION APPROVING EARLY RELEASE OF FUNDS
RETAINED PURSUANT TO CHAPTER 26 AND CHAPTER 573,
CODE OF IOWA, FOR THE MORMON TREK BOULEVARD
EXTENSION-WILLOW CREEK TO OLD HWY 218 PROJECT.
WHEREAS, the City of Iowa City entered into a contract with Iowa Bridge &
Culvert, LC [hereinafter "Contractor"] for the construction of the Mormon Trek
Boulevard Extension-Willow Creek to Old Highway 218; and
WHEREAS, more than ninety-five (95%) of the work under the contract has been
completed; and
WHEREAS, pursuant to Iowa Code Chapter 26, Contractor has requested in a
sworn statement early release of funds retained by the City pursuant to Iowa Code
Chapter 573; and
WHEREAS, the City Engineer or designee has determined that erosion
stabilization remains to be completed, the value of which is estimated to be
$20,000.00; and
WHEREAS, Contractor was given notice of this determination on January 18, 2008;
and
WHEREAS,. the City is entitled to retain an amount equal to two hundred percent
of the value of the labor or materials yet to be provided pursuant to Iowa Code
Chapters 26 and 573.
WHEREAS, $40,000.00 of the amount due under the contract will continue to be
retained for the payment of claims for materials and labor yet to be provided
pursuant to Iowa Code Chapters 26 and 573.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF
IOWA CITY, IOWA;
1. The City Council hereby finds that at least 95% of the work under the
contract for the Mormon Trek Boulevard Extension -Willow Creek to Old
Hwy 218 Project has been completed.

2. Pursuant to Iowa Code Sections 26.13(3) and 573.15A, the City of Iowa City
intends to reduce the amount of the retainage from 5% to an amount not less

whichever is sooner.
