RE: Motion authorizing the City Engineer to sign an application
for use of Highway ROW for utilities accommodation within the
the City limits.
Anytime Iowa Department of Transportation right-of-way is being used
for utility placement whether it be gas, electrical, telephone, cable,
water or sewer, etc., an application to the Iowa Department of
Transportation must be approved by Council.
This particular application is for crossing State right-of-way to connect
sanitary sewer for Hunter's Run Subdivision to the County Home sewer.
Before this work can be completed, Hunter's Run will have to resubmit
their preliminary plat to the City for approval. Then construction
plans must also be submitted to the Iowa Department of Water, Air
and Waste Management for their approval.

AGREEMENTS: The utllitycompsny,corporation,applicant,permltholder orlicensee, (hereinafter referred toasthe permit holder!
f
agrees flint the following stipulations shall govern under this permit. '
!. The location, construction and maintenance of the utility insialiation covered by this application shall be in accordance with the
currant Iowa Department of Transportation Utility Accommodation Policy.
2. The installation shall meet the requirements of local municipal, county, state, and federal laws, franchise rules, and regulations,
regulations and directives of the Iowa State Commerce Commission, Utilities Division, the Department of Water, Air and Waste
Management, all rules and regulations of the Iowa Department of Transportation, and any other laws or regulations applicable.
3. The permit holder shall be fully responsible for any future adjustments of its facilities within the established highway right of way
cause) by highway construction or maintenance operations.
4. The Iowa Department of Transportation shall give the permit holder at least 48 hours notice of any proposed construction or
maintenance work, on either existing or newly acquired right-of-way, that is likely to conflict with the installation belonging to the
permit holder in order that the permit holder may arrange to protect its facilities.
5. The State of Iowa and the Iowa Department of Transportation assume no responsibility for damages to the permit holder's
property occasioned by any construction or maintenance operations on said highway if permit holder has been notified in -accordance
with stipulation number 4 above or if the facilities is not located in accordance with this permii.
6.Yhe permit holder shall take all reasonable precaution during the consttuclion and maintenance of said installations to protect and
safeguard the lives and property, of the traveling public and adjacent property owners.
7. The permit holder agrees lu give the Iowa Department of T•ansportatiorl forty-eight hours' notice of its intention to start
construction on the highway right-of-way. Said notice shall be made to the Engineer whose name is shown below,

9. The permitholder, and its contractor-, shall carry on the construction or repair of the accommodated utility with serious regard tc
the safety of the public. Traffic protection shall be in accordance.with.Part VI of the current Iowa Department of Transportation
Manual on Uniform Traffic Control Devices for Streets and highways.
10. Flagging operations are the responsibilityofthe permit holder. The original plaeemeniofsigns and removal completion of the
work shall be accomplished by the permit holder. • 6� i,419
Operations in the construction and maintenance of said utility installation shall be carried or'f4 susiha manner as to cause
minimum of interference to or distraction of traffic on said highway. 17
12. The permit holder shall beresponsiblc—'-{anydamagethatmayresulttosaidhighwa-�•causeoftheconstructimtoperalion,Ili,
mainunance of said utility, and shall reimt i the State of Iowa or the Iowa Department ransportation any expend itufc that the -
State of Iowa or the Iowa Department of Transportation may have to make on said highway because of said Permit Holder's s utility
having been constructed, operated, and maintained thereon.
13. The permit holder shall idemnifyand save harmless the State ofIowa, and the Iowa Department of Transportation from any and -
all causes of action, suits at law or in equity, or losses, damages, claims,ior demands, and from any and all liability and expense of
whatsoever nature for, on account of, or due to the acts or ommissions of said Permit holder's officers, members, agents, represcnta-
1 ives, contractors, employees or assigns arising out of or in connection with its (or their) use or occupancy of the public highway under
this permit.
14. Non-compliance with any of the terms of the Iowa Department of Transportation policy, permit, or agreement, may be
considered cause for shut -down of utility construction operations or withholding of relocation reimbursement until compliancd is
assured, or revocation of the permit. The cost of any work caused to be performed by the State in removal of noncomplying
consf-uction will be assessed against the permit holder.
15. A copy of the approved permit shall be available on the job site at all times for examination by Department of Transportation
officials.
16. This permit shall terminate 20 years from date of approval for gas a nd water mains outside the corporate limits of a municipality
in accordance with the Code of Iowa, Chapter 320. Renewal maybe requested.
17. 'The following special requirements will apply to this permit:
APPLICANT(5) shall be PERMIT HOLDER(S) for purposes of construction of said improvements. Upon dedication
of said improvements to the City of Iowa City and the acceptance of said improvements by the City of Iowa
City, the City of fOldA CITY shall be the PERMIT HOLDER. The Issuance of the permit nullifies
permit 1!52-782 accepted on 10-25-81,

We, the undersigned downtown merchants, are concerned about the impact of the
new hotel parking needs on downtown Iowa City.
You have approved a hotel design which restricts visual and pedestrian access
to our businesses; now, you have before you a proposal to reduce the number of
spaces available to our clients and customers.
The assignment of additional parking spaces in the Dubuque Street parking ramp
for the use of the Holiday Inn places undue economic pressure on those businesses
already located on the Plaza. The hotel operators should also pay the current
rates for parking spaces.
We call on you to reject any further changes in the parking plan for the Holiday
Inn since current needs for parking are not being met.

