This action will take place on or shortly after 20 January 1984. COMMENT; This action is being taken after completion of the postcard survey. The survey was requested by a resident of Esther Court. Of the 18 postcards issued to the affected residents, all 18 were returned. Thirteen of the responding residents favored the proposed removal of parking. Vehicular access is proposed from Stewart Road via Old Highway 218. Topography ranges from low level floodplain to steeply sloping 22-28 percent. ANALYSIS lloodland Valley Estates is located in Johnson County, within Coralville's two-mile extraterritorial jurisdiction. The location of this subdivision places it in an area which, according to the interjurisdictional agreement between Iowa City and Coralville, would be annexed by Iowa City if it were annexed at all. Therefore, Iowa City is given an opportunity to —reviewand comment prior to action by Coralville. The preliminary plat was reviewed by Iowa City in August, 1983. The Planning & Zoning Commission and City Council recommended approval, but noted concern over the provision of secondary access. Although a 40 foot access easement was provided for that purpose between Lots 3 and 4, Iowa City recommended that the secondary access meet the standards of other streets in the subdivision, i.e. a 50 foot right-of-way. The final plat shows a 50 foot opening for this ease- ment, however, the easement should be specifically shown and labeled on the plat. Another concern for this development regards the legal papers. For rural subdivisions located within Iowa City's two-mile extraterritorial jurisdiction, legal papers typically required include: (1) an agreement stating _that whenever the development is annexed within the city limits of Iowa City, all connections of the development's utilities onto Iowa City's utilities will be required; and (2) an assessment waiver for all public improvements (e.g. water, sanitary sewer, storm sewer, and pavement). In addition, it would be desirable for Iowa City to obtain a future dedication agreement for the access easement described above. The agreement would provide for the dedication of the easement to Iowa City as a right-of-way upon annexation. STAFF RECOMMENDATION The the stff finalrecommends WoodlandIowa Valleyforward Est Estates berdenied unless the recommendation mentioned above and the deficiencies and discrepancies listed below are corrected. Said plat was prepared by MMS Consultants, Inc. The matter will be considered by the Coralville Planning and Zoning Commission at its regular meeting January 5, 1984 at 8:00 P.M. in Coralville City Hall. Enclosed herewith please find a copy of said proposed final plat and I will forward copies of our City Engineer's and Building Official's reports as soon as they are submitted to me. These materials are being forwarded to you in compliance with enumerated paragraph 6 page 2 of the August 3rd Agreement be- tween Iowa City and Coralville. Clearly this proposed subdivision lies on the Iowa City side of the "line of jurisdiction" and we will be awaiting your report on Iowa City's findings and recommendations before Coralville takes any action thereon. The Coralville Planning and Zoning Commission meeting of January 5, 1984 will result in a recommendation for or against. Thereafter the Coralville Council will consider the proposed subdivision at its regular meeting on January 24, 1984 which presumably will give Iowa City a "reasonable time" to report its findings or recommendations to Coralville for their consideration. We wish to give Iowa City as much time as possible to review this plat. The developers are basically presenting this matter to Johnson County which is in turn waiting on Coralville which in turn is waiting on Iowa City. I would appreciate it if Iowa City's findings and recommendations could be forwarded to Coralville in time to include the proposal on the January 24,,1984 Council agenda. I would like to speak against the granting of Industrial Revenue Bond's (IRB's) i to Sim Clark for the construction of the Gilbert Towers Apartments. There are two (2) reasons for my interest in this case: (1) As a member of the Iowa City Fair Rent 3 Coalition I am concerned with what I still consider to be the drastic rental housing j{ situation here; (2) As a taxpayer to the Federal government I'm concerned with why f I'm paying the -high taxes that I'm charged with. jAs you are probably well aware by making the interest earned on IRB's non-taxable I the Federal government is losing significant amounts of income which indirectly is made up from the taxes that we all pay. Therefore, we should all be concerned about the use to which these IRS's are put and who is receiving them. In this case ,you are being asked to grant $850,000 to a man who already was given 4__I$B`s in.1982-83 worth $4.1 million. This man owns real estate with a total assessed value of well over $8 million. I don't think that in establishing IRB's it was the intended purpose of the Federal government to have us taxpayers subsidize millionaires like Jim Clark. In the 1982 Survey of Rental Housing in Iowa City written by The Planning Commission there was a subtle warning to the City Council pointing out the fact that between 1975-1982 30% of all the new apartments built within 1 mile of downtown Iowa City were built by one person. That one person is James Clark who has continued to build new apartments at a comparable rate. There is a great danger in allowing one person to control such a large share of the rental housing market. By decreasing the competitive nature of thehous-fng market you are enabling one person to set the standards in rent and quality to which other landlords will aspire. Lets look at what these standards are. 9/ Rents -- survey taken of Ralston Creek Apartments for which Clark received $2 million IRB. This survey covered 44/60 units randomly selected, Results are in this handout which show that the average 3 bedroom apartment rented for $645; 2 bedroom rented for $520 and 1 bedroom $256. These figures at least for 2 and 3 bedrooms are way above the average value of an apartment of this size in Iowa City which are $537 for 3 bedrooms; $428 for 2 bedrooms, and $305 for 1 bedroom as determined by the Fair Rent -Coalition this summer. These results show you the kinds of figures we are dealing with in the current Rental Market. The apartments Clark is constructing in large numbers are definitely in the higher priced bracket. As a point of information we calculated that Clark's total yearly income from the Ralston Creek apartments is 8424,000 and this property represents less than 1/4 of all his holdings. What can we say about the standards in quality that Clark is setting. Needless to say this is difficult to objectively assess. I could present anecdotal evidence attesting to the shoddy construction on previous Clark projects funded with IRB's but I won't. Perhaps we will hear direct testimony from current tenants later. I should mention that among groups concerned with preserMtion of neighborhoods the term "Clark Apartments" symbolizes everything that they are attempting to resist in terms of new development. I should also remind the Council how in the construction of the IRB funded Ralston Creek Apartments, Building Code restrictions were violated by having the apartments extend too far into the street. Only after the buildings were completed did they come to the Council asking to be exempted from the restrictions This was an awkward situation to put the Council in and certainly reflects on a poor quality in the planning and design of the construction. One way of assuring quality labor in construction is to hire union workers. As I will mention in more detail later Clark construction often does not use union labor. I have nothing personal against Jim Clark. T have never met him and everyone who I encountered, who does know him, says he is a nice guy. I am sure that Jim Clark is doing what every red-blooded American would do. Once you make some money you 91 2. Upon accenting such loans it is his responsibility to make sure that the local community benefits from his projects and it is the Council's job to make sure that this occurs. What has Iowa City gotten from giving Jim Clark these IRB's? One can imagine that at least during the construction of the projects new employment opportunities would be offered to local laborers. How do we determine if local labor is being used on these projects? The best measure is to ask the local labor unions. I have done this and officials of at least the carpenters, cement finishers, roofers, plumbing unions are willing to state that to the best of their knowledge none of their members were hired on the Ralston Creek •job. Some of them have told me of seeing laborers from Illinois on the project. How does this benefit the local employment situation? Are Federal taxpayer subsidized low interest loans being used to break the labor unions? The most obvious benefit to Tows City from this project comes from the construction of the badly needed new apartments. However, I am a bit surprised at the contradictory behavior of the City Council with respect to this issue. A few months ago when the Fair Rent Ordinance was before this council, we were told that one of the reasons it was turned down is because there is no housing shortage in Iowa City. If there is no housing shortage then why are you giving an IRR for the construction of new apartments? I feel that there is indeed a need for the construction of new apartments but not of the high—priced type that Jim Clark is putting up. We are well aware that Clark is required to set aside 20% of his apartments for See*Eee-B housing of low income people. However, in our survey of Ralson Creek Apartments we found that this included only one Bedroom apartments that comprised 10% of the total number. In summary, I have presented evidence as to why I think. Jim Clark should not receive this $850,000 IRB-- it is not good for the competitive nature of the housing market and as it stands now does not directly benefit the local community. Those omitted were occupied but no one was home when survey was conducted. It is proposed that the proceeds from the sale of said Bonds be loaned by the City to Gilbert 'Tower Associates, with loan payments sufficient to pay principal of, interest and premium, if any, on such Bonds as the same shall fall due. The Mayor then asked if there was any person or persons present to express views for or against the proposal to issue said Bonds, notice of said hearing having been published as required by law. The Airliner suffers a constant problem caused by the operation known as Dooley's. Water rune through the ceiling at all times of the day and night and in several locations. It is impossible for The Airliner to operate in this disruptive situation. This problem has been going on for the past several years. This is not the first time I have brought the problem to the attention of City and County officials. I have not received relief from this problem. The parade of owners who rent John Wakefield's liquor license have without exception operated in a manner that has disrupted the business of The Airliner.