RE: Parking/Hotel
On numerous occasions in the past, we have expressed our concern about
the parking arrangements available in downtown Iowa City. We have met
with your traffic consultants and have expressed our very deep concerns
about the parking condition at the Dubuque/Burlington parking ramp. The
hotel has been furnished 70 stalls at $20,000 a year, or less than the
$25.00 per month parking permit that some tenants in Plaza Centre One
presently pay. We have repeatedly requested additional parking permits
for the building and have been denied them.
We have indicated to you before that we have been told by potential
tenants in our building that one of the major factors for not locating
in Plaza Centre One is the inability to guarantee a certain number of
parking stalls. These parking stalls are for people who are in business
in the downtown area and it is mandatory that they use their automobiles
for the conduct of their business.
We have not requested parking stalls for what would be a normal parking
requirement for a building of our type. We fully understand the advantage
of the bus system and of outlying parking areas for those people who
live out of reach of the bus system, but do not need their automobiles
on a frequent basis throughout the day. It is interesting to note that
as high as 30 percent of the employees of our tenants live outside the
City of Iowa City, consequently, they are coming to our town to work
and shop here on a daily basis.

To expect a further disintegration of parking availability due to specific
demands of the hotel would be an impossible situation for us. We fully
expect that the people who have already made an investment in the urban
renewal program in downtown Iowa City will be as fully accommodated as
the hotel and that there will be no preferential treatment. The 70
stalls that have been allocated to the hotel are an imposition on the
present parking situation as we see it, but to increase it would be
impossible for not only building users, but merchants and shoppers as
well.

As directed by Section 23-16 of the Municipal Code of Iowa City, this is
to advise you of the following action:
ACTION:
Pursuant to Section 23-143 of the Municipal Code of Iowa City, the City
Traffic Engineer will direct the installation of signs so as to create a
one-way alley in the block bounded by Dubuque Street, Market Street, Linn
Street, and Jefferson Street. This action will require the installation
of a ONE-WAY signs at the west end of the alley and DO NOT ENTER signs at
the east end of the alley, creating a traffic flow pattern west to east.
This action will take place on or shortly after 6 January 1984.
COMMENT:
This action is being taken at the request of the Wesley Foundation, First
United Methodist Church, Economy Advertising Company, and St. Marv's Roman
Catholic Church. These four property owners own the land adjacent to the
affected alley.

Department of Transportation proposes to let a pavement repair
project on Primary Road No. I-80 on February 14, 1984. A portion
of this project lies within the City of Iowa City and extends from
the City's west to east corporation lines.
The work will be done in accord with the current form 810034, "Agree-
ment for Primary Road Extension Maintenance and Operation". Project
costs will be paid from the Primary Road Fund and no charges will
be made against the City.

Individuals serving on Boards/Commissions play an important role in advising the
Council on matters of interest to our community and its future. Applicants must reside
in Iowa City.
The City Council announces Advisory Board/Commission vacancies 90 days prior to the
date the appointment will be made. This period provides for a.30 -day advertising period
and a 60 -day training period for new members. The training period allows new members to
become familiar with the responsibilities and duties of the advisory board/commission
before becoming a full voting member.
After a vacancy has been announced and the 30 -day advertising period has expired, the
Council reviews all applications during the informal work session. The appointment is
announced at the next formal Council meeting. Appointees serve as unpaid volunteers.
Council prefers that all applications must be submitted to the City Clerk no later
than one week prior to the announced appointment date. PLEASE USE A BLACK INK PEN.

TO THE FOLLOWING COMMISSION:
RESOURCES CONSERVATION COMMISSION
One vacancy - Unexpired term
January 3, 1984 - January 1, 1985
The duties of members of the Resources Conservation
Commission will include serving as an advisory body
to the City Council of Iowa City. They shall re-
search, review, and recommend policies, rules, reg-
ulations, ordinances, and budgets relating to mat-
ters of energy and resource conservation and pro-
vide recommendations and reports to the City Coun-
cil on the activities of the Commission. The Com-
mission shall exercise broad responsibility for
development of resource conservation policies and
shall pay special attention to long-range planning
and programming. The Commission shall, for the
- public weifare, make recommendations on energy
matters. These recommendations may relate to local
governmental and quasi -public agencies, private
residences and investment properties, and office,
commercial and industrial properties.
Iowa City appointed members of boards and commis-
sions must be qualified voters of the City of Iowa
City. The persons appointed to this Commission
shall be, by training, education, experience, or
demonstrated interest, knowledgeable in matters
pertaining to energy use and conservation.
This appointment will be made at the January 3, 1984
meeting of the City Council at 7:30 P.M. in the
Council Chambers. Persons interested in being con-
sidered for this position should contact the City
Clerk, Civic Center, 410 East Washington. Applica-
tion forms are available from the Clerk's office
upon request.

The duty of members of the Airport Zoning Com-
mission will be to recommend to the City and to
the County an airport zoning ordinance. The Air-
port Zoning Commission shall have such powers as
are specified in Chapter 329 of the Iowa Code
(1983).
One member of the Airport Zoning Commission must
be selected from the Planning and Zoning Commis-
sion and appointed for an initial tens of two
years. One member must be selected from the Air-
port Commission for an initial term of four
years.
These appointments will be made at the January 3,
1984, meeting of the City Council at 7:30 P.M. in
the Council Chambers. Persons interested in being
